TITLE: Amendment No. One to Professional Services Agreement with Harris
Miller Miller & Hanson, Inc. for John Wayne Aircraft Noise Abatement
Departure Procedure (NADP) Analysis
ABSTRACT:
In February of this year, the City of Newport Beach retained Harris Miller Miller & Hanson,
Inc. (HMMH) to conduct an analysis of the aircraft noise abatement departure procedures
at John Wayne Airport. Among other things, the project was designed to determine if
specific air carriers are using a quieter departure procedure than other carriers with the
same aircraft type and similar takeoff average maximum takeoff weight. Once the project
was underway, the City asked HMMH to supplement this phase of the project with
additional analytical work. The deliverable for this amendment is complete and was
authorized due to the time -sensitive nature of this work.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Approve Amendment No. One to the current Professional Services Agreement with
Harris Miller Miller & Hanson, Inc. for John Wayne Aircraft Noise Abatement Departure
Procedure (NADP) Analysis for the additional analytical work requested, add $30,000
to the contract for a new total not -to -exceed value of $140,000, and authorize the
Mayor and City Clerk to execute Amendment No. 1 to the agreement.
FUNDING REQUIREMENTS:
The current adopted budget includes sufficient funding for this project. It will be expensed
to the Airport Issues account in the City Council's budget, 01005001-811008.

DISCUSSION:
Commercial aircraft departing from John Wayne Airport (JWA) are typically flown directly
over Newport Beach using one of two Noise Abatement Departure Procedures (NADPs).
Aircraft that take off using NADP -1 climb more steeply early, but the ascent slows down
and the aircraft are often at a lower altitude later in the departure process than those
utilizing NADP -2. In turn, aircraft using NADP -2 climb more gradually early, but continue
to climb and are often at a higher altitude (than those utilizing NADP -1) later in the
departure process. In response to increased community concerns over airplane noise,
the City of Newport Beach retained HMMH earlier this year to study the current departure
procedures and their noise impacts. The City's goal is to identify the safest and quietest
departure procedure possible out of JWA.
The first phase of HMMH's work focused on determining if certain commercial aircraft
operators are utilizing a quieter departure procedure than other carriers with the same
aircraft type and a similar average maximum takeoff weight. HMMH obtained flight track,
aircraft identification, and correlated noise event data from John Wayne Airport for a four-
month period (October 2017 to January 2018) and the work included analyzing aircraft
noise for four operators and five aircraft types. The consultant utilized the FAA's noise -
modeling tool to determine if the noise generated by a particular plane and carrier is
greater or less than the model for that particular aircraft type predicts.
While the study was underway, the City requested further analysis of the data already
collected and analyzed for the four carriers and five aircraft types. HMMH was tasked with
analyzing the hourly (between 7 a.m. and 9 p.m.) data collected every day for the four-
month period. The results of the additional analysis will help determine if individual
operators produce discernable differences in noise levels for the same type of aircraft,
similar takeoff weights, and similar weather conditions. Due to the time -sensitive nature
of this work, the additional analysis was authorized and the deliverable for this
amendment is complete.
The information is now being used in the next phase of the project which involves
determining if an existing departure procedure can be slightly adjusted to further reduce
community noise or, if the study supports proposing a completely new departure
procedure.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.

AMENDMENT NO. ONE TO
PROFESSIONAL SERVICES AGREEMENT
WITH HARRIS MILLER MILLER & HANSON INC. FOR
JOHN WAYNE AIRPORT — AIRCRAFT NOISE ABATEMENT DEPARTURE
PROCEDURE ("NADP") ANALYSIS
THIS AMENDMENT NO. ONE TO PROFESSIONAL SERVICES AGREEMENT
("Amendment No. One") is made and entered into as of this 25th day of September, 2018
("Effective Date"), by and between the CITY OF NEWPORT BEACH, a California
municipal corporation and charter city ("City"), and HARRIS MILLER MILLER & HANSON
INC., a Massachusetts corporation ("Consultant"), whose address is 1508 Eureka Road,
Suite 190, Roseville, California 95661, and is made with reference to the following:
RECITALS
A. On February 19, 2018, City and Consultant entered into a Professional Services
Agreement ("Agreement") to provide aircraft noise abatement departure procedure
("NADP") analysis for John Wayne Airport ("Project").
B. The parties desire to enter into this Amendment No. One to reflect additional
Services not included in the Agreement, and to increase the total compensation.
NOW, THEREFORE, it is mutually agreed by and between the undersigned parties
as follows:
1. SERVICES TO BE PERFORMED
Exhibit A to the Agreement shall be supplemented to include the Scope of
Services, attached hereto as Exhibit A and incorporated herein by reference ("Services"
or "Work"). Exhibit A to the Agreement and Exhibit A to this Amendment No. One shall
collectively be known as "Exhibit A." The City may elect to delete certain Services within
the Scope of Services at its sole discretion.
2. COMPENSATION TO CONSULTANT
Exhibit B to the Agreement shall be supplemented to include the Schedule of
Billing Rates, attached hereto as Exhibit B and incorporated herein by reference
("Services" or "Work"). Exhibit B to the Agreement and Exhibit B to Amendment No. One
shall collectively be known as "Exhibit B."
Section 4.1 of the Agreement is amended in its entirety and replaced with the
following: "City shall pay Consultant for the Services on a time and expense not -to -
exceed basis in accordance with the provisions of this Section and the Schedule of Billing
Rates attached hereto as Exhibit B and incorporated herein by reference. Consultant's
compensation for all Work performed in accordance with this Agreement, including all
reimbursable items and subconsultant fees, shall not exceed One Hundred Forty
Thousand Dollars and 001100 ($140,000.00), without prior written authorization from

City. No billing rate changes shall be made during the term of this Agreement without the
prior written approval of City."
The total amended compensation reflects Consultant's additional compensation
for additional Services to be performed in accordance with this Amendment No. One,
including all reimbursable items and subconsultant fees, in an amount not to exceed
Thirty Thousand Dollars and 001100 ($30,000.00).
3. INTEGRATED CONTRACT
Except as expressly modified herein, all other provisions, terms, and covenants
set forth in the Agreement shall remain unchanged and shall be in full force and effect.

Subject: John Wayne Airport—Additional Aircraft Noise Abatement Departure Procedure (NADP)
Analysis
Reference: HMMH Proposal Number P18-20122
Harris Miller Miller & Hanson Inc. (HMMH) is pleased to provide this proposal to the City of Newport Beach,
California to conduct additional analysis of noise abatement departure profiles (NADP) for aircraft operating at
John Wayne Airport (SNA). Based on discussions at the City of Newport Beach meeting on Wednesday, June 13,
2018, HMMH proposes the following additional scope of work that would supplement Task 1 of our contract with
the City (Contract #7297-2).
SCOPE OF WORK
Additional Analysis as Part of Task 1
As part of the approved Task 1 of Contract #7297-2, HMMH obtained flight track and aircraft identification data
and correlated noise event data obtained from SNA for a complete four months (October 2017 to January 2018).
HMMH has analyzed aircraft noise for four operators (Alaska, American, Southwest, and United) and five aircraft
types (Boeing 737-700, 737-800 and 737 -MAX; Airbus A319 and A320).
The purpose of Task 1 was to determine if specific operators are utilizing a quieter NADP than others with the
same aircraft type and similar average maximum takeoff weight. The average maximum takeoff weight and
implemented flap settings were incorporated into standard NADP modeling profiles for each aircraft to obtain
representative modeled results in terms of the Single Event Level (SEL) metric. HMMH utilized the Federal
Aviation Administration's (FAA) Aviation Environmental Design Tool 2d (AEDT) to model single event levels (SEL)
and compare the measured noise levels at SNA's Remote Monitoring Terminal (RMT) 5S, 6S, and 7S. The
reported modeled and measured results were averages over the complete four months.
The purpose of the additional analysis as part of Task 1 is to take a "deeper dive' into the data already collected
and analyzed. HMMH proposes to look at the same four operators and five aircraft types, and analyze the data
from 7 a.m. to 9 a.m. each day for the complete four months of data (October 2017 to January 2018). The
average hourly modeled SEL results at SNA's Remote Monitoring Terminal (RMT) 5S, 6S, and 7S will be presented
in tabular format within the Task 1 technical memorandum.
The results of the additional analysis will help us determine whether individual operators produce discernable
differences for the same aircraft type, similar takeoff weights, and similar weather conditions.
Please note that no additional noise contour figures will be generated as part of this additional analysis.
