TITLE: Annual Concrete Replacement Program — Notice of Completion for
Contract No. 7168-1 (18R06)
ABSTRACT:
On January 23, 2018, City Council awarded Contract No. 7168-1 for the Annual Concrete
Replacement Program project to Nobest, Inc. The work is now complete and staff
requests City Council acceptance and close out of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project. On January 23, 2018, the City Council found this project exempt from
the California Environmental Quality Act (CEQA) pursuant to Section 15302(c);
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

The construction contract was expensed from the following accounts:

The contracted work has now been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:

The final contract cost was $854,849.14, which was approximately 9.0 percent higher
than the original bid amount. This cost increase was primarily due to an increase in
sidewalk replaced in the Buffalo Hills Park area, extra work associated with extending the
sidewalk next to Newport Harbor High School, and a large increase in the number of trees
needed to be removed in the Newport Hills community.
This project included two change orders for a total amount of $61,564.54, which was
approximately 7.9 percent of the original bid amount. The change orders included
additional excavation and surveying services needed at the City's utility yard concrete
tipping pad location, relocating backflow preventers out of the path of travel along new
sidewalk path leading to Andersen Elementary School and additional requested corner
access ramps near Newport Harbor High School.
The City added 31 working days to the Contract for work adjacent to Newport Harbor High
School. Additional time was needed to coordinate with Southern California Edison and
AT&T to remove existing utility poles and underground utilities before the new sidewalk
improvements could be implemented.

This project successfully reconstructed sidewalks, curb and gutters and driveways in the
Newport Hills and Spyglass communities in order to maintain and improve pedestrian
access and proper street drainage throughout the communities.
ENVIRONMENTAL REVIEW:
On January 23, 2018, City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15302(c) Class 2 (reconstruction
of existing facility involving negligible or no expansion of capacity) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
