Assemblyman Ross Johnson, who
moved to Irvine in January, appears
to be the Republican nominee to
represent the 35th District in the
state Senate after breaking rcti<cd
Assemblyman Gil Ferguson's
stronghold on the area and perhaps
ending his decade-long political ca-
reer.
Doris Allen, a third prominent
Republican in Tuesday's election to
fill Marian Bergeson's vacant scat,
lagged behind, 22%, with all pre-
cincts recorded, but the results still
unofficial at press time.
Johnson's projected victory, with
31.3% of the ballots cast, didn't get
the required 50%-plus-one-vote
needed to win the election outright,
setting up a May 9 runoCf with the
apparent Democratic winner,
Madelene Arakellan, of Ncwpor&..
Beach.
Ferguson got 25.3% of the 58,035
ballots cast.
Arakelian captured 7.9% of the
vote, while her riva l, Mike Palitz,
got 5.\%.

Cox target of protest over malpractice bill _
BY EVAN HENBILSON, STMF Warru
... Carrying signs, photographs and
prepared statements detailing their
experiences, angry members of a·
quality health care advocacy group
descended on the Newport Beach
district offices of Congressman
Christopher Cox Tuesday morning.
The dozen members of
Consumers For Quality Care came
from as far as Los Angeles and San
Diego to protest Cox's support of
legisf'ation capping pain and
suffering awards from health care
lawsuits at $250,000. Cox's bill,
passed last week in the House of
Representatives, seeks to impose
California's $250,000 cap
nationwide.
In addition to their complaints
about the legislation itself, the
protesters accused Cox of pushing
through a "secret deaJ" without
giving members of the public the
opportunity to voice their concerns.
People like Steven Olseo - a
6-year-old San Diego boy who
suffered brain damage allegedly as a
result of a doctor's negligence -
never got the chance to protest,
according to Jamie Court, director
of the consumers group.
Some protesters sat in
wheelchairs while others carried
crftches. Signs read "Cox sells out
patients" and "Dying for Dollars
has to stop." Security officers from
Koll Center, which manages th e
building, asked the protesters to
keep their activity on the public
street.
Cox's district representative Greg
Haskin invited the group up to
Cox's office where the piotesters
continued to air their complaints.
"This is not over," Court said.
"This (legislation) is not good for
patients. It's not good for
consum'ers. It's only good for the
health industry lobby."
Because state law limits pain and
suffering compensation at $250,000,
a jury reduced young Steven Olsen's
award from $7 million to $250,000,
according to the Consumers. Other
residents at the protest recounted
their experiences ~th medical
malpractice and sfaed that the
compensation cap prevented lawyers
from taking their cases.
But compensation was only part
of the issue, said Linda Ross, a
Newport Beach resident whose has
spent over three years questioning
the circumstances of her mother's
death.
"I can't close the wound on my
mother's death," Ross said. "This is ·
not about making the victims rich."
Cox was in Washington, D.C., and
coutd not be reached for comment
Tuesday. However, in a prepared
statement, th e congressman satd
emotional distress awards nec<f to
be kept under control so th at
residents of all social ranks could
have more access to health care.
"In New York City, where
CaJifornia's Medical Injury
Compensation Reform Act reforms
don't yet exist, health care is much
more expensive for the average
family," Cox wrote. "And in New
York City's eublic hospitals,
malpractacc LS rampanL The city
simply can not attract qualified
physicians to work there."
~ noted that his bill received
bi-partisan support in the House
and passed by a 247-171 margin.
But protesters questioned the
congressman's motives, claiming Cox
bad accepted Qver $162,000 in
campaign contributions from health
insurance lobbyists. Court tried to
give Haskin a bucket of manure
"because of aU the buU we have
from Cox," Court said. Haskin
refused to accept the "~ift."
"Next time it will be a barrel of
blood because the blood will be on
Cox's hands," Court said.
Costa Mesa Planning Commission

incorrect information about
who introduced Chriss

BY TINA BOROATrA, STAFF Wiurlill
The Costa Mesa Planning ·
Commission Monday approved plans
for a new 2,00().square-foot garden
center at the Fedco membership'store
but f}lso asked company officials to
meet with nearby residents to address
concerns about store noise and
late-night deliveries. 4)
About five homeowners spoke to the
commission about the Harbor
Boulevard store and its plans.
"They were mostly asking the
commission fo r help;" said
Commissioner Libby Cowan. "I didn't
hear anyone say, 'Do not approvc
0
this.'
They were mostly saying, 'We need
help dealing with this problem.' "
Residents have complained about
the clank and clatter of deliveries to
the store well after its 9 p.m. closing
time. Some residents have said they've
heard trucks unloading as early as 3
a.m.
"Ilut, for the most part, the
commission felt that's a separate issue
from the warehouse concerns," Cowan
said.
Fedco's director of stores Matt Ross
said last week that he has already
spoken with a few residents in hopes
of working through the problems and
casing their concerns about the new
garden center. But, Cowan said the
commission believes a more formal
meeting that's open to all residents
wou ld be more productive.
"And, we requested that (Planning
Department) staff help facilitate that
meeting, just to make sure that it
really happens," Cowan said.

Nern1ort city
planners tackle
cemetery plans
BY EVAN HEN.SUON, STAFF Wa.nn
Newport Beach residents and
cemetery administrators will have a
five-week hiatus before tackling the
Pacific View M~morial Park
conlroversy again.
At the direction of the New.eort
·Beach Planning Commission, caty
planners will incorporate
commissioners' suggestions into a new
plan for the cemetery's ultimat~
build-out. That plan will be brought
back on April 20 for the commission's
third public hearing on the project.
After nearly five hours of testimony
last week, residents, facific View
officials and commissioners still were
not able to pin down a mutually
acceptable plan, even though cemetery
officials offered to increase setbacks
and relocate a few of the mausoleums.
· Cemetery owners arc seeking a use _
permit allowing Pacific View to
exceed its 50,000-square-foot cap.
A plan to build crypts and family
mausoleums near residential property
lines have residents of Spyglass Hill,
Sea View and Spyglass Ridge worried
about the quality of their views,
lifestyle and property values.
Homeowners and cemetery officials
went through nine months of ad hoc
committee meetings without reaching
consensus. Residents say they resent
the "intrusion" of a Texas.based
corporation -which owns Pacific
View -threatening to overwhelm
neighborhoods of Newport Beach.
Cemetery officials counter that their
services provide a need for the entire
county -not just for .a few
neighborhoods.
Pacific View land use consultant
David Neish said cemetery officials -
heard so many suggestions from the
commission last week that they ~ere
still reviewing concept plans. At the
meeting, Neish su~milled a proposal
which increased setbacks from 30 f ect
to 66 feel in some areas and relocated
a few of the mausoleums in an
attempt to respond to residents'
complaints.
"The com.mission never really came
out and said whether they liked or
disliked our new plan," Neish said. "I
would say that 95% of the ideas
suggested would be very acceptable to
the cemetery."
Homeowners have been pushing the
cemetery to remove family
mausoleums from the plan entirely.
Neish said that proposal was
unacceptable.
Although he said residents objected
to not being allowed to respond to
Pacific View's presentation at the end
of the meeting, Spyglass Hill resident
Leonard Fish said in some matters,
the commiss.ion seemed to support the
homeowners' concerns.
"There seems to be a strong desire
on the part of the Pl anning
Commission to make certain that none
of the construction desires of the past
will be repeated," Fish said. "We're
very displeased that the commission
has referred it back to the planning
department, which has been very
anti-neighborhood without allowing
input from the residents."
At an earlier meeting, Planning
Commissioner Tod Ridgeway declared
a resolve to force the two sides to
compromise. He said Tuesday that
there appeared to be some movement
and that the upcoming weeks would
prove to be productive.
The commission could likely respect
the cemetery's concern about
maintaining yiel~. Ridgeway said, as
long as the cemetery gave
consideration to setback requirements.
"l think the common ground among
every member of the commission is
that they all think somethirrg's doable
in terms of a project," said city
Planning Director Jim Hewicker.

although Qfficials can't say
if the cases ar~ related.
As local police continued to
puzzle over tho case or a newborn
that washed up on the sand
Saturday, a third dead baby was
discovered in the county on
Tuesday.
· The incidents -here in
Newport Beach, in Sunset Beach
and Tuesday in San Clemente -
have similarities, but police said
they haven't been able to link the
discoveries to each other.
All three full -term babies were
about the same age -less than a
week old - and roughly the same
size and weight -between 6 and
8 pounds and 19 and 21 inches.
The umbilical cords were attached
to all three as well, Newport
Beach police and Orange County
Sheriffs officials said.
The string of shocking
discoveries began on Saturday,
when a dead baby was found on
the beach near 10th Street by a
Garden Grove woman who was
walking on the Balboa Peninsula
shore.
That incident was followed by
another tiny corpse that washed
ashore Sunday in Sunset Beach.
The most recent discovery was
on Tuesday morning. Unlike the

parking lot, according to Orange

Also in the box was a blue baby

baby was dressed in an oversized

Gamer said.
Coroner's examiners arc

according to Newport Beach
Police Lt. Paul Hcnisey.
But, solving the case could
prove too difficult, he added.
"They indicate it's not too
hopeful ... because of the length
or time in the water."
The babies found in Newport
and Sunset Beach were in the
water between four and six days,
according to police.
"It could be just a bizarre
coincidence," Newport Beach
Police Sgt. Andy Gonis said.
"We're still investigating it."

...,. Friday designated as the
·day to show appreciation
for police by breaking
bread with officers.
B¥ EVAN HliNl!llSON, ST.ur Wa.rru
NEWPORT BEACH -After a
14-year absence, Take a Cop To
Lunch Day returns to Orange
County on Friday at a time when
kindness toward faw enforcement
officers could not be more wel·
come, according to event creator
Pat Michaels.
"The situation with Officer Bob
Henry really sort of makes an ex·
clamation point," said· Michaels,
ref erring to t~ Newpfrt Beach
police officer Who remains in criti·
cal condition after being shot in
the head Sunday.
"A lot of our cops don't even
live here, but they protect us and
risk their lives every day. We
ought to do more for our public
safety officers."
' A local yachtsman and radio
: station owner, Michaels started
'the cop lunch in 1974 while doing
, radio comme.ntary in Santa Ana,
later taking the event to San Ber·
. nardino and Riverside counties.
: The event occurs annually on
March 17 -St Patrick's Day. Citi·
zens, either individually or in
groups, can call up their local po·
lice department and spend an
hour getting to know their public
safety officer over lunch.

The venue can be a restaurant
or an individual's home. School
classes have been known to meet
up with a police officer for a mu -
tual brown-bag session. The lunch
is meant to get citizens and offic-
ers together for a little bit of qual·
ity time.
The re-introduction of Take A
Cop To Lunch Day holds a par-
ticular significance to Michaels. In
1988, Michaels' daughter Stepha-
nie, a disc jockey at one of her fa-
ther's radio stations, took out a
young Corona officer named Tim
Payne. The lunch proved to be
prophetic: Payne and Stephanie
Michaels married the following
year.
Sgt Payne was shot to death in
the line of duty _in January,
prompting 'Michaels to think about
reinstating the cop lunch.
• "My original thought was that
most of us don't even know who
these guys are or have a chance to
say hi," said Michaels, who will be
lunching with Police Chief Bob
McDonell.

r COSTA MESA -Jim Albus hasn't been in the
limelight long enough to~ be bothered by large gal-
leries and media swarms.
"Hey, I'm still an undcrlink. Those big names on
the tour, they're the kingpins. I'm just trying to
~neak in there, but I've been getting a· Jot more at-
tention," Albus said on Tuesday, following his vic-
tory in the 10-player Senior PGA Tour Shootout. at
the Mesa Verde Country Club, a prelude to the in-,
augural Toshiba Senior Classic.
If Albus keeps up his pace, he'll soon be men-
tioned in the same breath with lee Trevino, Dave
Stockton, Al Geiberger and Arnold Palmer, four of
the 18 Team Cadillac members this year.

H old back your sneezes, please.
Al Gciberger would've
appreciated that on Tuesday
during the Senior PGA Tour Shootout al
the Mesa Verde Country Club, a $15,000
prelude event 10 the Toshiba 5'R Classic.
Geiberger's tee shot on l\ole· 3
landed in the rough to the right of t e
fairway, with two trees about 20 and 25
feel in front of him, respectively. It wasn't
a difficult shot in which 10 get out.
For somebody like Geibergcr, a little
slice on the shot and you're back on the
f1iiway, with a third shot aimed toward the
1,in.
But as fans surrounded the area where
Geiberge. was hilling, somebody sneezed
on his down swing. Geil:Sergcr hit a palm
tree, bogeyed the hole and was eliminated.
"I did hear that," he said. "It was pretty
well-timed. It caught me right at the wrong
time. I was just trying 10 catch a giant
slice."
Geibergcr agreed with most of the
players in the Shootout that the event
wasn't as playful as it normally would be.
"Today was a prelty day (in terms of the
weather), but th.c guys were kind of quiet,"
f'Jeiberger said. "They weren't kidding
~round as much."
Los Angeles home in 1966 and 1967 on a
motorcycle with a three-legged dog named
"Beer Can." •
"I' didn't want. to leave him at l)omc,"
said Albus, a self-proclaimed dog Jover.
"I'd put my dog on the gas tank and cover
him up with a blanket, because if was
pretty cold in the morning in the winter-
time.
"One day at the pro shop," he added,
"a member of the club, a veterinarian, Albus
said he'd do an operation on the dog's
leg, to move it µp so it wasn't in his way.
He didn't use the leg, anyway."
Albus, one of the great success stories of the Se-
nior Tour, was never a member of the PGA Tour,
but participated in the old winter tour in 1977 and
1978. "J'hey were mini tours, the minor leagues,"
he said.
Albus, noted as one of the top players in the
Metropolitan PGA Section of New York, quit as

1990. It couldn't have worked out better.
Last year, Albus enjoyed a banner sea-
son, becoming one of a record six Senior
Tour players to earn over $1 million,
while becoming the first former club' pro
to pocket" seven figures in a siQglc year.
'11 can't imagine that," he said: ''.I never
dreamed of tlaking $1 million."
In various PGA tournaments, while en·
tcrcd as a Monday qualifier or as an ex-
emption, Albus earned $3,750 in his ca-
reer in limited competition.
"I'm not like some of the big shots. It's fun for
me.'~
Veteran Al Gcibcrger said it's good for the Se-
nior Tour to have guys like Albus and Robert Land-
ers playing, the latter a Texas cattle farmer with
muttonchops, homemade clubs, blue jeans and worn
tennis shoes. , , ~
Albus, currently No. 3 on the Senior
Tour money list with $231,020 in six events, earned
$1,237,128 last season, a year when he won two
events, the Bank of Boston Senior Classic and the
Vantage at the Dominion in San ~tonio.
Last weekend, Albus repeated as champion of the
Dominion in San Antonio, shooting a 3-under-par
69 on Sunday to finish at 11-under 205 for a three·
stroke victory over Jay Sigel and Ray Floyd.
"Those guys arc great for the Senior Tour," Gci-
bergcr said. '!You'd be amazed how good 5ome peo-
ple are who didn't learn the game of golf until the
age of 20. When somebody like Albus or Landers
comes along, their the fans' horse, somebody they
can relate to. We have a.II the name players on the
Senior Tour, t~cn for these guys to come out and
play well, those are great stories."
Albus, a UCLA graduate, was the head pro at
LaTourettc Golf Club on Staten Island from 1969
to 1978. He played basketball and baseball at Buck-
nell University, batting .421 as an all-conference
outfielder in 1962, the eighth-leading hitter in the
school's history, befQf~ taking up golf in college. He
was a college baseball teammate of Fred Lieber-
man, former owner of the World TeamTennis New-
port Beach Dukes.
''It's not a bothersome thing to me at all," Albus
said of the larger galleries and new-found fame.

..,.. Seniors surprised at Tuesday's crowd
and its lack of old-fashioned enthusiasm.
BY RICHARD DUNN, S1•01lTS WllJTU.
H ey, are we having fun, yet? Some had to
wonder on Tuesday during the Senior PGA
Tour Shootout at the Mesa Verde Country Club.
"I don't think the guys participating in'this are loose
enough," said Larry Ziegler, who was eliminated afte r
the third hole. "They should be having more fun. You
give the fan~ good golf, but they're not loo~c enough.
They're almost too uptight. My goodne~~. it's like a
morgue out here."
During the first two holes, played on the back nine,
Ziegler was the only player cracking jokes.
"I don't hear any laughter from the !>pcctators," he
said. "I don't feel we participate
, in enough of these (shootouts) to
make it fun. I think the players
can still play h:ud and make good
golf shols, but to me, they're just
not loose enough."
• Today is the first round of the two-day
Senior Classic Pro-Am, featuring a double
~hotgun start. Twenty-seven fivesomes (135
golfers) will tee off at 7:30 a.m., the~
another 135 will tee off al 1 p.m.
Larry Gilbert swings away during Tuesday's run of the Shootout. He finished third and pocketed $1,500.

through Sunday.
Jim Colbert, the Senior Tour's money
leader ($242,635), and Dave Stockton will

Robert L::anders, the famed Texas cattle
farmer, also tee off at 1 p.m.
A total of 216 amateurs (four in a

foursome playing with a Senior Tour pro.
Each of the 54 pros wlll play at least one
day.
Amateur foursomes will have a different
pro partner each day.
Lee Trevino plays on Thursday, teeing
off at 7:30 a.m.
• The eight commercial tents that arc
easily accessible for fans between the 12th
and 13th fairways could be a problem.
"Those tents in the rough are spotted
right off the (13th) tee, so fans arc going
10 have 10 catch that if they're not
looking,'' Geibcrger sai d. "I don't know if
those tents arc in a very good spot. I'm just
glad nobody was down there bleeding
(after my errant tee shot landed in the
rough)."
• If the weather stays the same -it was
warm and sunny with a slight breeze on
Tuesday, a near-perfect day -tournament
officials can expect huge crowds for the
weekend. No rain is expected this week.

last remaining player wins $5,000. ------
Jim Albus defeated Dale Douglass on the last hole
for the title.
•Bob Brue bogeyed No. 10 and was eliminated
first. "I'm having trouble with my eyes," said Brue,
who pocketed $500. "I've got to close one eye when I
play, until my vision comes back.''
Brue hasn't played at Mesa Verde since 1962, when
Tony Lema won the Orange County Open, earning
him the nickname "Champagne
Tony" after he ordered
champagne for members of the
press following his victory.
"The golf course has sure
changed a lot since Lema won,
whenever that was," Brue said.
• George Archer ($600) was
eliminated after hole No. 11,
following a two-player playoff
with Ziegler on a single-shot chip.
Archer missed an uphill putt by Douglass
several feet to force the playoff.
"Shootouts are fun," Archer said. "I shanked that
putt, though. It's a bent green, and it'll be tough this
week."
•Ziegler won $700, falling out of the race after the
12th hole.
•Al Geibcrger ($800), who played in only six
tournaments last year because of rotator cuff surgery,
was gone after hole No. 13.

CORONA DEL MAR -While
Corona del Mar High· senior Orian
Slingsby could afford to use Tues-'
day's nonlcague duul meet again!>!
visiting San Clemente as a training
run, Sea King senior Tracy Clark
faced a stronger early-season test.
Clark's performance put a smil e
on the face of CdM boys and girls
coach Dill Sumner, who watched the
defending Sea View League 3,200-
meter champion handle fellow All-
Orange County cross country runner
Nancy Dollar by eight seconds in
victorious 1,600 and 3,200 efforts.
"( expected Tracy to have a pretty
tough race," said Sumner, who espe-
cially liked his standout's winning
1.600 time of 5:25. "I've seen some
girls make it to CIF with a 5:25, so I
think it's a very good time for this
early in the season."
Slingsby also completed the dis·
tance double, which helped the boys
claim a 77-58 team victory in a sea-
son-opening meet rained out twice
previously.
Clark's heroics, however. couldn't
keep the Triton girls from earning a
71-54 team triumph.
''Dollar run well at the (recent)
Sunkist Invitational, sq she's in pret-
ty good shape, and Tracy skipped
Sunkist," Sumner continued. "This
race really let us know where
(Clark) is at, and ( think she's OK."
Sumner particularly liked Clark's
ability to shift gears in her 3,200,
running the race in a negative split
(faster the secood l,~ than the
first).
"She had a 2:43 half-mile du ring
her second 1,600," Sumner said.
Junior Richie Nichols unleashed a
personal best in the shot put (5 1-4)
to earn ad~itional praise from Sum-
ner, who also cited double victories
from George Sumner (100 and 200)
and Nicole Albano (100 and long
jump) as Sea King highlights.
"We're not at full strength as a
team, so I'm not real concerned with
either team score," Sumner ex-
plained. "We're more concerned
with workfog toward April than a
nonlcague meet in March."
John Myung ( 400), Christy Cum-
mins (800), Matt Ferner (high
jump), Hunter McDonald (pole
vault) and Rick Lee (discus) were
also individual event winners for the
hosts, while Jennifer Gardner's gal-
lant anchor leg helped the girls
1,600 relay win the meet finale.
