By Carolyn Miller, Daily Pilot . . COSTA MESA -A Northern California man is suing Bullock's department store at South Coast Plaza on charges of radal dis- aimination, saying store officials wrongly accused him of shoplift- ing just because he is black. The civil rights case, stemming from an incident at Bullock's on Dec. 23, 1994, is scheduled to go before a jury in San Francisco Superior Court on Monday. Maurice Brewster, 40, a busi- nessman who lives in liberon, a town outside of San Francisco, alleges in his civil lawsuit that while be was Christmas shopping at,R111Jodc'~. he Wlisi.ngled.eut.as a suspect for sboplliting and detained by a store manager .solely because he was black. Brewster is seeking unspeci- fied punitive damages from Bul- lock's, owned by Federated Department Stores, for allegedly violating his civil rights, negli- gence and intentionally inflicting of emotional distress. "It's going to be in the seven figures because of the outrageous conduct,• said Edwin Bradley, Brewster's attorney. •And the message has got to be sent out that this is not a freak incident-it is common.• A Bullock's lawyer, mean- while, said the allegations came as a surprise since a store manag- er spoke to Brewster over the phone the day after the incident and he didn't make the claims he does in the lawsuit. Brewster and his wife, Rhon- da, were spending Christmas with their relatives who live in Costa Mesa, and were doing last- minute ho~day shopping at Bul- lock's, Bradley said. A n astonilblng lh1ng hap- pened Sunday afternoon during the St. Petersbwy Philharmonic Orchestra's concert at the Perlorming Arts Center. It was an event unheard of in Orange County, a genuine Dabbergastment for local music lovers. My wile and 1 have been going to Philharmonic Society concerts ever since the audi- ence sat in the bleachers al the usually aromatic UCI gym. You always heard it then. And all through the butt-numb- ~g -but acoustically splendid - years as Santa Ana High School. we heard it. too. Likewise in the past decade of opulence at the Perlonning Arts Center. , This time it was different. What we didn't hear on this historic, wet Sunday afternoon was applause - in all the wrong places. In musical circles, applaud- .mg between movements of a 'classical piece is considered the , ultimate in bumpJdnship. It is 1he badge of the concert-going luck, oafish behaVior that, ·according to those in the Big :city, typifies therubes in ()range County. • I doubt the distinguished first- ·chair critic for the Tunes, Martin Bemheimer, has ever reviewed a classical-music event in Orange County without chortling at the waves <>.! a.PJ>}ause that sur_ged f.rom the audience, whenever an orchestra took a breather between movements. Alas, Bemheimer was not on hand Sunday and bis colleague, Daniel Carriaga, apparently did not notice the momentous event thtlt was transpiring all around him Applauding between move- ments is basically innocent and harmless. But it is simply not <lone in polite, knowledgeable concert-going society. I haven't the faintest idea why we can't show our appreciation and enjoyment if we want to, but that's the waY_ it is. ~· Q.--~-- .. < •.• 4 ·~ -- My best guess is applause interleres with the concentration and mood of the performers. The pauses between movements of those classical pieces are there to allow the musicians to wiggle their fingers and change gears for the next movement. Probably this is especially so when a soloist is performing, as was the case Sunday. A quite attractive young fiddler from New York City, Pamela Frank. did a smashing job with ~ Violin Concerto No. 1 in G Minor by Max Bruch. Not a single clap intruded on her concentration as she transit- ed from allegro moderato to adagio to allegro energico (and I cantell you that Frank was mo/to energetic!). After t6e intemussion, the St .. Petersbwyers and their conduc- tor, Mariss Jansons, tackled one of the great war-horses of mod- em dassi.cal mugc, Antonin Dvo- rak's •New Worlcr symphony. Such compositions have four movements, thus, three oppor- tunities for applause. Three openings for some rube in the audience to blow what was sounding like a perfect game. After Dvorak's final, hall- shaking note -one of dozens in this romp of a symphony -the audience exploded. Thrilled by the orchestra, the late Dvorak's composition ~d certainly by their own good manners, the music lovers burst into a tidal wave of cacophonous applause. They stood and they cheered until Maestro Jansons (who Will take over the Pittsburgh Sympho- ny next year) rewarded his new fans with a brief encore -a "Lol- lipop," as Sir Thomas Beecham called such bonus pieces. We tried for more, but the maestro led the huge orchestra off the stage and into three wait- ing buses. Sadly, none ot the vis- iting Russians had any idea of the, historic, applause-in-all-the- right-places event in which they had just participated. POOR VALENTIN You had to feel scme of Valentin Gah.rz.in's pain. I mean. here's a guy who packs his tuba - and travels nearly a gazillion miles from St Petersburg to Costa Mesa. And an for practically naught He could have phoned it in So far as I could tell, he was- n't even on stage for the open- er, Carl Maria von Weber's delightful overture to "Euryan- the." Nor was he called upon to help back Frank in her virtuo~o performance. My wile and I first noticed 1 Galuzin after the intermission, in· the back row on the far right. His tuba was bell-down on the floor. He crossed his hands on top ofthe"'hom, then put hlS"'Chih on top of them and sat there. Finally, toward the end of the second movement, Valentin wig- gled his lips and plugged them into the large tuba mouthpiece. Valentin GalUZlI) played sev- en drawn-out notes. Then he put his tuba down on the Uoor, crossed his hands on top of it and put his head down again. This time all the way down, eyes to the floor. It had been a tough day at the office. • FRED MARTIN'S column runs every Thursday and Saturday. ~· ·---~ ·---~ ·-----_,,, I ' ; KAYAW~D~ I AT WESTCUFF ~ . Barn brouhaha may not get council hearing • Residents opposed to construction of historic barn on Holiday Road must pay $400 to appeal Plan- ning CoII1mission decision . By Evan Henerson. Daily Pilot NEWPORT BEACH -H resi- dents still hope to influence the rebuilding of a historic barn on Holiday Road, they will likely have to fork out $400 for an appeal hearing before the City Council. At the council's. last hearing Monday, Co'uncilman Tom Edwards asked the council to reView the Planning Commis- sion's ruling on the barn. The commission had earlier decided the barn, which would sit on Den- nis Holland's front yard, could encroach onto city property. Monday's 3-3 vote (may- or pro tem Jan Debay did not attend the meeting) meant that the planning commission's dea- sion stands. He wantl tlie opportunity to persuade the council to intervene. But city planners have said the city c~ot dictate what Holland does or does not build on his own pro}'.>erty. The council could only determine Holland's barn cannot . exceed the setback definitions. The state made Holland a gift , of the barn, which was part of the Buffalo Ranch building on the site of the Orange County Fair- grounds. The building was slated for demolition. Ever since plans for the park and nature center were first revealed, dpg walkers and equestrians have complained the new park's trail system will restrict access to the site. Tum.er and other project offi- cials say the county is still nearly two years away from completing the $2.5 million project. In addition to building the nature center. refurbishing the bike trails and conducting some minor street improvements, the county will sta· bilize some of the drainage swales -or barancas -which have eroded over the years. Pedestrian and , horse trails will be consolidated and volunteers will restock the area with native plants. Much of the funding for the project was in the now-dissolved county invesbnent pool. said Turn- er, who estimates that the county bankruptcy caused the project to lose 10%-15% of its funding and experience a delay of at least one year. • 11tl VOU#n'Hlt DMECTOlrf rum • o*lodially in the Dally Pt1o1. tf yOu'd like infonnatt0n on getting your orga· nizatlon llrted, c.116-42~321, Ext. 331. By Evan Henerson, Daily Pilot COSTA MESA -The first 10 yea rs are history and the Orange County Performing Arts Center has greatly 1 e,cceeded its audience's : expectations, said center administrators at the facility's , annual board meeting Tues- 1 day. In 19g'5, The Center logged , record attendance and perfor- ' mance totals and watched its , endowment fund reach $12.3 :million. • Now the real work begins. : Which means casting an eye : toward 'expansion. , No target dates have been : set or financial figures dis- 1 cussed, but the center's Facili- : ties Expansion Committee has tits marching orders. By resolu- 1 lion of its board of directors, : the committee is to "move with deliberate speed in exploring alternatives to meet Orange County's demand for the performing arts by creat- ing additional capacity at The Center." . ~ Translation: Build the seats and audiences will come. And increase. According to president Tom Tomlinson, the Orange County Performing Arts Center is operating at 160% capacity1 ba$ed on the number of perj formance days The Center can supply (Performances took plac.e on 300 of 365 days in 1995). Since The C~nter needs "down days" to take care of maintenance, adding perfor- mance days is not an option, Tomlinson said. "We are, in effect, the vic- tims of our own success," Tom- linson said at Tuesday night's board meeting, "and today are seriously limited in our capac- ity for delivering any other kind·of programming." And that will take both time and considerable research, center officials say. A marketing survey under- taken by the Connecticut- based AMS Planning and Research firm compared Orange County's arts patrons to those in the cities of Seattle, Washington and Minneapo- lis/St. Paul, Minnesota. Research studies indicate that Orange County residents attend arts performance 2-5 times more often than theLT counterparts in Seattle and Minneapolis, said Tomlinson. But those cities have more seats per thousand members of the cities' population, the studies show. ' Center administrators have talked lnf ormally about expanding the facilities for several years, said center spokesman Greg Patterson. But when the state of Califor- nia plunged into a recession, plans were placed on bold. ·But now with the improve- ment of the economy, a signif- icant growth in our audience and growth in the appetite of the market, there's clearly a need· for additional facilities,• Patterson said. ·we have no date to put a shovel in the ground, but - these are significant steps in the process of building new buildings.• According to Patterson, an ideal spot for new facilities would be land adjacent to the current building wh ich The Center owns. Studenm shoilld be commended ~ ·Jasgn for K~9 dOnatiori J ·1 am wriUng about the doDA-tion ot St,000 to the Costa Mesa K-9 Program by the Sonora ScbOo1 Student Council. I am the parent of two Sonora School students and as a local veteriDUian have cared for the Costa Mesa police dogs since the inception of the program. I was initially shocked that the student council would donate · such a large sum of its hard- eamed funds to the police dogs. But looking at it from the point of view of the children you can only have a sense of pride in their charitable effort. The children have demon- strated that they have resi)ect and admiration for their local police and that it is better to give than receive. They also pledged a suffident amount to make a difference -definitely not a token donation. Maybe they can see the val- ~ th:lt t.~dog~ ~cp~cnt, which we as adults tend to for- get. Igor, Nero ll and now Bart are loyal. brave, and dedicated to their service to our community. They willingly risk their lives to protect us with their only pay being premium dog food, the appreciation of their master, and an instinctive sense of pride in their work.·it is hard to argue with the children's wholehearted support for these dogs. " I, for one, will follow their example. We will start collecting donations for the K-9 program in the lobby of our animal hospital and start off the fund with a sig- nificant contribution. H the community responds with a thoughtful effort hopefully some of the surplus donations may find their way back to the children by the good graces of the Police Department. In any case the children can be proud they have done a good thing. KENMILUAN Costa Mesa Hooray for the Sonora stu- dents. What a wonderful way to show support for their communi- ty. 'Ibey will have a real sense of pride when they see their local police officer with the dog that they helped buy. Even though the kids bad great intentions I think the police should have been more mature and declined it and paid for it themselves. They are way beyond able to do it on their own. ---JAMES POR'f!m, Costa Mesa I am a teacher at the Sonora Elementary School and I'm replying to your •Should you give it back?" about the $1,000 donated by Sonora Elementary students. The $1,000 was donated by the Sonora Elementary Student Council, was money earned by the students at Sonora through various fund.raisers. The student council wanted to thank the community for all of their sup- port over the years by giving back to the community. Tt was a generous offer and one that the students, not the adults, made. The studeBts didn't take money away from the school, it is money they earned. That the students wanted to give back to the community and not just take from the community I think is a lesson we an should learn. MAE GALE Costa Mesa I say hooray and three cheers for the students of Sonora Ele- mentary School I think it's won- derful that they are taking an interest by donating money to help buy a new police dog for their community and for their protection. H the PTA needs money so desperately, they can always have another bake sale. LUCY MORGAN Newport Beach I am appalled first of all that you printed this on the front page. Sonora does not need any bad press. On-thL contrary, I think it is commendable that the children at this school chose to take their hard-earned money and b:elp the community. I'm absolutely appalled that a board member at the school dis- trict is thinking of reinstating cor- poral punishment. Why would we want to make a law that makes it OK for adults to assault children? KAREN URSINI Costa Mesa · As a mother of four, I am absolutely opposed to this idea. You know that the children who are going to be singled out for spanking are going to be the same ones over and over that are trying to get attention and these are the children that need more positive attention and love -not to be humiliated and abused in school. . I'm sure they get enough of that at home. CHARMAINE IAURIE Newport Beach lf spanking is good for a child then it must be even better for their parents. Any parent caught speeding should be spanked along with receiving a fine. The spanking should take place in the city square beginning at noon on Sunday, so as to set an example for all other adults. Llkewise, all politicians who do not keep their campaign promises should be spanked in a similar way on the next election day. IAWRENCE A. BOYS SOCCER Sea Kings go blank in 72-45 setback • Santa Margarita leads by as many as 35 en route to Sea View League win. By Barry Faulkner, Daily Pilot RANCHO SANfA MAR- GARITA -The Corona del Mar High boys basketball team picked up Wednesday where it left off Tuesday, when Coach Paul Orris kicked the Sea Kings out of practice for a lack of focus . The Sea Kings were virtually missing in action !or the first three periods at Sea View League host Santa Margarita, collectlng more turnovers (20) than field- goal attempts (18) and falling behind by 35. The visitors rallied to win the fourth period, making the final verdict 72-45, providing a glim- mer of spark Orris must hope finds some kindling for Friday night's visit to El Toro High. •That's the way we've been playing and practicing,• said Orris, more puzzled than frustrat- ed by his team's dismal perlor- mance. •I kicked them out of practice (Tuesday), because they had no focus and. no intensity. The kids seem to have no insight as to what they're supposed to be doing and we seem to have our minds on anything but what we're trying to work on. CONTINUED FROM 81 Leadbetter Golf Academy will host a free goU clinic for Southem California residents at NBCC. RSVPs are not reqajred, . In addition, Mogg, whose vtdeo-taped lesson a year ago improved a certain sportswriters golf swing, will give a clinic to members of several local high school teams at 3 p.m., including all four schools in the Newport-Mesa School District. According to Jake Rohrer, the event's pro-am chairman. it was Mogg's idea. •tt's a nice addition to the tournament activities," Rohrer said. There Will also be several booths 10cated on-site for toUllley spehators to visit, representing · Taco Bell Newport Classic apparel, among other things. a It takes countless hours of work for volunteers to make the Newport Classic Pro-Am a success, while more than $1.8 million has been raised to benefit Hoag Memorial Hospital Presbyterian. From scorers. to marshals, from sales to silent-auction organizers, from the setup crews to the cleanup crews, hundreds of people volunteer their time to give Newport Beach its finest and most traditional golf tournament of the year. a Preliminary discussions are taking place for a golf tournament in May at Newport Beach Golf Course to benefit financially underprivileged kids, as well as Newport Harbor High's golf team, which has in that can only field six varsity players in competlP,on. "Golf is booming," said Jim Warren, Newport Harbor golf coach, who plans to field five teams this spring, including the district's first girls team. The problem for Warren, who has 'hired three assistants this year, is the cost for the players. To practice on driving ranges, among other things, doesn't come cheaply for some 60 golfers on a regular basis. A tournament with solid com- munity support would certainly help alleviate some of the cost. Furthermore, the tournament -being launched by Newport Beach Golf Course starter Keith Wyrick -would create a Junior .Fund for kids in the Costa Mesa and Newport Beach area who want to play but cannot afford the basics, such as lessons, dri- ving-range time and clubs. Jobn Sullivan, a pro at Newport Beach GC, would reportedly be the 'main instructor Jor the kids in a •camp" environment. Kids would receive basic instruction four-to-five hours a day for about three days a week. Wyrick is looking for sponsors, players and donors for the event. Call him at the club (852-8681) if you're interested in helping underprivileged kids and the high school golf program. 0 Kudos to Rosemary Ely {Coto De Caza), a guest at Newport Beach Country Club on Tuesday who scored a hole-in-one on the 103-yard hole No. 4 from the ladies' tees. Joan Carr, Glee Queen and Allen 1\'ane were witnesses. Ely's shot bounced once, about four feet from the pin, then rolled into the cup. • RIOtARD DUNN Is a Daily Pilot Sportswriter whose club goff column appears every Thursday.
