SANTA ANA -With Brian
Laudenback's murder tri:il set to
open today in Or:ingc County
Superior Court, one or his
relatives snys the dead toddler's
mother also must accept some
responsibility.
"The thing th:H is difficult for
me to understand is how could
you ever leave a child who has
had a concussion with a
babysitter," Laudenback's aunt
Jackie Jefferies said. "You just
stay home with them and that's
all there is to it."
Laudenback, 33 -who faces a
second-degree murder charge in
the case -was watching the
22-month-old boy, Tyler Jaeger,
on March 27 while the toddler's
mother, Karey Jaege~ was at her
teaching job. in Glendora.
The couple i.hared Jaeger's
Newport Be:ich home and were
dating at the time, Karey J:seger
said.
Tyler Jaeger died of internal
bleeding and ruptured organs:
according to 11 coroner's autopsy
report nnd prosecutors contend
Laudenback inflicted those
injuries.
"If l would have been
su~picious (or Laudcnback), my
son never would have been left
in his care again," Jaeger said in
a recent interview. "I wns so
careful with everything about my
son.
"I thought at nome with Brian
would be the safest place for
him," Jaeger said or her son. "I
couldn't send him to day care
with a fractured skull. I thought
the safest place for him would be
at home with.someone l thought
loved him."
Jaeger said she had
Laudenback care for her son the
final two weeks of the boy's lire.
At first, Tyler Jaeger stayed
with Laudenback because the
boy had an eye infection and
couldn't go to child care. At the
-end of the fim week, Tyler
Jaeger suffered a skull fracture,
caused when the boy tumbled off
a play table, Laudenback
reportedly told hospital officials
at the time.
Defending her decision to
leave her son home that day isn't
new to Jaeger.
She also had to do it when she
appeared on a television talk
show, that hasn't yet aired, to
discuss child abuse prevention.
"The audience was very
hostile.'' Jaeger said, :sdding they
oskcd her questions such :is:
"How could you not know (if
your child was being abused?"
But Jaeger said she
understands why people react
that way.
''People think: 'Something like
this could never happen to me,
because l \\Ould I.now -that's
their defense mechanism,"
J:lcgcr said.
Jefferies, who has been asked
by her si)ter Marsha Laudenback
to handle media inquiries, was
careful to illustrate she's not
dismissing Jaeger's pain.
"The loss of a child is
something every mother must
feel fearful of at sometime or
another," Jefferies said. "I
certainly have. This is all very
sad."

A man serving probation
for a felony stalking
conviction was arrested by
state Department of Justice
agents in Newport Beach last
week, after authorities
learned he had tried to buy
a gun.
Agents were alerted to
Andrew Ozimec's pending
purchase while reviewing the
Dealer's Record of Sale,
which is filed with the
Department of Justice and
reviewed by agents as part of
the mandatory 15-duy waiting
period and background check
on all prospective gun
owners.
Authorities )ay O.dmec,
who is from the Newport
Mesa area, had i.tulked his
mother and his wife and
violated a court order
requiring him to stay away
from them. He also had
recenlly threatened to kill his
wife, according to authorities.
Agents caught up with him
lust Wcdnest.luy at his
brother's We st Newport
home.
Attorney General Dan
Lungren credited Ozimec's
arrest to the state's
mandatory waiting period on
gun purchases.
"This arrest may have
prevented two murde~. all
because the waiting period is
in place,'' Lungren )aid in a
press release distributed
Tuesday.

Dut residents of the Spygla)s
Hill l lomeowners Association,
who thought they were buying
homes overlooking a park-like
ccme1ery, are balking at the
cemetery's plans to built.I crypts
and family mausoleums as close
as 30 feet from their property
line.
Pacific View's proposal,
residents claim, would hinder
their ocean views, impact the
quality of residents' life and
destroy neighborhood property
values.
According to homeowners,
their understanding with Pucific
View ndminbtrators wus
dissolved when the cemetery
changed hands and fell under
the jurisdiction or Service Corps
lntcrnutional.
Residents have also
submitted a counter propo)al
that would give Pacific View an
additional 44,000 square fee t of
mausoleum development and
,-.ould increase burial setbacks
from 30 lo 100 feet.
Cemetery officials, who want
tp use nearly 100,000 square
feet of additional space for
maintenance buildings, offices,
and fomily mausoleums, have
called the residents'
scaled-down proposa l
unacceptable.

OK. Alexandra, I'd like to write
about Newport's celebration of the
swallows' return to Capistrano. ls
it true that the natives become

in the streets?

UH, IN CASE YOU'RE

SWALLOWS REALLY WENT -
About a quarter-century ago, I set
off all sorts of n3tionwide shock
waves by reporting that swallows
have stopped returning to Mission
San Juan Capistrano.
1 offered proof that the fabled
critters were going instead to
nearby Lion Country Safari. When
calls came in from media
everywhere scekitt& explan:uions,
the answer was simple.
"It's all those droppings from
the wild animals. ln short, Lion
Country offers the birds a more

McCormick heads a foundation

Says my informant: "Pat gained

she \\Oll'ld've been hurled into

dressed the board, asking to pro-
tect such procrams as the Environ-
mental Nature Center, teacher
training and the personnel com-
mission, as well as teaching and
staff positions.
The EnvironMental Nature Cen-
ter was a favorite among residents
at the meeting, pulling in strong
support.
"One important thing students
learn (at the ENC} is respect for
every living thing," said Marcia
Fudge, a nature center volunteer
from Newport Beach.
School board trustees received
on Tuesday a prioritized list or 63
bleak cuts -adding up to $12
million -the district may have to
make because or potential losses
from the county bankruptcy.
The list was compiled from sug-
gest ions of district staff and
ranked by members or a citizens
advisory committee.
An important piece or informa-
tion is still unknown, however. The
COUNCIL

are becoming increasingly more of
a problem for us ordinary, every·
day citizens," said resident Marg-
aret Walsh. "l haye the right not
fo be spoken to if I don't want to
be."
Under the aggressive panhan-
dling law -which was modeled
after a similar measure enacted in
Anaheim -individuals may not
solicit money from anyone in a
manner that would create fear of
"bodily harm or the commission of
a criminal act."
It would also prohibit anyone
from rendering services like win-
dow washing without the consent

district isn't sure how much money
it will get back from the county.
The county has made an initial
offer of a 77% return, amounting
to an $8 million loss, but it has al-
ready received objections from the
creditors committee.
Superintendent Mac Bernd said
a list of scenarios using different
rates of return from the county
will be given . to the board next
week.
When making the list, based on
a 77% return as a worst-case sce-
nario, district staff will figure in
possible income from such sources
as: using district reserves and leav-
ing only the required minimum;
selling surplus property; borrowing
from district reserves and restruc-
turing debt.
At times, testimony from the au-
dience became emotional, as was
the case with investment banker
Chriss Street.
He called the package of budget
cuts a "disaster" ·aqd pounded his
fists on the podium when he made
points about a lack of district ac-
countability for its involvement in
borrowing money to invest in the
COUJ\ty pool.
of the owner.
The other measure -which
mirrors laws in Brea and other cit·
ies in Northern California -
would make it illegal for anyone to
sit, stand or "otherwise occupy"
the center median of a roadway
for any reason other than crossing
the street.
ln a memo distributed to the
City Council last week, police
Capt. Rick Johnson cited 30 re-
ports of panhandling in the city
last year and tallied the tecord of
one man - a 30-year-old white
mal e -who had been contacted
by police 14 tiples in the past 12
months. His offenses included al-
leged possession of marijuana,
begging, selling on a freeway and
two traffic warrants.

CITY ,,.......,.1
1991-92 fiscal year. Expensive law-
suits and the settlement of the po·
lice department sexual harassment
lawsuit have further widened the
monetary gap.
The city has tried to keep pace
by reducing its work force, con·
tracting with private agencies, re-
ducing employC'e salary and ben·
efits and cutting back on city
projects whenever possible.
llut for all of its efforts., the city
has not been able to "turn the
corner," accbrding to Murphy. Fi·
nancc officials anticipate a $3.8
million deficit for the upcoming
year and a deficit of between
$500,000 and $2. l million for fiscal
year 1996-97.
For the upcoming year, the city
expects to make up the losses by:
•Delaying Sl.3 million of capi·
tal projects until the following
year.
• El iminating $2.3 million from
the city's operating budge t.
•Gene rating $500,000 through
new or increased fe es.
At a Tuesday morning press
briefing, Murphy and Danner were
cautious about revealing specific
projects that would be delayed or
which fees might be increased.
The city may consider imple·

other potential mo-.e is a fee in·
crea~e at the Balboa Yacht Ilasin,
although yacht basin fees could
only be u ed to support state tide-

Approxim:itcly one-third of the

come out of other city agcncie~.
