months of negotiations, the dis-
trict's non-tPdching unioh has set -
tled on a three-year contraC't with
school ofhc1als, providing a 1 2%
retroactive ptty mcrease
The contract also includes a
provision lhdt allows certain
employees to weRr shorts on the
job dunng the summer and a
corQprom1sc plan tor the trouble-
some issuP of scheduling noon-
time aides.
The union's previous contract
explred June 30, t 995, but was
extended dunng collective bar-
gaining, which began In October

force some customers
to kick the habit
of lost business quite as much as establislunents
without outdoor facilities. That's because
patrons will be allowed to smoke outside.
Mary Lovejoy, who manages the. Beach
Ball, a bar near the Newport Pier. said her
tavern isn't so lucky.
"H's bound to hurt business," Lovejoy
said. "We don't have anyplace where we
can build a patio here.

NEWPORT, BEACH -On
June 8, the residents of the
Bayshores Community Associa-
tion will decide whether to con-
tilme with their current leader-
ship or ·whether to wipe the slate
clean and start over.
The date has been set and the
proxy ballots will be sent off to the
assotjation's 249 homes within
the next two weeks. What began
as a debate between board mem-
t>er pbilo9ophies will now be set -
tled -for the first time in
Bayshores history.-by vote.
The June 8 recall election
could also, according to som e r!?s-
idents, set an interesting prece-
dent as far as problem-solving
techniques are con cerned . Got a
beef with ygur leadeBhip? Just
vote them oil.
"Say you've got a new board,·
said Teny ·Buckley, a Bayshores
resident who opposes the re.fall.
"If they make one unpopular
decision, it only takes 13 home-
owners to go for another recall.
"That's what everyone is really
concerned about. Why use this
process to begin with?•
The answer, says board m em-
ber Ayres Boyd, is to force neces-
sary change. Boyd., and fellow
board members Bill Messenger
and Martha Gooding are trying to
unseat association president
Bruce Swnner who, they claim,
has defied the community's wish·
es and damaged the association.
Much of the debate stems from
the board's decision to fire a popu-
lar maintenance .. worker, a move
which Sumner. sa}'5 wiU save the
association more than $20,000 per
year. The board's subsequent deci-
sion to hire a . different property
management association further
ruVid~ the minority from Sumner
and fellow board members Bob
Taube, Jim Cate and Gary Jaquess.
Following an April 10 hearing

in Orange County Superior
Court, the two sides ultimately
agreed to hold a recall election of
the entire seven-member board.
lfesidents can vote either by
proxy or on June 8 at a location
within the community.
Residents will vote on two sep-
arate questions.
1. Should the entire board be
recalled.
2. If yes, who should take over.
Residen~ were given. until 6 p.m.
Tuesday-to submit their names for
consideration. Taube, the board
secretary, refused to release the
names of those wno will seek office.
Sumner, a retired judge and
former assemblyman, has said he
doesn't think a recall will be pro-
ductive, but is Willing to hold the
election. He said he would not
submit his name for reelection if
the recall is su ccessful.
"If I'm recalled, then that's the
decision that has been made,"
said Swnner. "We're not talking
about the U.S. Senate here.•
Opponents of the recall have
noted the regularly-sCheduled
board election will take place in
September, three months after
the recall. That means the newly
elected board members might
end up serving for only three
months. ·
Boyd also said he will not sub-
mit his name to run again if the
recall passes, claiming that the
/minority members are seeking
:'new blood a&oss the board.
"The community would best
be served with entir~ly new faces
on the board," Boyd said. "We
continue to th.ink that way."

standards. And whenever these standards
are adopted, they are supposed to let the bar
owners know, and lhey would have two
years to install the technology, and then
smoking would be permitted in those busi·
nesses that have those air conwtioning units.
"r think it's very unfair, especially in a bar
that does not serve food. I can understand it
in restaurants because people should be
able to eat without people smoking nearby.
But they don't have to come in this bar. They
can go wherever they want to. And if they
want smoke-free bars, then why don't they
open up their own businesses."

Monahan said he's hopmg legislators
approve a new proposed Assembly bill,
whi ch would extend that grace period until
the year 2000.
"I've already sent a let1er to Sacramento
supporting (the bill)," Monahan said. ''The
bill is pro-business. 8drs and res,taurant
lounges are about the last place where
someone who smokes can still go.
Even some non-smokers say they believe
the law is unfair. John Lodwick and· Frank
Reuland, two non-smokers who stopped
into the Goat Hill Tavern for a beer on Tues-
day, said they don't mind walking into a
smoke-filled bar. In fact, they said they've
come to expect it.

'Random' vandals hit both Newport high schools DUI arrests

smash and destroy the windows of
five classroom s and one door,
according to police reports.
The damage was confined to
Dodge and Beek Hall, and no
property was missing at the ti.me
the police report was m ade.
"It looks like random vandal·
ism," said Harbor High principal
Bonnie Maspero, who added the
campus is accessible to outsiders.
"We don't know whether it's
someone young being malicious
or som eone who wants to convey
a message."
The other school that suffered
damage was Corona del Mar High
School at 2101 Eastbluff Drive.
Vandals there brok~ several win-
dows on buildings throughout the
school's campus and caused an
es~ted $1 ,000 worth of dam-
age, according to police reports. .
In addition to breaking wln{
dows, the culprits also broke th~
lights and globes in two class-
rooms and lights in a restroom,
according to police.
There are no suspects in the
two incidents and it is uncertain
whether they are related, accord-
ing to p<>lice.

Agency's redesignation of the
Santa Ana River flood p lain
means homeowners living along
the river will have their flood
insurance bills cut in hall.
And by April of 1998, officials say
residents will no longer have to pur-
ch8$e flood insurance of any kind.
The break comes as a result of
FEMA'i recognition that the Santa
Ana River Mainstream project has
substantially decreased the risk of
flood along the river. Federal,
state and local agencies have
spent an estimated $500 million
on flood plain improvements.
Since · J4nuary, Rep. Dana
Robrabacher, R-Huntington Beach,
has been lobbymg FEMA Director
· James Witt to recogruze the agree-
ment and redraw the National
Rood Insurance Rate Map to pass on the msurance saV1ngs.
This week, the congressman
learned his efforts had been suc-
cessful and the map would be
redrawn
"Orange County taxpayers have
mveSted hundreds of millions of
dollars in this project.• Rohrabach-
er, said in a prepared statement.
"It's time we receive some benefit
from our investment.·
A Rohrabacher aide said flood
insurance bills generally cost
between $500 and $600 annually.
