Noisy neighbor no longer, .

A 40-year lease s1gned in 1983 by
the Nederlander Organization and the
32nd District Agricultural Assn. called
for an 18,500-seat outdoor amphithe-
ater to be built at the Fairgrounds in
Costa Mesa. The Paalic Amphitheatre
,and its crosstown rival Irvine Meadows
were about to put Orange County on
the "popular music map.•
Frank Sinatra, Barry Maililow and
Guns N' Roses all played at the Costa
Mesa arena in its heyday.
But noise, traffic and parking prob-
lems related to the new facility brought
community protest -and eventually
lawsuits. Residents m the Mesa del
Mar and College Park n~ighborhoods ,
complained about the distµrt>ance from
concert noise.
In response to the suits, the courts
slapped strict noise restrictions on the
amphitheater on the west side .
Residents also viewed Nederlander
as a "bad neighbor'' as it cqntinued to
book concerts during the Orange
County Fair, creating traffic and park-·
ing problems. ·
Finally, after 10 years of lawsuits
and community •protest, a potential
.solution was fpund in the Fairgrounds'
purchase of the $12.5 million
amphitheater from Nederlander.
Fairgrounds officials intended to
stage events that did not exceed noise
restrictions or cause traffic problems.
But m October 1995, after two sea-
sons, and after renovations and repairs
and installation of a new custom-made
sound system to try to keep the sound
within the venue, the Fair Board of
Duectors declared the facility "use-
less" and closed it indehrutely.
The severe 9Z-decibel sound restric-
tions placed on the amphitheater at the
time eliminated many of the acts the
Fairgrounds could book. According to
Fairgrounds directors, a church service
could not be held within those guide·
lines.
As a result, the board of directors
claimed the origmal sale of the
amphitheater was a "white elephant•
and sued Nederlander, alleging fraud
and antitrust violabons.
At the time of the sale, Nederlan-
der's connections with other area con-
cert .arenas were believed by some to
be a reason to get rid of potential com-
pebtion from the Costa Mesa arena.

The amphitheater's pnmary func-
tion is as a storage unit.

Decisions about the amphitheater's
future -whether it gets bulldozed or
revamped -will be made based on
the entire 160-acre mttster plan for the
Fairgrounds.

amphitheater will not reopen.
And if it does reo.Pen, the stage,
chaU'S and amptutheatcr buildings will
all hav~. to be repla_ced. . .

evaluation through the planning

a commuruty asset and not a problem.•
The Nederlander Organization set-
tled out of court with the Fairgrounds
m 1998 for an undetermined amount;
however, lawsuits brought by the
amphitheater's neighbors have yet to
be settled.

The awards ceremony, which
begins at 11:30 a .m., will recogruze
those who have made sigruficant

Keith Davis. He was instrumental in
revising the city's massage and adult
entertainment ordinances that now
reqw.re a stringent application pro-
cedure. Davis also bas worked in the
patrol division and the special

when she started as a records tech-

Barger. A resident of Costa Mesa for
28 years, Barger has been a senior
volunteer for the Police Department
smce 1994. He has logged 2,225
hours at the West Side substation
where he has coordinated many of

• Reserve Officer of the Year -
Dan Guth. Hired in 1994, Guth came
from the ~~erton College Police
Academy. He has worked the maxi-
. mum number of hours as a reserve

award, named after the penal code
number for vehicle theft, is given to
the officer who works diligently to
recover stolen vehicles. Presented
by the Automobile Club of Southern

way Patrol, the award has a specific
set of criteria, all of which were met
by Casarez. ~t year he recovered
12 stolen vehicles worth $115,105
and made five arrests.

Authorities say a smoke detector may have
been responsible for saving two lives Monday
night dunng a fire in the East Bluff neighborhood.
No one was mjW'ed m the blaze that began
around 11:15 p .m. at a house in the 2000 block of
Avenida Chico. The homeowner, 51-year-old
Dave Peterson, and his 11 -year-old daughter
were awakened by the sowid of the blanng
smoke alann. The downstairs portion of the
house was consumed wtth smoke. Peterson
quickly called firefighters, who responded within
five minutes. ·
Firefighters believe the ongin of the fire was a
smoldenng cigar butt that fell onto a couch.
There was no ma1or damage to the structure,
although same contents were fouled hy the.smell
of smoke.
Authonbcs credit two smoke alarms inside the
home for the prompt r "ponse by both the home-
owner and fire crews.

they wera alerted Cdrly and able to escape with-
' out any h{lm1." said Lt. :John Blauer, community
relations offtcer for the Newport Beach Fire and
Marine Department. "There could have been
worse problems." '

O n June 27, Billy Iler was
removed from life support
systems after an
automobile accident which
occurred on a return trip from
Las Vegas. This tragic death was
a shocking and devastating blow
to lils hwidreds of fnends.
One year earlier, Billy was in
Davis at the Volleyball Festival
coaching the Ora'nge C.Ounty 17
White team. Back surgery and
extended demands from his job
at Comcast Cable forced Billy
into coaching retirement in
February or he would have been
in Davis coaching a team this
year.
As Gary Nakamura, Darryl
Gan and I sat stunned in the
dorm room at the University of
California at DaviS where the
Orange County Volleyball Club
stoys during this year's volleyball
festival, our thoughts ran in a
multitude of directions.
Obviously, the shock caused
by word of the death of a friend
who was so close to each of us,
was very heavy on our rrunds.
We also had to determine our
approach regarding the release
of the informabon to the club.
Billy bad coached one team in
January and his team from last
year was also mtact at the
tournament.
Our decision was to keep the
news from the players and
coaches until the end of the
tournament. That seemed to
keep things in an emotionally
stable position and we felt Billy
would have wanted it done that
way. Unfortunately, it was very
tough for Gary, Darryl and myself,
The first volleyball team I
ever coached was the Newport
Harbor High School junior varsity
team in 1975 and one of my
players was John Nguyen, a very
young freshman who had just
arrived in the United States from
Vietnam. His English was not
that good, but his heart and
desire for success were top of the
line. We became close fnends.
Ten years later John
approached me about his little
brother, Billy, playing for Balboa
Bay Volleyball Clubs. He told
me about this talented and
intelligent player who needed
some discipline. Billy became an
integral part of the Balboa Bay
Volleyball Club for the next
seven years. I coached the 1987
BBVC 14-and-under team that
swept every game in winmng the
Junior Olympics national
championship. This team
featured Steve Neidringhaus,
Ryan Foster, Matt Sherwood and
Billy, who played every position.
His athletic successes were
many, from helpmg lead Dan
Glenn's Newport Harbor team to

the ClF Finals as a freshman in
1988 (along with his older
brother, Mike) to guidmg Tom
Pestolesi's Irvine Valley College
team to the Junior College state
championship in 1993, Silly was
a "winner" who possessed the
charismatic ability to make all of
those who surrounded him into
winners. As ap outside hitter,
Billy led the University of Pacifit
men's volleyball team to its first
playoff berth in school history.
Everything that Billy did, he
did with a passion. He played
with passion, cared with passion,
worked with passion and won
with passion.
His loyalty to mends was
equally as successful. Even
greater was his unique
understanding of what it is really
all about
