Negotiation arc under way between the Trust for Public Land, representing the conservancy, and The Irvine Co. to establi h a • purchase price and option agreement for the two properties. The Irvine Co. h:id reached an accord with the city in August to develop 258 acres of its remaining undeveloped land in Upper Newport Bay. The Irvine Co. is willing to sell the properties for open space preservation at their fair market vaJue, but company officials have said that a land purchase sale must be complete by the end of the year, or the properties will be developed. The land, originally appra, iscd at $80 million, was recently appraised at $69 million, though the purchase price has not been established. "The council voted to dp that because you work for the corpora- tion," h.e said. "If you weren't pre- pared to back up the organization in the public eye, everybody would be intim.idatcd." But Yagman said if he wins this lawsuit. the council members will have to pay each individual fine . "They arc in a Catch-22 now from which there is no. escape," he said.
