The City Arts Commission meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires
that the special meeting City Arts Commission agenda be posted at least seventy-two (72) hours in advance of the
meeting and that the public be allowed to comment on agenda items before the Commission and items not on the
agenda but are within the subject matter jurisdiction of the City Arts Commission. The Chair may limit public comments
to a reasonable amount of time, generally three (3) minutes per person.
The City of Newport Beach’s goal is to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an
attendee or a participant at this meeting, you will need special assistance beyond what is normally provided, we will

III. PRESENTATION
1. Presentation of 2018-19 Cultural Arts Grants – The City Arts Commission will
present the 2018-19 Cultural Arts Grants awards to:
• Balboa Island Improvement Association ($2,000)
• Baroque Music Festival, Corona del Mar ($4,000)
• Chuck Jones Center for Creativity ($2,000)
• Ensign intermediate School Dance Club/Newport-Mesa Unified School District ($1,000)
• Newport Beach Film Festival ($5,000)
• Newport Beach Sister City Association ($2,000)
• Newport Elementary School Foundation ($3,000)
• Pacific Symphony ($5,000 Chair Greer reported $40,000 is set aside each year pursuant to Council Policy I-10 as
Cultural Arts Grants to provide arts and cultural enrichment for the community. Arts organizations submit grant applications to the City Arts Commission, and the City Arts Commission awards grants subject to City Arts Commission recommendation and City
Council approval. Cultural Arts Grants provide an opportunity for City of Newport Beach residents of all ages to experience the benefit of professional arts programming that the City Arts Commission is sometimes unable to offer in its yearly agenda. In 2019, the
community will have an opportunity to experience baroque music, local concerts in the City, a Film Festival industry seminar, a Pacific Symphony classical music experience in
K-6 schools, an afterschool dance program, classroom art and musical instruction, and an
international art exhibition. On behalf of the Newport Beach City Council and City Arts Commission, she thanked Cultural Arts Grants recipients for their interest in providing arts

and culture as an experience for the community. The City Arts Commission hopes to
provide more funding in 2020 and looks forward to recipients serving the community again. Chair Greer presented awards to Cultural Arts Grants recipients and posed with recipients for photographs.

Chair Greer requested the Minutes reflect her appointment of all Commissioners to the
Phase IV Sculpture in Civic Center Park Exhibition Committee. She thanked staff, the community, Councilman Herdman, members of the City Arts Commission, the Phase IV Sculpture in Civic Center Park Exhibit Committee, and the City Council for their support
and contributions. Motion made by Chair Greer, seconded by Vice Chair Bendetti, and carried (6-0-0-1) to
approve the draft Minutes for the meeting of December 13, 2018 as amended. AYES: Greer, Bendetti, Glabman, Divine, Kaufman, Little

B. Consent Calendar Items
3. Financial Report – Review of financial information
Library Services Manager Basmaciyan reported the Programming balance decreased
from $27,553 to $26,800 due to staff overtime of $553 for the concert on Balboa Peninsula. The Professional Services balance decreased from $34,750 to $33,260 due to
transcription fees of $362, an art installation fee of $303, and a charge of $825 for cleaning
Sphere 112. The City Grants balance decreased from $40,000 to $17,000 due to the awarding of $23,000 in grants.
In response to Chair Greer's inquiry, staff indicated a check has not been issued to Ensign intermediate School Dance Club/Newport-Mesa Unified School District because the
signed grant agreement is outstanding.
4. Cultural Arts Activities – Monthly review of cultural arts activities from the
Library Administrative Office for upcoming Library and City arts events and services

Library Services Manager Basmaciyan advised that the art of Diana Ghoukassian was on
display in the Central Library gallery through January 4. An exhibition of In Residence landscape paintings by Gianne de Genevraye opened on January 7 and will close on March 1. On January 12, the Newport Beach Sister City Association will host a reception
to welcome Ms. De Genevraye. Motion made by Chair Greer, seconded by Vice Chair Bendetti, and carried (6-0-0-1) to
approve the Consent Calendar.

VII. CURRENT BUSINESS
A. Items for Review and Possible Action
5. Recommendations for 2019 Concerts on the Green – The Performing
Arts for Concerts on the Green Ad Hoc Subcommittee will report on recommendations for the 2019 Concerts on the Green.
Vice Chair Bendetti reported the subcommittee received a record number of submissions from local and national acts. The subcommittee recommended performances by Side
Deal, which is composed of members from various notable bands; Flashback Heart Attack, which performs music from the 1970s and 1980s; The Smith Band, which performs country music; and Queen Nation, a Queen tribute band. Because of the number of
submissions, the subcommittee is confident they can find a replacement band should one be needed.
Chair Greer announced that a vote on the subcommittee's recommendations will occur in the February meeting of the City Arts Commission.

Chair Greer indicated the subcommittee is exploring a potential concert on the Balboa
Peninsula for the summer of 2019.

Chair Greer advised that the subcommittee continues to receive proposals for children's programming.
Commissioner Kaufman reported the subcommittee is soliciting feedback and ideas from the community and local arts organizations regarding potential partners with the City Arts Commission for children's programming.
In reply to Chair Greer's query, Library Services Manager Basmaciyan agreed to
determine whether the subcommittee could publicize the opportunity for a local arts
organization to partner with the City Arts Commission.
9. Publicity Liaison Ad Hoc Subcommittee – Commissioner Michelle

Vice Chair Bendetti would begin publicizing future phases of the Sculpture Garden once a plan is approved.
10. Sculpture in Civic Center Park Exhibition Development Ad Hoc Subcommittee – Commissioner Arlene Greer, Commissioner Marie Little,

Chair Greer reported many members of the public attended the Council meeting to support the City Arts Commission's request for Council approval of the Sculpture Garden Phase
IV. The Council approved the City Arts Commission's request. The Newport Beach Arts Foundation presented a $10,000 donation to the City Arts Commission during the meeting.
The subcommittee is working on a program for a donor wall.

Commissioner Glabman requested an agenda item in February regarding a special
exhibition by the Sherman Library and Gardens.
Vice Chair Bendetti requested agenda items for a vote on the subcommittee's recommendations for the 2019 Concerts on the Green and for a potential partnership with Lido Village for an art walk.
Chair Greer requested agenda items regarding the feasibility of the City acquiring Burnt Matchstick and a proposal for the restoration of Metalphor.
IX. PUBLIC COMMENTS ON NON-AGENDA ITEMS
Jim Mosher requested a status report regarding the restoration of Metalphor.
Chair Greer reported Commissioner Baker is pursuing an additional bid for the restoration
work. The item could return to the City Arts Commission in February.

Cultural Arts Activities for January 2019
Art at the Library
“In Residence" landscape oil paintings by Gianne de
Genevraye
January 7 - March 1, 2019, Central Library Gallery
The Newport Beach City Arts Commission presents an
exhibition of landscape oil paintings by international
artist Gianne de Genevraye, on display at the Newport
Beach Central Library gallery.
Gianne de Genevraye paints public gardens in Europe
and the United States. She is a Contemporary Nature
Painter, exhibiting widely with work seen in collections
in France, Italy, Sweden and the United States. Born in California, she received her Bachelor of Fine Arts
at the University of California Irvine, studying under contemporary masters Judy Chicago, Tony Delap,
Craig Kaufman and John Paul Jones. She was studio assistant to Jennifer Bartlett in France for three
years. In 1990-91, she was an Invited Artist at the American Academy of Rome.
In 2017, Gianne was in residence at the Villa Fontaine in Antibes, France, beginning her residency for her
upcoming Sister Cities exhibition at the Newport Beach Public Library. She then returned to Baja,
Mexico, painting in both Cabo San Lucas and San Jose del Cabo. In 2018, she traveled during the spring
with Newport Beach Sister City to Okazaki, Japan to paint in residence during the cherry blossom
festival.
In Gianne’s own words, “I paint and exhibit internationally to bring a message of sustainability,
accessibility and beauty to my patrons, collectors and viewers. The public gardens of the world are my
canvas to bring this message to the people.”
The exhibition will be on display during library operating hours, January 7 through March 1, 2019.
On Saturday, January 12, Newport Beach Sister City hosted a "reception and conversation" with Gianne
de Genevraye at the Newport Beach Central Library, 6:30 - 8:30 p.m. The event was free and open to the
public.
On January 28, 2019, Ms. de Genevraye hosted an art lecture for 22 Corona del Mar High School
students and their art teacher.

Proposal for Metalfor Restoration
RECOMMENDATION:
Staff proposes that the City Arts Commission authorize the use of the Lenahan Estate fund to pay for the
restoration of the sculpture Metalfor.
FUNDING REQUIREMENTS:
Restoration costs have been quoted at $11,750, and will be expensed from Account No. 0106053-841015,
“Lenahan Estate Fund”.
DISCUSSION:
In 1986, Warren Hancock, a Newport Beach art collector, donated the sculpture Metalfor to the City of
Newport Beach. The value of the piece when it was donated to the City was $15,000.
Created by Bret Price, Metalfor was originally placed outside the Newport Beach City Hall for part of 1986
and 1987, until it was moved to the front of the Newport Center Library. When the Newport Center Library
closed in 1994, the City relocated Metalfor to a grassy area beneath a bluff on the east side of the
intersection of Superior Avenue and West Coast Highway.
The royal blue painted steel abstract work, which weighs 1,400 pounds and is 8½ feet tall, was the centerpiece
of the 22nd annual Newport Beach City Art Festival in 1986. Intense heating of the metal to make it malleable
created its curvilinear form. The steel was repeatedly bent and rolled during this period of elasticity to give it
"a sense of softness (and an) illusion of flexibility," sculptor Price explained.
The piece requires restoration work. Metalfor has endured great deal of exposure to the elements. The
royal blue paint has faded and there are signs of corrosion. There are patches of discoloration and some
oxidization.

Mr. Price has a vested have an interest in protecting the piece against any intentional or unintentional
alteration or destruction, thus preserving the integrity of his work and returning the piece to its original state.
Mr. Price also has the technical knowledge, facility, and equipment to restore the piece. Examples of his

Furthermore, the California Art Preservation Act (California Civil Code §987) is a 1979 California law that
provides legal protection for artists' moral rights. The Art Preservation Act provides for civil
penalties and injunctive relief for the intentional or negligent destruction or mutilation of a work of fine art.
The Act also provides artists the right to claim authorship and disavow modifications to works of fine art.
The rights granted under the act subsist for the life of the author plus 50 years. At the very least, Mr. Price
should be consulted about the proper restoration of the piece.

Mr. Price will attend the February 14 City Arts Commission meeting to answer questions about the
restoration process.
Staff initially recommended that the funds required to ship and install the replacement piece be drawn from
Account No. 4002-8080, “Professional Services”. However, staff considers the use of funds from the Lenahan
Estate to be appropriate in this situation. These funds were donated to the City of Newport Beach along with
a collection of Elisabeth Wiltrout Longridge paintings in 2011. Subject to recommendation from the Arts
Commission, the funds were provided for arts related matters for or relating to the City but not for regular
operational costs of the Arts Commission or the City.
The Lenahan Estate fund is an important source of funds for special contingencies as the Cultural Arts
Division has no budget set aside for major repair of art.

2019 Concerts on the Green
RECOMMENDATION:
Staff recommends that the Arts Commission approve the performers recommended by the Performing
Arts for Concerts Ad Hoc Subcommittee for the summer 2019 Concerts on the Green series.
FUNDING REQUIREMENTS:
Performance fees and sound engineering for four summer concerts is estimated at approximately
$29,750.00 (not including Side Deal’s fee), to be expensed from the City Arts Commission 2019/20
programming budget.
DISCUSSION:
The City Arts Commission presents live music in the Civic Green during the summer months. The
Performing Arts Ad Hoc Subcommittee recommends performers to the City Arts Commission for
approval. Staff negotiates a fee with the performers, coordinates the use of the Civic Green, publicizes
the events, and hires a sound engineering contractor for the performances.
The performers submitted for approval for summer 2019 are:
•The Side Deal (Rock/Country/Alternative Rock), TBD, not to exceed $7,500 (June 16); or,
•Alternate band— Hollywood U2 (U2 Tribute Band), $3,250.00 (June 16)
•Smith Band (Country/Pop/Rock), $3,250.00 (July 7)
•Queen Nation (Queen tribute band), $3,500.00 (August 25)
•Flashback Heart Attack (80s cover band), $3,500.00 (September 15)
The sound engineering firm, Triskelion Event Services, Inc., provides the sound equipment and speakers
for $3,000.00 per concert. The total cost to host the concerts is $29,750.00.
The concerts will again feature food trucks, as they did in 2017 and 2018.

Acquisition of Burnt Matchstick
RECOMMENDATION:
The City Arts Commission requested staff investigate the feasibility of the City of Newport Beach
purchasing Burnt Matchstick, a popular sculpture in the Sculpture in Civic Center Park Exhibition, Phase
III.Staff recommends that the City Arts Commission work with their support group, the Newport Beach
Arts Foundation, to raise funds for the purchase of Burnt Matchstick.
FUNDING REQUIREMENTS:
Artist Karl Unnasch has informed staff that Burnt Matchstick is priced at $55,000.00. This price does not
reflect the costs associated with moving the piece to a new location (should the City Arts Commission
desire to do so) or maintaining the piece in perpetuity.
DISCUSSION:
The City Arts Commission requested staff determine the proper course of action to purchase the
sculpture Burnt Matchstick after its exhibition in the Sculpture in Civic Center Park Exhibition, Phase III
project. Phase III is scheduled to be removed in summer 2019.
For fiscal year 2019/20, the City Manager has directed all City departments to function within a flat
budget. The budget for the Cultural Arts Division will remain at the same level as Fiscal Year 2018/19 for
all programs and exhibits. The proposed budget for Fiscal Year 2019/20 does not include any funds for
the purchase of art.
Staff recommends that the City Arts Commission work with their support group, the Newport Beach Arts
Foundation, to raise funds for the purchase of Burnt Matchstick.
