By Jennifer Armstrong, Daily Pilot
NEWPORT BEACH -The
City Council has voted once
again to shut down the city's only
nude restaurant by blocking its
entertainment and adult-oriented
business permits.
Arbitration Judge Lloyd Blan-
pied, Jr .. early this month upheld
the council's previous decision to
revoke The Mermaid's live enter-
tainment permit and not renew its
business permit. Without any dis-
cussion, the council Monday
approved enacting the judge's
reccommendation.
City officials halted the penruts
a few months ago, saying condi-
tions inside the club at 4248 Mar-
tin ale Wa violated ci r
tions and permit conditions.
For example, officials said ,
club dancers did not stay at least
6 feet away from patrons and took
tips from patrons. Officials also
charged the dancers touched oth-
er dancers and patrons and the
club did not provide the required
restroom attendant.
After city officials blocked the
permits, Mermaid owners An and
Olivia Nguyen appealed that
action to the council. The council
backed up the city staff's decision
The Nguyens then appealed to
the arbitration judge, whose rul-
ing the council could reject.

City histori~ ate a year late
I t seems everyone is celebrat-
ing this year as Newport
Beach's 90th birthday. Non-
sense. Last year, 1995,' was the
city's 90th birthday.
Ob, I'm aware that every
serious historian of this dty,
from Laney Sherman to Bill
Grundy, have said the city was
organized in 1906. Little do
they know.
When I was the city judge of
this city, I walked into the old
City Hall five days a week.
There, over the front door in
black letters 12 inches high, it
said, ·city Hall 1905."
That old City Hall was locat-
ed on the oceanfront just east of
the Newport Pier. It had been a
schoolhouse. The city bought it
for its city hall. At that time
they painted above the front
door, "City Hall. 1905."
You can't see something like
that on a da -to-da basis for
years and years without coming
to the conclusion it's right. So,
go ahead, the rest of you. Cele-
brate this town's 90th birthday
this year if you want to. The
trouble is, you're a year late.
The reason I went into that
old City Hall with such regular-
ity was that it hou~ed my court-
room. I was the city judge of
this fair city from 1937 to 1947,
excluding the World WM n
years. As the city j"'dge the city
furnished me a courtroom, a
large room in the City Hall that
was the City Council Chamber
one night a month. The rest of

the time it was the courtroom of
the dty judge. It was also the
site of other activities. Act4ally,
it was an all-purpose room that
I shared with others.
The so-called judicial bench
was an ancient oak desk on a
slightly raised platform in the
o e room. u y m
front of that desk was a large
table the council met one night
a month at. During the day,
however, it was a work table for'
some men from the county
assessor's office. The table was
inevitably littered with large
books the assessor's men pored
over, doing whatever county
assessor's men do.
Off to the right of the judicial
bench was a very noisy, clatter-
ing machine·operated by a girl
from the Water Department.
This machine sent out water
bills. Fortunately, it was out of
order much of the time as the
girl worked on it with a pair of
pliers and a screw driver.
To the left was a desk for a
man from the Department of
Motor Vehicles who adminis-
tered driver's license tests.
Behind my desk was the chart
for the eye test. nus resulted in
some confusion when some of
the drunks appearing before
me tried to pass the eye test
while being arraigned.
Off in the comer was a small
office that housed an ancient
oak desk, same vintage as my
"bench." In a drawer of that
desk was a bottle of whisky and
some paper cups. This was
what Frank Rinehart, city clerk
and unofficial city boss, called
his public relations office.
So, whatever your original
purpose in the so-called court-
room, whether to pay for a
your water bill ($3), get a dri-
ver's license (free) or complain
about your tax assessment (a
waste of time), you were
expected to drop by and have a
drink with Prank.
Now a city that made that
efficient use of space couldn't
have made a mistake about the
time it was organized. Obvious-
ly, the city was organized in
1905.
I rest my case.

Phillips, who used Borders as a
starting pitcher in 1994 and '95,
was fired by SCC President
Wayne Kraiss on May 8, 1995
because of "philosophical differ-
ences."
Kraiss called Phillips' signing
of Borders a "bold and positive
step" in a letter to the former
baseball coach, the same letter
that stipulated he should not
anticipate another contract.
In retrospect, the firing also
signaled the beginning of the end
for Borders and her career at
SCC. She pitched only 24 t/3
innings last season for the Costa
Mesa-based NAIA school, finish-
ing with a 5.18 earned-run aver-
age, pitching out of the bullpen.
"I told Ila she has every oppor-
tunity to be one of our starting
pitchers," Pigot said. "In fact, one
of our reasons for pursuing a
senior is for that player to come in
and be an impact player. If she
pitches only 20 innings, that's not
doing her, or us, any favors."
Whittier, which plays in the
Southern California Intercolle-
giate Athletic Conference, opens
practice Jan. 6. Its first game is
Jan. 29. Whittier will play at sec
on April 8 and host the Vanguards
April 29 in nonconference games.
Whittier, which graduated four
seniors from its pitching staff last
season, was 8-26-1 overall in
1996.

was lead-directing, n11king for the
lead of dummy's suit. Partner olilig·
cd, but J<~ost Rtumblrd al the very
first hurdle.
West led the queen of diamonds,
covered with the king and taken by
the ace. Catering t.o the posi;ibility
that. partner might also have the
nine, East returned the four of dia-
mondi;, which would establish a
CADILLAC 9040 FORD
long diamond no mat.ler who held
the nine. The operntion succeeded
but the patient. died.
Gi\tcn the preeent. er a diamond
trick, declarer reeled ofT eight tricks
in the black suits to bank nine
trick11 hr.fore the defcnctcr11 coulct
colloct five. A cont.rnct thnt should
have been defeated came home.
Roulh's bidding show<'d a bal-
anced hand of some 13-14 points.
Thus declarer could not hold ace·
king of spadet, king of hearts and
enough in clubs to run nine trickll.
Which of these cards does West
hold? It doesn't mnlter which card
declarer is ·miRRing, since North-
South canne>t. hove more than eight
ninning tricks. Count them.
To t.c11t which high-card partner
holds, East has a choice of 11ure-
trick lines. The defender can cnsh n
scconcl diamond and then shift t.o a
spade to see if partner signals for a
continuation. A11 the cards lie.
declarer will probably nm for home
with eight t.ric~!! to avoi~ going
spade in dummy and leads a third
diamond, West signals in heurt.s
and that i11 down two. Equally effec-
tive iR for East to 11aRh a third dia-
monrl right off the hnt ond await
instruction!! from pRrl.ner.
