Ficus tree battle in hands of th·e court
A judge is e~pected to decide today
whether 25 controversial ficus trees in
Balboa Village should be uprooted.

hour has arrived in the ficus
fight. At 10:30 a.m. today a judge
is expected to decide whether 25
ficus trees should be tom up on
Main Street in Balboa Village. If a
final decision is handed down, it
will likely mark the end of a bat-
tle in which even the most im-
passioned enemies can't help
but have sympathy for the other
side.
Even the people who most
desperately want the trees re-
moved agree they're gorgeous.

artist brings something
different to his performance,"
said Curran who bad just

Orange County Marketplace
In Costa Mesa Sunday. "He
was one of the greatest
entertainers of all time. He
had such a far reach and was
such a dynamic performer.•
Judging by the appearance
of the aowd that attended
the third annual Endless
Summer Oasslc Car, Truck
and Motorcycle Show and
Elvis Feat at
the marketplace, many
others would agree.
Although the event was
geared toward Elvis fans, cat1
They agree that the trees create
delightful shade, a stunning
canopy and ambience that just
won't be there once the trees are
replaced with much smaller,
much younger coral gum trees
-at least not for years.
At the same time. residents
fighting to save the trees have ex-
pressed sympathy for the mer-
chants and residents who have
suffered plumbing and sewer
line problems as well as struc-
tural, sidewallc and even founda-
tion damage, though many dis-
agree that the ficus trees are to
blame for these problems. Also.
most concede, it's unfortunate
that the tree fight directly
threatens Balboa Vtllage renova-
tions, which they hail as a des-
perately needed boost for the
area.
NO RESOLVE
The mutual sympathy hasn't
been enough to keep them out
of court, despite an 11th-hour at-
tempt to mediate the problem.
"Unfortunately, and in spite of
good faith on both sides. the par·
ties have been unable to reach a
mutually agreeable settlement,"
Mayor Tod Ridgeway announced
at the Aug. 13 City Council meet-
ing.
As a result, Judge Ron Bower
today will consider whether to
grant an injunction to the Balboa
Arborist Society to stop the city
from removing the crees. City
Atty. Bob Burnham said it's likely
that Bower will make a decision
today, instead of postponing the
decision for a future date.

brought their concerns of Inad-
equate housing conditions to
City Council members Sunday at
a meeting held at St Joachim's
School Hall.
The meeting was organized by "
the Orange Cowity Congregation
Community Organization. which
presented 18 months of research
including meetings with various
housing organizations, code en-
forcement, City Council mem-
bers, landJords, apartment man-
agers and more than 400 families
in the hopes of finding Nsysternic
solutions to the problem of de-
plorable. substandard housing
conditions# in Costa Mesa.

laid into the water at the
Lynx's side, representing the
three sites of the attacks and

the moment when the first
jetliner smashed into the North

It won't be the first time
Lynx has been the ship of
honor at a solemn patriotic
event. Barlier this summer,
the boat took part in a
sunset Dag-lowering
ceremony at Balboa
Pavilion.
The Lynx ls a replica of
one of about 500 privately
owned boats in the War of
1812 that served as the
country's first line of
defense by raiding British
trade ships.

the forefront at most
meetings, usually the

American ocean waters is the
result of human activities,

Academies. A study was
sponsored by the U.S.
Minerals Management

Energy, U.S. Environmental
Protection Agency, National
Oceanic and Atmospheric
Administration, U.S. C.Oast
Guard, U.S. Navy, American
Petroleum Institute and the
National Ocean Industries
Assn. that showed less than
8% is from tankers and spills
from pipelines.
The reportconcludes that it
is the consumers of oil who
are responsible for oil in
waters through land-based
runoff, polluted rivers,
airplanes and small boats and
jet skis.
The marine engine
manufacturers and the Jet Ski
industry are both aggressively
promoting their new
environmentally regulated
marine four-stroke engines,
replacing the older technology
of the two-stroke engines
found in jet skis and
outboards. Additionally, I
wonder about the amount of
fuel that is legally dumped
from the military and
commercial jets while in ftight
over the ocean. Even in an
emergency, a vessel Is never
allowed to release petroleum
into the waters, yet it is
acceptable to dmnp from the
air. •
The nightly news clips of
seabirds swimming in oily
water usually get the m ost
attention, but the study points
the finger directly at the
landlubbers who are the worst
offenders, harming our
waterways wtth oil runoff
from their cars and trucks and
the development of more
roads and paved areas. It is
easy to look the other way and
thinking •ah. this one time

existing boater regulations, yet
I have been at meetings where
a few wanted more
regulations, inferring once
again it is the boaters causing
all the pollution.
Then I think we need to
expand the regulations to
include all water activities
such as swimming, swfing
and kayaking into the Marine
Pollution Act that governs
boaters. Imagine a summer
weekend with 100,000
beach-goers who casualty
wade out in the water when
nature calls, and we have all
seen a person lying sideways
over a kayak only up to their
waist in the water. Logic
dictates that lcayakers and
surfers should be required to
wear waterproof diapers while
enjoying their activities..
OK. I have been in the sun
too long today, but listen to
the studies and don't be quick
to point your finger at the
boaters. There are areas such
as those off Santa Barbara that
have natural seepage of oil
into the ocean that account
for a small piece of the
equation.
As I sign of{, who is ta.king
bets on bow long it will be
until the ducks return to the
Grand Canal? I bet the
quacking will return before
the end of the month.

guards a run for their

day," he said. "The guards

saw two victims in a set of
10-foot waves. Turner said.
While Zeiser managed to
rescue one person im-
mediately, both he and the
second victim took a hit
from a second 10-foot
wave. Both made It out
safely.
"It was a very successful
rescue," Turner said.

T he progressively higher prices for homes
in the Newpon-Mesa area have failed to
deter home·buyers from putting their
money in residential property
purchases, dramatically increasing the
number of transactions compared to past years.
The average prices of homes, which have nearly
doubled during the past five years, in Newport
Beach, Corona del Mar and Newport Coast
combined have reached about S 1.2 million, while
homes in Costa Mesa. though significantly less, are
valued at slightly more than $430,000, according to
the Orange Coast Realtors Assn.'s statistics ranging
from Jan. l to Aug. 15 of 1997 and 2002.
The dramatic increase in price has been offset by
low mortgage rates -which are hovering at a
30-year low-that are enabling home-buyers to
continue moving from home to home or move
from rental properties.

even suggested that the Westside
would. be better with fewer
Latinos (who, oddly enough,

pedestrian-oriented). "Condemn
that property!" "Increase my
homds value!" Bveryone wants
to bury the ud,Uty lines. But few
want to "bury the hatchet."
Before recreating the Westside in
a new image, though. how many
really appreciate whatlt has to
offer1 How many really give the
Westside credit for contributing
to the overall economic vitality
of Costa Mesa?
It would tab an exhaustive
study of each and every business
on the Westside in order to
perfectly represent it as the
micro-economy that it Is. But it
is possible to get a good feel for
it if you consider the business
makeup of the 92627 ZIP Code.
In this southern portion of Costa
Mesa there are more than 1,600
busines.ses employing almost
17,000 people, who earn nearly
$500 million each year.
While the Westside is entirely
within the 92627 area, it
certainly does not comprise the
entire empl~ent base.
However, the Westside
redevelopment area is home to a
great many manufacturing,
construction
and
wholesale
trade
businesses.
So
considering
only these
three types of
businesses,

Costa Mesa

than 6,700 people at an

community as well as it has.
Granted, this brief article is
not a precise representation of
the Westside -an area that
encompasses homes, schools,
retail businesses and
professionals as well as the three
business categories examined.
But it does serve to demonstrate
that the Westside does support
many families that make a
substantial financial
contribudon to Costa Mesa. The
West.side is not a piece of raw
land to be carved up without
regard for what will be lost and
without concern for those who
depend upon the jobs provided.

the Corona del Mar I ligh girls
tennis team than it did la.st
year.
The Sea Kings went 24-0 en
route to their second straight
CJF Division rv crown in beat-
ing Palm Desert. 13-5, while ex-
tending their winning streak to
36 since moving to the Pacific
Coast League in 1999.
So the only thing better than
going undefeated would be to
go undefeated and win the CIF
title a third year in a row, a feat
CdM will try to accomplish this
fall.
But the road may not be as
easy as last season as CdM lost
eight seniors including such
standouts as Brittany Reitz, r
Leslie Damion and Brittany
Minna.
However. the Sea Kings re-
turn six players from last year's
CIF champion hip team in-
cluding senfors Anne Yelsey
and Taylynn Snyder along with
juniors Brittany I lolland,
Amanda Rubenstein, Juliette
Mutz.Ice and Jamie Steele.
In CdM's titJe match against
Palm Desert. Yelsey won two
singles' matches after losing
her first match as Holland
posted three singles' wins.
CdM should still figure to
pack a punch and be right
there with the top teams in the
county when CJF playoffs be-g1n, but Coach Andy Stewart
acknowledges that the climb to
the top this year will be more
difficult
"As Jong as our players stay
healthy I think we shouJd be
very good and do as well as last
year but it won't be as easy a:.

know anybody coming in that
can replace a Leslie or a Brit-
tany, that's asking a lot. But I
still think with Anne. Brittany
(Holland) and Tuylynn we're as
good as anybody with those

has served eight years in NFL; last year
included Super Bowl XXXVI.

E ven in his finest hour. Laird
Hayes, the NFL official, was his
own toughest cridc, overruling
himself on a couple of issues
that nobody watching Super Bowl
XXXVI last season would notice.
When Hayes received his Super Bowl
XXXVI ring at the NFL Officials
Association union meeting last May, it
didn't represent a dramatic. last-second,
game-winning field goal by Adam
Vtnaderi to lift the New England
Patriots to a 20-17 upset victory over
the St. Louis Rams.
"I made a couple of boo-boos, sol
was a little disappointed in my
performance,• said Hayes, who made
his Super Bowl debut. "The ring to me
doesn't represent the Super Bowl and
the Rams losirtg to the Patriots. It
represents all the people along
the way who made it possible
for me to be there, starting with
my wife, Maggie, who has been
a saint."

A Newport Beach resident, Hayes
broke into officiating as a Princeton
undergraduate student, starting with
intramural basketball.
"I'm not really sure why I started. I
guess to make a few extra bucks," said
Hayes. who anended graduate school at
UCLA
Inspired by his late father, Will. he
turned his attention to high school
basketball and soon was a member of
the Los Angeles Basketball Officials'
Association. Hayes worked his way to
the varsity level, then it became small
colleges. then a few years later baseball
entered the picture. "I figured I knew
the strike zone. because I was a catcher
in baseball," Hayes said.
Hayes never thought about
football until 1976. when he
was hired at OCC and
Wendell Pickens told him
about the Orange County
Football Referees Association.
In only his third year, Hayes
said he got his first big break.
when veteran crew chief Larry
Arason liked Hayes' work and
Hayes. in his eighth year as
an NFL side judge, points to a
couple of breaks along the way
and some inOuential people
who helped him design a
flexible schedule at Orange
Coast College, where he's a
physical education instructor
and head men's soccer coach.

future Pac-10 official mentor,
the late Dave Kamansld,
whose nephew at the time rowed on

who at the time was a Pac-10
Conference side judge and would
sometimes get Saturday assignments in
Washington or Oregon and needed an

missing a soccer game.
Hayes, on the other band, tries to be
as flexible as possible in the OCC
Athletic Department, teaching aerobics,
table tennis -anything former and
current OCC athletic directors Jane
Hilgendorf and Fred Hokanson would
ask of him.
"We're. resurrecting surfing this fall,· a
proud Hayes announced.
A Princeton graduate by way of Santa
Barbara's San Marcos High, Hayes
started the OCC surfing team in 1978
when a couple of students approached
him about It and he was serving as the
college's Asal.stant Dean of Students, a
role he ftDed from 1976 to '85.
After a few years working at the
district office u Director of Community
Relations, Hayes was assigned back to
Orange C.out, thls time in 1987 to fill
the role u men's IOCCel' coach.
Hayes had Utde experience in .accer.

Hayes, who started officiating

applied to the NFL in 1990, upon the

After the NFL scouted him and Hayes
passed a series or psychological tests
and FBI bacqround checks. he became
a ftnaUst for an NFL spot in 1993, then
received the big call in 1995.

according to Longoria. as Levin
worked her way onto varsity as
the duo garnered second-team
All-Academy League honors.
Even though Longoria thinks
be has a strong team this season,
he also looks further ahead.
"Wf!re still a year away," Lon-
goria said. "But I'm pleased with
what we've had and the progress
we've made." Last season Woodbridge's
Michael Haddon beat out sec-
ond-place Alec Urtusuastegui
(Newport Harbor) at league fi-
naJs, but Urtusuastegui re-
turns as a senior on Kay's
squad this season, which gives
the coach added optimism.

It also helps that Sage Hill sits

players, Longoria said.
