April 21, 1993 Costa Mcszi City Council Council writes stiff guidelines into graffiti law T he Costa Mesa City Council Monday strengthened its graffiti ordinance, bringing the city's laws in line with those or surrounding communities. The ordinance offers a reward of $500 for information leading to the arrest and conviction Of any person for painting graffiti on public and private property. Additionally, the ordinance makes it illegal for anyone under 18 to possess graffiti tools such as aerosol paint container, marking pens or felt tip markers greater th:in l/16th of an inch if they are on public property, or on private property without the owner's permission. Children traveling to or from school and who have a legitimate reason for having such material arc immune from this portion of the ordinance. "We don't want to step on someone's freedom of expression," said Councilwoman Mary Hornbuckle. "But at the same time, we don't want someone's freedom of expression spread on warehouses and buildings all over town." The ordinance also mandates th at businesses selling such devices must keep them in gl:iss cases or behind a counter and that anyone convicted of writing graffiti faces six months in jail and a $1 ,000 fine , along with a suspension or delay in the issuance of a driver's license for one year. The council will be asked to approve a second reading of the new ordinance at its next meeting on May 3. lf approved, the ordin ance will take eff cct in 30 days. I n other action, the council: • Denied a request from a Huntington Beach charity, United Children's Fund, to solicit fund s door-to·door within Costa Mesa . Usua lly, non-profit organizations are granted such requests. But council members questioned the legitimacy of the United Children's Fund, which reported that out of S 1.7 million raised nation-wide last year, S 1.1 million was given to three little-known organizations. Nope of the council members had heard of the three organizations -the National Child Safety Council, the-International Child Safety Council or the National Fire Safety Council. City staff traced the organizations to a post office box in Jackson, Michigan. Additionally, city requests from the charity's representative, Jerrold I. Kaufman, to furnish more information to the city were unsuccessful. • Officially opposed Senate Bill 1114, which would restrict city governments from cutting public safety services in any budget cuts. Council members agreed that while police and fire arc the city's most important services, community members and not state politicians should dictate what a city spends money on. •Approved a one-day cleanup event for seven blighted neighborhoods of the city. The $10,000 event, which is paid for by federal funds, will take place June 12. The areas range from Shalimar on the West Side to two sections of Baker Street on the East Side. Trash and debris will be collected, graffiti will be removed, alleys and sidewalks will be cleaned and repaired and other c1ty·resident cleanup efforts will be included in the Neighbors for Neighbors program. •Approved setting a date for the Goat Hill Tavern to be issued a conditional use permit by the Planning Commission. The city attempted to close the popular bar down three years ago by revoking its permit, but lost a court battle. As part of the court decision, the city must grant the tavern a new permit. No date has been set for the new hearing. VOL. 87, NO. 98 Delivery oan1nteel Lo c -a I 0 n I y .. From A1 accord on the rcn1s or face a massive vendor re· treat from the swap meet. The Marketplace already has lost 25 percent of its vendors because of the expected rent increases which were 1ehcduled to 10 into effect May I . Be· cause rents arc due six weeks in advance, these vete ran ven<fon pulled out or the swap meet, say· ing they were unable to operate with the new rosts. Vendo~ present at the mee1ing Tuesday said more sellers would vacate stalls should the rent in· creases go inlo eff cct. Under the terms of the original lease, vendors were hit with rents double and sometimes 1riple the rates they had been payln1. Outlining its proposal to the board, Tel-Phil at- torney Robert E. Currie told ~he group of about 200 vendors that rent increases should be based on attendance figures. Tel-Phil propoKd that rents remain under their current slruettan until 1995, when Marketplace attendance is expected to retu rn to its previous levels. • • The operator also proposed that the board be given food and beverage income .at current rates until 1995. Tel-Phil operates those concessions. Under a counterproposal from the Fair Board, the concessions were expected to donate 51 per- cent of sales to the board, the amount originally stipulated in the 1991 lease. The existing lease, which expires this month, had 15 percent of sales donated to the board.
