Brown, City Clerk - 949-644-3005, (brown@newportbeachca.gov Jennifer Nelson, Assistant City Clerk TITLE: Appointments to the Building and Fire Board of Appeals ABSTRACT: Appoint three applicants (Robert Ahlke, Bill Caskey, John Robert (J.R.) Walz) to fill the two scheduled vacancies that ended June 30, 2018, and one unscheduled vacancy, vacated by Audrea Cook, ending June 30, 2019, on the Building and Fire Board of Appeals, pursuant to City Council Policy A-2 (Boards, Commissions and Committees), Newport Beach Municipal Code Chapter 15.80, and the Maddy Act. Members of the Building and Fire Board of Appeals serve a four year term. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; and b) Appoint Robert Ahlke, Jr., Bill Caskey and J.R. Walz to fill the vacancies on the Building and Fire Board of Appeals, and determine which two appointees will fill the seats with terms that expire on June 30, 2022, and which appointee will fill the remaining balance of Audrea Cook's term which expires on June 30, 2019. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The Building and Fire Board of Appeals is charged with hearing and deciding appeals of orders, decisions or determinations made by the Building Official or the Fire Marshal relative to the application and interpretation of the building code. On December 1, 2017, an unscheduled vacancy occurred with the resignation of Audrea Cook who was appointed to serve on the Building and Fire Board of Appeals for a term ending June 30, 2019. In addition, two scheduled vacancies occurred on June 30, 2018 that were not filled. F.'s Appointments to the Building and Fire Board of Appeals October 9, 2018 Page 2 Pursuant to City Council Policy A-2, Newport Beach Municipal Code Chapter 15.80, and the Maddy Act, the City Clerk prepared and posted a Notice of Vacancies on Wednesday, June 13, 2018, in the City Clerk's Office, at the Central Library, on the bulletin board in the City Council Chambers, and on the City's webpage. In addition, the Notice of Vacancies was published in the Daily Pilot on Saturday, June 16, 2018. As of the date of this staff report, the City has received three applications from Robert Ahlke, Jr., Bill Caskey and J.R. Walz to fill the vacant positions. As provided in the Notice of Vacancies, applications will be accepted by the City Clerk's Office until the three positions are filled. Copies of the applications are attached hereto as Attachment A. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
