ecutors said Tuesday they are only
prepared to charge a local man ar-
rested in connection with the
death of his girlfriend's 22-month-
old son with felony corporal pun-
ishment and not the homicide
charge police had sought.
Brian John Laudenback, 32,
who has yet to be charged, made a
brief appearance at Harbor Mu-
nicipal Court in Newport Beach
Tuesday for his scheduled arrflign-
ment. At that time, both sides
asked fo r more time for the case.

iinaled the Costa Mesa couple out 1or one of its prestigious volunteer
awards.

When the couple arrived on the
West Side, the aood life was still
several yean away. Their oldest
ton. Jorse Jr., then 13, fell into
company with a local gang during
his first year at Estancia High
School, eventually amassing a
string of small·time crimes, such as
fighting,
It wasn't until Costa Mesa's
homegrown gangs let loose their
first shots in the summer of 1992,
and Jorge Barrios, now 20,
watched a good friend die that his
mother said "enough."

In addition to hosting meetings
for other mothen, Barrios is a
founding member of Madres Costa
Mesa, a group of moms committed

proaram at the city's Rea
Community Center to help steer
kids away from rr<>uble. Since
helpina open the center last
spnna. the couple· hasn't missed a
ni&ht.

bar closed for now
An Orange County Superior Court
judge ruled Tuesday that The Mermaid
-a nude bar poised to open in
Newport Beach near John Wayne
Airport -will have to keep its doors
closed for now.
City Council members asked for the
preliminary injunction because they
believed the owners of the business,
located at 4248 Martingale Way,
intended to open despite the council's
previous denial of both a conditional
use permit and an entertainment
permit.
Judge Warren Siegal agreed with
Newport Beach attorney Jeff Goldfarb,
who argued th:.it the si te at 4248
Mart ingale Way can only be used for
businesses which primarily are
restaurants.
But attorney Ron Talmo, who
represents Mermaid owners An and
Olivia Nguyen, said the judge never
ruled on what "primarily" means.
"Doth sides left there sort of looking
at each other," Talmo said. "He never
ruled in fact on whether we are a
rest au rant."

S peaking of 'Vhich, the book barely
mentions the Newport years. It 's a
straight anecdote-rich account of his
sho"biz career, when dancing partners
included such awesome kids as Shirley
Temple and Judy Garland. Don't look
for any tabloid·tyJM.shots at colleagues;
that wouldn't be the Ebsen style.
He's grateful for all the goodies
that've come his way since leaving
Orlando, Fla., in 1928, ;ind landing on
Broadway with $1.65 in a pants pocket
and a reserve of S25 in a shoe.
That bankroll was fattened in variable
increments, until he struck the big
gusher in '62 as Jed Clampett in
television's epic series, "The Beverly
Hillbillies." Following that nine-year
run, up popped anolher big winner,
"Darnaby Jon~s." As for the book's
title, it has to do with the oft-told tale
of his aborted·role as the Tin Man in
the MGM cla.ssic, "The Wizard of Oz."
The original costume was powdered
with aluminum dust, causing a violently
allergic reaction which nearly sent him
over the rainbow. Exit Ebsen, enter

Talmo said the business could be
called a restaurant because it does
intend to serve food and beverages.
But city officials say it's a theater
because it will have topless and nude
dancing and adult movies.
According to city zoning laws,
theaters aren't allowed in the Newport
Place Planned Community -where
The Mermaid is under construction.
Talmo said he will ask the 4th
District Court of Appeal in Santa Ana
to re·hear the case within the next two
weeks.
He plans to argue that the city's
motivation for keeping The Mermaid
out of town is steeped in moral belie($
-not zoning laws.
Adult businesses are protected by
the First Amendment of the U.S.
Constitution. Several cities, including
Anaheim, have lost.court battles for
nol having sufficient reason to bar such
businesses from opening.
City Manager Kevin Murphy said the
zoning law is clear.
"When it's not in his interest, he's all
of a sudden a restaurant," he said.
"You can't have your cake and ·eat it,
too. Jf you look at the proposed layo ut,
it's real evident what it is. It's a

There was another momentous miss.
Director Ron Howard wanted him to
~tar in "Cocoon," but Buddy was locked
into a one-year contract with TV's Mall
Houston. When Don Amechc received
an Oscar for the role, he thanked his
mother, his father, his agent and the
director, adding, "Also, I want to thank
Buddy Ebsen for being unavailable to
play the pllrt." .
There wasn't much else Our Hero
missed along th e way, skipping along his
own Yellow Drick Road. There can't be
too many regrets in a'l enviable career
that's included working wit~ enchanting
Audrey Hepburn in"the '61 smash,
"Breakfast at Tiffany's."
Even his wartime servi~ as a Coast
Guard officer aboard the patrol frigate,
USS Pocatello, is related with the same
folksy humor permeating the showbiz
stuff. As the People magazine reviewer
put it: "Like its dancer·actor author,
this autobiography is an affable,
ingratiating, profoundly decent book."
Amen, brethren, he's all of the above,
and more.
P eople'.s review closes on this
warming note:
"Having been born in li1tle Dellevillc,
Ill., Ebsen plausibly brings off on the
page the same fblksiness he has so often
brought to the screen. It doesn't even
seem too cloying when he writes, in
explaining the lor.gevity of his career, 'I
never left a dressing room without
thanking God for the job.'"
· The Good Lord must appreciate the
heartfelt gratitude because, as Buddy
Ebsen reaches No. 86, the ol' hillbilly is
still gainfully employed.

Newport Beach makes It
ealler for restaurants
An appetite for Newport Beach just
got sweeter for restaurateurs looking
to open a small cafe.
The council voted unanimously
Monday to eliminate off-street parking
requirements and increase the amount
of allowable floor space for speciality
food shops, such as fast·food restau·
rants, bake~ies and ice cream shops.
The previous code limited food
shops to 1,200 square feel -large
enough for about 12 customers.
The new law, proposed by the
Economic Development Committee
and endorsed by a majority of planning
commissioners, expands the limit to
2,000 square feet and 20 patrons.
ln other action:
• The council voted unanimously to
require retailers to cover adult
magazines with blinder racks. The
ordinance was proposed March 14 and
will go into effect on April 28.
•The council voted unanimously to
pay National Library Relocations
S33,704 to relocate the old library into
the new Newport Center Library this
summer .

Tyler Jaeger died from what au-
topsy reports showed to be a rup·
tured liver and pancreas. Lauden-
back, the live-in boyfriend of the
child's mother, Karey Jaeger, was
babysitting Tyler at the time tht
child died.
Police later began investigating
whether the Newport Beach man
was responsible for a skull fracture
the child suffered eight .days be-
(ore. At that time, Laudenback
told J.aeger that her son fell off a
slide. Officials at Hoag Hospital
believed the injuries were consis-
tent with such a fa ll and released
the child back to his mother.
Autopsy reports now indicate

"substantial" sexual conduct. Life
without parole would also be man-
datory for repeat child molesters.
Bergeson, 67; says opinion polls
reflect a widespread belief that
crime is out of control in Cali·
fornia.
Given the public mood, Berge-
son predicts a number of law-and-
order bills to come in Sacramento,
including a challenge to the insan-
ity defen se. The U.S. Supreme
Co.url on Monday refused to con-
sider a challenge to Montana's ab-
olition of the insa nity defense, cf·
fectively .opening the door for
other states to remove the insanity
defense from· criminal codes.
"People are outraged in the
kirtds of trials we see and the
kinds of taxpayer dollars that are
spent," Bergeson said. "The public
doesn't agree with what's going
on."
