City runs up costly legal tab with bars

COSTA MESA ~ With the final deci-
sion Monday to revoke the operating per-
mit of the Island Trader restaurant/bar,
city officials may find themselves stuck
with another costly bar tab from a New-
port Daulcvard establish nent.
Like previous controversies involving
Hoguo-.Barmichaels an" Henry N' Harry's
Goat Hill Tavern, Island Trader owner
Gregory Howell said he's considering fur-
ther court action to try and save his thriv-
ing night spot.
The costs .:>f suet. an action would al-
most certainly be hif h on both sides.
During the 1990-91 fiscal year alone,
the city spent $94,321 in legal fees to try
and close Hogue Barmichacls and $52,323
on Henry N' Harry's Goat Hill Tave rn,
according to the city finance department.
Both bars remain open pending further
litigation.
"I just don't know what l'm going to
do," said Howell, whose troubles with the
city started last spring when next-door res-
idents started complaining about rowdy Is-
land Trader bar patrons ruining their
neighborhood.
Similar complaints from residential
neighbors caused the ci ty to take action
against Hogue Barmichaels and the Goat
Hill Tave rn, located just a few blocks
away from the Island Trader.
For now, the Island Trader remains
open under a Superior Court order stem-
ming from a lawsuit 1-foy.ell filed m N0;-
vember protesting restricted operating
hourii city officials earlier tried to impose.
Just three weeks ago, the City Council
went ahead and upheld a Planning Com-
. mission decision to revoke the operating
permit for the restaorant and bar. O f-
ficials !>ay Howell violated the terms of his
1988 operating permit by allo\\ing his es-
tablishme nt to become ·more ..of a bar than
a re!>taurant.

four-to-six feet.

Mandatory helmet law prompts angry response from assemblyman , local bikers

NEWPORT BEACH -Six days after
the mandatory motorcycle helmet law
took affect in California, Assemblyman
Gil FerguS<>n told a crowd of 500 angry
b1l..crs in Sacramento Monday that he is
j)ro-choicc - on helmets.
"\ve " .. t to replace this law with a
law that respect' their free dom or
choice," the Newpoit Dlach Republican
said Tue day. "lf we're going to be
con istent, then we should make people
wear a helmet in the shower, because
100 time~ more accidents happen in the shower than occur on
motorcycles."
ll1kc~ rallied against the helmet law at the state Capitol on
Monday, the first day of the new legislative session. Carrying
"Im peach Wilson" sig ns, motorcyclists demanded repeal of
the he lmet law and oddly enough have cl aimed Ferguson as
their ''patron saint" on the issue.
Ferguson. a former Marine Corps
machine gunner and veteran of three
wars, said he identifies \\ilh the bi kers'
desire for freedom from government
regulations -not with the ir
motorcycles.
Although Ferguson earned a Purple
Heart for his wartime bravery. he said
he's neve r been on a motorC)cle. "l
wouldn't get 'On a motorC)cle "1th two
helmets on," he said.
Ferguson plans to introduce a bill that
would allow motorcyclists 10 ride
without helmets, as long as they could show proof o( medical
insurance thnt would cover potential injuries.

I t was a dark and stormy day, Sunday was. Not real great
weather• for having a couple hundred of your nearest and
dearest drop by for an open house.
If you factor in that your plumbing isn't working and your elec-
tricity isn't either, you have no parking, no runnin& water and no
heat -well, it might be prudent to rethink the whole deal.
But this was a "Sneak Peck" at the Orange
County Philharmonic Society's 1992 House of

tractive person what she had done to deserve having to be a scant·
ily clad serving wench on such a chilly day. "Carol's my sister in
law,'' she grinned. "Obviously, l'll do anything f?r her."
I nsked another fine-looking lady what she had done to deserve
her job in the I louse of Design: decora ting the laundry room.
"I'm a student/' explained Cheryl Gibson, who is in her second
year at the Interior Designers Institute in Newport Beach.
.. My kids arc grown and in college," Cheryl said, "and now It's
time for mom to do what she wants to do."

and what her more experienced colleagues do with the other 30·
plus rooms, from April 4 through M:iy 5. Advance tickets may be

My guess is Cheryl will pull it off in grand style. Anybody who
can enthusiastically talk about turn ing a dank cubicle with washers
and dryers into "'an 18th century secret garden" has a fine fu tu re·

"The SDA tells us that we need
collateral, or that our incomes are too
high to qualify for their low-income
program, so we've kc.pt on doing it
ourself," D'Agos1ino says. "We can't give
up.''
D'Agostino said he and his partners
kept the company alive by putting all of
their personal funds into the business, and
by reinvesting any money earned th rough
sales.
"We figure ~hat for 1he next year and a
half. we're going to have to do the same
thing," Silvia says.
The com pany did manage to ob1ain
"fac1oring" financing. an arrangement
whereby a financier makes production
loans to a m'a nuracturer, usi ng receivables
from customer orders for collateral.

which has contributed to subpar profits

and despite their limited background in
the business. They went to business school

in Rhode Island, and they believe they

oversees production, graphics and

COSTA MESA -It may be
known as the "Buffaberry ordi-
nance," but it's non-profit charity
groups that will be getting a cherry
of a deal when it comes to fund
raising.
The City Council gave initial ap-
proval Monday night to an ocdi·
nance allowing charity groups an
opportunity to sell seasonal agri·
cultural products such as strawber-
ries for short-term fu nd -raising
events.
Councilm an Peter Buffo said he
helped push for the ordinance fol·
lowing a successful stra" berry
fund-raiser fo r a local• non-proftt
group last year. With funds for so-
cial organizations becoming more
scarce, the ordinance will give
groups one more way to help raise
money, Buffa said.
Under the ordinance, non-profit
groups W'ill still have to get proper
health permits through the county
and will only be able to set up
stands at churches, schools or
commercial zones.

Newport resident caught a young
man in the act of stealing his car
stereo early Tuesday and wrestled
the burglar to the ground, authori·
ties reported.
Police arrested Paul Ebel, 24, a
csident of the .3700 block of Sea~
shore Drive, on suspicion of at-
tempted grand theft after the 4:20
a.m. incident.
Bruce Snell, 37, a Lido Sands
resident, was leaving for work
when he reportedly found Ebel in
the front seat of his 1987 Chrysler
LcBaron, which was parked in the
driveway.
Ebel allegedly had his hands on
the pullout stereo in the Chrysler,
which had apparently been left
with a door unlocked, Newport
Beach Police Sgt. Andy· Gonis
said.
Snell pulled Ebel ·out of the car
and wrestled him to the ground,
Gonis said. Meanwhile, Snell's
wife, who was inside the house,
heard the commotion and called
police, Gonis said.
Ebel was booked into city jail on
$10,000 bail. He also had $29()..
worth of outstanding traffic war-
rants, Gonis said.
The police department recorded
809 car burglaries from January tG
Dec. I, 1991, Gonis said. And the
Balboa Peninsula is a popular tar·
get for car burglars, he said.
Most of the peninsula car bur-
glaries have occurred in the early
morning hours, and the thieves
typically look for cars with un-
locked doors. But another com-r
mon entry method is using the ce-
ramic portion of spark plugs to
break windows, Gonis said.
"We've recognized there's a
problem, especially on the penin-
sula, and we've assigned one f11M
time investigator to these partial • .

easier when the Costa Mesa Police
Department joins six other cities
including Newport Beach in a new
regional crime analysis program.
Known as PROACT (Proactive
Resource Organization Against
Crime Through TechnoJogy), the
crime unit will help officers im-
prove their collection of crime
analysis data and set information
distributed more dficiently be·
tween agencies.
For example, the unit is ex·
pccted to help officers fight auto
theft -the fastest growing crime
in the region -by tracking all the
locations where stolen cars arc re-
~overed, according to a report pre-
sented to the City Council Monday
night.
Officials say the unit will also be
h~lpful in trying to catch mobile
criminals such as the "Envelope
Bandit," who used a gun and ma-
nila Sl'vclopc to rob 3.S different
businesses in 14 cities during a
five-month period.

And, in my quest for justice, I

unw3rranted toes -specifically Eric
Shepard's of the Los AngeJes Times
-without justice.,
Notably, it was -suggested in
Monday's column that Shcp3rd w::is
perhaps responsible for Baraj as
being omi11cd from the team
because he wa~ the recorder duri ng
the Division I voting. That
insinun1ion was inaccurate.
The sports writers, you sec, spend
their entire day voting on the
All·CIF teams. Players arc
nominated and written on the
chalkboard, then \Oted on and
recorded. To volunteer for the task
of recording is commendable in the
first place, going beyond the call or
duty.
Moreover, attempts to reach
Shepard by phone on Saturday night
to get his comments on the mailer
were unsuccessful. However, there's
no acfensc for .acting upon this issue
without having first questioned him.
The mystery, which I accept as my
own mis re3ding considering no one
else remembers what happened on
that day (Dec. 17), has slipped into
the abyss. Barajas did not make the
All-CIF Division 1 football team. My
apologies arc extended to Shepard,
the Los Angeles Times, Mater Dei
Coach Bruce Rollinson and the
Barajas family. ·
Barajas js still, in the eyes of
many, including my own, an All-Cl F
player. Chalk ii up to a name having
fallen through the cracks, but
Barajas' 12 interceptions from his
cornerback position certainly
warrant All-CIF consideration.
Three of .his picks were returned
for touchdowns. A junior who also
played wide receiver, Barajas added
40 solo tackles and 19 assists. He
made first team All-Angelus League
and first team All-Orange County by
the Orantc County Register as a
dcf cnsivc back.
Next autumn, hopefully, we'll get
it right:
