Mayor Sandy Genis requires a response.
Ms. Genis begins her letter 8skinJ Mr.
l.obdeU to present all of the facts (an
response to William Lobdcll's Editor's
Notebook. Nov. 25). We would ask
Mayor Genis to do the same and off er
lbe following clarifications and

Ms. Genis states that she (U"St
complained about our lunch bannen in .
October as she felt they were han&ln& in
the public right-of-way (tbc flfSl seven
feet from the curb face).
Triangle Squ:irc never received any
communication rcga.rdin& our lun(htime
banners from the city until we read the
mayor's rccen~ comments.
The b:inners were not hanging with.in
the public right-of-way. Ms. Genis told
us &his summer a moratorium on the
l>Jnner portion of the s.ign code has
enacted for the downtown area due to
construction of the Costa Mcu Freeway.
Code enforcement will not resume
regulating banners until January.
We h:ivc reviewed the transcript of
the Nov. 10 Cos101 Mesa Redevelopment
Agency meeting :ind member Genis•
comments regarding the lunch blUlnen.
At th:it meeting she stated there was a
problem with ouf signs being tied to
public streetlights and palm trees i.n the
public right·of-w:iy.
She sai~ "I know the Ught posts are ou.rs" and also stated ... J may go out
there with my prunin& hook and cut the
ropes."
I n fact, Triangle Square paid for and
owns the streetlights, palm trees, .
benches. etc. that arc located in the
public right-of-way. Our development
contract with the ci1y contains an
encroachment penmt and a maintenance
airccmcnt for these items.
When we tied a rope from a banner
on private property to the streetlight or
the p.ilm tree, it was to a palm tree or
streetlight that we paid for. maintain
and repair at our sole expense.

RcadinJ the paper tbi.s mornin1 it
appears there is a point or clarification
in o.-dcr. Many people mentioned a lot
of banners and other p:arapbanclia th:at
t ayec arc quite ugly. Out then, beauty

But all of these arc on priwtc

arc on public property. Had these beeo

this would not hove been an issue.
However, when they arc on public
property, then the public incurs
liabili&y. And you do not use someone

I believe it is ridiculous with all
the people who are on
