uled to announce today that
two Costa Mesa students will
'be given scholarship opportu-
nities worth more than
$100,000 each, said a founda-
tion spokeswoman.

foundation's first foray into
Orange County.
"We know that Orange
County is a large area, and
Costa Mesa is where we chose
to start awar.ding our scholar-
ships here," said Jennifer

foundation.

unidentified swimmer was report-
ed to have died Tuesday night
after several beachgoers had
attempted to rescue him as he •
stJvggled to reach the shore with
his two friends.
The swimmer, believed to be a
32-year-old from Newport Beach,
· who was traming for his first ocean
swim as a triathlete, did not have
any vital signs when he was
brought into Hoag Hospital,
authorities said. Both paramedics
and a phys1oan who JUSt hap-
pened to be at the beach had per-
formed CPR while others at the
beach watched intently.
The drowning occurred at 7 :35
p.m. about 125 yards off shore of
the Corona del Mar State Beach.
. The friends were reportedly swim-

of them lagged behind near the
swimming line at the east portion
of the beach. The two friends
twned around and signaled to the
victim who responded. But
moments later, several observers
noticed the victim wave for help.

fee or other charge unless specifically

In the same article, Pat McGuinnis, the
Department of Education's assistant to
the general counsel said: "Stu de nts
re<;eive grades and credit for cheerlead:
ing, so any fee would violate the state's
law mapddting free education." ·
The· district contenQed they were well
. within theu»n ghts and pressed on.
However, shortly before bial ti) 1Q96,
the district -upon hearing some com-
ments made by the presiding judge -
settled with the Delaney family for
$50,000. Jackson settled her portion .of
the case with the Delaneys for an undis-
closed amount earlier that same year.
Her mother, Eileen, said that she and
her husband were •very proud of
Heatticr and hope very much that she
was able to help otlier children.•

lines the rules and regwations of the pro-
gram for the student, advisor, pnncipal .

H~ther Delaney, then 17, and her
parents, Philip and Eileen, of Costa Mesa,
filed a 78-page lawsuit in Orange County
Superior Court on Sept. 8, 1994 after
attempts to solve the problems through
alternative routes with the school and dis-
trict failed.
The case drew the attenbon of the
state Department of Education, the
American Civil Liberties Union and the
national press corps.
The lawsuit stemmed from months of
complaints from the Delaney family after

Sons proposed building a 48,000-
square-foot addition to the south side
of the Robll1Sons-May store at South
Coast Plaza. The bctsement and first
floor will be enlarged. Any parking
lost to the addition will be made up by
the demolition of the old Benrugan's
building, according to staff reports.

signs in the public right-of-way based
on content was unconstitutional. The
council adopted an ordinance that
. complied with that finding by elimi~
nating criteria for signs that were
based on content in 30 days, portable
signs will be allowed to be displayed
only between 6 a.m. Friday to 6 p.m.
Sunday in public right-of-ways,
excluding street medians, tight posts,
utility poles or other structures. Other
signs such as balloon signs, inflatable
signs or other signs with moving
parts, flashing lights or that could be
considered dangerous will be prohib-
ited. Anyone wanting to c:ti.splay polit-
ic ical campaign signs will be required
to file statements with the city and
have them removed no· more than 10

posed that the council take a look at
its appeal procedure in an effort to
streamline the process wtuch is some-
times time-consuming and costly for

council members who want to review
d ecisions by staff or lesser governing
bodies an option to call a matte r up
before the council rather than the
Planning Commission. For example,
if a council member ts calling up a
zoning administrator's decision for'
review, rather than have it go to the
Planrung Conunission, the council
member bas the option of having the
item come directly to the council.

SUMMAR~ The council bas been
exploring conducting a study into the
logistics of moving the Civic Center to
the Pacific Savings Plaza on the cor-
ner of Newport Boulevard and 19th
Street. Vanguard Uruversity
expressed dD mterest m expanding its
campus onto the Civic Center. Also, a
space study of the Pohce Department
found that it would need to be
expanded by about 26,000 feet at the
cost of $12 million at its current loca-
tion. The cost to construct a station
from scratch would be about $19 mil-
lion Letters were sent to Plaza owner
Nickolas Shammas asking ..him if he
would consider selling the property at

mas said that he is currently in nego-
tiations for the property in the $20

This one began at 7:45 Sun-
day morning when the pager on
the night table dragged me out
ol an especially deep sleep with
its oJfensive, three-note shneK.
The machme blared four
more times before 1 could grab
it, struggle out of bed. stumble
to the kitchen where my read-
, ing glasses were, tty to remem-
ber which button activates the
message, focus on the little win-
·dow and try and read the words
. that wer~. for a few more
moments, JUSt a bleary mass.
I knew what it would say:
"VRT CALL DISPATCH." Tllft
meant the Shenff's Victun
Response Team on call was to
phone in for details and location
of an incident for which we
were needed,

dered away from a campsite on
the Poudre River, about 15
miles from downtown Fort
Collins. He was last seen about
8:30 Saturday night, meaning
he had been missing some 12
hours by the time my partner on
this 6 a.m. to 6 p m . shift, Kathy
Mills, and I began head.mg out
of town and up into the moun-
tains.
We had been told that
Lanmer County Search and
Rescue was out in force, along
with several deputies, heli-
copters, tracking dogs, a dlve
team and part of the shenff's
mounted posse.
I couldn't resist contrasting
the two searches.
Two thousaqd miles dway,
the Coast Guard, the Navy,
the FAA, the NTSB, NOAA
the sta!.e police and local con-

searching hundreds of square

same age as John Kennedy. But
our guy was hardly a JFK idol
type. Indeed, he seemed to be a
floater, a gypsy of sorts.
Our victim advocate team
had been called out to·ensure
that the man's wife -we'll call
her Alice, him Ted -received
whatever care she neeaed to
get through the ordeal.
Ted was 37 and legally blind,
Alice told us. He~also had high
blood pressure, a bad heart and
W'as mildly epileptic. She told
us he had served prison time for
murder when in his late teens
{not so. it turned out). He had a
tattoo of a dagger on his left
forearm and a cobra on his
nght. Above the snake was a
white supremacy symbol.
The campsite and tent were
awash in stuff: Clothes, bed-
ding, food, canvas luggage and
a huge trash bag ~~l of empty
beer cans. .
Alice said Ted had a}?out
thr~ beers the evening before.
Her cousin and his wile had
quaffed the rest of an Old Mil·
waukoe 12-pack. The two cou-
ples had been travelin9 the ·
west for several months, stuffed
into a big, early '80s GM sedan.
Kathy and I spent most of the
mommg µying lo de-trash the ·
campsite and energize a pitiful
JJttle fire so we could heat some
wdter for coffee Both were los-
ing battles
The head of the Search and•
Rescue team checked with us
every 45 .nunutes or so to report
what was going on. 'Basiqilly, it

sightings.
By late morning, Kathy and I
agreed that we needed to work
up alternative plans for Abee
that night 1f her husband was -
found dead, or if he was still
missing. To make the necessary
calls, I had to drive 11 serpen-
tine tniles back to where my
cell phone would work.
When I returned to the
campsite about an hour later,
the news was good: The cous10
and his Wife had found Ted m
the parking lot of a gas station
in Fort Collins.
He became ticked off,·he
said, because Allee was on h.is
case for drinking. So he, legally
blind, decided to walk the 15
miles to town. DO\.\'ll a curvy
mountam road In the dark.
So there it 1s. Two men, both
lost. One With a bound.Jess
future, the other with hardly
any And the efforts to find
them were equally intense.

Rowdy Yo hails from Mesa, Ariz. His
real name is Gary Noel and he's a sec-
ond-genera tion dog act owner who's
been perf omung for nearly 21 ye ars.
H e and his padner, whose real name
is Giovanna Cardella, said they have
enjoyed their time at the Fair. Cardella
said she" enjoys puUing on the perfor-
mances for the kids.
