Push cart ban called unfair
•City Councilwoman Libby
Cowan believes the move has
racial undertones. Othe~ say it's
just a matter of safety and noise.
By Susan Deemer, Daily Pilot
COSTA MESA -Critics of a new ordi-
nance banning llcensed and unlicensed
sidewalk vendors and pushcart operators
from residential areas believe the outright
ban unfairly targets the mostly Latino entre-
preneurs. ..,,,,
The ban, which would go into effect 30
days after it's officially adopted April 21, is
based on negative reports Crom both city
code enforcement officers and police offi-
cers. A similar ban was not approved in
1991. but stiff regulations were approved
that year.
Although initially it was noise problems
that prompted the oty to take action, city
officials say a threat to the public's health
and safety from unsanitary food prepara-
tion, trespassing and traffic hazards
prompted the ban.
Maria Alvarez 1s among those residents
who live in the Shalimar Drive area who say
they don't mind the noise as long as it is not
at night. Many residents depend on ven-
dors to bring them food, she said. Some
worry the ban will hurt individuals like ice
cream vendor Jose Estrada.
As the 58-year-old made his rounds
Tuesday aJong Shalimar Drive, his bell ring-
ing drew customets to frozen Bomb pops
and drumsticks. Estrada took the job not
only to make money, he said, but because
he likes the exercise he gets walking.
"The law is the law," Estrada said in bro-
ken English. "I will look for another job."
Nesto Bollnela, 40, came out to buy a
chocolate ice cream bar when he heard
Estrada ringing his bell inside· the courtyard
of his apartment complex.
•Basically the people that complain are
Caucasian," he said. "Those people (ven-
dors) ma.Ke something in order to live. To
work. We cannot complain about it and
even we buy the stuff sometimeS" to help
them.•
City Councilwomal! Llbby Cowan, the
lone council member who voted against the
ban Monday, said city officials failed to
prove the push cart operators pose a signif-
icant risk to residents.
"We have taken away another ability for
someone to make a living," Cowan said.
"We should be doing code enforcement."
But City Councilman Joe Erickson said
he supported the ban based in part on resi-
de}lts' complaints about noise.
Erickson, however, admits there is no
"bulletproof evidence" people will become
ill from the food.
"Push carts are like a telephone solici-
tor," he said. "They come into your neigh-
borhood, they make noise and leave trash."
City Code Enforcement Officer Sandra
Benson has reported numerous citations,
including incidents involving vendors who
sell cream cheese or other food prepared in
their kitchen sink or bathtub.
Additionally, vendors have been cited for
selling com on the cob, tamales and tortillas
prepared under unsafe conditions.
Benson's report showed that from July
1996 through February 1997, 38 citations
were issued to illegal pushcarts selling
items such as com, tamales and ice cream.
Another 24 citations were for those selling
flowers, cotton candy, strawberries and

But Tom Ahrens, supervising environ-

Michael Ober, a former New-
port Harbor High School and
Orange Coast College football
player, died Monday of skin
cancer in a central California
hospital. He was 49.
Mr. Ober came to Newport
Beach with his family in 1952.
He attended Newport Harbor
High, where he became a foot·
ball team standout, before grad-
uating in 1964. He continued
laying football as he went on to
attend Orange Coast College,
Whittier College and USC.
His local friends remember
him best for making the win-
ning touchdown in a critical
Newport Harbor game against·
Anaheim, his mother, Polly
Ober, said.
After graduating from col-
lege, he moved to Hawaii,
where he worked for 10 years.
An ordained minister, he
worked in real estate near San·
ta Barbara until he fell ill. He
and bis wife, Lynda, recently
celebrated their 24th wedding
anniversary at a Hawaiian·
themed party, his mothe~ said.
He died in an emergency
room near his home in Solvang.
"He'll be remembered as a
legend, a gutsy guy," his moth·
er said. •He sbould've died
months ago, but he made it this
far because of his strong con-
nection with God."
Mr. Ober is survived by his
wife; three children, Adena,
Michael Jr. and Caleb; his sister,
Patsee; and his mother.
Memorial services are sched-
uled for 11 a.m. Saturday at
Santa Ynez Valley Presbyterian
Church, 1825 Alamo Pintado,
Solvang. The family requests
that everyone attending wear
Hawaiian attire in his honor.

urday morning after h e allegedly
attacked an art instructor and cut
off his hair, police reported Tues-.
day.
Jeffrey Bender, a 32-yea.r-old
Los Angeles resident, was walking

McNeil of Huntington Beath

blinding him with the flash, said
Costa Mesa police Lt. Ron Smith.
McNeil reportedly punched
Bender in the face, knocking him
down. and began kicking him in
the face and head, Smith said.
The assailant then began cut-
ting oU Bender's hair with scissors

hairdresser. "
Police found five clumps of
black ha.tr on the ground, Smith
said.
Bender and McNeil are
acquaintances and the altercation
was reportedly provoked over a
mutual friend, Smith said.
Smith said Costa Mesa para-
medics attended to the instructor's
cut lip and other cuts and abra-
sions on his face. ·
McNeil was arrested and held
on $50,000 bail.
. OCC is pursuing disciplinary
actions for the student, said OCC
spokesperson Jim Carnett.

HAWKS ADD TO MESA WOES
• Laguna Hills slugs its way to
a 9-3 Pacific Coast League
baseball triumph, extending
Mustangs' losing streak to four.
By Barry Faulkner, Daily Pilot
COSTA MESA -One doesn't need to be
MIT material to figure the mathematics
behind the Costa Mesa High baseball
team's recent swoon, which continued Tues-
, day with a 9-3 loss to Pacific Coast League
' visitor Laguna Hills.
: "The last six games, our pitchers have
~ given up an average of nine runs,• Mesa
: Coach Doug Deats explained. •we're not
· going to score nine runs a game, so unless
something changes. we're going to be on
the wrong end of a lot of scores."
The Mustangs (6-7, 1-3 in league) have
now been on the wrong e nd of four straight,
including last week's Pride -of th~ Coast
Tournament.
But at least Deats' troops showed some
• lite at the plate, collecting nine hits off
senior right-hander Justin Stanfield, who I
went the distance, stn.king out eight. to
improve to 2-3.
•1 thought our approach against him was
pretty good early," said Deats, who watched
his team seize a 1-0 first-in.rung lead that
held up until the third.
Laguna Hills (6-7~1 . 3-0-1), got RBI sin-
gles from Cory Pardoe and Jared Novak to
reverse the one-run deficit in the third, then
blew things open behind Nick Harvey's
three-run home run in the fourth.
Mesa. which got two. hits apiece from
Layne DeTemple, Al Lambert and Alex
Marquez, scored a pair in the sixth on RBI
by Lambert and Rya.n Gallacher. But Stan-
. field, who fanned five straight at one point.
closed the door, getting the final two outs on
the Hawks' second double play.
"That's a good team," Deats said of the
Hawks, who should battle Aliso Niguel and
University for the PCL crown.
HBut to see Marquez get a couple hits
was encouraging, and I thought DeTemple
played a good ballgame today."
DeTemple, a senior, went 2 for 3 with a
double and bunt single, scored a run, made
a stellar catch on a foul pop while retreating
down the right-field Line from his second
base position. and also worked a scoreless
seventh from the mound.
•He's working his way in there," Deats
said of DeTemple's pitching effort, which
followed hard-luck starter Joe Jeffers
(three-plus innings) and Scott Smith.
"(Jeffers) didn't pitch badly," Deats said.
"But our guys aren't going to throw the ball
by anyone, so our plan the rest of the year is
not to let our pitchers go through the Lineup
more than twice."
Jeff Fischer added a two·run home r for
the visitors, who 'had eight of their nine
starters contribute to the 13-hit attack.
Ben Felter and Robbie Gloster singled to
open the game for Mesa and Felter, after
tagging and going to third on DeTemple's
Ily to center, scored on Julius Vasquez's
fielder's choice grounder.
