Brown, City Clerk - 949-644-3005, (brown@newportbeachca.gov PREPARED BY: Jennifer Nelson, Assistant City Clerk TITLE: Appointment to the Finance Committee to Fill an Unscheduled Vacancy ABSTRACT: Due to the resignation of Patricia Eckert from the Finance Committee, an unscheduled vacancy was created on September 5, 2018. Pursuant to Resolution No. 2018-71 and Finance Committee Description, this citizen appointee position belongs to Council Member Muldoon. The City Council is being asked to confirm Council Member Muldoon's appointment of John Reed to fill the unscheduled vacancy with a term ending June 30, 2019. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Confirm Council Member Kevin Muldoon's appointment of John Reed to serve on the Finance Committee for a term ending June 30, 2019. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION Pursuant to the Maddy Act and City Council Policy A-2, the City Clerk prepared and posted a notice of an unscheduled vacancy on Thursday, September 6, 2018, in the City Clerk's Office, at the Central Library, and on the bulletin board in the City Council Chambers. The notice was also placed on the City's webpage on Thursday, September 6, 2018, and was published in the Daily Pilot on Saturday, September 8, 2018. As per the notice, applications were accepted by the City Clerk's Office until noon on Thursday, September 27, 2018. 10-1 Appointment to the Finance Committee to Fill an Unscheduled Vacancy February 26, 2019 Page 2 A copy of John Reed's application is attached hereto as Attachment A. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
