SANTA ANA -As firull argu-
ments closed Monday in the penal-
ty phase of John Joseph Famalaro's
murder trial, one key figure was
both omnipresent and conspicu-
ouslyabsent.
Ann Pamalaro, the 71 -year-old
mother of the con-
fatally bludgeoning 23-year-old
Denise Huber after he abducted
her from the Corona del Mar Free-
way in Coste Mesa. where her car
ble\v a tire late one night in June
1991.
Despite a massive manhunt and
publicity campaign, Huber was
missing for three years until police
found her nude, gagged, hand-
cuffed body in a
victed killer, did
not appear in
Orange County
Superior Court as
she has throughout
the trial, sitting
apart and alone.

Defender Denise Gragg. "Sh e was
an actively destructive fo rce .... She
was crazy.•
The 39-year-old defendant, a
former house painter, was found
guilty last month of raping and
•
cult life in some respects," but
warned the jury not to let him
•steal the compassion that is the
victim's just due.•
"Sympathy is a great thing,"
Evans said. "(But) when you look at
the enormity of this crime, ladies
and gentlemen, you have to ask
yourself, 'Has be used up his sym-
pathy?'"
Walking the jury through the
details of the crime, Evans added,
"Does our sympathy extend to him
stuffing a rag in her mouth? Does
our sympathy keep going when he
puts bags over her head?•
Evans described Famalaro's life
as one of squandered opportuni-
ties, and pointed to his handcuffing
of two ex-girlfriends as signs of •an
escalating pattern" of sexual vio-
lence.
Evans said it was ironic defense
attorneys should plead · for
Famalaro's life when he showed no
regard for the life of Denise Huber,
a UCI graduate and Newport
Beach resident.

Attempting to paint a more sym-
pathetic picture oft her client,
Gragg catalogued the afflictions of
Famalaro's childhood. She
described him as a sickly child,
bedridden and weak, who lived in
constant fear of bis mother and suf-
fered "the agony of knowing he
was not normal."
Gragg silld showing sympathy
for Pamalaro did not mean forgiv-
ing him and showing him compas-
sion did not preclude compassion
for Huber and her family.
"Compassion is like love,• she
said. "It is not finite."

"The people were really grateful, because the
water is so cold there tha't you don't have long (to
live)," said Mcintosh's wife, Kathleen, who had just
returned from Alaska to Corona del Mar at the tune
of the incident

COSTA MESA -City Council
members approved a 1997-98
budget of $73.8 million Monday
night, down 15% or $12.9 million
from last year's overall budget.
Included in those budget cuts
was a plan to replace police offi -
cers with reserve officers in the
department's Drug Awareness
Resistance Education program.
And council members say they
hope to squeeze enough money
out of the budget to give them-
selves a raise. .
Although the bulk of the
decreased budget can be attrib·
uted to the capital improvements
budget being nearly 70% lower
than last year, the city's day-to·
day operating budget also
dropped 3.5%.

"I am onJy one person," said
Courtney McNutt. "I can't do il
au. but I am striving to let people
know thdt an accident that hap-
pened to my son could happen
to them really ~asily."
In Costa Mesa, the Communi-
ty SeTVJces Department already
has plans to spend $90,000 to
replace tot lot equipment at
Wimbledon and Mesa Verde
parks and $52,000 to replace tot
"lot equipment at Balearic Com-
munity Center. However,
McNutt believes the equipment
at TeWink.1e and Mesa Verde
parks should also be inspected
or updated
Ryon, now 5, slipped off a
rung of a metaJ ladder on play-
ground equipment at Chris Carr
Park when he was JUSt 2 years
old. His parents say he has been
traumatized by the accident and
may be permanently disabled.
The McNutts are sUing the
city of Huntington Beach and
the manufacturer of the play-
ground equipment, Miracle
Recreation Equipment. The city
since has replaced the equip-
ment.
•We both lost our jobs due to
the impending lawsuit,~ McNutt
said. "(Our employers) didn't
want to give us time off."
McNult said at least two local
schools -Killybrooke and Col-
lege Park elementaries
agreed to distribute McNutt's fU-
er to parents before summer
break.
McNutt said most people
assume park equipment is safe,
but some playgrounds are 25 to
30 years old.
"Parents should take their
children to newer parks because
some of these parks are an acci-
dent waiting to happen,"

co unterfeit sunglasses
Three vendors were arrested at
the Orange Coast CoUege Swap
Meet on Saturday on suspicion of
selling counterfeit reproductions
of licensed sunglasses.
Costa Mesa police, worlong
with dgents from the Oakley and
Ray-Ban sunglasses companies,
conducted a sweep of the swap
mee t at 2701 Fairview Road in
hopes of nabbing hawkers of the
counterfeit products.
Sara Ramirez Vilchis, 24, of
Huntington Beach; Maria Elaina
Ibrahim Espinoza, 25, of Westmin-
ster; and Gabriel Onyekwere
Ochuba, 37, of Los Angeles
were cited on misdemeanor
charges and released at the scene,
said Costa Mesa police Lt. Ron
Smith.

but ignored the warnings, said

McNutt said the ladder steps
his son slipped on were 12 inch-
es apart but should have been
only 10. The steps also were
heavily worn, rusty, and there
was an indentation on it that
wasn't noticeable until you
looked underneath it. The ladder
was installed at the park in 1972.
Ryon is now afraid of hospi-
tals, after undergoing four
painful examinations doctors
performed to check for nerve
damage, his father said. McNutt
said his son will have to have
another checkup when he is 7
and again when he hits puberty.
"It's going to be a long time
before we know for sure,•
McNutt said. "There's nerve
damage ... it's been two and a
hall years since the accident,
and he is incontinent, and there's
a potential of him being impo-
tent."

Cashier foils gurunan 's
robbery attempt
An armed gurunan ran off emp-
ty-handed early Sunday morning
after trying to rob a cashier at the
drive-through window of a fast-
food restaurant.
Around 3 a .m., the gunman
walked UJ? !P the window at the
Jack-in-the'Box in the 2200 block
of Harbor Boulevard, pulled a
chrome revolver from bis jacket
and pointed it at the cashier, said
Costa Mesa police Lt. Ron Smith.
The cashier slanuned down the
window, ran inside and called
police, and the gunman fled on
fool, Smith said.
Smith said nothing was stolen
and no one was injured.
The suspect is desaibed as a
male Latino between 25 and 30
years old, 6 feet tall, about 190
pounds, with brown hair and
brown eyes. He wore a mustache,
goatee and brown ski jacket with a
hood.

Demise of Da Vmci
program greatly
exaggerated

Despite fear and confusion to
the contrary, Newport Harbor's Da
Vinci program is not at risk of los-
ing its state grant funding.
Da Vinci, a four-year high
school uschool-to-work" academy
that began at Newport Harbor two
years ago, integrates math, sci-
ence, history and English for 100
students a t each grade level and
provides juniors with a mentor and
seniors with work experience.
Some parents fear if the Orange
Courity Board of Education votes
not to act as a fiscal distributor of
those funds anymore, it may be dif-
ficult or impossible for the school to
access those grants.
HFor people like me who have
been on grant-writing teams, if it
will prevent funds, we're going to
get excited about it," said parent
Diana Long. "(The county) is the
clearinghouse. They are the
receiver and distributor of those
funds .... I wasn't sure who else that
would be."
County education trustees said
if there ever would be a vote on the
issue of ending fiscal authority for
school-to-work funds, it would not
occur anytime soon.
The program receives $260,000
over four years from a Specialized
Secondary Program state grant
and starting next year will receive
$84,000 annually from a California
Partnership Academy grant, said
Scott Dukes, coordinator of the
program and a physics teacher at
Newport Harbor.
The partnership grant requires
a school-to-work component that
includes mentors and work experi-
ence for upperclassmen and also
requires that 25% of the students
in the program have special learn-
ing, economic or language needs.
Only the partnership money is
channeled through the county
educabon deparbnent, said Eliza-
beth Parker, a county department
trustee.
Newport Harbor receives
$3,000 in federal school-to-work,
or "Vision 2020" funding that
comes through the county, but
Dukes said Da Vmci has not bene-
fited from any of that money.
However, Da Vmci could talc
advantage of future VJ.Sion 202
f\mds as they became available,
Parker said.
Parker said some of her col-
leagues may attempt to stop acting
as a fiscal agent for federal and
state school-to-work funding
because a group of parents oppose
those kinds of programs.
Parker said a group of parents
who favor home schooling and pri-
vate schools spoke out against
school-to-work at recent county
education board meetings.
Ken Williams, a trustee for the
county education department, said
he supported vocational programs
that were afterschool and did not
interfere with core ctuTiculum, but
that he opposed federal school-to-
work mandates.
"Basically, school-to-work is not
about academic instruction. It's
about diluting academic instruc-
tion," Williams said. "It's more
about taking local control and pre-
empting local officials about mak-
ing decisions affecting them."
Williams said businesses control
Vision 2020 funds instead of e lect-
ed leaders and that the grants did
not cover everything that schools
accepting the money would be
required to do.
"The school-to-work will be
another unfunded mandate upon
the Newport-Mesa Unified School
District," he said
Williams said he would not
attempt to end the county's role as
a fiscal agent for school-to-work
federal funds until he thought he
had enough votes to do so.
Williams also said he thought
the Da Vmci program was a "won-
derful program.•
Wendy Leece, a trustee for the
Newport-Mesa Unified School Dis-
trict, said she opposed school-to-
work and VJSion 2020 programs
because she feels like it places too
much emphasis on career and
labor skills and takes away from
fundamental academic skills.
However, Leece said she wasn't
sure whether or not Da Vind fell
into that same category and that
she wanted the school board to
review the program.

• Baker Street: Five packs of cigarettes worth S 11.25 were stolen from a
convenience store in the 1000 block

from an unlocked car parked in the 1500 block.
• Cecil Place: A backpack, camping equipment, cash and other property
worth SSOO were stolen from a car parked in the 100 block. The window

purse in the 200 blQCk.

• Windsor Court: S2,600 in S 100 bills were stolen from a freezer inside a
residence. There was no sign of forced entry.
• West Coast Highway: Five palms and other miscellaneous plants that
were soon to be planted, valued at $2,350. were stolen from behind a
building in the 3300 block.
• Superior Avenue: A stereo, speakers, spare tire, key card and floor mats
valued at S650 were stolen from an car in the 1400 block. A door was pried
open.

3800 block. There was no sign of forced entry.

Section baseball selections.
Urban and Harper were
named to the second team in
Division HI and rnvision IV,
respectively, while Calvary
Chapel High standouts Randy
Blood and John Tucker. both Cos-
ta Mesa residents, were first-team
picks in D1V1Sion V.
Urban, whose four-year career
included a district-record 20
home runs, hit .392 with eight
homers and 26 RBI for the Sailors
this spring, while also posting a
4-2 pitching record with two
saves and 28 strikeouts in 31
innings.
It's the fust All-CIF distinction
afforded Urban in baseball,
though he was a first-team All-
CIF Division V football honoree in
football last fall.
Urban, an Orange County All-
Star who wiU continue on the dia-
mond at Rancho Santiago Col-
lege, was a four-lune dl.1-clistrict
selecllon who was three times
named All-Sea View League He
played first base, thlrd base and
shortstop . in adclition to his pitch-
ing dubes.
Harper, a sophomore first
baseman who also pitched for the

baseball season, all-tar seniors from
four leagues in Orange County,
including the Sea View and Pacific
Coast, squered off tn the inaugural
South County Showcase of Players Otl
Saturday at Windrow Park.
Danny Pulido (Sea View) was called
for batter interference in the bottom of
the ninth inning to end the game m
controversial fashion.
With two out in the ninth and a Sea
View runner (Irvine's Ryan Brucker)
trying for third on the front eod of an
attempted double steal, batter inter-
ference was called by the home plate
umpire, ending the game abruptly,
according to coaches.

the catcher tried to make a throw on
the play,• Newport Harbor Coach Jim
Kiefer said. •rt didn't look that way to
me. (Brucker) had a good Jump, and
we had been running all night •
