NEWPORT BEACH -A civil
war has erupted in the usually
close-knit community of Bayshores
that could lead to the recall of com-
munity association President Bruce
Sumner. a highly respected jurist
and former EtSsemblyman.

NEWPORT BEACH -While
activists rack their brains search-
ing for ways to make the Mermaid
feel unwelcome. anjrvine man is
more concerned tha~e city's first
nude nightclub bares all in its
advertisements as well as on stage.
A lawsuit recently filed in
Orange County Superior Court
accuses the operators of Mermaid
of consumer fraud and misleading
advertising. The suit alleges that
the controversial club brings in cus-
tomers through deceptive means.
Among the claims:
• Customers are not informed
that they get hit with a 10% sur-
charge when they use a credit
card.
• Mermaid ads say the busi-
ness offers "no cover charge,"
but charges patrons a two-drink
minimum that costs $20.

election to recall the entire associa-
tion board should be allowed.
The three minority members of
the Bayshores Community Associa-
tion board of directors, Ayres Boyd,
Martha Gooding and Bill Messen-
ger, have charged that Sumner and
his three allies on the board have
defied the community's wishes.

is using an •ambush style" of

leadership, meeting in secret and
disrupting the community.
"The leadership style Bruce
Sumner brings to this board is
really inimical to what this com-
munity stands for," said Gooding,
an attorney.
Sumner, 71, recently led the
fight for the county charter Mea-
sure T, which failed last month.
But he's probably best known as a
former Superior Court Judge who
served in the state Assembly and
was once the head of the Orange
County Democratic Party.
The former jurist said the recall
would take place if those wanting
it would follow association bylaws
-which say 5% of the community
must ask for a "recall election."
"You've got to follow the legal
procedures to follow a recall action
and they haven't done so,• he said,
noting that his opponents asked for
a "special meeting" not a recall.
"I don't ~ it's a good idea,"
Sumner said of the recall. "But it's
the right of the people who live
there. It re&lly is a political move on

members.

Toledano said. "I have no mten-

The suit calls this statement a lie,
claiming that no more than 30
women work at the business.
Although bis client is seeking
less than $300 in damages, hun-
dreds of patrons may be due a
partial refund, according to attor-
ney Martin Anderson, who repre-
sents Mitchell Stn.ith of Irvine.
"I want to send a message,"
said Anderson. "It's not fair to
consumers and competitors to
deal with a place like this where
the statements are totally bogus."

Alzheimer's patients to handle.
But Dick -Mueblke and her
staff from the Harbor-Area Adult
Day Care Center bre athed a sigh
of relief on Monday, when they
finished the day without a glitch

Muehlke, director of the Harbor-

The visitors' bureau will set up
a giant aichway of balloons at the
Santa Ana River jetty where the
Olympic runners will enter the
city. Williams said she is also
working with officials from the
NeWP.ort-Mesa Unified School
District to get pep squads and
school bands to participate in the
festivities.
Olympic banners are $75 and
can be purchased through the
Newport Beach Conference and
Vl.Sitors Bureau through Saturday.

Let's get the bias offstage first.

would be the first to acknqwl·
edge that I taught him every·
thing he knows about plumbing.

owners' association squabble that

away from.
But be won't do that -at.least
not until it's won. That isn't his
style.
Consider for a moment the
message Baugh's victory sends
the Republican big shots who, if
they were not directly behind
this maneuver, have certainly
condoned it.
elected officials. A prime mea-
sure of that stupidity is the offi-
cial Republican reaction to Dis-
trict Attorney Michael Capizzi,
who brought charges against the
Space Cadets of the 67th. Instead
of being "repudiated• (Baugh's
word), Capizzi should be held up
by his fellow Republicans as a
model of the kind of integrity
they seek and admire in public
officials.
The party supported it, but '
Bruce didn't. When he was told

the freedom to invest bis time

ness that it is now limited. Nev-
ertheless, he chose to use a year
of that precious time to direct
the crafting of a new charter for
the county of Orange. He
believed in it consumma.tely,
and he lost. But he's philo5ophi-
cal about that. In a lifetime in
and around politics, you win
solhe and you lose some.
At breakfast the morning after
the election, be told me: "The
charter was defeated by a whole
series of special interests whose
approval of the final version did-
. n't translate into support. It was
opposed by both political parties.
The Republicans wanted more,
not fewer, elective offices;, and
the Democrats -particularly the
unions -objected to privatiza·
tion.
"The League of Women Vot-
ers refused to endorse the charter
because it doesn't believe in term
limits. The Committee of Corre-
spondence didn't want a strong
CEO. And, incredibly in view of
our recent history, a lot of citizens
want to continue to elect the
treasurer and the recorder

because they think it brings
democracy closer to the peDple.
All these single issue voters
added up to enough to defeat the
charter.•
But while he was sweating out
the .vote count on Measure T last
week, Bruce was enduring the
frustration of another election -a
Bayshore Homeowners Associa-
tion meeting at which the main
item on the agenda was authoriz-
ing a recall (it required only 5%
of the members).to remove Bruce
from his position as president of
the group.
I'm not going to get into the
issues that brought about this sit-
uation because my bias would be
clear. But I can't look away from
the irony.
This man who has given much
of bis lite to public service ends
up losing a bipartisan blueprint
for responsible government and

The irony isn't lost on him
either.
"This kind of completes my
political career,• he said a little
wistfully. "I've run in all kinds of
elections, representing both polit·
ical parties, but this is the first
time anybody has tried to recall
me. It's a strapge kind of last hur-
rah."
'M eanwhile, over in our
neighboring 67th Assembly
District, we have a loser who
won. His name is Scott Baugh,
and 14,572 Orange County vot-
ers, supposedly of sound mind,
voted for him to represent them
in Sacramento after he was
indicted by a grand jury on four
felony and 18 misdemeanor
charges growing out of a ludi-
crous caper aimed at rigging an
election.
Those voters had two other
legitimate choices on the ballot,
but that doesn't really matter. If
Baugh had been running unop-
posed, "Unopposed" should
have won in a landslide.
r The message says: •There is
J no degree to which you can
humiliate us or show your con-
tempt for us or dumb us down
by the candidates you force
feed to us that will drive us
away. We will still go to the
polls like good sheep and vote
for these bozos."
That message is loud and
clear; and we will pay for it in the
quality of our representation for a
good long time to come.
And don't lecture me with the
innocent until proved guilty
argument. Three people have
already confessed to this fiasco,
and its outlines are certainly visi-
ble enough that whatever the
judicial outcome, the verdict of
"stupidity" is clear.
And stupidity is a quality that
only political bosses want in

promising political careers three

can then, when the party still
embraced people like Tom
Kuchel and Earl Warren.
After six productive years as a
state Assemblyman, Bruce was
considered a lock for the Calilor-
nia Senate -until he ran afoul of
to shape-up, he refused to com-
promise his integrity and lost the
Senate seat to a member of the
John Birch Society.
Maybe he served us better as
a Superior Court judge and a
community leader of tireless
energy and enormous savvy. We
can only speculate on that.
But one thing not open to
speculation is his public integrity.
That hasn't wavered from his.run
for the state Senate to his current
problems with the homeowners'
association in Baysbores.
That's what defines a real win-
ner.

NEWPORT BEACH -It was the Back Bay
baptism for first-year Corona del Mar High
boys volleyball coach Steve Conti. But the
same could not be said of Sea King senior
standouts Derek Newcomer, Brian Coleman
and John Coon, whose steadying tnfluence
and considerable talents helped rally the vis-
itors to a 7-15, 13-15, 15-1, 15-12, 15-12 Sea
View League victory at Newport Harbor
Tuesday night.

estimated his adrenaline level at its highest
point since his playing days at Estancia High
and Golden West College.

up at about 5:30 and just laying in bed. The
emotional intensity of this rivalry wasn't
something I'd experienced as a coach.·
Experience on the Back Bay burner, how-
ever. was more plentiful in the CdM lineup
than that of the Sailors, who belied the youth-
ful Dldkeup of their squad all too well the first
two games.
·Newport is the scrappiest defensive team
we've played all year and they showed a lot
of heart by coming out and playing very
well,• Conti said. "But I thought we also
played scared and tentatively, until we start-
ed to relax in the middle of the second
game.•
CdM, indeed, began turning up its inten-
sity in the second game, rallying from a 12-4
deficit to within 14-13, before a back-row
spike into the net gave Harbor an apparently
comfortable C\lShion and sent nearly half of
the 700 spectators home with notions of what
would have been Newport's third straight tri-
umph over their arch rivals and sixth out of
the last seven.
Newcomer, the Sea Kings' veteran setter,

however. said his confidence never wavered.
• 1 knew that once we started getting it
going, we would win. and the (15-1) third game
really boosted us up high,• Newcomer said.
·(Newcomer) has the attitude that we're
going to win, and I think that rubs off on the
other guys," Conti said. •He's just our old
reliable.•
Newcomer's net presence went beyond
setting, as be finished with six kills and six
stuff blocks, including the game-winning
roof job to silence Harbor's spirited fifth.

was more conventional (a match-high 27
kills), while Coon (14 kills and two stuff
blocks) earned praise from Conti for playing

"Coleman is consistent, day-in and day-
out," Conti explained. *But Coon is normally
a right-side player, who has accepted a move
· to middle blocker for the good of the team.•
Veteran junior Blair Hoppe (11 kills and
three blocks) and freshman Dennis Alshuler

winners, while senior middle blocker Wes
Badorek (20 kills and seven stuff blocks) and
senior Eric Bernhard (16 kills) paced the

COSTA MESA -When it came
time for Triangle Square to hang
its promotional banners for the
annual Ima,gination Celebration -
which will be held this year from
April 20 to May 5 -shopping.cen-
ter partner Rich Shapiro didn't
think anything or it.
The City Council had approved
the same banners last year, so
Shapiro figured he'd just need to
get the city's "rubber stamp," and
that would be it. But he was wrong,
and the error left the City Council
on Monday wondering whether
they should call an emergency
bearing to handle the matter.
And this wasn't the first flap the
shopping center has had with the
city over banners. Back ,in 1993, lh-
angle Square's management was
cited for flying holiday greeting
banners from the light posts around
the downtown shopping center.

The Fountain Valley center,
which served Alzheimer's
patients from the Huntington
Beach and Fountain Valley areas,
had to dose when the school dis-
trict that owns the site leased by
the center sold the property.
Now, clients from all three
areas will share the Costa Mesa

Councilwoman Sandra Genis,
who was mayor at the time, com-
plained the flags were hanging in
the public right-of-way and,
therefore, violated the city's code.
This most recent tangle began to
unravel on Friday, the same day the
banners were hung around 'Iliangle
Square, which will showcase perfor-
manoos and artwork from local stu-
dents throughout the 16-day oole-
bration. Shapiro called City Manag-
er Allan Roeder's office, just to get
the final' OK That's when Roeder
told him the approval could only
come from the council, and unless
the council agreed to call an emer-
gency hearing, he'd have to wait
until the next meeting in two weeks.
"The banners were supposed to
be put up today,• Shapiro told the
council on Monday night. ~aut the
company we hired to do it jumped
kinks in ow schedule. for exam-
ple, we have to have ~o lunch
periods now, and this morning we
had a little difficulty getting
everybody in."
Hoag Memorial Hospital has
donated a van that seats 15 and is
being used to take patrons from
Huntington Beach and Fountain
Valley who need a ride. And the
staff from the Fountain Valley
center has followed the clients
over to the Costa Mesa facility.
