The Lake Fore t school's pen-

nearly $2,000, which will go to
the fund for the officer's young
family.
School children frorr{ kinder-

paper check in the amount of
$1,950 to Henry's widow, Patty,
and Newport Beach police officer
Sgt. Andy Gonls.
"l wanted lo thank all of you
for all your hard work," said Pat-
ty Henry, whose 6-year-old son,
Bob Jr., is a student in the Sad-
dleback Unified School District.
"I hope when all of you see a
penny and pick it up you will

our family."
Bob Henry, 30, was critically
wounded dunng a March 12
shooting incident that left a Gar-
den Grove man dead and Henry
in a coma for 33 days. Henry died
April 13 of a cardiac arrest sec-
ondary to complications from the
gunshot wound to his head.
Debra Slaughter, a fourth-
grade teacher at the school and
the wife of Newport Beach police
officer Randy Slaughter, pro-
pbsed the penny drive for the
11-lenry family after the officer's
funeral on April 19.
"I'm a wife of an officer and I

• Fifth District supervisor
says her plan would save
$110 million a year, but
the-county would still
default on its bond.
By Evan Henerson, Staff Writer
County Supervisor Marian
Bergeson, the board's most avid
proponent of the Measure R sales
tax increase, has developed a
Plan B to serve as an alternative to
the tox hike.
And, ~aving reviewed her own
p lan, Bergeson still believes that
the tax increase is the proper
course of action.
Huh?
•The point we're trying to
make t9 all of the folks who are
clamoring for a Plan B is that they
have the ability to develop a plan
of their own," said Bergeson aide
Dave Kiff. •1 think a lot of them
don't want to admit how problem-
atic creating a Plan B is. •
"The idea is to give voters
some sort of an option. We'_re say-
ing, 'Here's Plan B and here are
the consequences of this P•an B.'"
Bergeson was even more blunt
about the plan, which she intends
to bring before the Board of
Supervisors.
"Horrible, isn't. it?" she said.
"I've gone through the budget
and come up with every option
that could possibly come forward. -
All of these options are untenable
and I don't think anybody will
support them. .
"This is information that the
public needs to understand. The
tax increase is the easiest and
least painful way out of Uus s1lua-
tion."
Plan B has nine provisions,
including a 20% pay cul for all
county personnel (an expected
savin_gs of $75 rniJlion); reaJJocd-
tion of all property l<\X revenue
distributed lo county's enterpnse
special districts ($22 million); and
the elimination of all life msur-
ance, accidental death and dis-
memberment benefits for county
employees ($6 million).
In addition, by retaining half
the amount in county reserve
accounts from special e nterprise
districts, the county would get a
one-time revenue stream of $100
million.
In total, the plan would !>ave
Orange County $110 million
annually as well as provide the>

Business representatives who
attended the hearing called the
council's decision a "step in the
right direction," but said it might
not be enough to prevent future
Starbucks situations.
"'Hopefully with a marketing
plan and a specific area plan for
Balboa Island, we'll be able to
h old the line a little bit," said John
Noys, who operates John Noys
Jewelers ~d is president of the
Balboa Island Business Associa-
tam. "We're not trying to keep
anybody out, but we have enough
places that sell cheap fooP."
The council nearly nixed
changing the ordindnce at all.
Several council members said that
the Starbucks situation was not
appropriate grounds to change
the regulations. Others said that
by adding a potential "hurdle,•
the city could send out an anti-
business message.
"The current regulations are in
place for very good. reasons," said
Mayor John Hedges who tried,
unsuccessfully, to introduce a
motion ·blocking the change.
"This (effort) is being driven by
the fact that a national coffee
cha.iri'is coming into town and the
competitors don't like it so they've
raised a fuss."
Lee Sutherland, who owns the
Balboa Island Coffee Co., said that
the issue went beyond Starbucks.
"That's just the first business to
·come under the new ordinance."
Sutherland said. "We're not trymg
to stifle competition, but l Uunk
the public has a right to a say."

one-time fund release of 5100
million, enough to prove to the
state that the county had estab-
lished a revenue stream and
could fund $750 million-$800 mil·
lion 1n bond debt obligation.
Few it any of the provisions
would be easily accomplished,
according to Bergeson. Several
would require special emergency
legislation, wbkh the state might
be unWilling to provide. The
county would still end up default-
ing on at least a portion of its $1
'
billlon bond 1n June.
In addition, Bergeson believes
that by 1ub1tantially reducing
salaries, the county would force
many of its personnel -such u
sheriff'.& deputies and county
prosecutors -to seek other Jobs.
The cost.. of preserving the
sales tax, then,,, would be a com-
promise of public safety and ser-
vices, according to Bergeson.
Bergeson plans to present Plan
B to her board colleagues in a
couple of weeks. She has sent a
copy of the proposal to county
CEO William Popejoy, and the
two have discussed the plan.
Popejoy was in Sacramento and

Giorus, 41 , a wealthy orthope-
dic surgeon and lrvme resident,
was convicted in 1992 for hiring
thugs to beat up his ex-wife, the
daughter of the late actor John
Wayne, and her then-boyfriend
Luby, as the two returned to
Luby's Newport Beach estate in
October 1988.
The attackers tied Wayne up
and smashed her face on the
garage floor. Then they pisto~
whipped Luby and slashed his
Achilles tendon before fleeing.
During the trial, prosecutors
argued that a nasty custody battle
in 1988 over the couple's toddler,
Anastasia, was the motive for
Gionis to hire a private-eye and
two thugs to beat up Wayne and
Luby.
After he was sente nced to five
years in state prison in 1992 on
four felony co\!$ of conspiracy
and assault, Gionis' conviction
was overturned by a state court of
·appeals and he was Creed on $2
million bail.
But Gionis was re-arrested
four days afte r the stale Supreme
Court. Jelnstated his conviction
May 4 -a ruling prosecutors hope
will end ln Gionis serving his
five-year state prison term.

Sailors write final chapter to frustrating campaign , No OIDJlS, CdM .
closes ~ut today • Newport rallies twice, but
El Toro prevails in eighth, 7-5,
to claim playoff spot.
By Dennis Brosterhous. Staff Writer
NEWPORT BEACH -Despite some
vocal support from an unexpected
source, the Newport Harbor High
baseball team could not play the role
of spoiler Thursday afternoon.
With much of the Corona del Mar
High baseball team in the stands, with
an obvious rooting interest for New-
port, the Sailors rallied from two
deficits to force extra innings, before El
Toro pushed over a pair of runs in the
STANDINGS
eighth for a 7-5 Sea View League vic-
tory.
HWe went out battling," said a dis-
appointed Newport head coach Kirk
Bates, who 'downplayed the Sailors'
role of spoiler on Thursday. "We sim-
ply wanted to firush the season with a
win and end_ on a positive note. H
El Toro (13-13 overall) improved to
7 -8 in league play. The best CdM
could do with a win today would be to
finish 7-8, but El Toro owns the head-
to -head tiebreaker advdntage, having
won the season series from the Sea
Kings.
The Chargers bolted to a 2-0 l~ad in
the first inning. With runners at second
and third and two outs, Travis Senik hit
a ground ball which was gloved by
...
...
Newport first baseman Mike Freeman.
But the Newport pitcher was late
covering first, with both runs racing
home following the late throw.
The Tars (9-15, 2-13) earned their
and only lead in the second inning.
With one out, Andy Langsdorf
walked and one out later, Zach Biehl
also reached on a · walk. A wild pitch
moved both runners into scoring posi-
tion, from where Greg Wertman came
through with a clutch single to right-
center, scoring both runs.
Wertman took second on the throw
home, then scored on two subsequent
wild pitches to put the Tars ahead, 3-2.
"Wertman really bowed his neck.
aJld came through for us in that spot,"
said Bates.
Down 5-3, the Sailors sliced the
deficit in halt.in fhe bottom of the fifth
as Chad CO\uccio walkecl stole. sec-
ond, moved to third on Joe Urban's
sacrifice, then scored on Danny Puli-
do's groundout to deep short.
Newport tied the game m the bot-
• tom of the seventh with a one-out ral-
ly. Coluccio was tut by a pitch and stole
second. Urban's sharp single to left
moved Coluccio to Uurd with the tying
run coming home on Pulido's long sac-
rifice fly to center on a 3-2 pitch.
Travis Vessells' clutch two-out sin-
gle with two on broke the fie in the top
of the eighth, with a bloop single to
center by Joe Smith bringing borne an
insurance run. Newport was retired in
ord er in the bottom of the eighth.
