.• Coldwell ·Banker senior
vice president Charles
Johnson also accused of
tax violations by federal
grand jury.
By Christopher Goffard, Dalt Piiot
Orange County business
leader and Balboa Island resi-
dent Charles Johnson bas been
indicted by a fedetal grand Jury
on S5 counts of financial fraud
and tax violations, authorities
,said.
In an indictment Wed last
Wednesday in federal court in
Pittsburgh, Johnson was
accused of Wing false state-
ments and fraudulently transfer-
Jin{J and concealing assets in
connection with the bankrupt-
cies of tbJee companies he ran
from 1991 to 1995, said Christine
Dibartolo, spokeswoman for the
Department of Justice in Wash-
ington, D.C.
Johnson also stands accused
of filing false statements during
a personal bankruptcy in 1996,
of committing bank fraud, and of
failing to account for employee
withholding taxes, Dibartolo
said.
Johnson, who works as senior
vice president and Orange
County regional manager for
Coldwell Banker, could not be
reached for comment.
Company spokeswoman Alex
Kent said, "At this point in time
Mr. Johnson has been put on
administrative leave, and we're
looking into the situation."
Dibartolo said the alleged
bankruptcy fraud began with
Johnson's involvement with
Doerr Brothers Inc., a bankrupt
Pittsburgh-based truck body
fabrication company he took
over in 1991. Johnson used the
collapsed company's assets to
open Johnson Fabricating,
which went bankrupt in 1993,
and in turn spawned Johnson
Industries, which went bankrupt
in 1995, she said.
While he operated Johnson
Industries, he allegedly used
fraudulent documents in con-
nection with a defense contract,
Dibartolo said.

proven guilty.•
Dibartolo said Johnson has
not been arrested, and a trial
date has not yet been set. Thirty-
four of the counts carry a maxi-
mum 5-yea.r prison term, with a
$250,000 fine, while the bank-
fraud allegation could draw a
30-year term with a $1-million
fine.
The indictment stemmed
from an investigation by the
Bankruptcy 'IUk Force, which
comprises the U.S. Attorney'•
Office, the PBI and the IRS
Criminal Investigative Division,
Dibartolo said.

general campaign to Balboa Bay Club; d~ends
prosecution of Huntington Beach assemblyman.
MARINERS MILB -Coun-
ty Diltrict Attorney Mike
Capizzi, gunning for the Attor-
ney General's office in 1998,
said the state needs quicker
eieCUtions on Death Row and
a tougher stance against politi-
cal corruption u he brought
his early campalgn message
Tuesday to the Chamber of
Commerce.
A bout 50 buslnesspeoplee
gathered at the Balboa Bay
Club to hear 'the man behind
the county's recent $30 million
settlement with Merrill Lynch
and the prosecution of Assem-
blyman Scott Baugh on cam-
paign fraud charges.
In bis speech, he defended
the Merrill Lynch settlement,
explaining that the county
could have collected a maxi-
mum fine of SCO million if the
case went to court. Capizzi
struck a $30 million deal with
the brokerage whose execu-
tives played a role in the coun-
ty's bankruptcy.
"That would be a three-to
four-year trial and an uncertain
result,• he said.
Capizzi, who started his law
career in an office at 18th
Street and Newport Boulevard,
told the audience that public
safety should be government's
highest priority.
•For a county of our size, we
have a very low crime rate -
and I'd like to take no small
part of the credit because of
our work in the District Attor-
ney's office," he said.
U he's elected to the state
office, he said, he'd work to

said it costs

year to keep

on Death
Row.
He also
said he
might pro-
pose doing
away with
unanimous verdicts in non-
death penalty criminal cases
and requiring only a 10-2 vote
to convict. "And we need to
have an empty jail cell ready so
those how feel like violating
the law know there's a place
for them,• he said.
He also stressed dedication
to keeping politics clean.
"I feel very, very strongly
that the cornerstone of democ-
racy is a fair political playing
field,• Capizzi said. • U we
allow that to crumble, all of the
things we hold so dear are
going to crumble.•
He hinted at the flak he took
from fellow Republicans when
he prosecuted Baugh on
charges that he was behind
putting a decoy Democratic
candidate up for election.
"Some feel that since I'm a
Republican, I should look the
other way when Republicans
violate the law,• he said. "The
criticism should be directed
toward those who behaved in
an unseemly manner.•

moved to new quarters from its
site adjacent to the nature center,
leaving the district with an attrac-

from the community, the gully was
turned into a long, narrow, wan-

reproduood.
ln the beginning, it was used as
an adjunct to high school science
classes, but over the years its focus

along with hundreds of local citi-

street in the winding paths and
picnic tables scattered about the

•Costa Mesa girls water polo
program, one of the school's best
already, gets a new coach for '97.
By Richard Dunn, Daily Pilot
COSTA MESA -Aquatics veteran Scott
Ferry, Costa Mesa Higb's boys swim coach
and a local beach lifeguard, was named Tues-
day u the school's bead girls water polo
coach, athletic director Jerry Howell con-
firmed.
Feny, who takes over Costa Mesa's second-
most successful girls athletic program in terms
of wins and losses during the 1996-97 school
year, will reportedly replace Crystal Whitmore
for one year.
Whitmore, the Mustangs' coach the first
two years of the program's existence, includ-
ing last season's postseason effort, is expected
to return the following season.
Whitmore, also Costa Mesa's girls swim
coach, will be working on her teaching cre-
dential during her hiatus.
Last season, the Mustangs finished 12-13
overall, including two wins in a post.season
tournament designed to determine an unoffi-
cial CIF Southern Section champion. A playoff
format for girls water polo in the section is still
in the development stages.
Of Mesa's nine girls athletic teams, only
two -water polo and Coach Shontel Sher-
wood's basketball team -ended with victories
in double figures, with the perennially suc-
cessful hoops team leading the way.
In the past 13 months, girls water polo has
graduated from a club activity to a CIF-sanc-
tioned winter sport.
"Girls water polo will explode,• Howell
predicted. •1t will be equal to boys water polo
within a year (in student participation).
There's probably a bigger interest in it now
than a year ago.•
Ferry, an Edison High and UC Santa Bar-
bara graduate, will take over a Mesa program
that returns first-team All-Pacific Coast
League performers Cari Howse (a converted
basketball player) and goalkeeper Stephanie
Lombardo.
Howse will be a senior this fall, Lombardo
a junior.
In 1996, Katie Grogan was Mesa's first prep
All-American in girls water polo, before
breaking scoring records last season as a
freshman at University of Massachusetts.
Costa Mesa's boys water polo program bas
won four CIF Southern Section champi-
onships.
Howell said the timing of girls water polo is
perfect, allowing springtime swimmers to con-
tinue to swim in the winter.

The Heat, a silver team from the
South Coast Soccer Club, opened
its 1997 season with a third place
finish the Wolfpack Invitational
going 2-1-1.
The third place match pitted
the Heat against last season's
arch rival, the Wolfpack Blue.
The Heat lived up to its name as
the squad caught fire early in the
match when Billy Lund scored o1f
of a comer kick from Chris
Crockett. Greg Perrine followed
with a goal to &ake the score 2-0
before halftime. Danny Krikorian,
Zach Powell and Scott Wade kept
pressure on their opponents the
entire game, while the Heat's
defense, paced by Ryan Denman,
Brian King, Ralph Morgan.
Devon Stephens, Steven Thomas,
Matt Willis and goalkeeper Louis
Day held the Blue to just one goal
for the 2-1 win.
In other action over the week-
end, Michael Gardiner and Per-
rine notched goals in a 2-0 win
over Dynamo. A 2-1 loss to the
Santa Clarita Exile witnessed
another Gatdiner goal.
The next tournament for the
Heat is the South Coast Invita-
tional in early August.

VALEN-WATEa POU) CIA-Coro-
na del Mar High's freshman-
sophomore boys water polo team
went on a 3-1 romp through the
East 17 and Under Water Polo
Tournament last weekend at
Val~cia High School as part of
its summer season.
The Sea Kings opened play
with a 12-6 win over Servite, fol-
lowed by a 12-3 victoI}' over
Katella. They suffered their only
loss Sunday morning when San
Diego posted a four-goal fourth
quarter to hand Corona del Mar a
12-8 loss. But the Sea Kings ral-
lied for an 11-9 win in the final
game over Foothill.
Corona del Mar was paced
offensively by D.J . Jackson. Jack-
