TITLE: Resolution Setting a Second City Council Meeting for August 28,
2018
ABSTRACT:
To assist the City Council with its recruitment of a new City Manager, the City of Newport
Beach ("City") desires to schedule an additional City Council regular meeting in the month
of August.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2018-57, A Resolution of the City Council of the City of Newport
Beach, California, Setting a Second Regular City Council Meeting for the Month of
August.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
The California Government Code and City Charter require the City Council to hold regular
City Council meetings. With the exception of the months of August and December when
there is only one meeting. The City Council holds two regular meetings a month at
4 p.m. on the second and fourth Tuesday in the City Council Chambers located at
100 Civic Center Drive, Newport Beach, California, or at such other location and time as
allowed by the City Charter, City Council Policy and Ralph M. Brown Act. City Charter
Section 407 allows the City Council to hold additional regular meetings provided the
additional regular meetings are set by ordinance or resolution.

The City Council is currently interviewing candidates for the position of City Manager. To
assist the City Council with the interview process, including a discussion of possible
compensation provided to a new City Manager, it is desirable to hold a second regular
meeting for the month of August. The attached resolution schedules a second regular
City Council meeting on Tuesday, August 28, 2018, at the hour of 5 p.m.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, SETTING A
SECOND REGULAR CITY COUNCIL MEETING FOR THE
MONTH OF AUGUST
WHEREAS, California Government Code Subsection 54954(a) requires the City
of Newport Beach ("City") to provide for the holding of regular City Council meetings;
WHEREAS, City Charter Section 407 provides that the City Council shall hold two
regular meetings per month except in the months of August and December when there
shall be at least one regular meeting in August and one regular meeting in December;
WHEREAS, City Council Policy A-1 provides that the City Council shall hold
regular meetings as allowed by the City Charter and the Ralph M. Brown Act; and
WHEREAS, the City desires to hold a second meeting in the month of August to
assist the City Council with its current recruitment of a City Manager.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: With the exception of the months of August and December when there
is only one regular meeting on the second Tuesday, the City Council holds two regular
meetings a month at 4:00 p.m. on the second and fourth Tuesday in the City Council
Chambers located at 100 Civic Center Drive, Newport Beach, California or at such other
location and time as allowed by the City Charter, City Council Policy and Ralph M. Brown
Act. For 2018, the City Council desires to hold a second regular meeting for the month
of August on Tuesday, August 28, 2018, at the hour of 5:00 p.m.
Section 2: If any section, subsection, sentence, clause or phrase of this resolution
is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this resolution. The City Council
hereby declares that it would have passed this resolution, and each section, subsection,
sentence, clause or phrase hereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
Section 3: The recitals provided in this resolution are true and correct and are
incorporated into the substantive portion of this resolution.
Section 4: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.

Section 5: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
