Brown Act. Among other things, the Brown Act requires that the special meeting City Arts Commission agenda be posted at least twenty-four (24) hours in advance of the meeting and that the public be allowed to comment on agenda items before the Commission and items not on the agenda but are within the subject matter jurisdiction of the City Arts Commission. The Chair may limit public comments to a reasonable amount of time, generally three (3) minutes per person. The City Arts Commission will consider the panel recommendation, and make a final recommendation for City Council at the March 21, 2019, City Arts Commission special meeting. DISCUSSION: The Sculpture in Civic Center Park Exhibition is an integral feature of the Newport Beach Civic Center project. Civic Center Park, which turned nearly half a million square feet of undeveloped land into a new public park, was designed by renowned landscape architectural firm Peter Walker and Partners (PWP). PWP developed a master plan for art in the park, and identified various spots in the park where art, particularly sculpture, may be exhibited. The City Arts Commission determined that a rotating exhibition was an optimal approach to bring sculpture to the City in a cost-efficient manner. In August 2013, the Newport Beach City Council authorized the City Arts Commission to implement an inaugural rotational sculpture exhibit in Civic Center Park. The acquisition program that the City Arts Commission developed for the exhibition created a model in which pieces are loaned for a 2-year period. Sculptors of works chosen for the exhibition are provided with a small honorarium to loan their work to the City. The City is responsible for installing the art, while sculptors are responsible for the maintenance and repair of their work. Admission is free and the exhibition continues to be enjoyed by a wide demographic, including schoolchildren, the local community and visitors from Southern California and beyond. In essence, the exhibition has become a “museum without walls” that offers the temporary display of public art that allows the City to avoid the obligation and expense of owning public art. The city sought to have a well-balanced representation of public art that would appeal to a diverse audience of all ages, while including artistic merit, durability, practicality and site responsiveness as criteria in the selection. The rotational nature of the exhibit ensures that residents and guests are exposed to a variety of work. On January 8, 2019, City Council authorized Phase IV of the exhibit. The City has hired Arts Orange County to manage the project. A call for entry was opened in February 2019 and 33 sculptors submitted works. The City Arts Commission has arranged to increase public engagement in the project by offering residents opportunities to become part of the selection of works by integrating these elements into the process: 2 of 3 • Conduct an online survey that invites the public to select individual works for inclusion in Phase IV. This will be completed on March 20, 2019; • Hold one regular City Arts Commission study session meeting where the public will be invited to express their preferences for the submitted art prior to panel consideration. This will be completed at the March 9, 2019, City Arts Commission study session; • Hold one curatorial selection panel meeting where public can express their preferences; • Utilize the March 9, 2019, City Arts Commission study session for the public to express their opinion of the panel’s recommendations. The panel consists of art professionals Dave Barton, Art Critic, OC Weekly, and Jeffrey Frisch, Arts Program Coordinator, John Wayne Airport Arts Program, in addition to the City Arts Commission. The curatorial panel assessment will include the following:  All top-scoring artworks in the online public survey will be considered and discussed in depth. Additional images of the highest scoring works will be reviewed. Additional information provided in application such as a statement of interest and resume may be used to help narrow down submissions.  Works will be considered in light of the following criteria: o Artistic Merit:  Artwork is of high quality and demonstrative of originality and artistic excellence.  Artist has strong professional qualifications. o Durability:  The artwork is made of high-quality materials, which can withstand the natural outdoor elements of coastal Southern California.  Artwork requires minimal to no maintenance. o Practicality:  Artwork is of appropriate subject matter for audiences of all ages.  Artwork is safe and shall not exhibit unsafe conditions or factors that may bear on public liability. o Site appropriateness:  Artwork is suitable in scale to be seen in environment.  Artwork is suitable for viewing from all angles.  Ten artworks and three alternates of various sizes, mediums, and subject matter will 3 of 3 be recommended to the City Arts Commission, who will consider the pieces at their March 21, 2019, Special Meeting for recommendation to City Council.  Based on scale and impact of work, the committee will assign artworks to site locations.  Based on artwork value and preliminary budget provided by artists, the committee will assign honorarium amounts to each artwork. Artist honorariums for artworks selected should total up to $45,000. The public will be provided with an opportunity to review the submitted works and offer input on the panel’s selections. The City Arts Commission will consider the Committee recommendations at the March 21, 2019, Special Meeting. The City Arts Commission recommendation will be submitted to City Council at the March 26, 2019, Regular Meeting for final approval.
