POSNEll, ST.UP Wann SANTA ANA -Did a former medical examiner, who testified on Tuesday that Tyler Jaeger's fatal injuries were caused by an ac- cident, raise e nough doubt to clear murder suspect Brian Lauden- back? The jury is expected to 6egin pondering that question today once attorneys conclude their clos- ing arguments, which began Tues- day afternoon. Laudenback never took the stand in his own defense during the five-day trial. During testimony for the de- fense on Tuesday morning. Dt. Kalil Jiraki used models of the skull, brain and abdominal organs to show the jury how all of the 22- month-old's injuries could have been accidental. "It's apparent that the cause of death is herniation," said Jiraki, referring to movement of the brain under the skull. "This ~erniation is a deadly phenomenon." · The movement causes swelling near the brain stem, applying pres- sure on parts of the brain that control the heart and lungs, be told the jury. · Brain swelling -prompted by a skull fracture -caused Tyler's death a week after Laudenback ,. contends that the toddler fell from an 18-inch-high play table. Jirak.i also said lacerations in Tyler's internal organs were con- sistent with damage he bas seen -during his six years as a coro- ner in Cleveland and Detroit -· caused by improperl,Y applied car- diopulmonary resusatatton. Asked by Deputy Public De fender Sharon Petrosino if bis re- view of Tyler's medical records and the work of doctors who per· formed the autopsy revealed whether the toddler's death was accidental or intentional, Jiraki said he had no doubts: "There was no abuse," he said. Jirak.i's testimony contradic~ that of three doctors who were called to testify by Deputy District Attorney David Brent. Two of the doctors perfbrmed parts of the au· topsy on Tyler; the third heads a child abuse wing at the Children's Hospital of San Diego. Under cross examination, Brent attempted to pick apart Jiraki'a testimony injury by injury. "I thought this was a community school and I'm very upset about this idea," said Gayle Stroffe, a Newport Beach resident who has a son at Corona del Mar and ~two daughters who have graduated from the school. "As far as I know, three indi- viduals started this and it sounds like they wanted to apply for it and get the paperwork through so CdM could be on the list. I don't even know why they are doing this. It has taken many years-to get the top teachers, to get CdM's academia top in the nation and I don't understand it." But organizers need volunteers. And if all goes well, local teens will have a study spot of their own before the month is out. Volunteers from St. Joachim\ Catholic Church in Costa Mesa and St. Andrew$ P resbyterian Church in Newport Beach, who organized the Shalimar Drive Learning Center, are hoping a new Teen Center will be up and running within the next few weeks. The new facility will be ot 777 Shalimar Drive, one building over Crom the Learning Center. Costa Mesa City H all staffers will begin firming up details for a proposal that would turn the former Costa Mesa High School farm into a youth sports complex. While school district officials are trying to decide what to do with the 18-acre parcel, the Q>sta Mesa City Council on Monday night directed staff to begin drafting a site specific agreement outlining just how the proposed three-way agreement with the city, the Newport-Mesa Unified School district and the Orange Fairview Developmental Center to · host spring boutique Thursday Fairview Developmental Center will host its annual Spring Boutique on Thursday frOfJl 8 a.m. to 2 p.m. Fairview is a non-profit organiza- tion which bills itself as the "home to over 1,100 developmentally dis- abled individuals ranging from in-. fants to senior citizens.'' · The center is on Harbor Boule- vard at Fafr Drive in Costa Mesa. County Fairgrounds would work. Under'the agreement, the city and the school district would share use of the sports facilities .,... which would feature three lighted basketball courts, two lighted soccer fields, a. practice football field and a new running track. A portion of the complex would be made available to the fairgrounas for lease' to satisfy parking needs during certain special events. The agreement could bring revenue to the financially strapped school ·district, which has $80 million tied up in'the . Orange County'investment pool. But, there's another carrot being dangled before the district. Newport Beach developer Tom Williams recently offered the district $10 million for the land. Williams has said he'd like to build 10 tract homes on.each of the site's 18 acres. For tickets or more information, call the school at 760-3472. The tree removal is pan of the city's effort to revitalize the .,_business district and make Main Street more welcome to pedestrians. With fewer trees, officials argue, there will be more walking space and some of · the street's attractive areas will become more visible. The City Council earlier authorized the removal of six parking meters on Main Street while merchants in the newly-formed Central Balboa Business Improvement District will be spending $20,.000 annually on marketing studies and area improvements. Several residents in the Peninsula Point Homeowners Association had pbjected to the removal of trees, claiming that the trees were an attribute rather than a hindrance. They expressed shock at the commission's willingness to sacrifice all of the trees and vowed to bring the matter to the city attorney.
