announced other goodies
coming his way, including a

Time to wake up, Mr. Anderson, the Oompa Loompas have gone
A s rughtmares go, ter-
ror always seems to
reach its apogee the
nanosecond before you
wake up bathed in a
drenching sweat. When we
have phantasms of falling
from some great altitude,
~e eyelids always pop open
like a couple of parachutes
from heaven a half moment
before our bodies slam to
the ground with a bone-
sha ttering thud. And just
when that dripping, !WOOY
monster is a momenfaway
from conswrung us for
lunch, we suddenly find our-
selves awake and begging
for air.
That must be how it was
for James Anderson, manag-
mg partner of Common-
wealth Partners, after Mon-
day's Costa Mesa City
Council meeting. After 17
months of being pulled
through a keyhole, poured
through an hourglass,
Anderson dnd his stand-in,
Phll Schwartze, can wake
up now. The Noguchi Follies
have, I think, ended, and
the Oompa Loompas have
left the building.
For that we hdve Mayor
Libby Cowan to thank. We'll
get to that m c1 moment.

BETWEEN THE UNES -
Now all of this didn't end
before reaching that pinna-
cle of horror we know of
nightmares. It was etched
on Schwartze's fatigued
mug just moments before
the touncil voted 3 to 2
Monday to bless the lWo
Town Center Development
Agreement (DA-00-04 to
those who have watched
this nightmare unfold).
•Are you going to nail
this thing down tonight?" I
asked before the vote.
~I don't k:nQw." he said
with a ton of trepidation in
his voice. "l have no idea."
Now you'll recall as a
matter of review that Com-
monwealth Partners is the
owner of the lWo Town
Center oUice campus, which
includes the late lsarnu
Noguchi's California Sce-
nario sculpture garden.
Since January, Ande~on
and Commonwealth have
been walking on hot co~s in
their bid to haye the City
Council bless their plan to
redevelop 1Wo Town Center
into an upgraded office
plaza with a pedestrian-ori-
ented emphasis on the the-
ater and arts. And it has
been a gripping adventure
in frustration.
The glowing obelisk in
the episoae has been
Noguchi's pnzed work;
specifically, the length of
time Commonwealth is to be
obligated to preserve and
maintain the California Sce-
nario. Noguchi devotees -
led by Counalwoman Linda
Dixon -voraaously insisted
that Commonwealth agree
to protect the garden • m
perpetuity,· d phrase now
as famous in Costa Mesa
as ·pregnant chad • is Ln
Florida.
For its part, Common-
wealth never demurred on
tile point thal Nogu'chl's
masterpiece should be pro-
tected. But "in perpetuity,"
meanmg rorever, doesn't
wash in real estate invest-
ment orcles. \n this case,
Commonwealth's financial
partner, CalPBRS, found the
phrase to be vague, unreal-
istic and a mackle on Its
fiduoary duties to responsi-
bly manage the assets of its
investmetit constituents
(some of whom are Costa
Mesa's city employees). But
not being so rigid as to nol
budge, Commonwealth
agreed to protect the
Noguchi garden for 50
years, twice as along as they
had originally p roposed.
1llis came, urlder Cowan's
leadership, after months of
maddening and cloistered
negotiations among a gag-
g le of city and Common-
wealth attorneys.
Despite all of this, the
Oompa Loompas in l1us
nightmare (the good folks
bent on preserving the CalJ-
fomia Scenario unb.l the
Earthstopsspinrung)had
Commonwealth lashed to a
poll as they danced around
chanting, "In perpetuity, m
perpetuity.• To this day, I
don't understand how Com-
monwealth could be legaUy
responsible for proteclLng
the garden "in perpetuity."
That's because the contrdct
reqwnng that they do so is
legally enforceable for only
20 years. And it can be
rescinded by some future
counal not so smitten with
the CaWomia Scenano.
Nightmares rarely make
sense.
Which bnngs us back to
Monday's City Council
meeting and what 1 hope
WdS the find! act in the
Noguchi Follies. It occurred
to me that we were about to
awake from this nighbnare
becduse the terror rocketed
to its zeruth just moments
before. Schwartze, on behalf
of Commonwealth, had just
agreed in total to language
proposed by the oty attor-
ney's ofhce. But then the "in
perpetwty • drums began
beall.ng in the distance. Th.is
urne, the Oompa Loompas
were clamoring for the pro-
tecbon of the Two Town
Center parking structure
thdt abuts the Calilorrua
Scenario Qdrden. These
wdUs, according to one
Noguchl scholar, are "mte-
grnl elements of the artistic
ensemble of the garden. It
would be IITlpossible to
modify them in dIIY way
without damaging the aes-
thetics dnd meaning of
.
Noguclu's work.•
Then in stepped Cowan,
as if to grab Commonwealth
by the shoulders and shake
it awake. She ended the
debate and 'Pressed for the
vote. DA-00-04 was
approved. Dixon and Coun-
cilwoman Karen Robinson
were the Jone dissenters.
And we a.1J woke up.
Tuesday, the day alter the
nightmare ended, I learned
that weeks ago Cowan -
sensing an important project
with long-term public bene-
fits was slippmg away -
interceded ui the dgreement
talks and directly negotiated
terms of the development
agreement that ulumately
proved acceptable to a
majority of the counctl and

would be shut down while
the work is underway. Com-
meroal flights would be sent
to the south end of the 5, 700·

to reconfigure Taxiway Gulf
and Taxiway Hotel. The Y-
shaped roadways, used
chiefly by general avtation
planes to reach the runway,

planner for TRG Land Inc. in
Newport Beach.
The council had to choose
between two options. Plan B.
the one the t:ouncil Chose, bas
narrower tum lanes and bus
bays -between 10 and 10 112

a pedestrian-oriented shop-
ping area. Plan E called for
wtder tum lanes and bus bays
-between 11 and 13 feet

in federal grants if the street is
widened to six lanes.
The city won't receive any
of that money, although they
still could reapply for other
funding. .
The city could have been
eligible for enough to cover at
least the design costs, esti-
mated at $250,000, if the coun-
cil chose the option with wider
lanes.

ers supported Plan B, saying

Christopher Dargan said both
sides have reached a deal that
still must be finalized.
Brockman and her attorneys
are reviewing the documents
that would cement the deal.
"The key to opening that
gate 1s (Brockman) agreeing to
the tenns," Dargan said. "They
hold the key.•
Brockman could not be
rectched for comment, but her
dttomey, David Cosgrove, said
a deal was in place.
According lo the terms of
the agreement, Brockman
would sell the 30-foot access
rOdd to the county for $5,000.
The move would release
Brockman from liability for any
injuries that occur to those who
use the Lrail.

The deal brings to an end a
nearly six-month feud between
Brockman and many members
of the equestrian neighborhood
swrounding the trail. Once
Brockman put up her row of
gates -a metal chain, steel
gate and line of poles-a num-
ber of her neighbors criticized
her for illegally .blockir\g a well-
traveled public trail.
Shortly after the gates went
up in late November, Brockman
g efended the move, inviting
residents to sue her if they were
unhappy. Brockman also
promised to •call the police• if
she foli.nd horses on the path.
Her attitude rankled resi-
dents living nearby, including
Jim Auster, who founded the
Back Bay Access Coalition Jo
lobby city, county and state offi-
cials to order Brockman to operi
the path.

lateral moves by Newport
Beach. But I think staff has
taken a lot of heal on our
behalf by the community, all of
it undeserved.•

Mesa resident on the East 17th
Street Ad Hoc Committee, was
one of a few who spoke in
favor of Plan E.
"I'm not for six lanes
either,· she said. "Some or you

point in the future, they are

It's provided us with a place to tell stories."

on performances ranging from drama to

"It's a building for us, but also for our
children and grandchildren and many

But before the theater can open its

ovation and secure an operating budget
for the first season.
With construction finally set to begin,
raising the dollars might prove an easier

on the verge of winning its
17th straight Newport-Mesa
District Junior High Champi-
onships. ·
Among the three divisions,
the 1l'ojans qualified 52 in the
top eight Tuesday at Corona
del Mar High. The qualifiers
advance to Thursday's finals,
also at CdM, with action
beginning at 3:15 p .m . with
the 1,600-meter run, an event
that did not toke place Tues-
day. ·The 400 relay was also
saved for the finals.
Macias qualWed first in the
.fOO (56.3) and set up one of
the more anticipated finals
against Corona del Mar's
Mike Caponera, who finished
in 57.5. But, Caponera's best
time this season is 55.0.
Macias also quallfied second
in the 800, winning his beat
by more than 100 meters in
2:14.1. He also cleared 4-8 to
make the cut in the high
jump.
Macias will compete in the
three events Thursday along
with running the anchor in
the 400 relay, which includes
Edward Diaz, Marlon Aragon
and Mario Herrera.
Harbor Day's eighth-grade
girls a.re poised to repeat as
well, so to speak. Led by
Melissa Swigert, the seventh-
gra"de team won its division
last year and is on pace to do
the same this year.
The championship meet
was broken into three divi-

under), seventh grade and
