informal backyard barbecue to a
swanky party featuring some of the
biggest names in the California
Republican Party, the incumbents in
two local county Board of Supervi-
sors races spent election night Tues-
day in their own way.
Second District Supervisor Jim
Silva was at the Costa Mesa home
of a fri end watching early ballot
returns, while 5th District Supervi-
sor Tom Wilson baskeQ in early
results that showed him in the lead
at a Republican party at the Sutton
Place Hotel in Newport B:J11.

•Newport-Mesa city
leaders say county should
not have settled for $420
million after seeking $2
billion in lawsuit.

with a $420 million Orange Coun-
ty bankruptcy settlement with
Merrill Lynch & Co. Inc.
The agreement, announced
Tuesday at the Hyatt Regency
Irvine, ls about one-fifth of the $2
billion the county was seeking
from Merrill Lynch in a lawsuit
that was settled this week in U.S.
District Court, Los Angeles.
About $2 million of the settle-
ment, which concludes any action
by the county against Merrill
Lynch, will go to Newport Beach,
Costa Mesa and various local
agencies.
The lawsuit was filed after the
1994 collapse of the Orange
County investment pool, which
resulted in a $1 .6 billion bank-
ruptcy, the largest municipal
bankruptcy in U.S. history. About
200 cities, school districts and oth-
er agencies lost money in the
investment pool.
Newport Beach will receive
$1.5 million, leaving the aty's loss
from the bankruptcy at $1.8 mil-
lion. The Newport Beach Library
will get $3,278, with $3,595 still
outstanding.
Costa Mesa will get $282,996,
leaving it with a $310,376 loss.
The city's Redevelopment
Agency will get $55,824, with
$61,225 still outstanding.

: Council has taken its first look at
• the preliminary 1998-99 city bud-
get, a sn million spending plan
that is down slightly from last
year but maintains all city ser-
vices without dipping into
reserves.
The proposed budget unveiled
this week represents a 4 .1 % drop
from the $80.4 million spending
·plan the council adopted last.
. .year. It is set for final council
:.approval June 15.
' In his written summary to the
-council, City Manager Allan
Roeder said staff cuts in the early
, 1990s that eliminated 79 full-time
'J'.)ositions have helped Costa
Mes~ balance subsequent bud-
gets, including this year's prelirn-
'inary budget, without more cuts.
~ ·Not only did those reductions
•e.l.low the city to meet the expect-
ed state revenue impacts, but this
proactive direction positioned the
=city to balance its 1998-99 ... bud-
. get without further staffing reduc-

Wilson's proposal to refund mil-
lions of dollarS .in vehicle license
fees paid by California motorists.
Wilson bas proposed cutting
the state's vehicle license fee by
75% over the next five years, a
move that is understandably pop-
ular with taxpayers but not as
warmly welcomed by city lead-
ers, who have come to depend on
those funds .
Roeder sai(i if the cuts g6
through as planned, and the
funds are not replaced by the
state with other revenues, Costa
Mesa would lose abOut $4.3 mil-
lion a year that it receives from
the state vehicle license fees, a
7 % bit to the general fund.
"The annual impact on Costa
Mesa would be greater than the
combined loss of all other rev-
enues taken by the state this
deeade," Roeder said.
With those possible state take-
aways looming, Roeder has rec-
ommended continuing the city
hiring freeze that has been in
'place since 1991, until the •
impacts of any more cuts in state
funding can be determined.

have been arrested on suspi-
cion of rigging stolen cable
television boxes for resale,
police said Tuesdaf. ·~
Scott Darrell Vowell, 38, and
David John Greene,· 35, w.ere
arraigned Tuesday in Harbor
Municipal Court on two felony
counts of cable piracy and pos-
session of methamphetamine.
They are being held jn Orange
County Jail on $50,000 bail
each.
Armed with a search war-
rant, narcotics detectives went
to Vowell's home in the 2200
block of Republic Avenue on
Friday night looking for drugs.
What detectives said they did-
n't expect to find were about
150 so-called black boxes from
various cable TV providers.
Costa Mesa police Lt. Ron
Smith said it appears the two
suspects were reprogramming

cable TV boxes to allow access
to premium and pay channels.
•It's possible they were try-
ing to sell the boxes out of the
home for $200 to $300," Smith
said. "This was a fairly sophis-
ticated crime."
The recovered boxes are
being examined by Media
One, a local cable company.
Police believe the suspects
either bought the illegal prop-
erty or stole it from unoccupied
homes.
"Sometimes people don't
realize they had a deposit with
a cable provider and don't
return the box,• Smith said.
Police said they found about
4 grams of methamphetamine
and drug paraphernalia at
Vowell's home.
Vowell also was booked on
suspicion of resisting arrest and
assaulting a police officer after
he wrestled with an arresting
officer and tried to strike him,
Smith said. The officer suffered
minor cuts and abrasions.

Santa Ana man dies
in single-car crash
A Santa Ana man was ki1ledJn
a one-car accident early Tuesday
morning when his sister drove a
vehicle off the road and struck a
tree in Costa Mesa, police report-
ed.
Robert Geiger, 22, died instantly
when the 1992 black Honda Civic
he was .in plowed into a tree near
the 500 block of Anton Avenue at
about 2 a.m. Geiger, who was rid-
ing in the front passenger seat, suf-
fered massive internal injuries,
authorities said .
The driver of the vehicle, Susan
Ariston, 36, also of Santa Ana, was
arrested on suspicion of driving
under the influence. She was in
stable oondition at Western Med-
ical Center on Tuesday afternoon,
where she was being treated for
chest injuries .
Authorities said Ariston. was ·
traveling eastbound on Anton' dear
Sunflower Avenue when she
apparently lost control of the car.
Police said Ariston was driving
about 25 mph over the posted
speed limit when she approached
a gradual tum. Police officers at the
scene claimed they detected a faint
odor of alcohol from Ariston.
Although the right side of the
car was badly damaged, Ariston
managed to escape the wreckage
and call for help at her nearby res-
idence.

Missing Newport girl,
13, returns home
A 13-yea,-old Newport Beach
girl who recently was reported
missing by her family has returned
home, police said Tuesday.
Nicole Alexandra Foster's moth-
er told the Newport Beach Police
Department that her daughter had
been staying with some friends in
Laguna Beach. The teenager was
missing for less than 48 hours
when she returned home over the
weekend.
Ex-Newport employee
faces June 11 hearing
A pretrial hearing is scheduled
June 11 for a former Newport
Beach city building inspector
accused of possessing metham-
phetamine for sale.
Michael Allan Lamard, 40, of
Tustin, who was employed by the
city at the time of his arrest April
30, was charged with one felony
count of possession of drugs for
sale. U convicted, he faces up to
three years.in prison.
Narcotics detectives from the
Newport Beach Police Depart-
ment arrested Lamard in a park-
ing lot a t Bison Avenue and
MacArthur Boulevard while dri-
ving a city-owned vehicle and
dressed in an official uniform.
Police said they found about 7
grams of methamphetamine in
his possession.
Lamard, who worked in the
city's building department for 17
years, was placed on paid admin-
istrative leave after his arrest and
then resigned.
Court hearing delayed
for bombing suspects
A Juvenile Court bearing for two
teenage cousins accused of deto-
nating a homemade bomb at
Estancia High School in Costa
Mesa has been delayed two weeks.
The 17-year-old Newport
Beach residents, who were not
identified because they are
minors, were ordered by Orange
County Juvenile Court ·Commis-
sioner James Odriozola to return
to court June 19 for pretrial
moti(>ns.
The teenagers are accused of
possession and use of a bomb and
possession of bomb-making mate-
rials. U convicted, they face a max-
imuin of four years in the Califor-
nia Youth Authority.
The pair were arrested by Cos-·
ta Mesa police last month after
they drove away from an eiplo-
sion at a pay telephone on the
Estancia campus. Police believe
the youths were trying to steal
money from the phone's coin box.
One of the teenagers, a senlor
at i;stancia High, also is charged
with possession of morphine and a
prescription painkiller that was
found in his car.
Both suspects remain in cus·
tody at Orange County Juvenile
Hall.
Body surfer nearly
drowns off Newport
A 44-year-old body surfer
remains hospitalized after nearly
drowning in heavy surf off New-
port Beach, authorities said Tues-
day.
Robert Wiese of Rancho Palos
Verdes was knocked unconscious
about 8:20 a.m. Monday when he
was caught in the undercwrent
near 15th Street, lifeguards said.
He and a friend, Michael
Bautista, were each riding a 6-foot
wave when Wiese's head struck
the ocean floor. After Wiese was
pulled from the water, two
bystanders started cardiopul-
monary resuscitation and be
regained consciousness.
He was taken to the emergency
room at Hoag Hospital in Newport
Beach, but his family requested
that no information be released on
bis oondition.
There have been six drown-
ings at Orange County beaches
since April 8, the latest occurring
Sunday when an Anaheim man
died while snorkeling at Crystal
Cove State Park.

I 'm writing this a day before
the election, and you'll be
reading it a day after. So if I
make any predictiohs here, I'm
either going to look prescient or
stupid -and I'm not up to
chancing the latter. So instead,
I'd like to take a last look -
unW November, at least, thank
God -at the election mail
stuffed in my box over the past
few days.
If ever our civilization is dug
up after an asteroid or a popu-
lace armed with AK-47s (for
self-protection, of course)
destroys us, the unearthing of
cellular telephones, Beanie
Babies and election brochures
Will offer convincing evidence
that this surely was a civilization
ready for extermination.
The money being spent on
mostly mindless -and some-
. times vicious -television ads
and mailers is breathtaking. It
has created a cottage industry
that reduces election to public
office to a spending contest in.
which the most money wins
with alarming and growing fre-
quency. The public officials we
get as a result are far too often a
direct reflection of this system. I
call it The Michael Huffington
Syndrome in honor of the one
time it came alarmingly close,
but didn't work.
So to celebrate this regression
in representative government,
I'd like to offer the following
Bell Curve Awards for the June
1998 election mailers:
Most Embarrassing: Bill
Lockyer, Democratic candidate
for attorney general. Seems as
how Lockyer claimed an
endorsement in an earlier mailer
from Sen. Dianne Feinstein that

never was given, so he had to
spend a sizable piece of his
election funds for a last-minute
mailer to put the best face possi-
ble on an acknowledgement of
this mistake "due to a miscom-
munication ip my campaign for
which I accept full responsibili-
ty."
Most Irritating: The various
pieces from both parties and a
variety of special-interest groµps
that were identified as "Voter's
Guides" under such sterling and
righteous labels as "Taxpayers
for Responsible Planning." Each
mailer offered ~ whole slate of
endorsements with the dis-
claimer in small print -very
small print -that "appearance
in·this mailer is paid .for and
authorized by each candidate
and ballot measure." This al.so is
known as the Buy-An-Endorse-
ment-Plan -all in th~ interest,
of course, of an enlightened
electorate.

The mailers for the candidates
for Orange County sheriff. Paul
Walters' mailer is headed •Join
the Cops• and presents Walters
as "Law Enforcement's Choice."
His opponent. Mike Carona,
beads bis mailer: "E.ndorsed by
Our Police and Sheriffs." On the
one hand, we have: "Your
Orange County Deputy Sheriffs
have endorsed Paul Walters"
and on the other, a photograph
of the president of the California
Organization of Police and Sher-
iffs offering bis organization's ·
endorsement of Carona. I guess
the only conclUsion we can draw
is that we're covered both ways
in the law enforcement business
so we need to know their posi-
tions on abortion to make a
rational choice.
Most Confusing: John
Hedges, candidate for Orange
County supervisor. Vutually the
entire front page of his mailer is
taken up with a photograph of
three jovial good-old boys smok-
ing cigars and brandishing two
martinis and a Scotch against a
backdrop of $100 bills. It is not
clear whether this picture is
meant to suggest Larry Agran
and his pals or George Argyros
aod his pals. Or whether
Hedges is deploring these fel-
lows or suggesting we can all
have lots of booze, cigars and
money if we elect him to the
Board of Supervisors.
But enough about election
awards. We need to save some
space for a respectful and grate-
ful flyover to perhaps the last

completely honest politician:
Barry Goldwater. I was amused
by the pieties expressed about
Goldwater by the Orange Coun-
ty Republican hierarchy who
apparently haven't been listen-
ing to Goldwater in recent
years.
Goldwater was a true conser-
vative -in the highest sense of
that word. But along with his
strong views on the proper func-
tion of government, he held a
lifelong respect for sueh oppo-
nents as John Kennedy and
Hubert Humphrey and an enor-
mous sense of social justice that
increasingly_ brought down both
his wrath and eontempt on the
Republican far right.
Goldwater called Moral
Majority and similar religious-
fundamentalist political-action
groups "a divisive element that
could tear apart the very spirit
of our representative system if
they gain sufficient strength.·
He railed at the military for its
discrimination against homosex-
uals. And he called the New
Right •nuts for expecting from
conservatism some things that
no political philosophy could or
should deliver.•
Maybe the Orange County
Republican movers and shakers
might one day follow Goldwa-
ter's lead and find their way to
his kind of conservatism. Maybe
Tuesday's election will start a
move in that direction.

ed the largest proposal for a
c:ommerdal airport at the El To~
Marine Cotps Air Station, voting
4-1 to eliminate plan Das a pro-

members did not want to build

serving 33.5 million passengers

sented, saying he still was con-
cerned that removing the

Newport pediatrician dieS-at 48
Services are today for Dr.
Richard Tischler, a well-known
Newport Beach pediabician who
died Saturday. He was 48.
Dr. Tuchler, who practiced
medicine in Newport Beach for 20
years, had a card be gave to chil-
. dren that read, "Happiness is chil-
dren, sheep dogs and Dr. Tischler.•
"He was the doctor's doctor for
children,• said bis brother, Dr.
Alexander Tischler. ·The kids
would wake up and say, 'I'm sick. I
want to go see Dr. Tuchler.' "
Born in Detroit. Dr. 11schler
received his medical degree at
Wayne State University's School ot
Medicine in Detroit and completed
his residency at Los Angeles Chil-
dren's Hospital.
He is survived by his wife,
Shari; a son, Griffin, 6; a daughter,
Gabrielle, 3; and three brothers,
Alexander, Howard and Gerald. ,

litigation and so far have received

School "districts have received
about 95 cents of each dollar that
they lost in the bankruptcy and
will continue to get portions of
whatever future settlements are
reached between the county and
its defendants to make up the last

"I just think he's an honest

least 6, 174 California voters
pulled the lever for him.
·1 think it's absolutely fantas-
tic," Palitz said Tuesday night.
"Those are people who are going
out to vote for me, and I'm

such an honor to be a part of it

But despite those early absen-
tee ballot returns, Hedges' sup-
porters were upbeat as they chat-
ted in his living room.

Early summer season
opens with large
numbers of tuna landed
in local seas, indicating
possible banner season
for ·local anglers.
Big schools of albacore
moved into offshore waters
on Monday and sportboats
decked good numbers of longfins
in the eight-to 15-pound class.
There is a real good bite on
aJbies about 66 miles, 180
degrees, from Newport's twin
jetties.
On Monday, the ·Rising Star,•
running an open party out of
Davey's Locker, had 50 albacore
by noon and the deluxe six-pack
sportfisher "Bongos 11" had six
anglers who decked 27 fish.
"Th.is is a real early start to what
could be a great tuna season,·
Nonis Tapp said. Tapp is the
manager of fishing operations
at Davey's Loc1reT, which can be
reached at (714) 673-1434.
Water conditions are ideal,
with a few big swells and very
little wind. According to Captain
Kirt Reynolds, operator of the
"Rising Star/ the aJbies are
moving up the coast and should
be off the east end of San
Clemente Island by the
weekend.
