ommission lightens up on drug rehab center
• Officials vote to lessen
restrictions and back
away from request for
names of clients.

COSTA MESA -The Plan-
ning Commission on Monday
night backed down from ·earlier
restrictions it had asked the city to
impose on a controversial drug
and alcohol Recovery Center.
ln a 4-1 vote with Commission-
er Linda Dixon dissenting, the
commission approved requiring
center owner Nancy Clark to pro-
vide the city quarterly re ports on
her clients. · ·
But Clark won't have to
ipclude the full names of her
clients, an earlier commission
requirement that she claimed was
illegal and would jeopardize her .
state license.
Last month, the commission vot-
ed to require Clark - who runs a
live-in treatment program in a 19-
unit apartment complex on Victoria
Street -to give reports listing her
clients' names,
criminal Pisto-
ries, how much
jail time,or fines
they received
and other
details on
demand from
Qty Hall.
But after
Clark objected
and city attor-Nancy Clark
neys found out
they could not legally require her
to hand over the confiderttial infor-
mation, the com.mission backed off.
On Monday, instead of requir-
ing Clark to divulge personal
information on demand, the com-
mission approved ma.king her give
less-detailed reports on her clients
to city i:t.aif. four times a year.
Dixon, the only commissioner
opposed to relaxing the rules,
feared property values in the ·
largely residential community
surrowiding the Recovery Center
will suffer if a live-in drug and
alcohol treatment center is
allowed to operate on the site.
That concern was echoed late
last year by City Councilman Joe

NEWPORT BEACH -February
marks the one-year anniversary of the
completion of ·Jeremy Wissing's Eagle's
Scout project, the coqstruction of foot
bridges with,ramps at Back Bay.
Although the concrete-fastened foot
bridges weathered this weekend's
storm, the dirt ramps that lead UP. to
them were washed away by the heavy
rains. ·u took 1,100 hours for the construc-
tion of the bridges and the ramps," 17-

themselves took about 600 hours to
complete.•.
Jeremy, who lives in Chino, had the
help of about 40 of his troop members
to complete his project.
"I was proud of it," he said. ul was
real dis~ppointed to hear that it washed
away, but you have to accept it. It's man
against nature. Man can't always win.•
Fifteen-year-old Troy Germain of
Fullerton also completed his Eagle
Scout project at Back Bay.
"l constructed some wheelchair
accessible ramps,• he said. •Tuey were
made of wood and dirt.•
TI'oy and his troop spent about 400
hours last summer on the project,
which also was washed away by the
rains.

The Newport Beach City Coun-
cil may lift the 40 restrictions that
were slapped on Wmdows on the
Bay owner Scott Shuttleworth two
weeks ago.
Shuttleworth was given a sec-
ond chance. by the council, which
voted 5-2 to reconsider its original
unanimous decision .
But the action <;lidn't come with-
out sparks as Shuttleworth and
Councilman John Hedges
engaged in a heated verbal battle.
Hedges insisted nothing had
changed from the council's action
two weeks ago. · l
ln addition, several community
members criticized the council for
backing down from its original
action.
But that didn't stop the majority
from changing course, which was
supported by several people who
had come to speak in favor of the
restaurant.

John Noyes. "l think we need to
work out this issue a little harder."
The council voted to reconsider
five specific restrictions including
removing the bar frt>m the outside
patio area and stopping all food
· service on the patio at 9 p.m. on
week nights and 10 p.m. on week-
ends.

Feb. 23 during the next council
meeting.
ln other action, a handful of c1ty
employees will be plugging in
their cars before clockmg out for -
the day once 17 electnc atv vehi-
cles come driving into Newport
Beach.
The cowicil voted 6-1 m sup-
port of applying for $82.8b7 in
grant funds from the Air Quality
Management Distnct to ledse 17
electric vehicles for three years
and purchase and install 17 chdfg-
ing stations.
The council has also approved
a contract with Edison Electnc
Vehicles to butld the City Hall
charging stabon.

Air Pollution Reducbon Review
Committee and the Orange Coun-
ty Transportation Authority will
pay for installation costs, but the
city will fund mairttenance of the
station as well as the cost of elec-
tricity dunng the one-year tnAl.
The completion of the Newport
Beach and Balboa Pier repair pro-
ject was also approved by the
Newport Beach City Counal
Monday night.
Repairs were finished on Jan.
26 and included the removal and
replacement of several pier pil·
ings. braang and connecto~.
Due to recent storm activity,
three additional pilings were
replaced at the Balboa Pier push-
ing the final cost to $146,259.71 -

attorney general opuuon has
some school board members
questioning the legality of the
district's zero-tolerance drugs and
alcohol policy.
Rende red in December, the
decision by Attorney General Dan
Lungren states, •A school district
may not adopt a zero-tolerance
policy mandating the expulsion of
a student on first offense involving
the possession of a controlled sub-
stance or alcohol. Such an auto•
matic expulsion policy would con-
travene state law."
The chstnct 1s seeking a legal
opinion as to whether Newport-
Mesa's infamous zero-tolerance
policy falls Wlthin the legal lirmts
prescribed. ·
The opinion requires that cas-
es of possession of drugs and
alcohol be handled on a case-by-
case basis rather than handled by
the wide. stroke of the brush of
zero· tolerance. ·

I think the reason Robert Graham is a for-
mer Qty Council candidate and will
remain to be so is because of his support
of the brldges. I think the public has spoken
on bridges before and we don't want no
stinking bridges.

There is more to the bridge issue than
Graham has addressed. Just as the Mesa
Verde area residents, which include Gra-
ham, do not want the cut-through traffic on
Gisler, the residents on Costa Mesa's west
and east sides don't either.
Bridges at Gisler and 19th Streets would
serve as pass-throughs for nonresidents.
Not business generators. I think Costa
Mesa has provided our share, with Sun-
flower, Victoria and the Newport Boulevard
Costa Mesa Freeway pus-througbs.
This is one of the reasons Graham was
not ele<lad. Costa Mesa does not want
those bridges.

from Coast Highway via a 19th Street
bridge over the Santa ADA River, is ill.con-
ceived.
This bridge would disrupt through traf-
fic, conbibute to acridents and aime, and
lower property values and livtng conditions.
It woul<l also end any reasonable attempt '
to restore the Santa Ana River mouth a.a a
viable and connected wildUf8 refuge and
scarce habitat for lbeaed-outbuman visi-
tors to someday enjoy.
UVing in this area, I personally do not
mind the •extra• three minutes required by
my daily drives to the Huntington Beach
Pier.
Though I've heard it •can't be done," if
anything, this Victoria thoroughfare could
be exploited to provide a more direct north
coast path to the Costa Mesa Freeway (and
thus South Cout Plaza) while allowing for
an additional entryway, via Harbor Boule-
vard into nt.angle Square.
This way, the eJ:isting commuter "mash•
at 19th and Newport Boulevard would be
eased rather than greatly exacerbated.
However, the aOlling and entry area for
Victoria School would have to be upgraded
to accommodate their twice-daily schedule.

Richard Nixon's "crimes
against the American people
and our Constitution• as being
much different from the cur-
rent Clinton scandal.
However, it must be
remembered that the crimes of
Nixon started as a third-rate
burglary by political party
zealots and over time.escalat-
ed into.a constitutional crisis
when Nixon attempted to cov-
er up the entire affair.
1Wenty-five years later and
after four years of White
House stonewalling of the spe-
cial counsel in the matter of
the president's financial deal-
ings in Whitewater, the navel
Office debacle, the FBI file
affair, etc., it is only now that
the American public's interest
has been piqued by a sex
scandal.
While the polling of the
American public seems to sug-
gest the president's private
sexual appetite is not of any
significance vis-a-~ his per-
formance in office (which is
debatable), this is a small
event that could eventually
lead to larger consequences ii
perjury and obstruction of jus-
tice charges (yes, a coverup)
are confirmed.
U proven, the idea that the
personal character of ihe pres-
ident does not matter will
erode into a crisis of leader-
ship. Indeed, Nixon had to
resign in the face of over-
whelming proof that be had
lost the moral authority to lead
this nation. ·
Tue moral authority of this
president was problematic at
best even when he was first
elected in 1992, but the mores
of the country have changed
greatly in the years since the
Watergate affair.
For those who say that
character does not matter c·it's
the economy, stupid•), today's
crisis in presidential leadership
is the same as 25 years ago -
it's just that we went into this
one with our eyes open.

I am writing in response to the
artide written on the two
boys whose lives were taken
as the result of a car crash last
week. My heart goes out to
their families. I am a graduate
of Costa Mesa High School. I did
not know the boys involved,
but I do have a few things to
say about the artide.
I would like to thank "gang
expert•. Bob Boies for his won-
derful stereotype of a "party
crew• member. In my six years
at Costa ~ I knew many
people who were involved with
many different crews, and to
my knowledge, all they want to
cfo is dance and have a good
time. There wasn't any former
gang members in th<>;se crews
as I recall. It's not like they spent
three years in San Quentin as a
gangbanger and then got out
and statted a party crew.
Most of those kids are 15 or
16. They don't have the chance
to get Involved In gangs
because they spend all of their
free time setting up these get-
togethers and enjoying them.
These are kids, kids spending
time and money so that other
kids have something to do that
doesn't involve drugs and ak~
hol. This is the positive outlook
that our community needs. The
article didn't put enough
emphasis on that. Will they be
put on the "Most Influential
People in the Newport-Mesa
Area .. list? Or does akohof have
to be involved? But I digress.
What did Newport Harbors
principal have to do with this
anyway? I forgot how hard It
IT\LISt be to deal with the gangs
at Newport Harbor. I mean,
come on, did he know these
boys?
Personally, if I were a principal
(the head representative for a
schooO and I was intefviewed
about the deaths of two boys in
my district. the first words out
of my mouth 'NOUld be my con-
dolences to the families.
They were humans In our
community too, not just gang
members that evolved to main-
tain their social function, as
Boies put it.

Bill White was one of the
last of the shorthand
court reporters. Today, all
court reporters use sophisticat-
ed stenotype machines.
White was the court reporter
for Judge Franklyn West. He
was something of a burden for
Judge West, who was patient,
polite, courteous and kind.
White was none of these.
U two lawyers would talk at
the same time, White would
throw down his pen, sit back,
cross his arms over his chest
and bellow, "I can't·take two
people talking at the same
tim • e.
Judge West would look
pained, then suggest politely
that the attorneys heed the
court reporter's advice. No two
people could have been farther
apart in personalities than
Judge West and Bill White.
However, Judge West realized
White was one of the last of a
dying breed and kept him on,
although he was obviously
pained with some of White's
outbursts.
White had been an itinerant
court reporter who, before
coming to Orarige County in
the early '30s, had reported all
over the United States. Also,
White said, he had reported
some of the most famous cases
of the times.
He said he had report!!d the
Loeb/Leopold case and was a
close friend of Clarence Dar-
row. White said he had report-
ed many famous cases, so
many in fact that Judge West
said if all his stories were true,
White would have been 130
years old.
However, the story I liked
the most was of the time he
was the personal reporter for a
robe rt
gardner
General Machado, then dicta-
tor of Cuba.
White said he had to wit-
ness the executions of Macha-
do's political enemies in the
dungeons of Morro Castle. The
executions were done by gar-
roting the victims. I also knew
that death by garrote was by
strangulation but didn't know
exactly how it was done. White
said Machado's garrote instru-
ment was a steel collar that
was placed around the prison-
er's neck and tightened by a
large key on the back. White
would tell in lurid detail how
the prisoner's neck would
stretch up and up and the gar-
rote turned until finally the
head fell over because there
was no neck left to hold the
head up. White left no detail
out in telling the story.
Well, the Newport Beach
City Council-watchers decided
to hire White to report on City
Council meetings. White asked
me to go along and identify
the various City Council mem-
bers as they spoke.
Of course we now know the
formal evening council meet-
ings were a facade. The real
.
meeting took place that after-
noon at some local bar. Came
the night of the meeting, City
Clerk Frank Rinehart would
mutter something, Lloyd
Claire, the city boss, would
move wit• to be passed, and
the rest of the council would
vote unanimously that "it"
pass.
Rinehart was a world-class
mutterer, and the council
watchdogs were never able to
hear or understand what "it"
was that was being passed.
The council watchdogs wanted
White to listen to Frank Rine-
hart and write down what be
said.
The night of the coµncil
meeting, White got as close to
Rinehart as he could and sat
there posed with his notebook
and pen. Frank muttered
something. White looked puz-
zled and gQt closer. Rinehart
muttered something else.
White got closer. He leaned
over so far he was practically
sitting in Rinehart's lap.
Finally, White leaned back.
closed his notebook, put his
pen in his pocket and told me
that he had reported mutt~rers
all over the United States, but
this guy was undoubtedly the
worst mutterer he bad ever
heard, and he hadn't been
able to understarid a word be
had muttered. White stalked
out of the meeting.
I said that Frank Rinehart was
a world-class mutterer. I guess he
was. U you can't take the word of
a man with 130 years' experi-
ence listening to mutterers,
whose word can you take?

communication with its network
of volunteer commissions and
advisory committees.
During, a workshop at which
no formal action was taken. the
council agr~d to ask each coun-
cil member to write down goals
and objectives for each of the
committeeS' they serve as lia.i.sons

City Council committees keep
city officials up to speed on issues
affecting teens, seniors arid other
topics.
The council appoints residents
to serve unpaid terms on panels
ranging from the Planning Com-
mission -which has final author-
ity on most items it considers -to
various committees that simply
advise the council. ·

A Buena Park man was arrested
and two men were injured after
two separate fights broke out
among at least 10 patrons at a pop-
ular Costa Mesa sports bar Satur-
day, police reported.
Nicholas Montes, 22, was
arrested on suspidon of fighting in
public after police responded to a
separate call about a fight at Leg-
ends Sports Bar and Restaurant on
Anton Boulevard, said Lt. Ron
Smith of the Costa Mesa Police
Department.
The first fight broke out inside

when a man in his early 20s hit a
Santa Ana man in the head with a
beer botUe, the police report said.

involved in the barroom brawl,
which had spilled into the parking lot

The Back Bay area took a whop-
ping this weekend, officials said.
Flooding in the Big Canyon area
washed out a 20-year-old bridge
along Back Bay Drive. The r08.d
itself was closed early Monday.
Still, the recently launched
dredging of the Back Bay was able
to continue in spite of the storm, offi-
cials said.
"The dredging project was set up
to be able to handle this kind of
weather," said 4zly' Paul, manager
of coastal facilities for the county.
John Scholl, a state Fish and
Game biologist who watches over
the Back Bay, hopes the city will
make the cleanup of the area sur-
rounding the estuary a top pi;iority.
•There are a lot of people who
like to come here to see the beauty
of the area,• Scholl said. "There
were 3-foot bridges that were built
by the scouts. Now they've been
destroyed.•
In addition to washed out roads
and bridges, there were three land-
slides in the Big Canyon area, Scholl
said .
