tor closed his case against Brian
J.,audenback on Monday with a
medical expert who told the jury
he has no doubt that Tyl er Jae-
ger's death wasn't an accident.

of San Diego, corroborated testi-
mony from two doctors in the Or-
ange County Coroner's office who
performed ·the autopsy on the 22-
month-old Newport Beach resi-
dent who died last March.
"Tpis fracture is low on the left
side of the head," Chadwick said,
describing a skull fracture that
Laudenback said Tyler suffered
when he fell from an 18-inch-taU
play table. ·
"It means that there was a low
impact (and) that requires the
child to fall on the side of the
head or be struck on the side of
the head. If one falls on the side,
the shoulder or the body usually
strikes first and the head might
not hit at all."
As for the severity of the injury,
Chadwick said it could be ex-
pected "if the . child fell 10 feet
and. struck a protruding object." .
Chadwick also agreed with the
coroner's officials who testified in
the murder trial last week that the
two skull fractures didn't kill the
toddler. There wasn't enough
brain swelling to cause death, he
said.
Instead, the loss ·of more than
10 ounces of \>lood from ruptured
and torn abdomi nal organs killed
Tyler, Chadwick said.
Asked by Prosecutor David
Brent what type of accident would
cause that much damage, Chad-
wick said it would require some-
thing akin to a child falling off a
bicycle moving at 20 to 30 mph
and landing on a handlebar that's
sticking up. ·

The board agreed to postpone

trustee Wendy Leece said she

"no" vote.
"l feel that there are several cl-
ements in this particula r video that
would be borderline as far as the
law that says that abstinence
should be taught, and l realize
th at it would be presented in con-
text of the whole entire sex educa-
tion curriculum," said Lcece,
whose unsuccessful bid fo r the
school boan.I five years ago fo-
cused on revamping sex education.
Overall, she said the videos
aren't the best choice for the dis-
trict.

Councilwoman Norma Glover said
that tier dispute with the ~ity's Ii-
brary board of trustees last week
stemmed, not from their stand on
library policies, but from a per-
IODal attack directed at her by one
of the trustees.
Glover accused trustee Lucille
Kuehn of mocking Glover's accent
during ~ Feb. 21 board meeting.
The insult . prompted an angry re-
l.>ponse from Glover at a subse-
quent library board meeting.
Glover said she could deal with
"assassinations of my beliefs or
policies" sin~e such activity was
part of being a public figure. But
personal attacks and particularly
those directed at her speech or
heritage are another matter, she
said.
"My regional dialect is a p.art of
me that 1 can never change," said
Glover, who was born in Okla-
homa. "I don't think LuciJle is a
representative of Newport Beach.
Newport Beach is a sophisticated
town which accepts people who
speak differently, look different or
are a different color.
"In 58 years, l ~ave never en-
countered this kind of prejudice
before. l felt like my heart had
been sliced When I heard that
tape."

Coming from the Kyoto Academy
of International CUiture in Kyoto,
Japan, these students spent their
two days observing the hotel staff in
daily duties at the bclldesk,
concierge and housekeeping areas.
Since the students speak limited
English, verbal communication was
a challenge, but not an obstacle to
~cir learning.
"Sometimes you can communicate
without Jhc spo~en language," said
Ralph. Roobeim, a spokesperson for
the hotel at 4500 MacArthur Blvd.
"Sometimes language is not a
barrier."
"The community thing ·
that happened was the best
part about it," Paulsen said.
"Everyone was working
"'together and I loved it.
There was never a time
when there wasn't a mass of
people either shopping or
helping out.
But, just in case, their teacher
served as an English translator, he
said, for the times when actions
couldn 't speak louder than words.
The Sutton Place Hotel, fonncrly
called Le Meridicn, was selected as
the training site for the ho~l students
by Fujimi Egami, a travel agent from
the Nippon Travel Agency in Los
Angeles.

didn't leave until Paulsen
did at about 5:40 p.m ..
"Hopefully the weather wiU get
better and we will be able to show
them the clearer side of California,"
said Egami.

"They're very cordial," said Linda
O'Toole, general manager of Sutton
Place. "And they smile; a lot, of course
-because they hope Lo be in the
business."
The goal of this first-ever
rummage sale was to
generate extra funds for
Whittier §_chool so studen~
can experience the same
educational activities -like
ricld trips and computers -
that other schools have
access to, Paulsen said. That
way, all students will be on
the same level when they
mee t up at Ensign Middle
School.
The entire $7,500 from
the sale will go to. Whittier
School for the educational
items and activities. Without
the donations, the children
would have to do without
these "extra" items.

Next week's Toshiba Senior Cfassic Golf Tourna-
ment is being heralded by some as "one of the most
coocerted community ef(orts" in Costa~Mcsa's rec~nt
history. Btu, for a few City .G<Juncil members. the char-
ity event isn't worth the estimated' $3~,000 wo~lh of po-
lice services that organizers were hoping the city would
absorb.
"We do receive requests from· other charities that
are located here in the ci1y, like the Lion's Club's fish
Fry, and we do not lessen the security fee~ for them!"
said Mayor Joe Erickson, who along w11h Council-
women Sandra Genis and Mary H9rnbuckle voted
against the (ee waiver on Monday night.
But the council did authorize the closure of six street~ during tournament hours, which will run March
15-19, from 7 a.m. "through the end of play" -a deci-
sion which nearby residents supported.
"Those street closures are as much for the bcberit
and safety of the residents as they are for {traffic con-
trol)," said Charles Robertson, who Hves on Tahiti
Drive one of the street's targeted for closure.
Robertson and other residents who spoke during the
council meeting on Monday said the event wi ll likely
bring the city sales tax revenues, in addition to benefit-
ing a 'number of charities. .
The other streets that will be closed to traffic during
. the tournament are:
•Capri Street.
•Java Road at Maui Place.
• Kornat Drive.
• Gisler Avenue.
• Club House Road.
Residents living in those areas will be issued par~ing
permits that will allow them access.
In other matters, the City Council:
• Delayed final adoption of two ordinances targeting
aggressive panhandlers and beggars who solicit alms
from street medians. The postponement will allow the
city attorney ·time to review pending litigation against
similar panhandling ordinances in other cities. The
matter will be placed on the agenda for the council's
March 20 meeting. ·
•Cleared the way for construction of six condomini-
ums at the site qf the current Art Colony studios at
120 23rd Street. 'the council gave initial approval tc l
general plan amendment that changes the current lanci
use designation from neighborhood .commercial to
high-density residentia.J: The property owner intends to
raze the Art Colony studios -built on a 19,800-
square-fool parcel just cast of Newport Boulevard -
to make way for the new condominiums.
•Authorized the formation of a Newport Boulevard
review committee to include two residents, two prop-
erty owners, two business owners and one individual at
large. Council member Gary Monahan and one mem-
ber of the Planning Commission will be appointed to
serve as liaisons to the committee. The committee will
examine ways to improve the stretch, marked mostly by
budget mo1cls and strip malls.

rear window.

stolen from the carport or the victim's house.
4000 ·block or Jamboree: Someone reportedly pried open

though school trustees decided to
open a Personnel Commission spot
to the public instead of reappoint-
ing the man who'i held the job for
15 years, the incumbent isn't going
without a fight.
, Longtime Newport-Mesa Uni-
fied School District personnel
commi~sioner Thomas W. Hender-
son is openly campaigning for the
post, even publicly asking school
trustees at a recent school board
meeting for .another term.
The ·Newport Beach resident,
whose term expired last week,
urged the school board to let him
continue his work with the com-
mission.
"I would very much like to con-
tinue on the commission," said
Henderson, who was a school
board member himself from 1972
to 1979. "It is very rewarding work
and I think I have something to
contribute to the district."
The late-night crowd attending
the board meeting cheered Hend-
erson's campaign plug.
One trustee, Jim de Boom, said
that Henderson hlls been a ca-
pable commissioner and that the
board might reappoint him once
they look ~ver the other ap-
plicants. .
The personnel commission
meets once a mont~ to oversee
personnel management practices
for non-teaching -or classified
-employees. Commissioners are
involved in recruitment and estab-
lishment ·of employee eligibility
lists, salary recommendations and
discipline judgments.
While commissioners earn a
lowly $25. per meeting,-they can
receive district-provided health
care benefits. District officials de-
clined to say whether Henderson
re<;eives health benefits.
School trustees just cut the
three-member commission's bud-
get Crom $25,000 to $20,000, which
covers recruitment and selection
of employees and other expenses
such as office supplies.
The next commission meeting is
March 15.
The board called for applica-
tions for the vacant position in
December and about 32 people
have responded. From the list,
trustees will select a new commis-
sioner during a public meeting in
about two weeks.

Somehow Dorothy Harry
persuaded, bullied, dragooned
almost all the housewives in
Shorecliffs to make life-sized
Santa Clauses. They were made
of a chicken wire frame covered
with red and white oil cloth,
topped with the usual bearded
head and cap and finished off
with a pair of bluck boots. They
we re good-looking, king-size
Santas.
So far, so good. We had a lot
of authentic Santas. What to do
with them? "We display them,"
said Mr~. Hacry. Soon every
household in Shorecliffs was
trying to outdo every other
household in displaying its-Santa.
We had Sanw o.n our front
yar-ds riding in sleighs, walking
dogs, riding surf boards, skiing,
having evening martinis, being
chased up front yard light
standards by toy dogs. It was
really amazing the amount of
originality the Shorecliffs
residents displayed, all u,nder the
constant prodding of Mrs. Harry.

Word of our display spread
throughout the Southland and
soon there were streams of cars
driving bumper to bumper
through Shorecli(fs every
evening. Each car was crowded
with excited youngsters looking
at all the Santas outlined in the
flood lights of our front yards. It
was nice and somehow you f cit
that you were contributing, to the
Christmas cheer of the whole
Southland as those cars full of
children drove through lhe tract.
However, this happy Christmas
story has, as I said, an unhappy
ending.
A fter four or five years
Shorecliffs had no more
Santas. The darker. side of man's
ch:iracter had taken over. Mos't
of our Santas had been stolen.
When you went to bed your
Santa was on your front lawn
doing something interesting and
differeni. The next morning your
Santa was gone. I can just
imagine some fond father riding
past about three in rhe morning
when the lights in the house
were out, but the Santa was still
on the front yard. He says to his
young son, "Sonny, that there
Santa would look good on our
lawn. Run up and grab it."
However, I must admit that my
Santa was stolen by a local
Newport Beach youngster who
was caught by the police. That
was the first time it was stolen. I ,
don't know who got it the second
and last time. Dy that time l
didn't care. My Christmas spirit
had !loured.
In the meantime Mrs. Harry
had given to th e city the three
lots on which the Corona del
Mar branch library is localed.
Unfortunately, Dorothy Harry
died soon after, and with her
died the Shorccliff Santa Cfau!>:. ·
parade.
As 1 said, thil. is a Chmtmas
story with :i !lad ending. Scrooge
wins :igain.

San Francisco 49ers, who won this
year's football contest by a land-
slide margin, officials at the center
reported.
By 9 p.m. Sunday, when the out-
reach operation had shutdown,
some $309,000 had been pledged
to local, national and international
Jewish charities.
That surpasses last year's total
of about $300,000, Jewish Federa-
tion spokeswoman Debbie Stein
said.
"This is (the day) when we con-
tact more Jews than on any other
day,'' Bill Shane told a group of
volunteers during a training ses-
sion. "Whal we're asking them to
do is renew their com mitment to
Jewish life."
While officials at the Jewish
Federation have plans 10 expand
the Baker Street campus in the fu.
ture, cons.truction is complete for
now, and the last of the seven
agencies -serving preschool stu-
dents to seniors -originally slat-
ed to occupy the building moved

video was made in 1992 and that
health concerns are djfferent now.
Leece said she was also con-
cerned that descriptions of certain
sexual activities in the videos could
encourage date rape. "In other
words, it just leaves too much out
in the open and I feel there's too
many negative aspects about it and
we need to find something more
current."
And the attitude the video
seems to show toward parents isn't
a positive one, she added.

ages adolescents to talk and com-

the council last November, Pham

sion to invest in the now-bankrupt
county pool and warning against
the use of treated. waste water.
Now, Pham, 44, is hoping to
bring tQ the Golden State what
Newt Gingrich offered to the na-
tion -the "Contract With Cali-
fornia."
The plan calls for three new
laws:
• Accountability for elected of-
ficials.
• Convert public services to J?.ri·
vate companies. Public , u hlity
agencies should go first because
they can easily raise rates, some-
thing that's driving businesses out
of the state, Pham said.
• Public health. This is one of
Pham's key issues; he has argued
about the use of treated sewage
water locally.
ROBERT RUPER
Ruper, an eye surgeon, says he's
running on the strength of his cli-
ents -who have heard him be-
moan the current state of politics.
He's never run for any office be·
fore.
"I believe these professional
politicians have forgotten about
the people they're representing."
Ruper, 57, said. ..The pedple can-

in state playoffs (2-3) has been less than
sterling, particularly when measured
against a 22-6 record (.786 winning per-
centage) in the Southern Section playoffs
during Coach Paul Orris' nine seasons at
the helm. · ·· -
"We talked about it in practice all
(Inst) week," Owen said of the quest for
the school's first CIF state basketball
championship. "The trend has been that
once we win (the section), we haven't
gone on and had much success (in the
state regionals). But we want to go as far
as we can this year. We still have a lot to
prove." .
The Sea Kings (18-11), .seeded fourth
in the eight-team Southern Regional,
could prove a lot by beating first-round
visitor Serra (17-12) tonight at 7:30.
Coach Paul Orris said he has also
stressed the importance of the stale pl ay-
offs more than in previous years.
"I think maybe we .have a little more
talent than we've had lo go a{ter (a state
title}," Orris said .. "Every game we've
played in CIF has been a step up each
time and Serra is another step up from
St. Bernard. We have to be a little more
efficient than we were Friday night."
Verbum Dei .
Verbum Dei, the No. 2 seed in the re-
gionals, went on to beat the Del Rey
League champions in overtime, 87-81.
CdM held off Del Rty League repre-
sentative St. Bernard, 47-46, to win the
JV-AA title in th e se'CC>nd half of Fri-
day's Division lV doublehead~r· at UC!.
The· Sea Kings, who own (our section
crowns, are led by Newpcirt-'Mesa Dis-
trict Player of the Year Brian Fracalosy,
as well as first-team All-Sea View per-
formers Dominic DeGrazier (coaches'
team) and Bri'1n Coleman (Daily Pilot
selections). .
Fracalosy, averaging nearly 17 points
per game, had a team-high 15 against St.
Bernard, while Coleman sank the game-
w inning free
throws with 35.8

Friday evening we attended the Division
IV-AA CIF Finals for boys basketball at the
Bren Center on the University of Irvine campus.
Arriving early we enjoyed the exciting conclusion to
the Vcrbum Dei-Serra game, which was won by
Verbum Dei in overtime.
In fact, at the conclusion of that game, the players
and fans were so excited that in their celebration two
lables were accidentally overturned, banners fell to
the noor and Verbum Dei players taunted the Serra
cheering section with their victory.
When the excitement subsided, awards were given
10 both teams and the CIF Trophy was awarded to
Verbum Dei.
The Corona del Mar-St. Bernard game began and
true lo a CIF Final it was a hard-fought, clean game.
Exciling and heartwarming to see both teams play
with heart and dedication! ...
Corona del Mar won and again, the build up of
excitement and emotion broke into the normal victory
celebration between players and fans. However, no
tables were overturned, no taunting took place, no
banners fell to the floor, just the natural emotion of
the celebration of ·a big win!
Suddenly, the announcement ...
"The Awards Ceremony was being canceled due to
·unsportsmanlike conduct!"
What? Why? Where? No congratultions, no
ceremony, no trophy, no MVP, no introduction or the
players for both teams, no announcement and no
explanation!
Surely, something serious must have happened. A
fight? A riot? No, nothing to warrant the cancellation
of the awards ceremony. It was truly heartbreaking.
The basketball players for St. Bernard and Corona
del Mar did not know what to do. Both teams sat or

thing that Sharon Smyth has noticed
since takina over the Estancia High soft·
ball program this season, it's the change
in attitude.
"It's changed a lot for the better,"
said Smyth, who l.s taking over for Coach Bob Rey-
nojds this season. '1bcre arc a lot of girlJ who are
coming out this seuon that didn't 5how interest be·
fore.''
One of the more 1ianlf1eant new mcmben is Cyndi

stood and waited. Finally, in an anticlimactic manner,
the CIF Trophy was handed to Coach Paul Orris of 0
CdM for a. team picture, and the disappointed St.
Bernard players left their chairs for the locker room.
Everyone in the Bren Center, players, coaches, fans,
students, friends and parents stood in disbelief!
Apparently a CIF official ordered the cancellation
of the awards ceremony.
l do not have a son on th is basketball team, but
our children over the years have graduated from
Corona def Mar High·and I have been involved in
the activities on campus and in the community.
I was deeply appalled and truly disgusted at th e
very inappropriate and completely unfair rush to
judgment.
For some of these athletes, \his was the game of
their lives. The biggest game next to a State
Championship final.
W ithin an instant he destroyed a moment th:ll
cannot be relived by any of the seniors on
either team, he robbed both teams of the
congratulations of achievement they deserved and he
destroyed an entire priceless "Kodak moment."
He destroyed for all of the parents who stood in
disbelie(, with their cameras poised. There were 3,200
people in attendance and all were affected by this
decision.
This is a lot or power for one man (or woman) to
wield. I am troubled by this "negative
re-enforcement" philosophy, and disgusted by the
actions of power hungry people.
Too many times over the years, I have seen
coaches bench hard-working, talented and dedicated
players for some petty reason, the outcome of too
many games determined by referees who nashed a
red card, when a yellow card would be more
appropriate and too many officials ruin events
because they are enamored by the power their
position gives them.
If they cannot be compassionate and make fair
decisions, they don't deserve to be officials.

middle of the surge ... .
As reported in Saturday's edition, CIF Southern
Section Commissioner Dean Crowley entered the
Coronu del Mar High postgame locker room to
off er a sincere apology to the Coronn del Mar
High players, their families, their school and their
community, for deciding to cancel the traditional
~ awards ceremony that follows CJF championship
events.
He said his decision was based on a concern
over crowd control, and that tbe school had been
made aware beforehand that spectators were
expected not to rush the court in any postgame
celebration.
A public address announcement requesting
spectators remain off the court was also issued at
the game.
It was my observation that no tables were
overturned when Verbum Dei players stepped up
onto press tables to gesture toward the Serra
accepted to college. Academics and athletics are very
intense for college acceptance and repeatedly our
children continue to rise to the challenge. Why, as
adults, when they work hard to meet the challenge,
do we continue to punish rather than reward?
Don 't we want to raise young people who will be
good citizens, set fine examples for their families and
contribute to their community?
W hy then do we continue to destroy their
precious important moments of
accomplishment. Did this CIF official think he was
building self-esteem and self-confidence?
What gave this man the right to make that call on
crowd, following their victory, and ho bystanders
(i.e. newspaper reporters) were dfected by this
unsportsmanlike display.
I was. however, l)lomentarily pinned beneath
merging CdM players and bludent spectators, who
pushed toward each other to share their "normal"
postgame joy, with press tables (and reporters)
caught in between.
As a crowd of students pushing toward the
players drove my head downward toward the press
table, I began rising forcibly from my chair and
driving backward with outstretched arms to free
myself from the communal high-five.
As my movement forced some of the student ,
rooters away from the press tables, the CdM
players' momentum continued foiward, driving a
table or two a few feet toward the stands, and also
into my legs. before 1 continued to backpeddle I
into the students.
A minor neck strain, a small thigh bruise, and a
healthy dose of ndrenallnc, triggered by concern of
more serious injury, made this a championship
moment I hope to never relive.
Friday evening? CIF is supposed to set the ultimate
example in athletics.
This man owes St. Bernard High School and
Corona def Mar High School an explanation and he
owes both basketball teams an apology.
I hope he can humble.himself and show these
athletes that he can set a good example. A start in
that direction would be to step forward and admit he
judged too quickly, admit he made a big mistake and
apologize!·

"Nancy is a speedy player, who uses a lot of small
ball -drag. slap -to find a way to get on base,"
said Smyth. "And she has the ability to steal some
bases.''
Senior J-{caiher Giraud backs Barnett in the order,
with Black, Honeycutt and catcher Jennifer Robert-
son malting up the power part of the lineup. An-
other starter is speedy freshman Stephanie Seer, who
has been playing on travel teams.
The Eaates won't have to ao far to improve on last
year's numbers -2·18 overall and 1·9 in the PCL.

NEWPORT BEACH -You won't be reading about
this Dan Glenn volleyball team in USA Today.
Glenn's Newport Harbor High boys team lost two-time
Newport-Mesa District Player of the Year Mitch McCoy,
as well as two-time All-District setter Eric Vallely to
. Division I college programs.
The coach of last fall's national champion girls squad also had soccer
injuries sideline two others expected to be among his top eight.
Throw in a knee problem 6-foot-4 senior Greg Slick aggravated the
first week of practice, and Glenn is, for the first time in years,
considering the possibility of not making the Cl F playoffs.
"The playoffs are usually a given around here," Glenn said. "But this
year, I'm not sure that's the case. I think it's going to come down to a
dogfight for the three playoff spots from our league."
Slick, a second-team all-league pick as a junior, figures to be the Tnrs'
No. 1 hitting weapon, should he be at full strength.
"He's our best outside hitter, our best passer, and he's the guy we like
to go to. But if he's hurting, we're hurting," added Glenn, who also
returns starter Wes Badorek, a 6-5 junior who was a second-team
all-leaguer on last year's 14-5 league co-champion.
Badorek and 6-4 senior Josh Richardson give the Sailors enough size
up front to compete, but ball control is an area of concern.
Max Spooner, a 6-1 senior setter, gained valuable varsity experience
filling in last year when Vallely's rickety knees kept him on the bench.

Spooners leadership skills add greatly to his solid play.
Senior Jon Benzinger, an all-league football receiver, will start as a
6-2 outside hitter, while 5-11 freshman Scott Archbold steps into the
starting spot that would have been filled by his older brother Bob, who
broke his leg in soccer and is out for the season. Junior Cameron Black,
who broke his foot in soccer, is out until at least mid-March, but should
be a strong contributor when he returns, according to Glenn.
Peter Cunningham, a 6-3 sophomore outside hitter, Dana
Messenbrink, a 6-1 sophomore setter, senior Eric Norr, sophomore
Tobin Junowich and junior twins Ryan and Graham Hoover fill it out.
