District voted Tuesday to accept
settlement Option A offered by
the pool participants committee.
If enough pool agencies accept
the settlement offer and the plan
is approved by U.S. Bankruptcy
Court John Ryan, Newport-Mesa
will receive up to $62 million of ils
$80 million investmcnr.
"It's been a long road, but
hopefully th~ dips and the bumps
will smooth themselves out,"
board Prctjdent Judy 'Franco said
after the vote.
The district will receive 76% of
its investment up front as well as a
series of recovery notes guarantee·
ing an additional 14% by June 5.
By agreeing to accept the recovery
notes, Newport-Mesa foregoes its
right to sue the county to recoup
funds . lost in the county bank-
ruptcy.
Settlement Option A gives in-
vestors an immediate investment
retutn of 76% with an additional
14% in claims and recovery notes.
Under• Option· B, agencies ac-
cept only the 76% and retain th e
right to recover the remaining
funds in court.
Should the county fail to make
the recovery notes "good as gold"
by June 5, the district can change
its selection to option D and sue
the county.

~ The latest controversy facing troubled Mesa
Consolidated surrounds the residency of Tom ~elson.
BlC TINA IlORGAlT~ STAFF \\'am.a
COST A MESA -Amid al-
legations or possible impropri-
eties regarding his residency in
the city, Mesa Consolidated
Water District chairman Tom
Nelson Tuesday night was asked
to "take a leave of absence"
from his elected scat until the
agency receives a legal ruling on
the matter.
Doard member Trudy Ohlig
suggested he step down from the
post during a special meeting at
the district's Placentia Avenue
o(fice. But her request didn't
capture the support of fellow
board members.
"It is absolutely essential that
we provide due process," said
board member Hank Panian.
"And I'm feeling uncomfortable
about what l perceive as a
breach of due process . . . The
mailer should be decided by the
auorney general's office."
The members agreed to hold
another special meeting at 7 p.m.
Thursday to consider forwarding
the matter to the state attorney
general's office for review.
This week, allegations resur-
faced that Nelson may have falsi·
fied his residency on election pa-
pers.
Nelson's dual residency -in
Costa Mesa and Seal Beach -
was first questioned last fall, dur·
ing his campaign for the district's
Division 5 scat.
This is the second blow to hit
the district in almost as many
weeks. The di strict has also been
plagued by reports of alleged
problems with sexual harassment
and sex discrimination against f e-
male employees dating as far
back as 10 years. Tuesday's spe-
cial meeting was called to discuss
those allegations.
Dul the meeting took a turn
when Ohlig played portions of a
videotape of Monday night's
Costa Mesa City Council meet-
ing, during which residents
Nancy Palme and Heather Som-
ers called for the resignation of
the dbtrict's five elected officials.
"It goes on the city (record)
that we are accused of malfea-
sance," Ohlig said, quoting one
of the residents. "1 don't want to
be painted with the same brush.
"I believe people arc innocent
until proven guilty, but I would
strongly request that Mr. Nelson
take a le:ivc of absence from the
board (until the matter is set-
tled)."
Ohlig said she was concerned
:ibout the negative perception
some have of the board.
"There is a lot going on out
there," Ohlig said. "1 would like
to show for the record that I did
not know about where director
Nelson is living. I feel Mr. Nel·
son should make a statement to
set the record straight and not
wait for the Jllorney general to
decide.
''I don't \\ant our di~trict lool..-
ing lake a bunch of crooks."
Nelson -\\ho has ~el"\ed on
the board since 1977 -ac·
knowledged dual re~i<lcncy dur-
ing his campaign last year. He
and other boan..I members claim
they asked the agency's attorney
to review the mailer at that time
and were told Nebon's Jual resi-
dency wasn't a problem.
"As for as I kn ow, I'm a legal
resi<lent and legal voter of Costa
Mesa," Nelson soid Tuesday.
Nelson said he purcha sed his
Seal Beach home -located in
Leisure World -after suffering
a heart atlack in 1984. However,
Nelson said he considers his tiny,
one room office at 107 E. 18th
St. as a second residence.
The office is furnished wit.h a
desk, any easy chair, a television
set and a convertible sofa.
faculty reaching a decision .
·With payments coming due in
June, the Clistrict had f~w· options,
according to.trustee Jim Ferryman.
"We've been through many
hours of meetings with staff and
the creditors committee," f'erry-
man said. "And we really don't
have any choice but to accept op·
tion A. It's the mo~t viable op·
tion."
Trustee Ed Decker offered the
motion which pa~sed unanimously.

The top senior scholars from Newport Harbor, Corona del Mar highs to be ·honored by chamben . . .
T hey emote on stage. They sweat
and toil on the sPorts field. They
volunteer their time to tutor and
feed the homeless. And they still have
time to win awards, devote time to
campus clubs and maintain fofty grade
point averages.
For their impressive achievements,
Ne)Vport Beach's top 30 high school
seniors -15 each from New.port
Harbor and Corona del Mar high
schools -will be feted this morning
at the 34th annual Scholarship
Awards Breakfast, hosted by the
Commodores Division of the Newport
Harbor Area Chamber of Commerce.
In addition to the applause and
admiration of the community, the
scholars will each receive a thesaurus
embossed with his or her name.
While each student's list of
accomplishments is long, the key
achievement being recognized this
morning is a high grade point average. Becat~ of extra credit for advance(!
placement classes, many of these
scholars boast grade point averages
above the straight-A, 4.0 ranking.
Many of the students have already
been accepted to several different
colleges and have some tough choices
to make in regards to where they'll
end up this fall.
The following are brief, resume-like
profiles of these top scholars. The .

investigators searched her apart·

complex a f cw blocks away from
South Coast Plaza -where they
reportedly discovered 39 garments
with Nordstrom tags still on them,
stashed in a closet, Rooker said.
Rooker said they arc still inves·

strom's own security officers -
just how much Brewer embezzled
during her stint at the store.
"This is obviously not 3' regular
shoplifrer," Rooker said. "She's an

professional:'
Johnny Scott, assistant manager
of security at Nordstrom, said an-
other employee informed store of-

stealing Crom the company. Scolt
declined to comment on the dt·
tails surroundina the case or the
method Brewer used to take the
gannents home undetected.
"Everybody htlS a problem with •
employee theft -they just don't
know it," Scott said. "We catch
about 20 a year ... They all get
fired and we prosecute most of
them."
Linda Luna-Franks, Nordstrom's
public relations director, said
Brewer hod been under investiga.-

support their suspicions of grand
theft.
Following her arrest, Drewer

of Plenty" by Emil Kosa Jr., is de·
scribed by Stary-Sheets as a ''dra·
matic" scene of bright lights shin-
ing on heavy clouds with the
mountains of Los Angeles in the
background.
"It's a startlingly beautiful
scene.'' Stary-Sheets said. "It's a
painting you could look at from
far away and b.e dra,vn into it -it
doesn't require a 'whole · tot o.r
imagination."
French-born Kosa, w~o died in
1968, was a "key painter" who
changed the way people thought
about nrt in the 1930s and '40s -
• revolutionizing paintings to include
pcopJe at work and life as mote
l~an .just -IJguid landscapes, Stary-
~hects said. .
Kosa was influential in the pe: .
Newport Beach/Costa Mesa Dally Piiot
riod known in art history as the "American Scene Painting Move·
ment" for which artists such as
Thomas Hart Benton and Edward
Hopper pined national rccogni·
tion .
Stary-Sheets said the painting
was a valuable piece in his Irvine·
based gallery's collection of ''Cali-
fornia Scene Painters." The gallery
loaned the hotel about 20 works of
art for 'a iwo-month·Jong exhibit
entitled "California Lundscape"
displayed in the hotel's lobby.
The 20-inch-by-26-foch pointing
was not secured to the wall, but a
card stating its price was posted
ben~aih it. Stary-Sheets said he
hadn't worried about the paint·
ings' ·safety because the' hotel pro-
vides 24-hour security. '
Art dealers statewide .were im·
mediately alerted that the painting
had bten ·stolen, Stary-Sheets said.
''The tragic thing is whoever

that painting has no nollon or idea
of its value," he said ... It's not
about the dollars and cents. Some
jerk just thinks it's ready money ..
They ought to put it back on our
doorstep because if they arc
caught, they will do hud time."
Sutton Place hotel spokeswoman
Kim Cosby said the hotel has
·never had a pninting stolen from
its premises. She said th~y did
have several events occurring at
the 435·room hotel Saturday and
that anyone could oome into the
mai n corridor to view the art ex-
hibit.
Newport Beach Police ~gt. Andy
Ganis said the case remains under
investigation and police will dis-
patch bulletins bearing a picture
of the painting to all law e~force_

"incredibly," Estancia baseball conch

"The bottom line is 'that (Cabrera) re-

Mustang Coach Doug Deats said.
"Actually," Estancia catcher Joe Her-

the pop in his fastball like he did last
