conscious girl filed a new mo-
don to dismiss the case Thurs-
day, claiming the district
attorney's office postponed the
prosecution of a Newport
Beach detective -suspected of
defrauding $269,000 of work-
ers' compensation -to gain
favorable testimony in the trial.
Newport Beach Police Delee·
tive Teri Fischer, who investi-
gated the alleged rape of an un-
conscious 16-year-old girl by
Greg Haidl, Keith Spann and
Kyle Nachreiner, is under in-
vestigation by state officials in
connection with irregularities
found on her workers' com-
pensation claim.
The gjrl is now 18. Haidl, son
of Assistant Sheriff Don Haid!,
is also I 8. Spann and Nachtein-
er are both 19.
Defense attorney Joseph c.a-
. vallo. who represents Haidl, ar-
gued in a motion that the pros-
ecution "has been willing to
forebear prosecution in order
to secure the witness's favor-
able testimony here" and that it
"threatens the right to a fair
triaJ."
Whether Fischer will be
called as a witness in person
has yet to be determined but

Thursday of the victim of an
alleged gang rape in a Corona
del Mar home, sifting through
pages of transcribed testimony
and minute-by-minute ac-
counts of the weekend in
question looking for inconsis-
tencies.
The victim, referred to as
Jane Doe, was on the witness
stand from 10:30 a m. until
3:30 p.m. -with an hour
break for lunch -during the
first round of cross·examina -
lion by Joseph Cavallo, defense
attomey for Grog Haidl.
Haidl, the son of Assistant
Sheriff Don Haidl, Kyle Na-
chreiner and Keith Spann are
accused of raping the uncon-
scious 16-year-old girl during a
party in the Corona del Mar
home of the elder Haidl. All

proposed zoning change that would
restrict local recovery homes.

NEWPORT BEACH -A bat-
tle that has raged on for years
over drug and alcohol-recovery
homes will have to wait at least
a few weeks more for a solu-
tion.
The Planning Commission
on Thursday agreed to post-
pone a decision on zoning
changes that could regulate
some recovery homes in the
City.
"We don't have all the an·
swers, and I'd prefer to do some
further analysis," City Atty. Bob
Burnham said ·
The move comes on the
heels of several City Council
study sessions and extensive le-
gal analysis of the issue wfth
the help of outside attorneys.
In attempting to navigate
through sweeping state and
federal laws that leave the city's
bands somewhat tied. city offi-
cials have turned to the local

City manager calls oh the reserves for aid

something in the proposed ~004-05 budget for the first time
ln his almost 18 years managlng
the city: dipping into the general
fund reserves to compensate for
a $2 mllllon take-away from the
slate.
Otherwise, the $109-millfon
budget was balanced without
increasing taxes or fees.
While the budget already ac-
counted for a loss from the state
pf about $867,000, it now faces
an additional cut of SI.I million
for the next fiscal year based on an agreement reached last week

unless you're unlucky enough to
live next door to an unsightly mess
and you want to pull your hair out
A few weeks ago, Maggie and I
went for a walk on one of our
usual routes. On the other side of
the street were two neighbors
talking across the low wall that
divides their properties. One itlan's
home was new, modem, and
exceedingly well rnanJcured; the
other's was a cottage surrounded
by a huge pile of tall weeds. l did a
doable-take. I walk past that house
all the time and I'd always
assumed that the person llvf!lg
there was old and too feeble to do
yardwork.. But here was an
able-bodied man in his late 40s.
Why would he let bis property look
lllce that?
I walked on by. down to Coast
Highway, over to Marguerite. and
back up the other side of the
street The two men were stW out
there talking. As I got mjdway
between their two homes. Maggie
stopped to sniff and pee. l stood
there waiting for her.
The man on the'J)ado of the new
house saJd loudly, "Whattaya
think?"
I looked up. He seemed to be
looking straight
ar me although
he was talking
to his neighbor
who was sitting
amJd the tall
weeds covering
his yard.
"Pardon me? ..__ __ ..__ __ .... Are you talking
to me?" I asked. MAXINE
COHEN
"Yes. You look
like you're
thinking about
something." be said.
I gulped. "Well, actually, I am. I
was thinking how awful those
weeds look."
"Tha.nk you for volunteering."
said his neighbor, dripping
sarcasm.
"Actually, I didn't volunteer. I
was asked," I managed as I quickly
puJled MaggSe along and walked
on up the street.
That was really odd. Not to
mention awlcward. I know I've
been accused of not having a
poker face but I couldn't have
orchestrated this any more
perfectly had I tried.
It brought to mind, several
months ago, CNN was canvassing
the man on the street to see what
she/he thought about some event
that was brea.ld.ng news. The thing
was, they asked Manhattanltes
who responded with blunt
straight-forwardness. Rudi
Bakhtiar remarked, "lf you want td
know what people really think. ask
people who live in Manhattan."
Well, I'm not from New Yortc. I
grew up 30 miles south of the city,
in New Jersey. Not sure It makes
much difference though because
since moving west of the .
Misslssjppl. I've corudstentJy
experienced myself as more direct
and outspoken than most other
\
people. A very mixed blessing.
indeed.
So. I was ruminating on what
happened, not feeling good about
having shot my mouth off and
thinking that maybe I should have
made up something else to say,
although I'm not sure I couJd have
thought up something right on the
spot. I was also feeling grateful that
I don't Uve next to a schleppy
property and that thJs is not my
problem because this man will
never clean up his yard now, not
after thl5.
And then three days ago,
walklngMaggiepasnhishouse
again. there was a young man with
a weed-whacker busily cutting
down the weeds. I could now see
that there Is a genuine ftagstone
patio, a healthy fruJt tree, and a
trellis with vines all over it
supported by two stone pillars on
the propeny. Really attractive.
I was surprised, to say the least.
One of the cardinal rules of
relationships ls that if you want
someone to change. telling them
so straight out is the worst possible
way to go about It. ft is i.Hherent in
human nature that we will resist
when told what to do. We will find
a way of critici7Jng the other
person (how offensive they are,
how dare they speak to me that
way. the nerve) and thereby
inv8.lidat1ng the message or w.: will
find a way to raUonalli.e ow own
point of view. We will not comply.
We will not give In.
Cert&nly, had I been invested in
this man cleaning up his yard, my
outspokenness wouJd have greatly
reduced the possibility that he
would ever do so.
And yet, three weeks later, that ls
exactly what he did. He must have
mulled It over and over and finally
come to the conclusion that what I
said was valid, and he was able to
do what he thought was right,
apparently without losing face.
The thing ls. this must be a man
who is good at being i.n
relationship. Because he did
exactly what It takes to make a
relationship wortc. i.e. he looked at
himself and took responsibility for
his pan instead of making It about
the other person. He was able to
incorporate another pecson's view
of his behavior and to recognize
that he was not behaving in a way
that he felt good about He was
able to see, possilily for the first
time, how his neighbors saw his
yard and to un~rstand what that
would feel like from their point of
view. And so he rud something
about It.
Now granted this is about weeds
this time but It really isn't about
weeds. Because the process ls the
same regardless of the content,
and lfyou c.:an see your part
around weeds. hopefully you can
see your pan around other more
important issues. lfyou are open
to understanding how your
behavior impacts others and what
that must feel like to them, then
you will most likely be able to look
at yourself and see what fits with
your own Integrity and behave
accordingly. It's not about losing
face. It's not about losing at all.
Because when we are in good falth
with ourselves, we win, by
definition, because we feel good
about ourselves regardless of
anything or anyone else.
So, hey man, next time I walk
Maggie by and you're outside,
introduce yourself. will you? I'd like
to know you!

modernization of St. Andrew's Olurch. I
am here to speak for the youth of our
area.
I have been a high school teacher and
assistant principal for 41 years. I am in
touch with what keeps kids in school and
makes them successful: extracurricular
activities.
These are the kinds of activities that
need space. I'm talking about choir. I'm
talking about dance. I'm tailing about
plays and musical productions. And, I'm
talking about every athletic team you can
imagine. And I'm also in touch with what
we have a shortage of In our area: venues
for performances and athledcs.
Do you know how hard It ls to book a
gymnasium for a practice or game in this
town? My heart smiles at the reality of the
1,000-seat gymnasium at St. Andrew's.
Think about your best memories of
rugh school. Was It the English class or
the athletic team you most identified
with, or how about the school play, or the
choral perfonnance?
St Andrew's doesn't lirrut their facilities
to its own members. The church
welcomes other community groups who
need space for their youth.
Let's look to the future. Let's keep our
eye on our kids.

REEL CRITICS
'The Iliad' for dummies
T he movie ~TuJy" ls loosely based on
the ancient. epic poem ~The Oiad~ by
Homer. Jt has all the elements of a
great film -sweeping heroism and horror,
as men and gods battle wits and wilb to a
tragic end.
But perhaps writer David Beo1ofr and
director Wolfgang Petersen thought that
such a tale would be too lofty for the average
multiplex viewer. So they diluted the story
and added the standard summer
blockbuster package: buffed action figures,
swords, sandals, mega-CGI effects, blood.
.--------. gore and giant fiery balls of twine. And, of course,
there's a plethora of
good-looking actors.
The gloriously golden
Brad Pin, as the
legendary warrior
Achilles, ls the real reason
to see this movie. He has
obviously worked out and

kingdom ln Troy. Helen's husband, King
Menelaus, gets a little dcked and asks his
buJJy of a brolher, King Agamemnon, for
assfJtance ln avenging his honor.
Agamemnon {the wonderful Brian Cox) was
only looking for an excuse for his powerful
armies to invade and conquer Troy -
although they had no weapons of ma.ss
destruction.
The Trojan Horse stands inside the city of Troy in Warner Bros. Pictures' epic action
adventure "Troy,• starring Brad Pitt, Eric Bana and Orlando Bloom.
And let's not forget that legendary Trojan
Horse, an 11-ton creation that signals doom
for Priam and his people. Up until that polnt
ln the film, the only thlng more wooden was
Brad Pin's performance.

Paris' older brother, the valiant Prince
Hector (Eric Bana), stands by his brother's
foolish actions even though it means a long
and blner war for his country. Meanwhile,
their lovely cousin Brisels, who had taken
vows as a virgin priestess, wUllngty chucks it
aside when she becomes Achiiles' war
trophy (and, of course, that troublesome
heel everybody still talks about).
ln spite of Its name, "Brea.kin' All The
Rules" conforms to every Hollywopd rule
for easy-going romantic comedies.

What follows is an extended comedy of
errors where good intentions go awry as all
the major characters try to hide their
secrets from their paramours. There are
some snappy satirical observations about
dating in the 21st century sprinkled
throughout the screenplay. But for the
most part, the story remains highly
predJctable and unfolds according to Its
planned formula. There's some great music
and edJting in this good-natured film. But
at its best, the core story Is lots of amusing
style with little substance.
Director Daniel TapUtz provides
humorous insights lnto the urban dating
scene whUe making sure he never crosses
the line into R-rated territory.
The battle scenes are Impressive,
especially when the principals go
mano-a-rnano ln the best movie tradition.
Veteran actor Peter O'Toole (HLawrence of
Arabia") gives an excellent performance as
King Priam, who must watch his sons
Hector and Priam get their butts kicked in
battle.
This PG-13 effort takes a mild turn on
the genre by placing African-American
yuppies at the center of Its soft-core "Sex
ln the Cl~ formula.
Jamie Foxx does a fine job playing
magazine editor Quincy Watson who
loses his job in a classic corporate
downsizing. He uses his newly found free
time to write a book. He takes the
cold-hearted concepts his company used
to lay off employees and turns them into

Newport Harbor High played Santa Bar-
bara in boys tennis. the Dons squeaked
by with a 10-8 victory April 14.
"We were luclcy to beat them the first
time," Santa Barl>ara Coach Steve Gere-
min said.
The rematch Thursday at Newport
Harbor had a little bit more al stake -a
chance 10 advance in the CIF Southern
Secdon Division I playoffs. But a slow
start doomed the Sailors in a 13-5 los.s 10
last year's CJF runner-up.
"We could have played better.ff
Sailor sophomore Robert Khoury
said. "We weren't as intense as
last time, so that probably played
a big part in (the reason we
lo ti."
Newport (14-7) was down, 5-1,
after the first round of play. with fresh-man Jake Aeming providing the lone
win. That was decidedly different than
the 3-3 score to start the April 14 march.
"Thar definitely took the wind out of
our sails.~ Newport Coach Jeff Thomsen
said. "We were hoping to split with them
in the firs! round like we did last time 10
give us a litde hope. We knew we were
