The Board of Trustees of the City of Newport Beach met in adjourned session 7 :30 P.M. date and place above shown. President Jumper called the meeting to order and the roll was called showing there were resent trustees; S.R.Jumper, Glenn Helms, G.P. Wilson, H.A.Robinson and J.C.McCain, Absent none. The minutes of the meeting of July 3d, were read and approved. ' Communications were read and referred to proper order 6f business. _ UNFINISHED BUSINESS; On motion of trustee H.A.Robinson seconded by trustee, G.P.Wilson and carried, the roll was called and the followinj entry was ordered made on the record of the Board of Trustees of the city of Newport Beach: Whereas, on the 10th, day of April, 1916-; there as held and had in and for the city of Newport Beach a general muni- cipal election and at said election there was, pursuant to chapter 351 Statutes of California passed at the Thirty -ninth Session of the Legislature, submitted to the qualified electors of the city of New- port Beach the question "Shall the sale of alcoholic liquors be licensed in this City "; and Whereas, the Board of Trustees of the city of ewport Beach did, thereafter and on the 17 day of April, 1916, duly canvassed the returns of said election, publish and declare the result thereof; and Whereas, from the said canvass of the returns of said election it was made to appear and did appear and the Board of Trustee found and established of record that the total number. of votes cast at said general municipal election so held on the 10th day of P_pril 1916, on the said question was 409 votes. . Thr,.t 176 votes on said question were cast "YES" That 233 votes on said question were cast "NO ". Whereas, at said general municipal election a majority of the votes ,cast on the said question were not cast in favor of license, and are not in favor of license; and "Whereas, more than ninety (90) days have elpased and expired from and after the date of said general municipal election Now therefore, the Board of Trustees of the city of Newport Beach do make and enter on its records the following order.: Il It is hereby ordered and declared that the city of Newport Beach and all of the territory existing within and bounded by the exterior boundaries of he city of Newport Beach as established. is and shall be no- license �erritiry, as that term is use$ and as provided for in an act of the egislature of the.Stad;e of California, entitled: "An act to provide for the regulation of the. traffic in lcoholic liquors by establishing local options; authorizing the filir of petitions praying for elections to vote upon the question whether he sale of alcoholic.liquors shall be licensed within the territory described in such petition; providing for the calling and holding of such elections; making it the duty of the proper geverning body to 4. declare such territory to be no- license territory unless a ma- jority P£ votes is cast in favor of license; providing that no license, Iermits or other authority to sell or distribute alcoholic liquors n no- license territory shall be granted; forfeit1gg and declaring 1 e31 such licenses ors permits theretofore issued and in force; making ,t a penal offense to sell, give away, or distribute alcoholic liquors within such territory, with certain ex_ceotions, and providing ienalties for such offenses." E Letter and bill from the Evening Herald for (280) line advertisement was again presented for consideration, Moved by trustee, H.A.Robinson 6econded by Trustee, G.P.Wilson and carried that the bill be rejected on account of its not.having been published as per verbal agreement petween three members of the board of trustees and Herald representat;.0 ILease from the S.P.Ry,Company for pipe line crossings at 30th and 36th, �treets was - presented for execution, Moved by trustee, G.P.Wilson econded by trustee Glenn Helms and carried that the same be executed and returned, the clerk and president thereupon executed the same_ MR J� Trustee, H.A.Robinson offered verbal report on bulkheads, and stated that as F.W.Harding had filed a petition for his bulkhead with more than 51% of the property owners signed, that he would recommend the adoption of the Harding plan. Open discussion followed relative to bulkheads, both the Pentland and Harding plans being considered. ]]loved by trustee, G.P.Wilson seconded by trustee, J.C.McCain and carried.that Leopold Goepper be employed at a salary of $3.00 per day to circulate a petition and.ascertain the number of people in favor ,i of the Harding plan of bulkhead in the territory East of Main Street in Balboa. The 'Test Coast Gas Company presented their unexpired fire insurance policy on the boilers at the Gas plant and asked that the city pay the unexpired portion of the same and that the policy be transferred to the City..Fo action was taken, and the Clerk was instructed to return.the same. Letter from the F.D.Cornell Company, owners of the Corona Del Mar Tract was presented asking for reduction in their water rate was referred to the hater Sup't and the !ester Committee. Applications from Paul E.Kressly, Geo,I "!.Spencer and t'l.T.Webber for the position of City Engineer were presented, No action taken. Letter from C.L.Lancaster relative to the tax Ordinance was read the same asking for an amendment to the said ordinance providing for the collection of taxes in two installments, No action taken. Moved by trustee, H.A.Robinson seconded by trustee, G.P.Wilson and carried that the water committee look into the matter of securing a right of way for the pipe line direct from the water plant to the reservoir. Clerk was instructed to write the State Board of Control asking them if they would consider the purchase of two more of the Municipal Gas Distributing System Bonds. A petition signed by 15 voters at Balboa was presented asking that th Board take the necessary steps to abate the nuisenne of soliciting for hotels and Apartment house, the same was .ordered filed no action being taken. Moved by trustee, H.A.Robinson seconded by trustee, Glenn Helms that whenever a property owner is willing to improve a street or alley without being forced to do so, that the City Engineer furnish the grades at the expense of the City the same as has been done in the past. Roll was called showing Ayes; trustees, Glenn Helms, and H.A.Robir_son; Noes; trustees, S.R.Jumper, G.P.Wilson, J.C.McCain, Absent None, President Jumper declared the motion lost. Moved by trustee, G.P.Wilson seconded. by trustee, J.C.McCain and carried that the demand of W.T.Webber for engineering in connection with setting tide gauge and grade at Bay Ave and 23d, at be allowed and warrant drawn to cover. I Moved by trustee, G.P.Wilson seconded by trustee, Glenn Helms and carried that the demand of iW.T.Webber for furnishing grades in the alley in Block to Balboa back of the Rose Bath House be allowed and warrant drawn to cover. ?Moved by trustee, G.P.71ilson seconded by.trustee J.C.McCain and carried that the demand of the Southern Counties Gas Co 11,783.87 for pipe furnished the 2xsxft City Gas System be allowed and warrant drawn to over. Moved by trustee, Glenn Helms seconded by trustee,H.A.Robinson and carried that C.J.Winkler be given free license on account of infirmity as provided for by the License Ordinance. Moved by truutee, G.P.Plilson seconded that the demand of Sickler & Ward for and warrant drawn to cover.
