School officials map out goals for next year

NEWPORT-MESA -In an
attempt to avoid the •gun to our
heads" decision-making that
trustees were forced to do this
year concerning school reopen-
ings, boundary lines and budget
reductions, school boa.rd mem-
bers will hold a special meeting
this morning to outline goals for
the corning year.

Bernd) and to be fair to us, so we
don't look like idiots out there,•
said Trustee Dana Black. "I need
to have some pre-planning to do
my homework."
Bilingual education, deferred
maintenance and curriculum
will be among the hot topics at
the meeting.
-Black said she has been in
many discussions about English-
only vs. bilingual education and
said she believes as long as lim-
ited-English speaking students
attend public school, there
should be some sort of bilingual
education.
"I'm not for total (English)
immersion," Black said. "It
works for speaking the lan-
guage, but not for comprehen-
sion. If they can't understand the
concepts, how do w e expect
them to read and be success-
full"
Trustee Wendy Leece also
said the trustees should tackle
the bilingual issue, but she con-
siders Orange Unified School
District's English-only approach
as a model.
Leece also hopes the board
will take action on a character
education plan they designated
as a goal last year but never
worked on.
"They're values -honesty,
punctuality. and respect -that
are not necessarily Biblical in
natur.e," Leece said. "{They ·are)
values the community can agree
on,•
Board President Marthe Fluor
said trustees also will discuss the
recent administrative restructur-
ing and new principals.
The meeting will begin at 8
a .m . at the new District Educa-
tion Center, 2985-A Bear St.,
Costa Mesa, but the trustees will
go directly into closed s.ession
for approximately an hour,
school officials said.
Black said she called the
closed session meeting to dis-
cuss personnel issues, including
what she can and cannot discuss
in public session.
"I want some cla.rilication,"
she said.

Newport Beach police accept new union contract

port cops second highest
paid in county; but council
must still approve pay hike,

agreed to a contract with the
city, ending nearly two years of
tense talks that escalated into
ad campaigns and p.olitical
jousting.
The Police Employees Asso-
ciation vote d 125-11 to strike a
deal with city officials, agreeing
to give up some of a proposed
raise instead of losing two vaca-
tion days.
The City Council will consid-
er the contract Aug. 25.
Officers will get a 1. 7 5 %
retroactive salary increase for
July 1, 1996 to March 15, 1997;
a 3.48% increase from Merch
15; and a l .6 o/o increase Jan. 3,

starting March 15 and a 2%
increase in 1998.
The city will not reduce offi-
cers' vacation time or flex leave
as was originally proposed -
the biggest sticking point in
negotiations.
The new contract also means
lower sterling salaries and few-
er days off for new hires -
another point of contention.
Police objected to the lower
starting salaries, saying it would -
drive away recruits and said
they wonied the reduction in
benefits could indicate a trend.
City officials pointed out that
the proposed raise would make
local cops the second-highest
paid in Orange County and said
they had to cut back on employ-
ees cashing in their leave time.
The police officers' epproval
left both sides relieved though
not overjoyed.
"It settled their concerns,"
city administrative services
director Denni~ Danner said.
"It's similar to what we've
offered in the past.•
Police union president Steve
Martinez said he and the other •
officers would be happy to put
the negotiations debacle behind
them.
"It was about the best we '

best for all the children

stack of local newspa-
pers that provide a transition for
me back into the real world. The
stack I just finished was very
heavy on two public school
issues that would seem to me to
share the same umbilical, even
though they appear on the sur-
face to be unrelated.
1\vo nearby school districts
are in a lather over bilingual
education, offering us an oppor-
tunity to learn from these con-
frontations before they surface in
Newport-Mesa. At the same
time -on a less shrill note -
the Newport-Mesa Board of
Education approved a district
health curriculum that includes
information for primary grade
students about the reproductive
system. Enough parents ques-
tioned its appropriateness that
the Pilot solicited comments from
its readers about this program.

What depresses me about the
debate on both issues is that it
often centers around a pair of
irrelevancies: political philoso-
phy and the needs and fears of
the parents. In only a few
instances did I find ijie argu-
ments based wholly bn the sin-
gle issue of any real importance:
what is good for the children.
Both bilingual and sex education
are complex issues that cannot
be dealt with rationally from the
perspective of either moral or
political absolutes.
City officials to examine
recovery center's operation

COSTA rvt:ESA -City officials
will debate on Monday whether to
allow a drug and alcohol rehabili-
tation center to operate special
programs in a converted 19-unit
Victoria Street apartment building.
Although City Council mem-
bers denied the center a permit
two years ago, the issue will be
brought back before the Planning
Commission on Monday night.
The city denied the permit
based in part on complaints
expressed by neighbors about the
facility's staffing, its proximity to
Victoria Elementary School and
the management's ability to mon-
itor residents' behavior.
At a Planning Commission
study session held on Monday,
commissioners recommended the
city abide by the council's 1994
decision. The denial or a permit
will not result in the center's clos-
ing, but could preclude the city
from placing conditions on its
operation, said Nancy Clark,
owner of The Recovery Center.
HThey can't close down the
operations of (this facility)," Clark
said. "The drug addicts and alco-
holics are here to stay. What they
are doing is voting down the city's
control. They are saying, OK, put
all these drug addicts and alco-
holics in this building, but you
can't supervise them."
Since the city denied Clark a
permit to operate the alcohol and
drug rehabilitation center two
years ago she has applied for and
received a state license. That
license allows her to operate
scheduled programs, conduct
periodical drug testing and place
other restrictions on residents.
Planning Commission Chair-
man Walt Davenport said
although the commission is lean-
ing toward a denial of the permit,
that action may be reconsidered
al Monday's meeting.
"They (operators of the center)
say it's not going to go away and I
suspect they are probably right,·
he said. "It didn't go away the last
time the City Council denied it."
The goal of all the various
factions in the bilingual educa-
tion dispute is -or certainly
should be -the same: to pro-
vide students with the best pos-
sible tools in order for them to
function at optimum levels in our
society. If this premise is accept-
ed then the question is simply,
how best do we achieve this
goal?
We decidedly don't achieve it
by electing school board mem-
bers like the one in Huntington
Beach who called the people in
Sacramento who didn't agree
with him on bilingual education
a "merry band of communists.·
Contrast this with the teacher
who wrote to the Times: "Every
Bay Knolls wants to be Newport Beach

But Newport city officials aren't
exactly rolling out the welcome
mat for them.
"Newport Beach would be flat-
tered that they want to be annexed
in, but they (city officials) simply
won't do it.• Newport Beach City
Councilman John Hedges said.
"Besides that, Costa Mesa is a fine
city. The people in Bay Knolls
would do well to annex into Cost.a
Mesa."

The area, which ts bordered by
Costa Mesa on three sides, was
scheduled to become annexed into
the city of Costa Mesa until nearly
all the residents petitioned to aban-
don the plans. Residents contend
they have associated themselves
with Newport Beach, many argu-
ing they bought there homes under
that assumption.
On Monday, the Costa Mesa
City Council agreed not to annex
the area because laws governing
annexations could overturn the
action if 50% of the residents object
to it. Bay Knolls residents agreed to
pay any extra costs to change the
sphere of influence to Newport
Beach.

The Local Agency Formation
Commission, whlch oversees
annexations of cities and special
districts, will make the decision.
Peggy Ducey, assistant to New-
port Beach City Manager Kevin
Murphy, said before Newport
Beach could take any steps toward
annexing the area. the city would
have to update a 1994 cost study.
That report showed it could cost
as much as $2.3 million in new fire
and police services and street
improvements to annex the entire
Santa An.a Heights area, where
Bay Knolls is located. Additionally,
the study showed it would cost
another $150,000 to $200,000 a
year to provide Santa Ana Heights
with Newport Beach-type services.
Ultimately the Newport Beach
City Council will determine
whether Bay Knolls residents will
be Newport Beach residents or
stay under the county's jurisdiction.
Bay Knolls resident Sadie Kelly
said if the city of Newport Beach
decides not to annex the area, she
would be happy remaining under
the county's authority.
"It would be better in the coun-
ty than in Costa Mesa,• Kelly said.

ments are offered up to support
what is frequently nothing more
than a personal antipa,thy

quently are; (1) that widespread
sex education over the past sev-
e ral decades has failed miser-
ably to cut down on unwanted
pregnanaes; and (2) that giving
young people factual birth con -
trol information along with other
reproducllve health information
encourages prorruscuity.
The first argument is especial-
ly ironic because sex education
opponents have been highly
successful m keeping 1t out of

our schools. Locally, since the
Anaheim Family Lile program
was thrown out 30 years ago.

movements in sex education
because school offiaals don't

pest ol emotion. When he speaks al
the death-chamber, he evinces a
strange but palpable ease, possibly
a by-produd of the notion that God
might resurrect him in another life.
From within a month of h1s
arrest in October 1994, Bennett's ·
chief concern Was not whether he
lived or died but in "rnaking It right
with Jehovah,· says the man who
represented him at trial, Deputy
Pub.lie Defender Leonard Gwnlia.
Yet if the mwderer has
resigned himself to his punish-
ment, others continue to wrestle
with it and their role in the grisly
saga whose climax 1t will mark.

Braswell entered the story
through an unhappy nuke. On
Sept. 27, 1994, what she describes
as •an insufferably hot night,~ the
air conditioning wasn't working in
the tiny Monte Vista Avenue
apartment where the recession
had drive n her to live . She kept
the door open to cool herself. She
says the porch light hadn't worked
in months.
Just after lO p.m. she lay in bed
watclung ~NYPo Blue" on her 8-
inch television, a show about cops
chasing make-believe killers in a
remote city. She wore her night·
gown. A tiny lamp lit lhe room.
Sixty feet away, Eric Wayne
Bennett, a crystal methampheta-
mine addict, stepped out of the
apartment where he lived with his
wife and two yoWlg sons and
noticed the light ln Braswell's
room.
He bolted through her door

penalty seems fitting, and some-
times it doesn't.
Throughout the trial, watching
tbe man who inhabited her night-
mares, listening to desaiptions of
how he murdered SO-year-old
Laguna Hills secretary Marie
Powell.Evans, Braswell looked for
reasons to keep him alive.
The best argument seemed his
two sons -Tyler, 7, and Tosh, 3
-utterly innocent victims who
would need a Oesh-and-blocxt tar·
get for their rage when they grew
old enough to grasp what he'd
done.
At one point -Braswell now
views the notion as crazed -she
even wanted to raise them herseU.
Her therapist told her they were
not up for adoption.
ironically, it wasn't until
delense lawyers put a witness on
the stand to describe how Bennett
turned him on to religion that
Braswell viewed the killer as
wuedeemable. The witness was a
child molester Bennett met in
Orange County Jail, and Bennett
the two districts.

name. Bennett was "the last

Hougan and her husband,
John, drove to Powell-Evans'
Laguna Hills condo. They arrived
around J"l :30 a.m. They found a
missing screen door and the
woman's car, sitting untouched.
Hougan is a dispatcher for an
Orange CoWlty police depart-
ment. John Hougan is a cop. They
didn't need to be told what the
signs suggested.
John made her stay outside
and went in. He found the body in
the downstain bathroom, mostly
naked. and badly bludgeoned.. The
night before, Powell-Evans had

Laguna Hills condo six weeks
before she died. Unm.onied. she
wanted to be close to her daugh·
ter and son·in-law. She was exdt·
ed about the prospect of "kid.-

says. ~All she wanted was her
grand ldds."
When they found her body,
police also found the phone num-
ber ol carpet and linoleum

"My mom, being the way she
was, was probably so nice to
him," Hougan says. "It was so
personal. the crime. It wasn't a
gunshot from a distance. This was
somebody that he knew, and he
beat her to death."
As a police dispatcher, part of
Hougan's torment is that she helps
strangers in trouble every day,
providing a calm voice in crisis
after crisis -and yet she couldn°t
help her mother.
She says she still fights with
the nightmares. She sleeps with a
cache of guns in her room: a gun
on either night stand: a shotgun
under the bed; a shotgWl in the
closet.

At trial, dwinq tho descriptions
ot the murder, Hougan stood out-
side and wept, asking for her
mother. At the tentenc;:ing, she
said sbe would spend her last
ounce of strength to see him exe-
cuted. •Here's this guy who's a. doper,
who can't hold a job, who cheats
on his wife, who's a murderer and
a rapist, and the defense attor...
neys say that his life is valuable?·
she says. "What has be dt.>ne in
his life to show he's a value to
anyone? He's done nothing. Then
there's my mom. who always did
thc·rigbt thing and never hurt
anybody." ·' . _
For his part, Bennett portrays
himself as immune to Hougan's
fury.
•There's a little bit of hate
th.ete, • Bennett says. "It's not
going to hurt me the way she
wants it to hurt me."
Bennett says he hopes
Hougan's police experience
would give her perspective on
the dangers of drugs. He says
crystal meth drove him to "try
thoughts• he wouldn't have tried
otherwise.
· Hougan says she's dealt with
many meth addicts who aren't
killers.
While her rage at him hasn't
ebbed, she now has second
thoughts about attending the exe-
cution. She just had her first child

evil place, but how do I do that
with what I've experienced?~ she

nandez was counting his bless-
ings Tuesday afternoon as he and
another Lee Roofing of Costa
Mesa worker baked in the hot
sun while replacing the wood
shingle roof on a Skylark Lane
home.
Sure, the sun was beating
down on them and the tempera-
ture was pushing 85 degrees: At
least the job wasn't further inland • .
•This is cool, this isn't bad,"
Hernandez said.
Hernandez, an 11-year Lee
Roofing employee, has certainly
seen his share of hot days on a
wood roof.
There were days in Yorba Lin-
da, Irvine and other inland valley
job sites where the temperature
on the roof climbed ne~ 11 O
degrees -jobs when there was
no shade in sight to keep the sun
off.
Add in 600-degree roofing tar
that is applied beneath the wood
shingles, and you have the ingre-
dients for a real scorcher, Her-
nandez said.
"If you're weanng tennis
shoes, it will melt the bottoms,·
he said.

minator Willie Hawthorne what
it's like killing bugs inside a small
attic on a summer day.
"It's probably another 20 to 25
degrees hotter than it is outside, H
said Hawthorne, dress~ in a T-
shirt, shorts and heavy duty
shoes. "When you sweat, the
insulation sticks to you a lot
more.•
Hawthorne, owner of All
CowUy Exterminating, which he
runs out of his Costa Mesa home,
spends his mornings working the
hottest indoor jobs and tries to do
outdoor work in the afternoon.
After a stilling period in a hot
attic or house, Hawthorne usual-
ly hoses off his head• and arms
before getting in his Toyota pick-
up with the "Born to Kill: All
County Exterminating" license
plate holder and driving to the
next job.
"If you keep your head cool,
the rest of your body stays cool,"
he said.
Hawthorne also drinks a gal-
lon of water each day.
Up until now, the summer
temperatures have been relative-
ly cool, making this past week's
heat wave seem particularly bru-
tal, he said.
"It takes the body awhile to
assimilate," Hawthorne said.
Hawthorne had only one piece
of advice for his fellow bug
killers: "Take the week off.•

The overtime reform approved by the Industrial Wettare Commission will
go into effect on January 1, 1998.
All California employers were mailed copies of the revised wage orders
recently. Employers and human resources professionals should read the
orders carefully. Business may not change overtime pay requirements until
January 1 . 1998.
Before next year, employers should talk with employees regarding
scheduling changes that might be appropriate under the 40-hour rule.
These changes might include compressed wor1<weeks, telecommuting and
other alternative work schedules.
Employers should be prepared to discuss with employees issues such
as health and safety, commuting, make-up time and childcare availability.
Moreover, employers are strongly urged to revise policy handbooks before
January 1 to reflect the wage order change by removing mention of eight-
hour pay and inserting 40-hour overtime provisions.
Labor attorneys will be on the lookout for employers who fail to update
policies. Businesses may be sued for failure to pay eight-hour overtime

stadiums.
A simple formula paved his road to

. steal second. Belt ball over fence,

But all that changed in one frustrating
season la.st spring, when Achterberg hit
a bumbling .289 in his second varsity
campaign for Coach Joe Koh's Sea Kings
and garnered zero individual honors.
•1t was the only season I didn't do
something noticeable,• said the former
youth league sensation, who en route to
the CdM varsity amassed home runs like
investment-minded collectors stockpile
Alex Rodriguez rookie cards. MI'd always
been an MVP or something.·
Something was precisely what
Achterbfrg decided to do about bis
sudden and frustrating futility. He
promptly quit football, doubled his time
in the batting cage, quizzed several
hitting coaches, and came to a startling
conclusion.
•1 guess my naturally ability could
take me only so far,• said the
powerfully-built outtlelder, who is back
in the groove for the Orange County
Dodgers, whom he helped secure a
berth in the Connie Mack World Series,

play baseball at UC Berkeley. I've loved
this sport since I was 5."
With improved swing mechanics and
renewed determination, Achterberg
enlisted Koh to help him find as much
high-level competition as possible.

American Legion summer schedule, Koh
pitched Achterberg's services to Dodgers
Coach and CdM resident Mickey
Hartling, who was conveniently short of
players.
-1 know talent, and I wasn't interested
in pulling someone off the sidelines
unless he could play," Hartling recalled.
-rd never seen Ryan play, but Koh told
me he had a lot of heart and he loved to
play the game."
Hartling gave Achterberg a shot and
he's done the rest .
~Coach Koh called me and told me I
had a game in halt .an hour,• Acbterberg
recalled of his Dodgers debut, about
midway through the team's regular
season.
Achterberg quickly won the starting
left field job and said he's hitting around
. 426 in the No. 9 spot in Hartling's order.
•The biggest single thing about Ryan
is, he's always on base,• Hartling said.
·we have a lot of talent on this ballclub,
but we just can't get him out of the
lineup."
Achterberg scored the only two runs
in the Dodgers' regional title-game
triumph over Albuquerque, which gave
them their ticket to Farmington. -a·s really exciting to see the work

squad opens the eight-team tournament
against a team from Cincinnati.
"Connie Mack is real competition and
it's a whole different world. To be
succeeding is just an uplifting
experience.•
Achterberg, one of few players on the
team with remaining high school .
eligibility, said a World Serles champi-
onship would be even more uplifting .
"We have guys on this team from the
Division I, Division II and Division Il CIF
(Southern Section) championship teams,
but I haven't had a lot of postseason
success in my career," Achterberg
explained.
"Most of these guys are very serious
about baseball. It's like a business to
them. That just really makes me want to
do better, because they're counting on
me."

opening round of the boys
National Junior Olympic Water
Polo Tournament.
Pulling players from only their
own lugh school's Newport Har-
bor High and Corona del Mar
each lost one and tied one in the
17-and-under division, with the
Sailors and Sea Kings both drop-
pmg to consolation-round play
slated for Thursday.
Newport's 15-and-under boys,
however, earned a pair of victo-
ries to advance in the wmner's
bracket, playing today at 12:30
and 5 p.m. at El Dorado High.
The Newport 15s d efeated
Santa Barbara, 15-1 Tuesday. then
followed that up by rallying from
a 3-0 deficit to claim a 6-3 verchct
over Oregon's Tualatin Hills.

In seniors play, Ron Cowan carded a

that Anthony Ybarra has stepped down
from hls position as the head coach of the
Mustangs' WTesUmg team.
Howell said that Ybarra has been
accepted to Nebraska Uruversity's gradu-
ate school and will continue his educa-
