Although city elections are not party-based,
Republicans are keeping a close eye on the
appo~tment of Costa Mesa's next council member.

COSTA MESA -Partisan politics are
once again finding a home in the city's
political fray as Republican politicos
keep a close watch on the Clty Council
appointment expected tonight.
Ass evident in the 2002 council election.
Orange County Republicans are anxious
to see more local leadership positiom
held by conservatives, since the county is
one of the nations Republican strong-
holds. While the tactics may not be as
blatant dwing this small-scale appoint-
ment process, concern over the candi-
date's political affiliation have not quelled.
Councilman Gary Monahan, who has
numerous casual ties to locaJ Republi-
can sets, said he has received a number
of calls from people asking which candi-
date has the inside track and what party
they belong to.
. •Tuey haven't been involved with me
as f:ar as lobbying efforts, but they are
watching very closely," Monahan said.
"They ask me, 'What's going on? What
can we do to help?'"
Monahan would not elaborate on
what kind of "help" they were offering.
Area Republican leaders did not return
phone calls on the subject.
QUIETER TACTICS

Republicans launched a negative phone
poU against candidate Katrina Foley,
pointing out -among other things -
that she was a registered Democrat.
While the phone poll was officially
commissioned by the Rental Housing
Commi.ssion, a sheU of the Orange
County Apartment Assn.. it was con-
dueted by county Republican Adam
Probolsky. The newly formed rental
commission was also headed by Man
Petteruto, who is also a member of the
Republican Party of Orange County.
And instead of focusing on rental

what to do with his body brought a lot of

A survivor of the
instant-millionaire dot-com
era is relaunching itself
locally after retreating from
an office on the outskirts of Silicon
Valley.
Internet company has
relaunched in Costa
Mesa, seeking a new
locale to find clientele
Loominate's services, which can be
tailored to customers' needs, cost a
company between $5,000 and
$100,000, depending on how in-deplh
the presentation.
The company is zeroing in on the
Southern California market, so the
Costa Mesa location makes sense,
Anderson saJd.
Loominate, a company that provides
streaming audio-video services, set up
shop in October at a Superior Avenue
office, which is about half the sl.z.e of
their previous space. Orange County's
economy was much more appealing.

seen the amazing growth and vitality of
the Orange County market."
Anderson and h1s team of between
six and 10 employees use existing
software to develop programs that
contain these visual presentations.
Anderson, whose family owned a
Newport Beach summer house,
graduated from UC Riverside with a
business degree. He co-founded
start-up Omnibility in 1999 before
joining McAfee Security, the Network
Associates division that sella anti-virus
software.
Anderson and two other partners
relaunched Loominate last year. The
company, which morphed from a
Loomlnate is working to slgn a deal
with a medical-device company that
manufactures a cardiac machine that's
too bulky to carry to client meetings.
Anderson, 32, left the company in
2001 to form Synernetis. He now Uves
in Rancho Santa Margerlta.

view-protection ordinance to limit home
remodeling in certain areas of the city.

ocean view" is one of the
prime real estate attractions
-a phrase that can ratchet
up a home price and seduce a
prospective buyer to shefi out
the big bucks.
lo 1978, Paula Litten was
beguiled by a home on Qle-
neagles Terrace that promised
nnt only an ocean view. but
city Ughts and "fantastic sun-
sets (that) make this home the
best view buy In the area"
When Litten felt her cher-
ished view was being threat-
ened by the Clarks below, who
wanted to add a second story
on Aviemore Terrace, she lob-
bied her neighbors to sign a
petition as.king the city to en-
act a view-protection ordi-
nance.
Tonight, the Oty Council
will consider the ordinance for
certain areas that the Plannlng
Commission approved In
March.
Not all residents on Avie·
more Terrace are going along
with Unen and her allies.
They contend the city can-
not restrict their property
rights to preserve the rights of
others to a view. Some have
gone so far as to compare the
potential view preservation
ordinance to slavery.
"To take away someone's
rights by giving someone else
a bog\IS right opens the city
up to litigation," said Jeffrey
Childs, who lives on Aviemore
Terrace.
The view from Marina
Highlands offers a panoramic.
distant view of the ocean be-
yond the Santa Ana River and
Huntington Beach that is al-
ready blocked by trees and
some second stories.

Highlands. the ordinance
would cover Marina View,
California Seabreeze. Freedom
Homes and "appropriate por-
tions of the East.side." It is de-
signed to protect views of the
ocean and the Back Bay.
The proposed ordinance
has two components -less-
ening the elfect.s of new sec-
ond-story construction In the
preservation areas on views
from surrounding properties;
and requiring Planning Com-
mission review and approval
of any second-story construe·
lion In these areas. The guide-
lines are not Intended to pro-
hibit view bloclcage outright,
staff said. Instead, the goal is a
balancing act between view
preservation and residents'
desire and needs to cor\Struct
a second story.
In Utten's case. her view to
the right is already bJocked by
a second-story home. Straight
In front of her below ls a clear
view obstructed only by one
tree on the sidewalk In front of
the Clarks' house. Her view to
the left is over the top of 1163
Aviemore Terrace. a two-story
house that was built with the
neighbors up above on GJe-
neagles Terrace In mind, Lit·
ten said.
When the Oarb tried to
add a second story In 2002, it
was ultimately rejected by the
Oty Council on the basis of
harmony and compatibility.
But some Marina Highlands
residents, such as Unen, were
not content with their victory.
They felt ii was important to
codify the main reason they
moved to the neighborhood,
Unen said. And they don't
want to feel pressured to build
on top of their own homes just
to maintain their view, she
added.
"U people are forced Into
going up to accommodate for
somebody else, then the view
has been taken away, and then
others lose their view," Utten
said. "It's like a domino ef-
fect.·
View protection supponers
also point out that they spent
more money for their views
than homes In the area with-
out them.
But opponents claim re-
stricting residents' right tu
build up ls not realistic for
growing families and limits
their financial opportunh1~
"No one lives in 1.500-
square-feet houses anymore."

They also claim that there is
no way that one second-story
addition can block a pano-
ramic view of an ocean that ti.
In the distance.
"The whole thing is about a.
thin line of blue over a mile
away," said Robert Reeder,
who owns two homes on Avie-
more Terrace.
1\vo other cities have taken
some measure to protect
views. Laguna Beach's zoning
code refers to a design-review
process to consider public and
private views. Monterey, on
California's central coast. also
Includes a policy that articu-
lates view protection as a pri-
ority ln residential areas.
Councilman Gary Monahan
said h e's not convinced at this
point that a view protection
law is necessary.
"I think people have the
right to build on their own
property, and it hasn't been
proven 10 me yet that there are
damages if someone builds on
their property and affects the
view,· Monahan said.

John Casoria, representative of
Trinity Ouistian Center, ls appealing
the Planning Commission's
continuance of a request by the center
for a permit to broadcast outside on a
regular buts. The outdoor activity
conaist.s of live tapings and broadcasts
in conjunction with the "Pralse the
Lord" 1V program and other religious
programming.
In March, the Planning Commission
unanimously continued any decision on
outdoor broadcasting for nine months to
give the center a chance to create an
operations management plan to deal
with neighbors' myriad complaints and
make ure the plan ls being complied
wt th.

"I would agree that we need to rehear

taller than 14 feet and that have vertJcal
walls that do not exceed 9 feet In height
The Intent of this is to prevent views
from being blocked, "oppression· of
neighboring properties and the loss of a
sense of scale when two-story
development occurs In the rear yards of
this tract.
ln March, the P1anning Commission
recommended that the overlay not be
adopted.
