Aebi said her terminally ill

journey.

"' New law: Adapt
for-handieapped
J ust wnen we all thought the commercial and indu1mial real
estate blfsincss was going to be very boring for the next
several ye:1rs, a recently passed piece of Congressional
lc$islation sneaked up on us. Title Ul of the Americans with
Disabilities Act (ADA) , which became effective January 26, will
permanently alter the design, renovation and new construction of
improved real property for ~ars to come.
While the ADA legislation is broad in scope •
and deals with many related issues affecting the
basic civil rights of disabled persons, Title Ill hits
directly at commercial and industrial real estate.
According 10 Andrew Bernstein, a real estate
attorney with Morrison & Foerster in Irvine,
"This law prohibits discrimination against any
individual with a disability in places of public
ac~mmodation." ,. •••
By definiti9n, places of public accommodation
covcJS a wide variety of properties, such as office
buildings, shopping centers, hotels and
restaurants. Therefore, virtually every -C----.-1 comm ercial property falls within the ADA
RoemalmEesrtcattae guidelines and will be subject 10 i1s provisions.
As with any newly enacted legisl:ition, there
arc many more questions than answers as 10 how
it will be interpreted and applied in practie:ll terms. For instance,
what exactly constitutes discrimination? How will the law be
enforced and who will do the enforcing? •
~ According 10 Mr. Bernstein, "Discrimination takes place
whenever a public accommodation denies a disabled person the
right to participate in the goods or se rvices offercCI by it because
of the person's di ability." Thus, any physical barrier or obstacle
which inhibits the ability of a dillablcd peoon 10 gain access to
goods or service pro\ idc.:d in a public place may be considered
discriminatory and a violation of ADA.
This is a federal la\\ which will take its place w 1th ocher state
and local legislarion also dealing w11h discrimination of disabled
persons. The enforcc'ment mechanism for the ADA is similar 10
that e tablishcd under previollS civil rights Ja\\s. Accordingly. Mr.
Bernstein anticipates that "both private parties and the Justice
Department will be bringing enforcement action under the
ADA."
faen &hough there m:iny uncertainties still surrounding the
future <tmpact of ADA in
commercial real estate, a few
