Jaclc went to Shorty's room, .--r • "; -.ir.a. .....,, ~·., robert · g a rdner , • -1 which was on the second floor of his rooming house. Shorty was asleep. Beside his bed was the manhole cover. When awak- 1 ened, Shorty denied any knowl· ~edge of it. Nevertheless, Jack Kennedy artest.etl his old friend Shorty for theft. By this time I was the city judge of the city of Newport Beach, wJlich inay or may not have-been a step"Up from taktng- tickets at the Rendezvous. The pay was about the same. I tried the case. Today, of course, judges are expected to disqualify themselves in cases involving people they know but in those days we had no qualms about it. After all, a city judge knew just about everyone who appeared before him. After saying hello and talking about old times, we went on with the trial. The prosecution case, put on by Kennedy (who needs a prosecutor?) was simplicity itself. The manhole cover had been stolen and was fowid in posses- sion of Shorty. Shorty's defense was equally simple. He bad gotten drunk and awakened in bed but sure as hell hadn't stolen that n>Anbole cover. I found Shorty not guilty. It was- n't the toughest case 1 ever decid- ed. It was almost a physical impos- sibility for Shorty, drunk or sober, to get that n>Anhole cover from its formal Jt!Sting place then six· blocks to his rooming house and up a flight of stairs to his room. (Shorty earned his name because he was 'al.>dut 5 foot 6 inches tall and weighed about 120.) Additionally, why steal a man- hole cover? There is a very limit· ed market for used manhole cov- ers. Actually, the only customer I c;ould imagine would have been the dty of Newport Beach and, drunk. or sober, Shorty wasn't crazy enough to steal the city's manhole cover and then try to sell it back to the city. Anyway, the story around Stark's was that Jiggs Dyson and Rebel Brown had done the whole thing as a joke on Shorty. The story was that Shorty had passed out. they h'ad purb.lrI:rn> bed,. - then conceived the story to put the manhole cover in his room, then can the cops. That made a lot more sense than the story of Shorty stealing the thing. and taking it to his room. That was the administration of justice in the old days. • ROBE.RT GARDNER is a retired judge and a resident of Corona del Mar. His column runs Tuesdays. RUFF ELL'S UPHOLSTERY INC. wt... It was the superintendents, with the bottom line in mind, who started this snowball rolling years ago. After opening with the good news, however, there figures to be some awkward silence (at best). when the "dirt" is revealed on girls water polo, which by Council decree (a motion to table the plan was " defeated, 25-24, before it was voted through, 30-21) will begin as a winter sport in December. The superintendents, as they are wont to do, will quickly compute that separate water polo programs for boys and girls will require paying more coaches, officials, bus drivers, clock operators, and a not-so- cool utility bill for keeping each school's pool toasty when the temperature turns crisp. The superintendents are l.Jable to get a little heated themselves about this, particularly since they were not given the chance to red flag such budget drainers, or set their subordinates' voting agenda accordingly, before the proposal was passed. The reason no such financial impact report crossed their desk. was conspicuously simple: one didn't exist. One council member pointed this omission oul Thursday, along with the pesky little provision in the Southern Section constitution requiring all items brQught before lhe Council "must contain the financial implications on member schools, leagues and the Southern Section.• Huntington Beach High Prinopal Jim Staunton. who presented the Sun.set League's proposal, responded b)< St4ting his league wasn't prepared to address such concerns.
