our plans.for a major desti-
nation resort hotel at the Newport
Dunes Resort, youi paper has earned
very informative and valuable news
articles, and a· nwnbet of letters to
the editor, that have expressed both
support and opposition to the plan.
We feel your reporters have
been fair and diligent, and we
respect the thoughtful concern of
the residents who have written in
opposition.
Unfortunately, as is often the case
in public policy discussions, errors or
fact find their way tp print, and
unless corrected, tend to become
pennanentJTlisconceptions.

I would like to try to correct some
of these JTlisconceptions, or at least
come at them from our own pomt of
view, before they become legend.
1\'affic impact: Much has been
made of the increased traffic impact,
and, indeed, we will add to the traf-
fic numbers, much as Dover Shores,
Sea Island, Linda Isle, and every oth-
er beautiful part of our community
does. The difference is that our traf-
fic is not on the road at peak hours
or commuting hours. As with the.
typical resort, our check-in ti.me is 3
p.m . and our checkout time is noon.
Our guests are simply not going to
be on the road at rush hour. While
we will add to the traffic numbers,
we will add very little to the traffic
problem.

Newport-Mesa's Sacramento rep-
resentatives, Sen. Ross Johnson
and Assemblywoman Marilyn
Brewer, laid into the new governor
for being motivated by politics and
the simple desire to keep his seat.
"It is purely political calcula-
tion,• Johnson said of Davis' posi-
tions on issues ranging from educa-
tion to "Big Box" retailers ... He is, I
believe, at heart, a political liberal."

and theaters of our community. And

not ours.

But, while Davis' cautious polit-
ical nature helped him take the
seat from Dan Lungren (who
Johnson admitted came off as the
extreme candidate), it plays into
Republican hands during both pol-
icymaking and elections.
"If the spotlight of public atten-
tion can be put on issues, that cau-
tion can be used to our advan-
tage,• Johnson said.
Davis has not followed some of
the more liberal Democratic pro-
posals, Bre wer added, because he
continuously thinks of how such
legislation will play with the mod-
erate voters who elected him.
Location: The Newport Dunes
Resort is the perfect place for New-
port's grand resort hotel. It will be on
the sand, at the edge of the lagoon,
in an area that is already an intense-
ly used recreational center for the
community. It will give visitors easy
access to the city's beaches, retail
shops and restaurants, without dis-
turbing residential areas. Bayside
Drive was always planned to be the
main entrance to the hotel. We are
working with our neighbors at Bay-
side Village to improve their envi-
ronment, their village entrance and
their secunty.
Quality of life: The hotel will pro-
vides a wonderful resort venue for
all Newport Beach residents, their
families and their visitors. The con-
ference and event facilibes will allow
major charitable and cultural events
Financial: We are prepared to
invest $100 million in this destination
resort hotel. In addition to becoming
a beautiful landmark site for New-
port Beach, it will provide more than
$1.25 million in net revenue to the
city treasury every year. That is
according to a study by the city, not
us. Please understand that this is
income to the city over and above all
Environmental: One writer
referred to the site as an M environ-
mentally sensitive" piece of land. It
.is not. In fact, it has been used as a
dredge spoils, i.e., its received mud
from the bay and been a dump basin
for the county.
Views: Several writers seem con-
fused about the location and think
we will be blocking ocean views. We
will not. We are in a low pocket of
land, below Pacific Coast Highway.

that will be blocked will be those

Dunes Resort has been a good
neighbor, and very much involved in
the life of our o ty. As a private busi-
ness enterprise, we hav~ tried to run
a successful resort and lo b~ gener-
ous and fair m our relationships with
our community. We hope and expect
that the community will, in tum, be
fair in its assessment of us.
Just one other thing. In answer to
the most often asked questions: YES,
the Fourth of July fireworks show
will continue, and YES, the Girl
Scouts will still have a campground
at the Dunes, as the y always have.

It also might save the GOP in
California, which ls reeling from
losing the governorship and the
not having control of the state
houses.
Judging from Brewer and John-
son's comments, the GOP plans to
get after Democrats on traditional
themes: that the Democrats are anti-
business; that the Democrats are in
the pocket of trial lawyers; and that
they are too friendly with unions.
Because of Davis' polillcal cau-
tion, they don't expect the gover-
nor to go to bat for tus fellow
Democrats, at the risk of bemg
tied to the left.
Republicans, it seems, are ha p-
py for now to have Davis be a
pretty mild shade of gray. It's the
rest of the Democratic party they
want to convince voters is a bright
shade of red .
Still, it's going to be an uphill
battle, a s both representatives
admitted. In the House, 16 Repub-
licans are being te rm-limited out,
and money ls tight, Brewer said.
In the Senate, tlungs are look-
ing better for the GOP, Johnson
said. They plan strong races for
five seats, three of which were
recently held by Republicans.
For Republicans to Win those
elections, it seems, Davis can rest
easy that he won't bear the brunt
of their attacks.
But he shouldn't count on being
sale when it comes time for his
own race .
".MY fear is if he's reelected in
four years, he'll go hog wild," ·
Brewer said.

I was pleased to read "Crime
takes a plunge in Costa
Mesa· Nov. 23. This came a
week after my class of 36 local
residents had just completed
Costa Mesa Police Depart-
ment's Community Policing
•Advanced" Citizens Academy
for the last 11 weeks.
Our course was a follow-up
to the "Commuruty Policing
Citizens Acadeniy" offered to
all citizens or employees of
Costa Mesa -a course that is
well-worth taking for anyone
who wishes to improve their
relationship with the neighbor-
hood and community they live
and/or work in.
The first course takes you
th.rough all the phases of the
Costa Mesa Police Department.
Every night you will learn
something new, including
SWAT, K-9, DUl, gang and nar-
cotics enforcement, major
oimes, traffic and criminal laws,
fire, helicopter and patrol opera-
tions, weapons training and
firearms safety cldss, neighbor-
hood watch and a ride along.
And the second course is a
continuation course involving
the Community Emergency
Response Team training pro-
gram. Instructor Teri Dumall
wants to train as many as she
can to be prepared for a disas-
ter, if it should ever happen
here.
During that time we mter-
acted between the Coi>ta Mesa
Fire and Police Departments,
learning six hours of CPR and
18 hours of the response team
duties, which included disaster
preparedness, fire suppression,
medical operations, light
search and rescue, psychology
and team organization -
along with a simulation.
We also took another ride-
along and our final night was a
high-profile case (Denise
Huber) showing how all the
different departments interact
to solve a case.
With headlines in our local
paper of •Crime takes a
plunge in Costa Mesa," it is
obvious that a course like the
Conununity Pohcing Citizens
Academy bas got to help the
community. I hope iI you like
living in Costa Mesa and wish
to improve the community and
neighborhood that you will

Woman with many
cats deserves break.
This is in response to the
articles in The Daily Pilot dated
Nov. 19 and 20, respectively
("Gearing up far a cat fight"
and "For pet owners, magic
number is four"). To charge Pat
Hotz Wlth a misdemeanor
crime for taking good care of
animals ts ludicrous. Pat Hotz
loves animals -penod. She
has more Jove in her heart for
animals than some people
have for their own children.
Anyone who knows Pat, and
there are many of us, knows
that she would never Jet an
animal starve and go without
shelter. As I understand it, the
cats are in the house, not out-
side and not bothering anyone.
1\'ue, she has way too many,
but rather than let the cats
starve to death or get run over
by a vehicle she puts herself
on the line with the authonties
just to give them a normal life.
There are people who own one
or two animals and wouldn't
take the time to show them
warmth and love that they
deserve, and sometimes even
abuse them, and here is a
·woman who takes better care
of these animals than most
people and she is going to be
punished for it.
Hopefully, this will end in
Pat's favor and someone in the
courts will realize this woman
iS not just some crazy cat lady,
but someone who really cares
about these animals. Her care
of them proves that.

Flier flew in face
of accuracy
I received a brochure •Fly-
ing in the Face of Safety•
questioning the safety of El
Toro airport. Obviously, it was
designed and distributed by
South County actiVlSts to kill
the proposed airport. What was
particularly offensive to me
was that they had the audacitY
to try to put Newport Beach in
a bad light with a quote insin-
uating people will die at El
Toro because our citizens don't
want flights over them. That is
just outrageous. I've taken the
•D• ride out of John Wayne
enough to know El Toro could
not be any more of a risk to fly
out of than our littlo ailport
with its dangerously small run-
way. In fact, I am certain the
majority of pilots would prefer
El Toro to John Wayne for rea-
sons of safety.

I 'm writing in response to David Comett's let·
ter ("Irvine Co. up to tricks/ Dec. 7). The
Newport Ridge North project along the toll
road at Bonita Canyon has been planned for
more than 1'0 years. Extensive environmental
studies were conducted that included public ·
heann~ and the opporturuty for the pubhc to
comment and influence the plan. Further oppor-
tunity for public input came when the zoning
was approved and tract maps were processed.
Even more hearings took place when the county
annexed the land from the aty of lrvinP. in 1997.
At each of these points, the govenunent agen-
oes responsible for processing the pro1ect notified
the public of their actions and invited input from
the swrounding communitieio.
Under the law, they are required REBUTTAL to notify the neighbonng resi-
dents And judging from the let-
ters on file in the official record from Harbor View
residents, some neighbors felt strongly enough to
actually partiapate ln the off1dal process.
That process is now over, all of the studies
are done and appropriate government approvals
are in place. Construction has begun.
Earlier this month, we sent a letter to the
neighborhood letting them know that they
would shortly see some construction activity. We
notified them even though there was no legal
requirement to do so. The only reason we sent
this notice was because we are trying to be good
ne1ghbors and wanted to inform them of the
steps we were taking to mmim.ize the impacts of
the construction on the neighboring community.
U Seawind res.1dents feel they were not prop-
erly notified by the government agenCie:,, they
should che<::k with the agenoes involved. We
were a pa.rt of that process at each step so we
are confident of what the record will show. U
they are new residents, they should cheek with
the previous owners of their homes to make
sure it was properly disclosed to them.
As we always do, the lrvme Co. has gone
well beyond its legal requirements on this pro-
ject to keep the neighbors informed a.Dd to miru·
rruze the impacts of the constn1ct1on on the com-
munity. And we will continue to work with the
neighboring communities <tddressmg new con-
cerns as they arise.

those rare law enforcement
cases where police have a
prime suspect, but can't make
an arrest without a crime being
eo~tted. . . ·
Such is the tenuous waiting
game for one Costa Mesa cou-
ple who are very aware a con-
victed sex ofC(\nder has fanta-
sized about having sex with
their 7-year-old son.
The case hasn't amounted to
more than 39-year-old Cary Jay
Smith writing about the boy m
his journal. Srruth doesn't live
near the boy's home, but police
said he did see the child when
he made visits to his parents'
Costa Mesa home.
Bound by the law, police
must perform a high-wire bal-
ancing act by reassuring the
child's parents that nothing will
happen while not being
overzealous about their poten-
tial leading suspect.
"It puts us in a very uncom-
fortable situation,~ said Costa
Mesa police Lt. Ron Srruth.
"This guy could be a ticking
time bomb, but law enforce-
ment is left powerless. n •
Authorities' worst fears are
that Cary Smith makes his fan-
tasies a reality. However, he
has spent the last eight months
in a treatinel)l program, where
he has undergone rehabilita-
pon. Smith originally entered
the program voluntarily earlier
this year, but a judge recently
said Smith should spend some
more time under watch
Smith was convicted in 1983
for asking a child to disrobe,
according to court docwnents.
His 15-year-old stepdaughter
has also made allegations that
Smith molested her over a two-
year penod when she was
younger.
Authorities know there is a
good chance a sex offender will
repedt.
Newport Beach residents
were furious when they learned
convicted child molester James
Lee Crummel was living in their
midst. Although be was facing
criminal charges in Riverside
County, Crummel was trying to
live peacefully with friend Bur-
nell Gordon Forgey. ,
Police knew of Crummel's
reputation, and even though
residents protested outside the
home where both men Uved,
authorities were unaware
either man had done anything ·
wrong.
The publicity surrounding
Crummel may have caused one
young man to step forward and
make aUegations against the
two roommates that they sexu·
ally molested him. Police
arrested the pair. and bot.b' ~ere
eventually convicted on child
molestation charges.(

Authorities admit the Smith
incident is unusual. If he is
released from the treatment
program, police could monitor

But they know that scenario
isn't realistic and must wait to
see what happens.

responsible for examirung the
Newport-Mesa district's dete-
riorating schools has sched-
uled its last meeting.
The Facilities Conunittee is
scheduled lo meet Thursday
to put together its final recom-
mendations to the school
board -that is, unless the
school board comes back with
more questions as they did in
the fall.
The group was originally
scheduled to be finished on
Sept. 28. At that time, they
issued a report with numerous
recommendations and the
board asked them to follow

Now the group is preparing
once again to iron out the final
details of those recommenda-
tions.
One of tbe main quesllons
remaining is what should be
done if the district decides lo
sell the Baleric and Banrurtg
Ranch sites.
The two sites have already
been declared unfit for
schools, said school board
member Wendy Leece.
The two options up for con-
sideration are putting the
money toward the totdl cost of
repairing the district's schools
or setting it aside for future
repair of the schools in order
to prevent a repeat of the cur-
rent problem.
The committee will recom-
mend the money be put
toward the school repairs,
Schultheis said.
The school board hkely will
vote tonight to approve an
agreement with real estate
appraiser Stephen White to
reappraise both sites before a
decision to sell is made
•As we're getting ready to
sell, we need an idea of what
(the sites) are worth,• Leece
said.
Schultheis said he expect-
ed the combined value of the
two sites to be in the neigh-
borhood of $10 million.
The BaJenc site has at least
one possible buyer. The site is
currently being used by the
oty of Costa Mesa.
Also, there has been inter·
est expressed in the Banning
Ranch site by private parties,
Schultheis said.
A final loose end thdt needs
to be tied up, he added, is dis-
cussing the structure of ts facil-
ities oversight committee,
which will be formed to man·
age and control any funds
·raised to pay for the school
repairs.

voted to deny Northwood High
the option of playing a free-
lance varsity football schedule
next fall. Rick Curtis, North-
wood's athletic director and
footbdll coach, said Monday.
Curt.ls said he could decide
as soon as Friday whether to
play a varsity or jwuor varsity
schedule next fall in the PCL.
"I'm disappointed about not
being able to play free-lance,
but tliese are the mies and
we'll abide by them," satd Cur-
bs, who invoked ire from some
PCL coaches last month by
announcing pldns to play dS a
free-larice team.
' The Irvine-based school
opened this fall with 28 sopho-
more football players and tt
complete freshmen team. The
freshmen went 9-1, but haU of
those games were against
freshmen B teams, Curtis said.
If Northwood elects lo play
at the varsity level, it would
eliminate the bye week the
other five PCL schools hdd dur·
ing the 1999 league ~eason.
