NEWPORT BEACH -Hundreds of
medical vials washed up on beaches from
Crystal Cove to the Newport Pier Monday
but lifeguards and fire department officials
contend beachgoers were not in danger.
"If you step on them you might cut your
foot with a glass," said Lt. Jim Turner of
Newport Beach lifeguards. "But we will col·
lcct everything we find and have it disposed
of."
Turner said lifeguards near the Newport
Pier only collected a handful of the test·
tubc·typc bottles, but Crystal Cove life·
guards reported a much larger haul.
"There is over a 100 so far and they're
still coming in," said Gator Cook, a Crystal
Cove lifeguard.
Newport Beach Fire Capt. Alan Schmchl
said the 6-inch·long test tubes cannot be
id~ntificd because they have no markings on
them.
And some coniaincd about a half·inch of
translucent clear material that resembles a
substance used in petri dishes· in testing lab·
oratories, Schmchl said.
"They don't look like they arc carrying
any kind of infectious waste, but how they
got in the water, that's a good question,"
Schmehl said.
But Matt Gadow, chairman of the New·
port Beach chapter of the Surfrider Foun·
dation, said he wants some answers.
''It's an ongoing problem," Gadow said.
"Those are two of the things that Surfrider
is trying to stop -military and medical
waste dumping."
Gadow i.aid the Surfnder Foundation, a
clean-water advocacy group,' has a constant
b:mle to keep all rorts of waste from getting
in to the water, especially runoff from sew·
age drains.
And he noted that just last week some
ammunition "a~hed up in Huntington
Beach Surfr1dcr suspects it was the result
of mihtar) dumping

deal with neck injuries and
panicky swimmers stuck in
riptides -Project Wipeout, a
14-year program and docudrama
on cervical spine injuries, has
them more than ready.
"With the program and the
movie, we have been able to
educate a lot of people who come
down to the beach," said Marine
· Safety Lt. Jim Turner. "We've
been able to educate the guards
and expand their training."
Turner is one of eight Newport
Beach marine safety officers who
teach lifeguards how to watch for
and treat swimmers who may
suffer serious neck injuries while
out swimmin$·
That combined with educating
swimmers on water safety has
helped reduce the number of
serious neck injuries and other
water accidents.

program started in 1979 by Hoag
Ho)pital i~crnist Dr. Jack
Sl anner, an a'id surfe r and

her group's pion -which the council will likely put
on the November ballot -to hove Newport
residents pay roughly $10 a month in order to
purchase and presc.·rve three prime pieces of land
around the Back Ba).

What cxacny is at stake in this special election?
At stake is the future of two undeveloped Upper
Newport Bay properties: the Castaways (upper and
lower) and Newportcr North.
The essent ial choice is between master·planned
development with hundreds of townhomes or
preservation of these unique areas for conservation
and recreation.
What urc the Implications of the outcome of this
social electiort?
There are just two scenarios -neither of which
is the st:uus quo.
Under the development scenario, The Irvine
Company "ill stare building nearly 400 townhomes
on Upper Castaways and Newporter North, plus a
marina on Lower Castawaj'S. With these
developments, already approved by the City Council
and the California Coastal Commission, there would
be more people, more traffic and more congestion.
Under the conservation scenario, these lands
would be permanently protected from development
and opened to public ncces~. Plans call for a
balance among habitat restoration and protection,
hiking trails and, on Upper Castaways, active
recreation. Some land on Lower Castaways would
be set aside for a new, permanent home for the
Newport Harbor Nautical Museum, as well as the
Newport Deach Historical Society.
What if the advisory vote fails?
The Castaways and Ncwporter North areas will
be developed. Grading for new homes and roads
would probably begin within the next 12 months.
The Irvine Company has a "buy-it-or-we'll-build-
on·it" deadline of Feb. l, 1994. RealistkalJy
speaking, there is no alternative to the proposed
;issessment district if funds sufficient to acquire
these properties arc not secured and available by
that deadline.
Voters thus should regard the advisory vote as an
historic -and o ne-time-only -opportunity.
How ~ould you sum up the costs and benefits of
this proposed assessment?
The costs arc easy to quantify: not more than $10
per month for 30 years.
The benefits are mainly twofold. First, there will
be a kind of permanent insurance policy against
these Upper Newport Bay areas ever being
developed. One consequence, then, will be that
Newport Beach over time will see less of an
increase in traffic, congestion and pollution.
Secondly. there will be more open and public
lands for hiking, recreation and conservation
purposes. Additionally, man1 economists believe,
particularly regarding an increasingly urbanized
area, that more open spaces and recreational
opportunities serve to increase -or, at th~ very
least, help to maintain -a city's property values.
This is a special election: does that mean we're
pn)ing for it?
No. Decause there arc statewide issues already on
the ballot, "c an effect arc piggy-backing. This
incurs no add111onal cost whatsoever to Newport
Beach taxpayers
Some people li\'e next to these properties; some,
nowhere ntar. Some ll\'e In valuable homes; some In
less valuable homes. Why should all pay the same?
This is not a property tax but rather a benefit
assessment district.
Unlike a traditional property tax, the basis for the
assessment is not the value of one's property -but
rather the probable benefit over time. One benefit
ca n be to help hold or increase current property
values; however, the principal benefits arc
environmental and rccrc~tional in na ture, and affect
people mo;c than property.
Ollculafang such lbenefits is coihplica,ted. For
example, some may·vicw a park ext <joor as a
benefit. Others may view a park as a nuisance next
door but as a benefit if nearby. Whether one has
children may well alter. the perceived benefit. The
value one places on environmental preservation or
less traffic can also affect the perceived benefits.
After careful analyses, it was determined that
projecting different benefits for different people
under diff cre'nt circumstances is impossibly complex.
It also was determined, based on public surveys and
focus groups, that most people favor a uniform,
citywide assessment, thinking that, generally
speaking, everyone benefits equally.
Most municipal parks arc maintained by
everyone, as arc the beaches, regardless af their
locations. Other public fncilities, such as libraries,
police and fire stations. similarly are acquired and
over time maintained by everyone equally.
What uactly will be lbe cosl to proputy owners,
and ror bow long?
It won't be more than $10 a month. It won't last·
more than 30 years.
The exact cost to property owners cannot be set
firmly until after the election, and until after th e
bonds have actually been sold at a particular rate of
interest. Interest rates for an assessment district,
not unlike in the case of a home mortgage, can
affect the ultimate cost to property owners
significantly.
Apart from interest rates, there are other factors
that predictably can affect the cost to property
owners. Each of these factors will tend to lower the
cost to property owners.
For example, if a statewide initiative on the June
1994 ballot is approved by voters, The Newport
Conservancy will receive SS million for habuat
restoration. These funds. and any funds the
Conservancy is able to raise over time, will serve to
either lower the annual cost to below SIO a month
or 10 shorten the life of the 30-year assessment.
Should Newport Beach annex either the Newport
Coast development or the Santa Ana Heights area,
this also would serve 10 either lower the assessment
or shorten the life of the assessment, as the re will
be a greater number of property owners· across
which to spread the total cost.
Jusl what does this assessment cover? What are
the hidden costs lo the city?
The $10 a month assessment provides a turn-key,
all-inclusive package.
It covers everything, from acquisition to
improvements to maintenance.
Tile financing is even structured to provide more
each year for maintenance, and to build up, in
effect, a permanent reserve for maintenance to Inst
beyond the assessment district.
There will be no additional or hidden costs to the

Many merchants and commercial property
owners do not live In the city. How do they benefit,
and why should they ha,•e to pay the assessment?
Open space tends to increase the va lue of all
properties nearby.
Also, available public parks help to make the city
a nicer place in which to live, which in turn attracts
more people, and more people with higher incomes;
thus, then, this helps to drive up the value of all city
properties, residential and commercial properties
alike. Bustncss and business properties benefit over
time when residential property values r.ise.
Why should Newport Beach bear the entire
burden or pa)ing for thl' e properties \\hen
residents from othei: cities ''ill come and use them
free or charge?
It's true that other cities' rc!>1denh "ill hend11
(rom these Upper Ne" port Day parl..s -ju\t a-. "e
benefit from parks else,,here. The )Oung people on
the west side of Ne\\ port Ocach ha"c had a
shortage of ballfields for > c:i rs. and nO\\ pla) on
field s in Costa Mesa.
As a practical matter, hO\\Cver, even if a
neighboring city would voluntarily be incl uded Ill
the proposed assess ment district (a highly unlil..cly
prospect), there is no other way 10 do so by the
Feb. 1, 1994, deadline.
Only Newport Beach residents will benclit from
organized piny on the ballfields. Only Newport
Beach will have the ultimate con trol O\er th e
management of these areas.
Why should "'' pny so much for a rcw extra acr~
~htn under the de\·elopmcnt scenario a lot or lond
would be dedicated to the cit) at no cost?
The land dedicated under the de\elopment
agreement would be not only le in acreage, it
would be fragmented rather than consolidated, and
would be adjacent to townhomes. Under the
a sessment, the extra acres are far more U!labk. and
for a vari ety of purposes.
For example, under the development scenario,
there "ould be le 1han half as muc h bnd (jusl 4.
acres) available for acti\'c recreati onal opportunit ic'
on Upper Castaways. The land on Nc,\-portcr North
would be limited and less accessible 10 the public.
And there would be no financing available for any
improvements, or for maintenance of the pt1rks.
Finally, the price is based on more than the cxua
acres of open space. The price rcl1cct~ the value or

level of compensation.
Negotiations produced n price fully 20 percent

rejected a claim Monday night
mode by a former city council can-
didatc alleging that the city O"-CS
him money in bock legal fees.
Denis W. Retoske, who rnn an
unsuccessful bid for a council scat
in 1992, has filed a suit against the
city in t"e amount of $144,444.41.
The suit states that Retoske is
owed the money for representing
former council member Orv Am·
burgey while he served on the
council in 1990.
The suit against Amburgey al·
leged that lie was trying to defame
Tim Green, the city's former golf
cour!ie concessionaire, and replace
Green with anothtr manager of
Amburgey's choice. The matter
was settled out of court between
the city and Green in November
1992, court records show.
Retoske states, however, that
the city has not paid him for at·
torney recs since August, 1992 for
Amburgey's defense. He making a
cluim for costs and expenses from
Aug. 1, 1992 through Feb. 19, .
1993.
The council rejected the Re-
toskc'l claim Monday during its
regulnr meeting following its policy
of rejecting all claims that are
filed against the city.

and how the t:inks are cleaned.

The OCC aquarium is the larg·
est cold-water aquarium in Orange
County. lt consists of seven tanks:
a kelp forest, a Corona del Mar
tide pool, a sandy bottom, a rocky
reef, an octopus tank, a tropical
reef and a jellyfish tank.
The aquarium is maintained by
students in enrolled in a special
one-unit beginning aquarium class.
Admission for the pu blic at the
event is free.
