high school, usually on Friday
nights. And I may have even
ended up at a football game or
two, watching the lowly Long
Beach Wtlson Bruins on a two-
beer buzz.
Being 11, I never really wor-
ried about the consequences of
getting caught drunk at a school
event. Never thought it could
happen.
But somewhere in the bac)c of
my mind, I knew the repercus-
sions of drinking before a prep
football game and accepted
them. Zero tolerance wasn't in
vogue yet; a few days' suspen-
sion would have been the wrist-
slap penalty. Plus, my parents
would have added a month's
grounding. (lbe last thing Mom
and Dad would have done is
challenge in court whether I was
under the influence or if my
due-pfl)CeSS rights ~ere violated

stood them and would live with
them if imposed.
Which brings us to the recent
brouhaha over Newport-Mesa
Unified's tough zero tolerance
policy, which automatically
transfers first-time offenders
(either alcohol, drugs or
weapons) to another school for a
semester.
Recently caught in the zero-
tolerance web are an Estancia
basketball player and eight girls
from the same high school's soc-
cer team. The hoopster's father -
a judge -is challenging the
school's decision in court. hoping

least 12 more days.
The 17-year-old varsity vol-
leyball and basketball player
was suspended from Estancia
High School in June after she
ad.tpitted drinking beer before
a school dance and was trans-
ferred to Newport Harbor for
90 school days.
Superior Court Judge
Ronald C. Kline Thursday
denied a temporary restrain-
ing order, which would have
returned Jennifer, 17, to
Estancia until a formal hearing
Oct. 1.

incriminate him with the tape of a
telephone conversation he held
with his adopted daughter, the
prosecution continued its case
Thursday against Mark Schuster,
the Balboa Island resident and
former Corona del Mar High
School football coach charged
with sexual felony.
Under questioning from
Deputy District Attorney Claudia
Silbar, Newport Beach detective
Richard Schulz told the jwy bow
he arranged a ·covert call"
between the alleged victim and
her father on Sept. 18, 1995.
The 19-year-old daughter,
who claims Schuster demanded
sex from her as "payments" for
favors. tried to dupe him into con-
fessing while Schulz recorded the
exchange.
In the tape, played in. court
Thursday, the daughter told
Schuster she didn't want to make
any more •payments.•

came Schuster's recorded
response.
·1 don't like it,• she continued ·rm tired of it.·
Then, at Schulz's urging, the
daughter used the word ·~·-a
term she claims she never used
with her father to refer to the
alleged intercourse.
Schuster's response: "Uh,
what sex? ... I don't know what
you're talking about."
Later in the tape, he spoke ol
his relationship with a new girl-
friend, and told his daughter:
•Whatever you think you're run-
ning from, it's over ... The pres-
sure is off .. . I'm feeling good
about this relationship ... I'm not
gonna bug you ... I'm not sure
what you're pushing at."
After she referred to •pay-
ments• again. he said. ·1 didn't
realize you were having a prob-
lem with it because you initiated
a lot of things .. "

Jerry Kirk. 65, a pianist playing part
time for the Nordstrom store at South
Coast Plaza. He began learning piano at
the age of 1 and set his mind to becom-
ing a musician.
He earned a bachelor's degree in
piano at the University of Michigan and
a master's degree in choral conducting at
Azusa Pacific University. Today, he plays
for private parties, composes choral
music and directs music for a church in
West Covina.

Opera," "Annie" and "Carousel." Kirk
says he likes to emphasize his music on
upbeat, cheerful songs, such as "The
Sunny Side of the Street."
Kirk often comes up with his own
songs to play. He uses small cards with
song titles and the lead line once in a
while to remind himself what to play
next. You can't imagine how his mind
works because he'plays one song after
another, simply non-stop.
There are a hundred songs on his
mind and all are memorized. He has dif-
ferent ways to arrange what to play one
after another.
"I think about the chords I'm going to
play in the next song, different variations
I want to do as I go along, and how to
make it interesting," he said.
"If it's a moody kind of a song, you can
change the chords. You can play it in dif-
ferent styles."
Kirk also uses a series of songs with a . ' .
• you lose the enjoyment of it, or if it's bor-
ing to you, it's going to be boring to the
people -period," he SG.id. "I meet a lot of
interesting people here.
"I like this job because it's fun to do
because you get to relate with people."
The interesting people range from
local musicians to opera singers from
New York. One lady leaves him a small
piece of chocolate whenever she walks
by, just to show her appreciation of his
music.
Irritations include occasional fans who
sing along -in a wrong tune and beat.
Perks included receiving thanks for his
music from his regular listeners.

almost every Friday when I play here,"
Kirk said. "His wife would bring. him
down and he would stay in the wheel-
chair for two hours while his wife does
her shopping."
Kirk usually doesn't accept any mon-. . '
an exception.
"One time as I was playing, I had one

looked at me while I was playing," he
recalls, •and then he came up to me, and
he wanted me to take the $20 that he
had .. . he insisted on that because he . .
' music has done to me in the last 30 min-
utes."' ·
"Music is a wonderful thing," Kirk
says. "It does grAt things to people. It
brings ~ck memories to people ... l play
music that people enjoy that brings back
memories.·

Fans in Dodger Stadium last
·Friday night, however, were
anything but forgiving toward
umpire Gary Darling when he
. dubiously ruled as "sate• a St.
Louis Cardinals base runner.
In this case, the game did not
come down to a matter of inch-
es. The runner, in my opinion,
was out by a mile. ·
·Here, irrlhe top of the ninth
inning with no score during a
. critical game for the Los Ange-
les Dodgers, the home plate
umpire made a hugely contro-
versial call and defended it in
front of 36,000 irate fans, includ-
ing my husband, our three sons
and myself, deiponstrating that
an individual stands by nothing
so passionately as his own bad
Darling immediately assumed
the defensive umpire position:
back arched, jaw set, joints
rigid. He then proceeded to
throw out Dodger manager Bill
Russell and third baseman Tim
Wallach for disputing his call. I
might suggest he really wanted
to throw out the crowd.
We jeered and hissed and
acted as enraged as I have ever
witnessed Dodger fans to be.
We were not just protesting. We

The Normandin family was

bellowing out our 10th or so

looked up at me and shouted,
•Why are we doing this?"
•Because the umpire made a
bad call,• I yelled back over the
crowd.
The little pink-haired lady sit-
ting in front of us, who had been
up to this point primly penciling
in every play onto her program
box score, jumped up and
directed down to the umpire
several obscene Italian gestures
with her forearm. The insolent
mob was now chanting a two-
word phrase involving strong
PG-13 language.
It was at this moment that I
found myself feeling mildly

empathetic toward the umpire
in question. Hey, I guess I've
made a few bad calls lD my life
and I'm SUie u beck glad I did·
il't have to defend them to a sta-
dium of hostile witnesses.
There wu the time I insisted
my husband wear ~ coat and tie
to a dinner party at which the
other~ attending antved in
Reyn Spooner shirts and bennu-
da shorts. It wu a bad call. Or
the time I set my sister up with
my old boyfriend. A very bad ·
call.
We've all made at least a few
bad callsJn our life: initiated a
short cut th.at detoured to a dead
end, gone for a ride on a bad
stock hunch. After all, the right
to make a bad call is protected
by our constitution, isn't it1 And
with it comes the right to never
let other people forget the bad
calls they have made.
Do you think Tom Sel.leck's
agent ever lets him forget he
chose to tum down the original
role of Indiana Jones? Lucky for
us one man's bad call became
another man's destiny .
Consider that in 1876, the
president of Western Union,
which was at that time the
largest communications compa-
ny in America, rejected the
chance 'to acquire the exclusive
rights to Alexander Graham
Bell's invention of the telephone.

really help a student who has a
drinking problem? Would a
mandatory three-week intern-
ship at the county morgue look-
ing at the bodies of drunk dri-
ving victims have a more lasting
effect? Does the punishment fit
the c:rime, espedally for those
non-drinking students who
were merely in the presence of
alcohol? Swell topics for discus-
sion.
But the value of zero toler-
ance isn't the issue here. 1bat
should be debated in front of
the school board on a Tuesday
night The fact is zero tolerance
is the policy, and every single
student and parent knows
exactly what will happen if stu-
smoking dope: they get a 90-
school-day transfer.
My son, Taylor, is in second
grade. On the first day of school,
he brought home a flier that
spells out the zero tolerance
policy and we, as parents, had
to sign it and bring it back to the
teacher. That night, we talked
~th Taylor about never bring-
mg weapons (7-year-olds have
a variety of them; in Taylor's
arsenal are an Indian arrow and
stone hatchet) to school, even
just for show and tell, unless he
asked us first.
A simple contract between
the district and the parents and

thought zero tolerance was
fatally flawed, we would have
stepped in front of the school
board and asked for changes.

And then we try to find legal
loopholes: due process wasn't
followed or how did school otti-
dals know -short of a blood test
-that the student was actually
under the inOuencet
Most of us believe it's a solid
deterrent: drink at a school
event, say goodbye to your
school for a semester. There is
some empirical evidence to
back this up. For example,
before the crackdown, the
restroom trash cans at DaVidson
Field after football games were
filled with empty beer cans. But
no more.
Newport-Mesa students still
drink, sure, but zero tolerance
has at least helped keep stu-
dents from downing a few
before school events.
Maybe it's even saved a life
or two.
So why take the district to
court if your son or daughter has
admitted to having a beer
before the school dance? It's the
wrong n o ea · y u
break the school rules, try to
wiggle out of the punishment
with some legal maneuvers.
The better moral is this: there
are consequen ces for your
behavior. Everyone was really,
really clear on what would hap-
pen if you consume alcohol -
one beer or a six-pack -before
a school event. As tough as it
seems, now it's time to pay the
price.
If someone wants to change
the zero tolerance policy -or
the way it's enforced -please
outline a better way of dealing
with students who drink, and
rally the community behind
your cause.
Until then, the community -
not the courts -should decide if
zero tolerance and its enforce-
ment make sense.
