• His love of fishing led to a
business operation that ranged
from sportfishing to ownership
of the Balboa Pavilion and
Davey's Locker.

Pbillo R. Tozer, longtime owner of
Davey's Locker and the Balboa Pavil-
ion, died .Thursday morning at Hoag
Hospital of complications related to
arthritis. He was 74.
As much of a Newport Harbor icon
as the Pavilion itself, Mr. Tozer was a
success in' the sportfishing businE!ss,
starting with a one-boat operation back
·in'the 1940s. The SO-year Newport res-
ident also -restored the interior of the
Balboa Pavilion, which today houses
not only Davey's Locker and the Tale of
the Whale restaurant, but also the
Catalino, Passenger Service and harbor
cruise operations.
Mr. Tozer had long sufferep horn
arttuitis of the back that compressed
his lungs and be had ,been bedridden
during the past-four months following a
hip operation, according to family
friend Bob Black.
A native of Utah, Mr. Tozer came to

settled in Anaheim. He enlisted in the
Anny Air Corps and was a B-17
bomber pilot during World War 11
Before he left 'the service, Mr. Tozer
had also put money toward purchasing
a 30-foot boat, Forever Amber, with
partner Ivan Johnson. The two men
tried · mackerel fishing with Forever
Amber for the last hall of the~ winter
season-in 1945 -Mr. Tozer's first com-
mercial venture. But they soon realli.ed
·the boat was too small and sold it.
Upon discharge from the service in
1945, Mr. Tozer and wife Bette used the
$5,000 they'd saved -culled from the
$200 a monttijle sent home during the
war -to buy a lot in Newport Heights
Still, Mr. Tozer's interest in sport
fishing as a business had been
sparked.
After joint sportfishing ventures
with a few different partners, Mr. Tozer

to attend a meeting Monday
night with city officials to discuss
strategies for improving condi-
tioris in the gang-plagued Shali-
mar Drive area.

ground for drug dealers and gang
merribers.
The City Council last month
approved a plan that indudes a
ban on street parking along ShaJ..

cal of the program, saying it will

which doesn't allow surfers in
the ocean between noon and 4
p.m. from June 15 to Sept. 15,
but gives them a total of 10
hours a day outside the limita-
tions.
Hoisting the yellow flag bear-
ing the black ball atop lifeguard
stands began in the 1960s to
insure the safety Qf swimmers
from dangerous wayward surf-
boards.
But Sharp claims the law is
unfair to surfers whe n the
weather is cool, surf is high and
the beach isn't crowded with
swimmers. Although he doesn't
dispute the importance of ~ety
for swimmers, he is rallying for a

first part ol their summer vacation-

Aside from his fascination with
household inventions, Evans was
a1sq impressetl with his domination
over Japanese students while play-
ing basketball.
"I liked playmg basketball
because 1 didn't have to jump,· said
Evans, whose five-foot frame would
most-likely be consi9ered average
hrught in America "(In Japan) I
was tall for my age.·

es. But when it came time to recall

other students) at night. we would

Approval of care facility not certain

NEWPORT BEAC H -Resi-
dents who followed the proceed-
ings of the city Planning Commis-
sion in 1989 might have experi:
enced a sense of deja vu Thursday
nigbt at City Hall.
As of press time, the commis-
sion was still· conside ring a
request by a Las Vegas doctor; to
construct an 84-unit, 100-bed pe~
sonal care facility for senior citi-
zens. The facility, referr~d to as
Summer House, will be built at
the intersection of Pacific Coast
Highway and Hazel Avenue in
Corona del Mar.

David Neish noted, tJ?.e plan is
unchanged from an earlier incar·
nation approved by the Newport
Beach City Council in 1989.
But the lack of change sur-
prised at last one commissioner,
Tom Thomson, who seemed
incredulous that the current appli-
cant had no wish to improv~ the
facility.
The once controversial project
had stirred up concerns from resi-
dents, who worried about traffic,
building height, noise, setbacks
from .Pacific Coa.S t Highway and
parking availability.
Between 1985 ~and 1989, the
project underwent several modifi-
cations to appease the concerns of
potential neighbors.
After the counc;il approval in
1989, former developer Emerald
Village' Associates Inc., ran into
financial difficulties a nd was
unable to proceed with the pro-
ject.
, But recently the project found a
new manager and new financing.
Dr. James Thomas, a Las Vegas
orthopedist, has agreed to accept
all of the conditions lhat went with
the previous approval.
Despite the 1989 ·approval,
area-residents were not necessari-
ly willing to accept the project
without giving inpUt Thursday.
Several complained that they had
received no notice. from the city
that a revised project was even in
the works.
Attorney Kenneth Catanzaritt!,
who owns property at 352 Hazel,
said that conditions have changed
since the previous approval.
Cantanzarite also said that the
proposed facility could interfere
with his plans for developing his
own property.

It will be open to SOY teens. U

group will open it up to citywide
participation.
But, he said. the community is
invited to attend.
"We're going to have food,
Denny's (restaurant) is donating
the drinks, and we 're going to
have music." he said.

him and later helped form a cor-
poration -Davey's Locker, Inc. -
in 1961, according to Mr. Tozer's
a utobiograpby, "Recollections
and Reflections of a Dedicated
BeachBum."
In 1965, Mr. Tozer signed a
lease to move Davey's Locker to
the Pavilion, which was then
owned by Alan Ducommun. A
few years down the line, Mr.
Tozer bought the circa-1905
building from Ducommun, who
bad restored the exterior. Mr.
Tozer put the structure through
an interior restoration and reno-
vation.
Described as a quiet philan-
thropist dedicated to the harbor
and the community, Mr. Tozer
was named the Newport• Harbor
Chamber of Commerce's Man of
the Year in 1973.
ln his book published in 1994,
Mr. Tozer depiets his business
success as a result of sheer luck
and good fortune, with money
and loans seemingly falling into
hts lap, always at the right time.

went to see the crowds.
This year, after being recognized as
National Player of the Year by USA Today
•: ', for leading Newport Harbor High to the
national, state and CIF Southern Section
championships. May is someone the 1995
Festival spectators are likely anxious to
behold.
The versatile 5-foot-10 standout will likely
treat the crowds at the Coors Events Center
on the campus of Colorado University in
' Boulder to her typically-dominant hitting
display, though she's projected to set at Long
Beach State.
"It doesn't really bother me," May said of
her expected time at outside hitter, where
she flourished for Harbor Coach Dan Glenn

Festival debut, amassing 14 kills with just
one hitting error for the West in the

leading her Long Beach-based Ichiban club
team to a third-place finish at the recent
Junior Olympics in Orlando. "I know a lot

Yacht Club, hosted an array of
colorful sails that graced the
Newport Turning Basin in a show
of synchronidty, speed and fierce
competition.
With 10 teems selected by a
national committee, the Hinman
hosted some of the top team
racing sailors in the country.
Attempting to make the rac-
ing mqre spectator-friendly, this
year's Hinman Trophy sported
Vanguard 15s with blue, yellow,
red and purple sails, allowing for
two separate races to run
concurrently.
The sails really enabled
spectators to closely follow a
sport that can be incredibly hard
to follow.
Another new twist to this
year's Hinman involved the drop
of the green flag. an alternative
penalty to the 720 that tacked an
extra 2.5 points to your team's
final score. Hoping to lessen the
number of protests that usually
occqr in team racing, on-the-
water judges can now throw a
competitor out of the race, with
no exoneration, for a foul.
A competitor's only recourse is
to do a 360 before the judges
raise the flag. This new rule
seemed to help in the protest
area, with no protests being filed
off the water, but the fast action
of the sailing sometimes blocked
the view of the judges, so a
number of protests were
disallowed.
Once the bugs are worked
out, this rule should be a great
help to judges and competitors
alike. This rule will also be
installed into the Collegiate
Team Racing program beginning
next year.
Former U.S. Naval Academy
Coach Gary Bodie led the sailors
through what he called "one of
the longer skippers' meetings in
history,· as he explained the new
rules. Yet another twist would be
the balk, a penalty that happens
to someone who is protesting,
but the protest is disallowed by
the judges.
Two balks and you spin a
circle. With heads now reeling,
competitors made their way out
to the course, all laughµlg about
who would have the most balks.
Over three days, the series
slowly dwindled competitors out
of racing. The first rotation saw •
the full 10 teams compete, the
second rotation was whittled
down to eight and the final
round found four teams. The
regatta saw some incredible
shows of team racing as the
series wore on, making the event
extremely exciting to watch.
Besides the racing, the other
pinnacle of the regatta was the
return of the Swinging TJJds to
the beach of NHYC, where

• Much of the focus is on next year's Olympics
as Festival competition begins today in Colorado.

T be 1995 U.S. Olympic Festival, including more than
30 competitors from Newport Beach and Costa Mesa,
. gets underway today with morning competition, with
Opening Ceremonies set for tonight at 7 at Mile High
Stadium in Denver.
Venues in Denver, Colorado Springs and Boulder will host
the 37-sport affair, which returns to its Colorado roots for the
first time since 1983 (the inaugural Festival was held in Col-
orado Springs in 1978).
This year's Festival, which runs through the July 30 closing
ceremonies, should hold added significance with the 1996
Olympic Games in Atlanta now less than a year away.
Team sport veterans Misty May, a 'recent Newport Harbor
High graduate, and Estancia Hig:h product Leah Braatz, are
among those returning this year, after sparkling at the 1994
Festival in St. Louis.
Braatz, a two-time All-American softball catcher at the Uni-
versity of Arizona, won a gold medal at last year's Festival, hit-
ting one of only two homers in the four-team tournament. This
year, 'she competes for the East, beginning Saturday.
May, who at 16 was believed to be the youngest competitor
at last year's event, earned a silver medal for the West.
After having garnered Nat;ional Player of the Year honors
for leading Newport to national, state and ClF Southern Sec-
tion crowns last fall as a senior, the Long Beach State-bound
May will play for the South, which begin's play today at 9 a.m .
against the East.
A pair of former Sailors, weightlifting sisters Gina and Cara
Heads, will try to improve· upon their fourth-place finishes in
St.· Louis, when the three~day weightlifting competition
begins Monday.
Gina Heads, the 1994 Daily Pilot Newport-Mesa District
Female-Athlete of the Year, is now a shot putter at Stanford.
