.Supreme Court to decide 14-year-old murder case

and rape of Newport resi-
dent Ginger Fleischli.

months ago, Ginger Fleischli's
two brothers flew to San Quentin
State Prison to witness the execu-
tion of her killer. Fourteen years,
and many appeals, had passed
since a jury convicted Thomas
Thompson of raping and murder-
ing the 20-year-old Newport
Beach resident.
Hours before the planned exe-
cution on Aug. 5, howeve r, the.
warden gave the brothers disap-
pointing news: The U.S. 9lh Cir-
cuit Court of Apped.Js had inter-
ve ned to block it.
"l was standing within a few
hundred yards of the person who
raped and brutally murdered my
sister,· said 48-year-old Jack
Fleischli, a Los Angeles-based
lawyer. "I was disappointed. That
should have been the end of it.·
The U.S. Supreme Court,
which heard arguments on the
case Dec. 9 and opened its 1998
session Monday, must now decide
whether the appellate judges act-
ed withln thdr bounds and
whether to gi~ the greenlight to
the execution.
The defense contends Thomp-
son's lawyer argued ineffectively
against the charge that Thomp-
son raped her, the special-circum-
stance allegation that made him
eligible for the death penalty at
his 1983 trial.
Observers expect a decision
within the next several months.
Fleischli's brothers say Thomp-
son's death cannot come too soon.

SOUTH COAST METRO -It was lights, camera
and plenty o( action at Planet Hollywood on Monday
as Academy Award-winning actor Cuba Gooding Jr.
and a crew of hundreds spent the day at the eatery
filming scenes for an upcoming movie.
Gooding and the production aew descended on
the South Coast Plaza restaurant by 6 a.m. Monday
and worked most of the day filming several scenes
for •A Murder of Crows• inside.
The film, which is .set in New Orleans, features
Gooding as New York City lawyer-turned-author
LaV(SOn Russell.

The fihn, which is now in last week of production,
has also shot m New O rleans, Key West and Los
Angeles. South Coast Plaza was the only Orange
County location selected for the film,_offidals said.
On Monday, filming took place inside the restau-
rant. including one scene with Gooding playing
Russell at a book signing.
Besides acting m the starring role, Gooding is also
the film's co-producer, his first stab at working
~hind the camera. The restaurant was closed all
day to accommodate the filming, but Planet Holly-
wood General Manager Joey VQ!pe said it was well
worth gi\ling up a day of business.

The lights at Pletcher Jones have sparked complaints among neigbbon.
Taking a dim view of Fletcher Jo1_1es
M any of my neighbors and I
object to the excessive
lights, both interior and
exterior, that have been installed at
the Pletcher Jones car dealers-hip.
They are an unsightly, commercial
intrusion into a residential neighbor-
hood noted for its quiet natural beau-
ty
But we also feel betrayed because
we believe the legal requirements for
public ~mment on environmental
1mpdcts were not met during the plan-
ning phase of this project. The envi-
ronmental unpact report prepared for
the city by LSA Associates Inc. failed
to analyze the lighting issue at all,
delegating this to the city planning
department. This prevented any pub·
lic review or comment on the lighting.
The inf onnation and graphics in
the envirorunental impact report
showed no light posts at all. The
report required that. u a lighting plan
shall be approved by the city, demon-
strating that appropriate lighting will .
be installed to mi.nimi.ze spillage into
the l)a bitat areas. The plan will
include, but not be limited to, lighting
directed onto the project site, and the
use of soft light intensity fixtures."
In my opinion. the dealership failed
to comply with this legal re~ement
for a lighting plan and the city f&iled .
to comply with the requirement that it
review and approve the lighting plan
I
before approving the building permit.
As a result, the lighting arrange-
ments at the facility are totally inap-
propriate for this ligbt-sensitive loca-
--tion-; It is regrettable-that approval
was given in the first place for such a
large commercial facility adjacent to a
. globally significant nature reserve,
and in full view of hundreds of resi-·-1
dents who bought their homes, at
least in part, for their spectacular
night-time as well as day-time views.
It is even more regrettable that this
eyesore has been foisted on the
neighborhood without opportunities
for public comment.

Pilot editorial missed
the mar1'
I take extreme issue with the
Daily Pilot editorial reqarding
the annexation of Bonita
Canyon. Your focus on children is
misguided. The editorial says,
among other things, that Irvine's
position hurts kids by routing them
to overcrowded Irvine schools
Let's see -if I am a child in the
new Bonita Canyon development
and it remains in Irvine, I get a
brand new K-9 school (which I can
likely walk to) in the Irvine School
Disbict, a disbict equally compara-
ble (and arguably superior) to
Newport-Mesa.
If anything, it will be under-
enrolled I then go to highly
ranked University High, or if this
situation seems problematic I get
an inter-district transfer to Corona
del Mar High. U Bonita Canyon
switches to Newport, I get .
schlepped across MacArthur and
Jamboree three miles to an older
rehabbed Eastbluff Elementary
School with other schlepped stu-
dents from Santa Ana Heights and
other areas.
U I live through that, I get the
privilege of continuing use of over-
crowded Newport streets getting
to a 7 to 12 junior high/high
school.
Hmm, what would be your
choice? Face facts -the annexa-
tion is aoout The Irvine Co. profit
and money for the Newport-Mesa
Unified SchoofDisbict.
Sure our district could use the
money, but Irvine was slated to get
far more dollars (due to bigger
generation numbers). There is no
net increase in dollars for kids.
Perhaps you should focus on
municipal benefits of the annexa-
tion, although there is not much
here. Thanks to some community
activism (and no thanks to our City
Council. which did absolutely no
planning to obtain ZERO develop-
ment mitigations from the devel-
oper on its own), the annexation
includes some more open space.
However, the elementary school
situation is a mess. This annexa-
tion is not about a superior school
situation for children. This kind of
misinformation is nothing short of
despicable.
U Newport 1s going to enrage
the other communities with its air-
port lobbying, they are going to
fight back. But Bonita Canyon was
planned for Irvine for many years,
and the kids were well ta.ken care
of.
I agree with the editorial, leave
the kids out of it.

Irvine mayor's actions
hurt whole co~ty
Irvine mayor, Christina Shea,
has given another example of the
selfish and vindictive attitude per-
meating in South County Qver the
El Toro Airport debate.
She is not honoring the agree-
ment her city made with Newport
Beach for a land swap negotiated
for the mutual good of both city's
citizens. The fact school children
Will suffer from the decision is of
little importance to her.
Why is she and the Irvine coun-
cil taking such action? Because
Newport Beach hired a consultant
to keep them informed of Irvine's
proposed annexation of county
tand, the El Toro Marine base site.
Not wanting the proposed air-
port at El Toro, she and her cohorts
continue to do everything possible
to sabotage the COUI)ty's plans for
it. Their plans of annexation, µke
others such as litigation against
the county, costs county taxpayers
a great deal of money.
This recent scheme will not only
deprive Orange County citizens of
an adequate airport, but insults us
further by costing billions of dol-
lars through the loss of revenues
from th~t land.
Although Mayor Shea is at war
with the county, she resents any
efforts from others like Newport
Beach that attempt to minimize the
damage she is causing.
· 1.rvine, and other South County
cities, in their feverish goal of
undermining plans for the new air-
port, are not concerned with the
long term effects their actions will
have on others. Unfortunately,
there will be many and the school
children of Newport/Mesa are but
one example.

Board· asks group to help
find new superintendent.

Tonight the school board will
ask the California School Board
Association to conduct its
nationwide search for a new
superintendent, boa.rd members
said.
Board President Jim Peny-
rnan said the district will save
money by having the associa-
tion conduct the search. The
district used the associjltion in
1992 to find former Superin-
tendent Mac Bernd. Ferryman
said the board spent about
$40,000 in the nationwide
search for Bernd but plans to
spend less for the current

secondary education study by
Tom Jacobson, the assistant

Two weeks given to solve dealer's lights problem

NEWPORT BEACH -Is there
any light at the end of the battle
over just how luminous Fletcher
Jones Motorcars' new dealership
can be?
The City Council on Monday
offered a ray of hope to Eastbluff
residen~ who have complained
about ·the Mercedes dealer's
bright lights disrupting their
nighttime bay views.
Fletcher Jones management,
city staff me{Ilbers and disgrun-
tled residents have two weeks to
get together, negotiate a plan for
dimming the lights and present it
to the Qty Council.
After that, the plan will go into
action and residents will have 30
days to assess how it's working.
The city has yet to issue the
dealership an official certificate of
occupancy ~nd.ing lighting
adjustments. Residents applauded
that move and d'emanded more
changes than have already been
made.
"It's like this sore tooth I have
for four or five hours every day,"
resident Hillary Thamer said. "In
the past few weeks there has been
a drop. But something has got to
cut that inside glare."
Fletcher Jones appeared before
the council, saying he would con-
tinue to work with city staff and
residents to resolve the issue but
couldn't leave his dealeBhip com-
pletely in the dark.
"We're rapidly approaching
the point where tbls was approved
as a business and will be operated
as a business,• he said.
The posh dealership opened on
Jamboree Road months ago and
soon began logging dozens of
complaints about the bright lot
lights and glowing white building
-com.pounded by its reflection
off the Back Bay.
Since then, the dealership has
attached shields and lenses to the
outside lights and installed a timer
to shut off rooftop lights at 7 p.m.
and tlie lot lights at 10:30 p.m.
The red car service lights are
set to shut off at night as well, and
the city is considering planting
trees along Jamboree Road to fll.r-
ther block the lights.

Some residents felt they hadn't
gotten a chance to stop the project
before it was approved. .,
But, f\OW that it's done, resi-
dent Peter Bryant said, "I don't
believe the City Council should
accept the facility just because
it's there.•
Councilman John Noyes,
meanwhile, pointed out that
Jones shouldn't be taking all the
heat for the problem.
"l feel for Mr. Jones in that

solve the problem, ~oyes said. ,
"The city told him he could build
this. I think it's patently unfair.
Let's come up with SOD:le creative

coached the Costa Mesa High softball
team for five seasons from 1984-88, will
head up the program once again this
spring, Mustangs' Boys Athletic Direc-
tor Jerry Howell said Monday.
The Mustangs were 6-14 last spring
unde\' Pacita Vasquez, after finishing 8-
16 the year before under Carrie Nel·
son. They missed the playoffs both sea-
sons.

find a pitcher for this year and for the

Davenport is the third-ranked
women's tennis player in the
world by watching her giggle
with her coach, Robert Van't
Hof, after a morning workout at
Palisades Tennis Club in Newport
Beach.
You'd never know Davenport is the
top-rated player in the United States of
America by driving the city streets or
walking through the glitzy malls. There
are no banners or life-size posters of her.
No parades or statues. Her special
appearances are almost never
publicized.
Davenport, you see, can find refuge in
Newport Beach. She's far away from the
te nnis crowds, autograph seeken,
cameras and bright
lightS, p~ of what
comes with the
territory when you win
13 tournaments on the
Corel Women's Tennis
Association Tour in
one season, including
six singles titles.
Davenport,

Hingis' greatest
Davenport adversary last year,
isn't one to cause a
fuss about herself. There isn't a
pretentious vein in her body. She prefers
doing things the quiet way, much like
the manner in which she has earned
nearly $3. 7 million in her career.
"I don't like to draw attention to
myself,• Davenport said the other day,
just before leaving her home in Newport
Beach for Australia to start the 1998
season.
"That's one of the reasons why I like
it here. People just do their own thing
here and leave you alone."
Davenport, who said du.ring a press
conference in·last September's U.S.
Open that all she was missing in her life
was a boyfriend, loves the area's
restaurants and movie theaters, but said
"I don't have a very exciting life•
outside of tennis.
That's the way Davenport wants it.
For some casual observers, she's the
greatest tennis player you've never
heard of.
Davenport is coming off her finest
year1 winning Sl,533,101 last season on
the WTA Tour, while reaching
career-high world rankings in both
singles (No. 2) and doubles (No. 1). •n just becomes nonnal, • Davenport
said of the often hectic life on the road,

focused, and when you're caring more,
you put more into it," Van't Hof said of
Davenport's rise.
Davenport, the daughter of a 1968
Olympic men's volleyball player, will be
thrust into the grand spotlight in '98 with
Hingis, Jana Novotna and Steffi Graf,
who bas announced she will return next
month to the tour after a year away.
