COSTA MESA -Attorneys in the case
of three teenagers accused or raping a
16-year-old girl finished a tedious round

opposed d osing arguments about the
authenticity or a digital video lape that
certutt<t the sexual encou nter.
,
Prosecutor Dan I less said the footage
on the digitaJ tape, which he alleges was
nor doctored as defense attorneys say,
provides its own credibility -in addi-
tion to the witnesses who have talcen the
stand to vouch ror Its valjdity.
"I asked the judge to look at the total'
circumstances. which Is what the ru.les
call for, not just one piece or evidence or
any particular tennlnology. • Hess said.
Defen se attorneys Joseph Cavallo,
John Barnett and Peter Morreale argued
Monday that the digital video tape.
which shows defendants Gregory Haid!,
Kyle Nachreiner and Keith Spann en-
gaged In various sexual acts with the
victim, is n ot an ortgtnal copy and there-
fore. must be excluded as evidence.
lWo abnormalities were found in the
rape: 21 frames of black and another l I
frames or fro1.en frames. which created a
fluttering image when viewed. Experts
on both sides or the argument have vari·
ous theories for what caused lhem,
ranging rmm simply shutting off 1he
camera whUe recording to allegatiom~
that San Bernardino Sheriff's Depart-
ment officials edited it.
"The standard (that must be metl is
whether or not the prosecution ha.'i
shown within 'reasonable certainty' that
the tape Is th e original." Barnett said.
ttThe prosecution's own expert has
stated that there were two reasonable
explanations for the 'flutter' ... One is
that the camera was turned off and the
uther is that ii is a copy. So they have not
shown 'reasonahll' n •rtainty' that lht•
tape is an original."
