Attorneys with the Villa Point
Condominium Assn. on 1\tesday
filed a request for a restraining
order against about 20
homeowners who won their own
victory last week when a judge
threw out a prior association suit
against them.

association President Peter
Kontos began a landscaping
project at the Z28·unit
higher-end complex.

Superior Court Judge David
Olaffee said Kontos' reign as

Kontos, who maintains an
unlisted number, could not be
reached Tuesday. His attorney,
Dean Smart, did not return calls.
Beginning at the tail end of
2002. the homeowners allege,
Kontos began a landscaping

character of the Italian
villa·styled condo complex.

I f there's one thing fun and Nadine
Turner have, it's spirit. And with four
kids and a demanding devotion 10
the Spirit Run fund-raiser, they need
iL .
"I guess we put in about 25 to 30 hours
each the wee le of the race," said Jim, who
along with wife Nadine has been essential
to the Spirit Run since 1994 when the
parents ofthen·elementary school Jcids
offered to lend a hand to the growing
fund-raiser. Now, three of their lcids who
benefited from the run are at Corona del
Mar High School. And though their
youngest only has one year left at lincoln
Elementary, chances are that the Turners
willc:ontinue to volunteer even after the
lasJ of their kids have left elementary
school.

Turners' most important volunteer tastes
include worlcing with the event's other 300
volunteers. At different times during the
Spirit Run one or both or the Turners
might be signing up new volunteers or
helping.match up their time and talent
with event needs. Nadine often wortc.s to
woo sponsors. and along with Jim takes on
a lot of the less glamorous jobs, too. Race
day is the prime example. l11ey show up al
4 am. to get the course ready, put the
volunteers in action and take on countless
troubleshooting tasks. Then, after the
runners and spectators have gone home.

In its 20-year existence, the run has
raised more than $1 million for Newport
Beach elementary schools. Last year
brought in about $120,000 and organizers
were hopeful that this year's run, which
toolc place on Sunday, would match or
· beat last year's amount The run includes
races for adults and enough events for kids
to make it the largest children's run in
Orange County.

Kohl's department store.
I was pleased to read that the
proposed Kohl's department store
has received Planning Commission
approval. However, in reading recent
letters I was s urprised at some of the
residents' opposition. Several letter
writers talk about the loss of recreauon.
I am not sure what they mean. If tl1e
theater and Ice Capades were
successful they would still be there. So
unless a new wave of residents (and
those writing le tters are not) plan to
patronize these types of uses, why not
clean-up the empty buildings and .
provide the residents of Costa Mesa
with a use -Kohl's -that makes more
sense and more importantly will
provide revenue to the city.
The people we should be listening tu
are the residents who live directly
behind Mesa Verde Center. They all
support the proje<:t. In fact. a recent
commentary by one of the residents in
this paper stated that the residents of
Mesa Verde see the addition of Kohl's a ..
a welcome improvement These are the
voices ow City Council should be
listening to -not the rumbUngs of the
same usual suspects that oppose every
projed that comes before the city.
Kohl's will be a nice addition to the
Mesa Verde Center and provide the
residents of Costa Mesa with an
amenity that will be used by many -I
bet even some of those who oppose the
projeci.

Segerstroms own the land, tbere are
three buildings on this land, two or
these businesses have gone out or
business, and the third is about to. The
Segerstroms put the land up for sale, a
huyer offers to buy It and put in a new
business. The buildings are the same
i.ize. and from what is reported all the
traffic, and environmehtal concems are
addressed and comply to the standards
that have been set forth from the city.
And the residents that are impacted the
most have no problem with this.
Excuse me but where do we live? I
thought this was America. where free
enterprise and supply and demand
dictated businesses and wfiere
Economics 101 was studied. Businesses
go bad every day. Who made the mayor
of the Costa Mesa a dictatorship and
said government can tell a business
how to run their business? To rectify
this problem w1th the bowling alley, the
Segerstrorns should shut them down,
and plow the three buildings down,
make it into a giant parting lot What
will the mayor and the Kona Lanes
people do then? Tell the Segerstroms
they can't?
After a few years of having a vacant
parking lot. maybe the mayor can tell
the Segerstroms to give up the land to
the city through eminent domain and
then the city can develop it, though into
what I don't know. As much as I can tell,
there will never be 100% agreement.
But wait we have 100% agreement
now with the proposed Kohl's store. The
Segerstroms want to sell, Kohls wants
to buy and there 100% support from
the neighbors dire<:tly affected by thi!>
proposal.

Higb's girls swim team trailed visiting
Corona del Mar for most of the non-
league •Battle of the Bay" dual meet
at Newport Hatbor Tuesday until the
final event the ~yard freestyle re-
lay. Newport needed at least a first
and a tbird-plac.e finish to beat CdM
and that's what It got to win. 86-84.
CdM won the Battle of the Bay last
season.

relay, but it was the quartet of senior
Annmarie Harvey, sophomore Anne
Belden and juniors Amber Harper
and Jessica Ball that put the hosts
over the top.
Harvey and Belden staked a lead of
21 hundredths of a second before
CdM's Ann Winners negotiated the
third leg to glve CdM the lead by 34
hundredths of a second, leaving
Ouistina Hewko and Ball to decide
the fate of the meet.

pion water polo team. led by an arm's
length. · three-quarters through her
leg. But Ball. behind the cheers from
teammates, friends and parents, gave
it her all and touched the wall a mere
15 hundredths of a second sooner.
"Christina is an awesome swim-
mer," said a giddy Ball in between
hugs from teammates. "I thought I
bad a one-in-a-million chance to get
up to her speed. but I guess It was
just the spirit of the moment. The
whole team was cheering for me and
that pushed me. Annie Wight is my
spirit. along with Carotyn Conway,
Kim Houseplan and Sabrina Cook."

swimming in an international meet
in Calgary. Alberta with the Irvine
Novaquatlcs dub team. the Sailors
(l-1) powered through the depleted
Sea Kings, 139-27.

"It's frustrating,· Salvino said "We
have to discuss the vaJues as far as
swimming is concerned.• A number
of swimmers left the meet early for
various reasons Salvino cited as

Newport won all 11 events, with
Coach Jason Lynch bighligbtlng the
efforts of Cole. who will swim for the
University of Utah next season. and
senior Nathan Weiner. Cole won the
200-yard individual medley (2:07.92)
and the 100 freestyle (48.87) while
Weiner took first in the 100 back-
stroke (1:04.09).
"I feel better this week than ln c.an-
ada," said Cole, who battled the flu
while In Calgary last weekend. •My
times are pretty solid. 1 took a few
seconds off the 50 free. For me, this is
a really fun meet."
Newport senior Ross Sinclair won
the 500 free (5:07.35) and 200 free
(1:52.93), while junior Micbad Bwy
placed first in both the 50 free (23.•7)
and 100 Dy (59.32). Senior Jay
Thompson touched first in the 100
breasmroke (1:07.08).
