And, he added; the law- sui t was filed merely to get the issue to court. Transportation corridor agency officials be· licvcd that a lawsuit by the en- vironmental groups was im- minent, and filed the suit as a pre-emptive measure. Harvey said Tuesday that he would press the council to mea- sure public support by holding a public hearing. "It will give people a chance to express their feelings on the lawsuit," Harvey said. But City Manager Kevin Murphy discounted Harvey's remarks. "The bottom line is the council has been a member of the TCA (Transportation Cor- ridor Agencies) for quite a number or years," Murphy said. "I would not recommend that the council hold a public hear- ing. I don't see what it would accomplish." Quesuon of the Day In addition, Murphy said Harvey's claim that the city is suing its own citizens is a "bogus argument." And since SPON itself has filed lawsuits against public agencies, Murphy doesn't think the group has a leg to stand on. "Once the.y (SPON) join a n organization where they can be plaintiffs in a lawsuit, then they can also be defendants in a lawsuit," Murphy said. Unless tenants admit they are un- related, it is difficult to prove that an owner is violating the law. hood complaints over the number of people ljving in a home on Shantar Drive are one example of an issue that cities are rapidly los- ing their ability to combat: over- crowding. "You're talking about the issue of the '90s," City Attorney Tom Kathe said. Court decisions are ha mstring- ing the ability of California cities to deal with overcrowding, Kathe said. "Our hands have really been tied to a large extent by the court and legislative decisions that re- quire us to allow large numbers of people in a residence," said Mayor Mary Hornbuckle. "Of course we don't like to tell people that as a city we cannot control what hap· pens in our borders. but there are some facts of life that you have to live .,..·ith." The courts long ago said cities cannot limit the number of family members who live in a home. The only law on the books is a Califor- nia housing code that is liberal at best. It states that a one-bedroom apartment of 450 square fee t can house 10 family members. A typical two-bedroom dwelling can have 15 family members. Ordinances lowering those num· bers have been shot down by the With legal cases pending, the only way the city can become in· volved in limiting overcrowding is if code violations occur. "Then we can come in." ' Other than that, however, it's difficult to e nforce the housing code. The r~asons for cities not look-• ing favorably on large numbers of people in a dwelling are obvious. Homes are built to handle a cer- tain number of people. The sef age systems and the structures themselves we re not built to ha~n- dle more. "You have to ask, was a two- bedroom home built to house 15 people," Kathe said. Another problem is the fact that· single-family neighborhoods are zoned for single families, with an average of four members. "The city needs to respect fam- ily rights and private property rights, but at the same time a resi· dential neighborhood was meant to be a certain way," council mem- ber Joe Erickson said. SIGNS From A1 i_ncrcase in requests for signs in the city. · Caught in the piiddle of the controversy, however, is the Second Church of Christ, Scientist of Newport Beach which sought to have a sign put up so visitors could find the church, tucked away in a remote area of town on Pacific View Drive. "I can understand sign pollution," said Christian Science church member Tony Sedia, who is working with city officials to get a sign for his parish. "But there aren't that many signs up." Sedia said the church's visibility problem was highlighted a couple of months ago, when several visitors could not find the parish for a seminar. "One ended up in Laguna Hills," he said. Sedia said his church just wa nts to have a sign that is similar to those posted for other organizations in the city, like the highly popular Mariners Church. Mayor Phil Sansone evdll noted that the Pacific View Cemetery near the church had a sign. "If you can put one up for dead people, why not one for the live people?" Sansone wondered. But Edmonston said some guidelines need to be developed to trim down the number of signs posted in the city. "I'm not ant i-church or anything," Edmonston said. "But I would think there is some criteria that would help keep this down to a minimum." f1ntasy 5/Decco Fantasy S Tuesday, July 28 drawing for $312,485 jackpot: 3, 22, 25, 28, 33 • Decco ¥ Hearts ...............
