That was the sarcastic con- tention by prosecutors handling the case against the 42-year-old Costa Mesa resident, charged with having unlawful sexual intercourse y.rith a teen'age girl who happened to be one of his former students. During closing arguments Wednesday, Deputy Dist. Atty. Matt Murphy said Vivanco, a for- mer assistant prinopal at Rancho Alamitos High School, must be one of the most unlucky people in the world. Not only did he have a string of former female students claiming he made sexu- al advances toward them dating ba,ck 15 years, but his timing was unfortunate when it came to th.is case. •1t took 13 years to find out he was having sex Wlth some of his students," Murphy said. .·And now, he's busted. UPTOWN AND DOWNTOWN Frank Gutierrez runs successful West Side businesses -Muebleria Vallarta arid Newport Custom Interiors -cater· ing to two different segments of the population. Muebleria Vallarta, a furniture and appliances store, caters to the local l..Qtino community, while Newport Cus· toin Interiors, a custom framing, iron-· works and furnitv.re store, caters to upscale Newport Beach clientele. The stores are right next door to each other on property Gutierrez owns on the comer of 19th Street and Placen- tia Avenue. One group of customers lives a life of necessity while the other lives a Ule of luxury. Some have $1,000 cars and oth- ers have $100,000 cars. Customers to Newport Custom Intenors are looking to decorate their million·dollar homes, while customers to Muebleria Vallarta are furnishing rental apartments that they might share with another family. Gutierrez is linked to one group through culture and ethnicity and the other group through education . IMMIGRANT ROOTS Gutierrez is accustomed to straddling two d.iff erent worlds. He grew up the child of Central Mexican immigrants to California's Coachella Valley, a farming community in Riverside County. Gutierrez later attended USC on a ·scholarship and graduated with a degree in business. As a student, he was interested in how business could help build communities -a novel notion. he admits. His upbringing and his education put him in a unique position. After graduating from USC, Gutier· rez shunned the corporate world and decided to venture out on his own. He opened Muebleria Vallarta in 1987. got to know his customers, he began to see there was a bridge linklng those two worlds. Many of his customers were the work force behind the businesses cater- ,ing to the up~cale community. They were the people who made the custom furniture, built custom frames and forged the custom ironworks . Newport Custom lntenors was fonded. Gutierrez antiapates that eventually he will make a total transition to his new business. He has even started branching out in oilier duectiofl5, act· ing as an agent to artists he has. met through hls custom franung business. •To be able to deal in two different worlds like this, you kind of have to grow up with it, he -5aid. • ·u you can't be successful in the community where you know the lan- guage and culture, how are you going to be successful outside that communi- . ty? • Gutierrez asked. Growing up in the Coachella Valley, he saw how it was possible for commu- nities, although geographically close, to be worlds apart. In his 17 years in Coachella, he never crossed the line into upscale Palm Desert. In fact, Gutierrez's business did evolve to serve the community. The greed and power grab of labor unions JS the driving force behind this bill, which creates substantial liability to employers and limited freedom to employ- ees. Labor uruons promote AB 60 as merely an eight-hour-day bill that includes flexibility for employers and employees. However, many provisions in the b11J contradict this claim. AB 60 requires a new one- size-fi ts-all mandate on employ- ers. The real reason is that unions want to bold on to this flexible work schedule as a bar- gaining tool for uruon negotia- tors. U everyone has the same opportunity, why belong to the union? Overall, AB 60 is an awful bill for both the small business employer, as well as the employee. The current system in California, and the rest of the nation for that matter, is a better and fair way to calculate over- time. As the voice of business, the Newport Harbor Area Chamber of Commerce urges everyone to write his or her legislator and encourage the defeat of Alf 60. Although AB 60 has passed through committee and is on the state Assembly floor, there may still be time to defeat it befoTe it gets to the governor's desk.
