The group that. maintains a mari,ne
habitat in the waters off Newport Beach
filed subpoenas Wednesday to obtain
expert testimony that it hopes will help
save the habitat from being destroyed.
~e ~arine Forests Society, which has
maintained an offshore aquacultural
habitat since 1988, filed subpoenas for
the testimony of two officials from the
state Department of Fish and Game and
a California Coastal Commission envi-·
ronmental specialist, said Rodolphe Stre-
ichenberger, the founder of the group.
Streichenberger said he h opes the
input of the three nien will help the
Marine Forests Society overturn a cease
and desist order-the CoastaLColDlD.ission
issued last week.

the underwater structure, constructed of
tires, plastic jugs, PVC pipe and other
materials, to be disassembled within 60
days.
But StreicheQ.berger thinks expert
opinion will prevent that from taking
place.
. •At the [Coastal Commission] hear-

on the project's behalf, he said. "We
want the testimony of technicians.• ·
Fish and Game senior biologist David
Parker, one of the men the group has
asked to testify, responded to Wednes-
day's move with a mixture of surprise
and skepticism.
Parker on Thursday said .he had not
been told the subpoena was filed and
that the Department of Fish and Game
had fa irly limited contact with the
Marine Forests Society ove r the years.
•All I really know is that they appar-
ently have placed materials there with·
out the proper permits and other
approvals that are needed to place mate-
rials on the ocean bottom,• Parker said. ·
In general, he added, Fish and Gattle
wasn't enthusiastic about placing tires on
the ocean floor.
•Jn our own experience, we ba~ not
used tires in any of our reef programs foJ
decades now,• he said. •we prefer the
very stable, long-lasting materials like
natural rock or various kinds of concrete
rubble."
The other officials whose testimony
the group hopes to obtain, Fish and
Game aquaculture coordinator Robert
Hulbrock and California Coastal Com-
mission staff ecologist John Dixon, could
not be reached for comment Thursday.
Ron~d Zumbrun, the attorney for the
Manne Forests Society, ~aid he hoped
expert input would contradict> what he

about the maripe habitat made by
Coastal Commission staff at last week's
hearing.
He said some of the criticisms made of
the habitat, such as~the suggestion that
its tires might release toxics, were
•absolutely faJse. • " · ·
But Llsa Trankley, the deputy attorney
general who is representing the Coastal
·Commission in this case, said she was
skeptical about the potential for over-
turning the cease and desist order.
•I think the Coastal Commission acted
on plenty of evidence and that their deci-
sion will be upheld,• she said.
Trankley also noted that Zumb(\lll has
been pursuing legaJ challenges to the
validity of various Coastal Commission
decisions for more than a decade, a fact
that Zwnbrun readily ·confioned.

the surf in Huntington Beach
last summer wasn't much dirt-
ier than it had ever been.
A riddle for water watchers:
then why was the beach
closed or posted with health
warnings for months? .
The answer is both Simple
and complicated.
The simple part goes like
this: the beaC:h look~ the way
it did because a California law
went into effect last summer
that made water testing stan-
dards stricter than they had
been before.
' So even though the water,
for much of the sununer, was
no more contaminated than
usual, beach postings made
things appear considerably
worse.
What's complicated is that
those same new standards,
because they can apparently
be triggered by urban ·runoff,.
have the potential to make
things appear grim at other
beaches as well. even though
their effects have so far been
confined to Huntington.
City officials worry that it
will happen iq Newport
Beach.
' ·If the Talbert Marsh
(runoff) were flowing in the
other direction,• Deputy City
Manager Dave Kiff said, it's
likely that Huntington's rash of
postings and closures would
now tQ Newport with it.
"That's a genuine possibili-
ty this summer,• he said.
The law that has made this
possible -for better and
worse -is state Assembly Bill
411. When it took effect last
summer in the middle of Hunt-
ington's beach troubles, it
expanded the range of tests
that were performed at the
ocean and lowered the thresh-
old at which health warnings
were required to be posted on
the beaches.
"The standards are more
stringent and they require us
to post signs you never saw
before," said Moruca Mazur, a spokeswoman for the
Orange County Health Care
Agency.
The net effect of this legisla-
tive-chang~as that' even.
though Mazur said "there
really was no significant
change• in the contamination
levels of Huntington waters,
the bedches there were bare of
bacteria-shy visitors for
months,
"We're looking for more
things and we're finding more
things,• Mazur said. "What
we see there is probably what
was there before.•
Though postings and clo-

plans Wednesday to present a
counter offer to a North Caroli-
na-based hardware chain's pro-
posal to lease the district's 14-
acre site near Adams Avenue
and Harbor Boulevard, district
officials said.

them. a ClF Southern Section Divi-
sion Il title.

Jones and the rest of Newport Har-
_bor~ boys and girls track and field
teams travel to Cerritos College for
the CIF Division 11 championships.
Jones boasts one of the state's
fastest times in the boy~ 300-meter
intermediate hurdles with a 37.16,
and his qualifying ti.me of 37. 7 5 is
almost a second better than his clos-
est rival.
Jones also has Orange County's
fastest time in the 110 high hurdles
with a 14.21. He'll continue an inter-
esting rivalry with Kenny Vmh of
Katella, who owns the prelirns
fastest time. Jones won both head-
to-head meetings this year.
He is also the fifth seed for the
100 and the anchor for the Sailors'

Jenny Cummins didn't run the
400, even though she was the fourth-
fastest qualifier. She decided to-hold
out for the 800, a strategy employed
by her and Sumner at this year's
Orange County championship.
Cummins said she is close to
qualifying for the Masters Meet in
the 800 a nd Sumner believes one
great tune will make up for two
good tunes. Cwnmins is the fifth
seed, but she lS capable of a top-
three futish.
CdM sophomore Season Meser-
vey, who transferred from Aliso
Niguel earlier this school year, is in
a position to help immensely. She is
the third seed in the 3,200 behind
Santa Margarita's Lori Mann and
Mater Dei's Jenny Sears.
CdM junior Diana Hossfeld was
not in top form for the 1,600 prelims
and she squeezed in as the ninth
qualifier. But with her illness pass-
ing, Hossfeld is one of the favorites ·
along with Mann and Sears.
Other CdM representatives
indude Mahler in the 300 low hur-
dles and Allison Brawner in the
high jump. Both are capable of top-
three finishes.
Mesa freshman Sharon Day is
the third seed in the 400. She and
Santa Margarita's Meghan Atkin-
son are the two most likely to finish
behind Morse.
Day is a real threat to win the
high jump. She already beat CdM's
Brawner, University's Erica Malouf
and the Paulick sisters, Undsey and
Kristy, in the PCL finals.
Day will also anchor Mesa's
1,600 relay team. ln the PCL finals,
the Mustangs beat Uni for second
place, giving CdM and the 'n"ojans a
tie. Mesa's squad of Day, Julie
Kroening, Lisa Dunn and Ashley
Schafer~ the seventh seed. Without
Kroening, who's a senior and PCL
champion ln bo th hurdles. the
squad won the f rosh/soph finals at
the Orange County championships.
After a nasty 1pill ln the 100 low
hurdles, Kroerung came back with a
47.16 in tho 300., e school record

boys tennis team had no trouble in
Thursday's CIF Southern Section
Division I second-round match with
Irvine. Even without Cameron Ball,
the Sea Kings cruised to a 14-4 vic-
tory over the host Vaqueros.
With a t'fip to the quarterfinals
wrapped up, CdM (19-7 and the No.
3 seed) looked ahead to the next task
at hand, but not to Tuesday's quar-
terfinal match against Dana Hills,
with the site of that match to be
determined by a coin flip.
Instead, CdM was anticipating
the first day of the ClF i.ntilvidual
cbampio!1Ships Saturday. Cd.M's sec-
tional is at the Costa Mesa Tennis
Center.
Among the schools at Costa Mesa
are three tearrtS that beat CdM,
Brentwood, Division l's No. 1 squad

"Eight of the top-ranked teams
