T he packet of seeds said
Shogion Giant Radish. It
was hardly an
exaggeration.
Murray McKerlie, a Costa
Mesa re ident who took up
gardening last year to keep
busy, had no idea that his new
hobby would be so bountiful
untir he pulled a 16-pound
radish out of his backyard
patch Monday morning.
"This one just grew a li ttle
bigger," said McKerlie, 79.
The retired tool engineer
planted the JaRanese Shogoin
radish seeds in August. His first
harvest yielded eight radishes
that averaged about five poui:ids
each. But one of the radishes
seemed to build up steam and
McKerlie elected to let it keep
growing.
"I didn't do anything special
al all," he said. v
On Monday morning, the
pressure to pick the 2~-foot
radish he ightened because
visiting relatives and Criends
wanted photos before returning
home to Niagara Falls.
So McKerlie, dressed in
slacks and a formal V-neck
sweater, yanked out the radish,
posed for pictures and carried
1t inside a bag to protect it.
Standing on his bathroom
scale and holding th e radish, he
figured it weighed 16 pounds.

No excuses, curb ramps
must be m.ade to .code
ly 1111 Garvin
According to a recent Daily
Pilot article, Tom Reid -my
colleague on the Access Appeals
Board -feels Triangle Square
would leave town rather than
bring ils curb ramps for
wheelchairs up to code. •
He says be Ceels the law
aJlows a compromise. Deputy
City Manager Don Lamm added
"they're only a fraction of a
percent off ... visually, you
~n't even notice." City
Attorney Tom Kathe says that
''if we comply with one, we
don't comply with the other."
These people missed the point.
The point is, in reviewing
applications for retroactive
hardship exceptions, which was
the case, the building offici al
and appeals boards must follow
state policies. And there are no
compromises. They must act as
if the development had not
taken place. Thus, decisio!lS can
only be based on conditions at
the ti.me the property was
developed, not at the time the
exception is finally granted.
The question is, did the
appellant provide evidence that
a hardship condition existed at
the time the ramps were
constructed? The answer is no.
The appellant's plans correc1ly
specified Oared sides should
have less th an J2.5% slope and,
in fact, the plans were approved
by Caltrans and the city. Thus,
despite all the rhetoric, it was
impossible to buil~ a case that
an undue burden existed at the
time the ramps were built.
Unfortunately, th e city found
several ramps with Oared sides
of 13.9%, 15.6%, .,16.8% and
22%. Without que~tioning Mr.
Lamm's mathematical skills, his
statement they are "a fraction
of a percent orr · is pitiful -
unacceptable for a person who
oversees the persons who took
the measurements.
Mr. Tony C'De Baca correctly
