Good afternoon,
Happy Friday everyone, as we in the City head into a three day weekend. We are closed on Monday, in
observance of Veteran's Day. Thank you to all the veterans in our community for your service to our
country.
Our next meeting is on Tuesday, November 13, and the following are items that may be of interest. As always,
this is not a summary of the entire agenda, which can be viewed here.
Study Session begins at 4 p.m. and two items that may be of interest:
• On January 1, 2019 Senate Bill 946 goes into effect, which prohibits local authorities from regulating
sidewalk vendors except in accordance with the provisions of the bill. To be in compliance, staff has
drafted a proposed ordinance establishing a program to permit and regulate sidewalk vendors. We will
discuss the key elements of the ordinance at the study session.
• Staff is seeking further City Council and community input on the pending amendment to the City's
Accessory Dwelling Units (ADUs) ordinance. As you may recall, the amendment, which is needed to
be in compliance with changes to State law, was on the September 11, 2018 City Council agenda. As
ADUs have received comments from the California Coastal Commission, staff would like to update
the City Council on the status of ADUs and receive any further input the City Council may have on the
item.
For the Regular Session at 7 p.m. the following are items of note:
• Under the Consent Calendar is the application for transportation (M2) grant funds for two projects
that will improve traffic flow. 1) Old Newport Boulevard and West Coast Highway Improvements will
widen north Pacific Coast Highway to add a third through lane underneath Newport Boulevard and a
dedicated right -turn lane onto Old Newport Boulevard among other improvements. The grant funds
are proposed for right-of-way acquisition costs necessary for the widening. 2) West Coast Highway and
Superior Avenue/Balboa Boulevard Improvements are part of the Lower Sunset View Park project and
the grant funds are proposed for the planning and design work for phase 2 that includes construction
of a second pedestrian/bicycle bridge across West Coast Highway. Phase 1, and the first
pedestrian/bicycle bridge has successfully received grant funding and the required Cooperative
Agreement with OCTA is also on the Consent Calendar.
• Balboa Village Streetscape Improvements will restore or install new plants, trees, planters, trash
receptacles and benches, and remove and replace existing damaged sidewalk and curb and gutter in
Balboa Village. If the contract is approved, the construction is estimated to be completed Spring 2019.
• The proposed ordinance creating a Sidewalk Vending Program that will be discussed at the earlier
Study Session is on Current Business. Because of the upcoming effective date for S13946, this allows
City Council to consider the ordinance for introduction.
As a reminder, public comment is welcome at the City Council meeting. The public can comment on any item
on the agenda. If you cannot attend the meeting and/or want to communicate with the City Council directly
