Murder trial focuses on why

SANTA ANA -To most everyone
who knew her, Donna Jacobson was a
lovable, friendly woman who often
hid that soft, sensitive side under a
rough exterior.
The former Daily Pilot credit man-
ager and St. Joachim Church parish-
ioner was known for speaking her
mind and taking a firm stand when

she felt she was right.
But that feisty attitude and unwill-
ingness to back down may have cost
Jacobson her life, attorneys said Tues-
day as a trial got under way in Santd
Ana Superior Cowt for Omar Coy-
otzin Rivera, 19, who IS accused of
stabbing her to death outside her Cos-
ta Mesa apartment in 1996.
"This case does not present you
with a whodunit," public defender
Mark Davis told the jury. "There 1s
abundant evidence that Omdr Coy-
otzin stabbed Donnd Jacobson to

Jacobson, 59, who worked dt the

month after selling d half-ounce
of cocaine to an underco~r offi-

She plead guilty to three felony
drug and weapon charges on Apnl
21 and was sentenced to 300 days
m county jail. The Judge reduced
her sentence by one day because
of lhe overrught stay after her
arrest before posting bail.
Newman said he doesn't want
the media spotllght to continually
focus on Schafnitz, who has been
known for many years for her
charitable contnbutions and work
on behalf of needy children

school board attempts to forge a
bilingual program and philosophy
that would be most efficient in
bringing limited-English-speak~
ing students up to speed with
their counterparts, community
members urged the board Tues-
day night to move cautiously.
The board took no action at a
~ilingual-education study session
Tuesday night but heard a report
from Susan Despenas, assistant
supenntendent of elementary
education, on what programs are
offered in the district.
Despenas also discussed what
latitude the board has to modify
and upgrade the district's bilin-
gual-education programs.
The only guidelines the boa.rd
is required to follow are federal,
which require that bilin~al pro-
grams use sound education theo-
ries, that parents be involved and

Leadership
Tomorrow, an
Irvine-based
group that
annually rec-
ognizes citi-Rush Hill zens who are
committed to
community involvement, will
honor both for their efforts al a 6
p.m . dinner and awards ceremo-
ny at the Garden Court Restau-
rant at Park Place, 3337 fvllchel-
son Drive, Irvine.
Collectively being honored
will be the many members of the
Shalimar Drive project, made up
of several smaller community
efforts that began in 1990 to dean
up the West Side of Costa Mesa.

DUI ARRESTS
A need for an after-school pro·
gram gave rise lo the Shalimar
Learning Center, while other
commuruty efforts focused else-
where in the neighborhood
"You start working on one
thing, and you fmd others,•
Madueno said. "It's like symp-
toms of the same disease."
While she has been a visible
and outspoken me mber. Mad-
ueno was quick to pomt out the
pro1ect is a joint effort of St.
Joachim of Costa Mesa and other
Orange County churches, the city
and police, so the spotlight for
tonight's award should be shared. ·nus is not something that just
came to me and hit me in the

"This is something that as a team,
we all worked on together."
Also being saluted is Hill. an
architect and owner of Newport
Internet Services and Hill Part-
nership.
He was the first chairman of
the Newport Beach Economic
Development Committee, a city
group formed in 1993 to advise
leaders on ways to enhance the
local business community.
During his tenure, Hill worked
with a City Council that generally
was labeled business-unfriendly
to develop several campaigns
designed to attract new business-•
es and keep the ones already in
Newport Beach happy.
Hill could not be reached for
comment about the award, but
Newport Beach City Manager
Kevin Murphy said the committee
chairman was a true visionary.

But after several years as head
of the committee, Hill abruptly
resigned in January, citing what h« saw as an increasingly anti-
business City Council.
Hill angrily stepped down the
day after the council imposed
dozens of restrictions on Windows
on the Bay and just weeks after
the Cannery restaurant owner Bill
Hamilton was denied a city per-
mit to start offering dancing in his
upstairs bar area.
But Murphy said the unharmo-
nious ending should not reflect on
Hill's otherwise successful tenw-e .•

•Adams Elementary School renovates entryway to
make campus more·inviting to visitors.

MESA VERDE -Adams Ele-
mentary School is putting out the
welcome mat for vts1tors.
In an effort to be more invitmg,
the entryway is getting warm
lighting and colorful, hand-paint-
ed tiles similar to those found at
Fashion Island m Newport
Beach .
Pnncipal Barbara Harrington
said the improvements are part of
an effort to counteract the so-
called "Ten Commandments" or
school visitation.
"Instead of makmg fortresses,
we want to make schools a place
that people feel welcome to vis-
it,· she said. "It's hard to feel
welcome with so many 'Thou
shalt not do this, this and this.'•
While most of the rules are
obvious, such as no drugs and no
smoking, they still must be post-
ed under state and county regu-
lations.

that greet people." Harrington
said .
But that won't be the case in
September, at least not at Adams.
Instead, visitors will be greeted
by a collage of colorful, hand-
painted tiles in the warm glow of
a lighted weather shelter.
Concrete was poured by par-
ent volunteei;s Tuesday as a first
step toward the $12,000 renova-
tion of the entryway.
On Saturday, parents and stu-
de nts will paint the first set of
tiles during the school's annual
Country Fair. So far, about 90
have been sold for $35 each. But
the school is hoping to sell 60 to
100 more.
"Anyone who wants to help
the school can purchase one,~
Harrington said.
Fonner school board member
Ed Decker holds the record for
the greatest number of tiles pur-
chased: six, one for each of his
children who attended the
school.

What this tells me is that there

people out there not usually
eard from. Not just because I
appen to agree with what the
ajority is saying, but because it
being said so evenhandedly
with a good deal more reason

Y difficult given Schafnit:z's isn't-
. -a-lark demeanor.
I wanted to respond, with the
est of our readers, to the Daily
· ot's invitation to speak out on
afnit:z's punishment. But I find
ost of the things I wanted to
y pre-empted by the letter

offenders who have been treated
with a good deal less compassion
and understanding.
I asked Joseph Nedza, who
prosecuted the case for the Dis-
trict Attorney's Office, if he
agreed with the assertion of
Schafnit:z's attorney, Robert
Newman, that "from a lay per-
spective, it may seem like pref-
erential treatment. But I don't
think her place in Newport soci-
ety played a part.•
Nedza refused to comment on
Newman's statement directly, but
then added: "The usual sentence
for a street seller with no prior
conviction and no gun is four to
six months in jail. But when you
plug in the size of the sale -16
grams of cocaine -and add a
loaded weapon, the usual sen-
tence goes to three to five years
in prison. So you figure it out. ff
Defending the light sentence
given Schafnit:z on the basis that
our whole criminal justice proce-
dure in drug cases needs a dras-
tic overhauling is sophistry. I
happen to agree with that, too,
but it can't be selective. Taking it
easy on Schafnitz while filling
our prisons with other drug
offenders who committed much
less serious crunes sends a dan-
gerous message, ihdeed.

review of the book "Crime and
Punishment in America" by
Elliott Currie points out that

Nearly 1,300 students were
nominated for the award, and just
20 were named to the first team,
including three from California.
The academic team is spon-
sored by Phi Theta Kappa. the
national community college honor
society, and USA Today. Grades,
leadership and conununity service
are considered in team selection.
A graduate of Newport Harbor
High School, Cubbage graduated
in December from Orange Coast
College, which paid her travel
expenses to Florida.
Also attending the recognition
ceremony were Cubbage's fiance,
Shawn Vegg, her mother, Marla
Vick, and sister, Heather.
Cubbage, who is a first-semes-
ter women's studies major at
UCLA, was nominated for the aw-
ard by OCC President Margaret
A. Gratton.
On April 16, Cubbage was
named to the 24-member All-Cal-
ifornia First Team for 1998, spon-
sored by Phi Theta Kappa and the
Community College League of
California. She works nine hours
each week with the Los Angeles
Commission on Assaults Against
Women. After completing a six-
week training course earlier this
spring, she earned the designa-
tion as a state-certified counselor
to work on the commission's tele-
phone hotline.

But not, it appears, for every-
one.
And therein lies the basis of
the anger over the Schafnitz sen-
tence. There are a good many
legitimate reasons for challenging
the manner in which we deal with
drug cnmes m Amenca, mcludmg
the refusal of politioans to take a
straight look at decrurunahzing
drugs. But as long dS the present
system is m place, it must be
applied eqwtably Anytlung less
simply will bulwark the contempt
that large segments or the popula-
tion -especidlly young people -
already hold for th e rules of our
society.

To get some additional per-
spective, I asked a highly
respected Orange County Junst
about the disposition of the
Schafnitz case. While reluctant to
be critical of another judge's
decision and acknowledging that
he wasn't privy to the details of
the case, he also wondered aloud
about the nature of the message
being delivered.
"The real concern to me, ff he
said, "is the perception that there
are different levels of justice
depending on money and social
status. And the further percep-
tion that the only way those who
have neither can level the play-
mg field is·by acqwring one or
the other. Unfortunately, that
sometimes comes pretty close to
reality, and a sentence Wee the
one handed down in the
Schalrutz case simply supports
that view.•
If two words could character-
tze the published reaction to the
Schafnitz sentencing, they would
be sadness and chsillu.siomnent.
The perception of inequality is as
destructive clS the inequality
itself. Even in a community as
well-endowed as the one in
wluch we live, buying justice is
anathema to those who perceive
it, mcludrng many who can
afford it.
That may be the only good
news we can extract from the
dregs of the Schafnitz case.

A handful of state employees
picketed Tuesday outside
'Fairview Developmental Center
in Costa Mesa to protest the lack
of a pay raise in three years for
workers at state hospitals and
developmental centers. The
midday informational picket
along Harbor Boulevard at Fair
Drive was held by members of
the California Association of
Psychiatric Technicians and Cal-
ifornia State Employees Associa-
tion, which represents nurses,
clerical, administrative and se r-
vice employees.
Union members at eight facil-
ities statewide Tuesday voiced
their demands for a fair contract
with · a reasonable salary in-
crease.
State employees have not
received a cost-of-livmg salary
increase since a 3% hike in Jan-
uary 1995 and have worked
without a contract since July
1995.
Union negotiators want an
across-the-board pay raise, but
Gov. Pete Wilson has proposed a
pay-for-performance system in
which supervisors determine
pay raises for each employee.
